    Up All Night: Senate Waits to Vote on Patriot Act's Future

    Senators continued their debate Friday night without resolution on how to move forward on expiring provisions in the Patriot Act—and it looks like they may be on Capitol Hill all night.Senate Majority Leader Mitch McConnell huddled together his rank-and-file late Friday afternoon, but deep schisms within the party were still present as supporters for the USA Freedom Act, which would end the NSA's bulk collection of call data, remained dug in.And Sen.

    Rand Paul vowed to continue blocking efforts to extend the expiring Patriot Act's surveillance authorities, a pledge that comes as a second act to his 10-and-a-half hour floor takedown of government surveillance earlier in the week.
    "Will be seeing everyone overnight it seems," Paul tweeted. "My filibuster continues to end NSA illegal spying."

    After voting to pass the fast-track trade bill, McConnell gave senators the news that they will be here a while.

    "Without reaching an agreement to go forward … the next vote will be at 1 a.m.," he said.
    The reason for the slowdown is that the Senate failed to achieved unanimous consent to move more quickly to take up consideration of NSA surveillance legislation.

    Because of the chamber's procedural rules, the earliest the legislation can now considered absent unanimous consent is 1 a.m.
    Supporters for the reform bill continued to lobby undecideds and McConnell threatened that a vote "yes" on the reform measure may mean the Senate would have to forgo its planned Memorial Day recess.

    "McConnell and his staff forcefully made the case that a vote for USA Freedom was a vote to cancel recess," a Republican aide said.When it comes to reauthorizing bulk data collection, nearly a dozen conservative senators are stuck in a tug of war between McConnell and their libertarian-minded colleagues, reform advocates, and constituents back home.Republican Sens. Kelly Ayotte, Joni Ernst, Tim Scott, Mark Kirk, Pat Toomey, Bill Cassidy, and Ron Johnson are still publicly not saying where they stand on the legislation, putting the future of the NSA program in limbo.
