    Who Gets H-1B Visas? Check Out This List

    Five of the top 10 were Indian outsourcers, but Microsoft is number three, IBM number eight, and Oracle USA number nine. The New York City Public School system ranks 22nd on the list.

    Criticism by federal legislators is mounting against Indian outsourcing firms that use the H-1B visa foreign worker program to staff their U.S. operations. Critics claim that the Indian firms skirt regulations and use the visas to train workers in the U.S. to facilitate moving jobs offshore.
    A government list obtained by InformationWeek of the top 200 companies receiving H-1B visas for foreign workers last year reveals that five of the top 10 were Indian outsourcers. The complete list of 200, however, shows a mix of foreign companies, U.S. technology vendors, and American universities. Microsoft is number three on the list, IBM number eight, and Oracle USA number nine. The New York City Public School system ranks twenty-second on the list, with 642 H-1B visas received last year.

    Earlier this week, U.S. Sens. Dick Durbin (D-Ill.) and Chuck Grassley (R-Iowa), both members of the Senate Judiciary Committee Subcommittee on Immigration, sent letters to the CEOs of nine Indian firms asking for details about how they use their H-1B visas. The companies, including Infosys, Satyam, Tata Consultancy Services, and Wipro, are among the top users of the visas.

    Last year, the nine Indian firms collectively were issued 19,512 of the 65,000 H-1B visas granted, according to the list. (In addition to the 65,000 granted annually, the U.S. also issues H-1B visas to 20,000 foreign students who received advanced degrees from U.S. universities.)

    As of press time, none of the nine Indian companies has responded to the Durbin-Grassley letters, according to a Durbin spokesman. However, a statement by the National Association of Software and Services Companies, an organization that represents Indian IT firms, defended the practice:

    "The Indian IT industry and NASSCOM do not see this as an immigration-related issue but one related to international trade, and would urge that work permits and intra-company transfers should not be intermingled and confused with immigration. Work permits are primarily a tool for facilitating trade and allow global companies to bring key staff to the US on temporary assignments, just as US staff often travel across the world for temporary assignments and this is clearly different from immigration."

    Although H-1B visas are most frequently used to employ foreign-born technology workers, it's important to note that the visas also are used to hire professionals in other occupations, including nurses and other health-care workers, university professors, lawyers, engineers, and architects.

    It's very hard for me to believe, that there are not U.S. citizens who could fill these jobs.
    In the area of medical institutions, the answer is simple. WE NEED MORE MEDICAL SCHOOLS AND MORE NURSING SCHOOLS.

    I'm not sure that's the answer because more schools will just bring in more foreign students. What we need to do is reduce the amount of foreign students allowed to enter our colleges and universities. Decreasing the number of foreign students will force the schools to increase incentives through increased grants in aid, scholarships, etc. for American students (colleges are not non-profit organization). It would also force the schools to compete more for the pool of available candidates, which means increased recruiting efforts. Right now, with huge amounts of foreign student applying, it's a buyers market. This means our schools don't have to do squat but sit back and wait for the applications to roll in.

    We have a lot of high school graduates in this country that simply can't afford an advanced education because of the prohibited cost involved. For example, a four year degree, including room and board, at North Carolina State University costs around $60,000. I repeat, this is a state university - most private schools cost well in excess of $80,000 for a 4-year degree. As for medical school, this will explain the cost issue:

    I agree, to a certain extent, of what you are saying MW. I went to a pretty respected school (the University of Florida) and, for the first year, I had to pay out-of-state tuition because I had not established residency in the state as of the first day of classes. The problem is that everyone in the Financial Aid office is too concerned with helping out minorities than other Americans. I'm engaged to a Hispanic girl (LEGAL Hispanic) so no one in their right mind can say I'm a "racist". However, it would irritate me that whenever I would go to speak to a FinAid counselor their first question would be "Are you by any chance a minority? We have stacks of scholarship applications for minorities." They didn't even bother to ask for my income taxes first, NO NO NO. It was whether I was a minority or not. I did manage to get about 90% of my tuition and room and board paid for (mostly because of my grades and major) so it wasn't that big of a deal for me but I did see that policy destroyed a lot of my friends who were also just plain, unhypenated Americans.


    What we need to do is get more counselors out there to help EVERYONE, not just minorities. My senior year, I had a counselor that was really great and encouraged me to apply for every scholarship she could find. She told me that every white American she had met with didn't even bother to come see her because they had heard everything was for Hispanics or other minorities. Truth is, a lot of us have the upper hand since some of the financial aid is reserved for CITIZENS ONLY. Also, GPA is a big decider in this. As long as the kids do well in school, they should find every chance they can to apply for a scholarship. I was lucky enough to not have to work a full time job in college which was great for me. I only hope others can have the same luck I did.

    More medical schools are not the answer. The average debt of a 2006 medical graduate was $150,000, so many students are opting for the higher paying specialties, especially the surgical subspecialties. Also, a number of medical students are interested in the lifestyle of a particular specialty, such as frequency of call and office hours. The most important specialties, Family Practice/Internal Medicine and Pediatrics have average salaries of less than $150,000 a year. The number of family practice resident slots was only 3,000 out of 20,000 total in 2006, funding for these programs is decreasing. Many doctors going out into practice do not want to practice in the rural, underserved areas for varied reasons. And these areas and hospitals are the ones who depend on H1B doctors. More and more physicians in their 40s and 50s are quitting because of burnout.

    The US government has played no small part in making practicing medicine unpalatable (think Medicare, Medicaid and micromanaging) and has resulted in a real need for more foreign docs. These visa holders are not taking anyone else's job, and most of the ones I have worked with in 30 years of practice have been good, caring physicians.
