    Off Topic

    This is off topic

    Does anyone know, if its law that anything you work after 40hrs is time and half ?

    As well is it legal for a employer to change the time you worked. Lets say you go in at 5:45AM, clocked in and working. Cause you have to help the 3rd shift person to close out his/her shift. As well lets say you get off at 2:00 but you are not allowed to leave until your shift is closed out, so it could be 2:15/2:35 before you get out of there. So he cuts out anything on your shift before 6:AM and anything after 2:PM

    Even though you are expected to do this to complete your job

    Sorry for the off-topic question. Just rather frustrated and need to know. Am aware there are/were some business owners on this forum.

    Covered nonexempt workers are entitled to a minimum wage of not less than $5.15 an hour, effective September 1, 1997. Overtime pay at a rate of not less than one and one-half times their regular rates of pay is required after 40 hours of work in a workweek.

    Don't let them take one minute off your time sheet. If you are standing around waiting on someone else, that's their problem, not yours. Punch out and leave, punch in and work. Also, you should have a State Wage and Hour Department that you can call and make a report. Do you keep track of your time? You should.

    What a Jerk!

    You are not a salary employee, then don't give them anything they are not payed for. If you show up early, hang out in the break room until you are getting paid at 6am. If comes in there asking you why you are not working tell him that you understand the policy is that we aren't getting paid before 6am so I'm not working without pay.

    No pay, no work, plain and simple. I've seen where employers try to bully their way onto employees about having to be at a certain place without being paid for it. Don't stand for it, Triumph, you can do better. They may be able to bully the illegals but not us citizens.

    In the State of California, you can only clock in 7 minutes to start time, and 7 minutes after the end of the workday. This rule prevents people from abusing and mis-using overtime which they are not entitled to. Many companies have started a point system that lead up to disciplinary action to termination. Clock in earlier than the 7 minutes, and you get half a point. 10 points and you are gone.

    Aye, In this case though its a requirement. Expected to make sure everything gets done, so the next shift runs smoothly. You are not allowed to leave until its done.
