SEC. 1. EFFECTIVE DATE TRIGGERS.

(a) With the exception of the probationary benefits conferred by Section 601(h), the provisions of Subtitle C of Title IV, and the admission of aliens under Section 101(a)(15)(H)(ii) of the Immigration and Nationality Act (8 U.S.C. 1101(a)(15)(H)(ii)), as amended by Title IV,

(i) the programs established by Title IV of this Act; and

(ii) the programs established by Title VI of this Act that grant legal status to any individual or adjust the current status of any individual who is unlawfully present in the United States to that of an alien lawfully admitted for permanent residence,shall become effective on the date that the Secretary submits a written certification to the President and the Congress that the following border security and other measures are funded, in place, and in operation:

(1) Staff Enhancements for Border Patrol: The U.S. Customs and Border Protection (CBP) Border Patrol has, in its continued effort to increase the number of agents and support staff, hired 18,000 agents;

(2) Strong Border Barriers: Have installed at least 200 miles of vehicle barriers, 370 miles of fencing, and 70 ground-based radar and camera towers along the southern land border of the United States, and have deployed 4 Unmanned Aerial Vehicles and supporting systems;

(3) Catch and Return: The Department of Homeland Security is detaining all removable aliens apprehended crossing the southern border, except as specifically mandated by law or humanitarian circumstances, and U.S. Immigration and Customs Enforcement (ICE) has the resources to maintain this practice, including resources to detain up to 27,500 aliens per day on an annual basis;

(4) Workplace Enforcement Tools: As required through all the provisions of Title III of this Act, the Department of Homeland Security has established and is using secure and effectiveidentification tools to prevent unauthorized workers from obtaining jobs in the United States. These tools shall include, but not be limited to, establishing:

(i) strict standards for identification documents that must be presented in the hiring process, including the use of secure documentation that contains a photograph, biometrics, and/or complies with the requirements for such documentation under the REAL ID Act; and

(ii) an electronic employment eligibility verification system that queries federal and state databases to restrict fraud, identity theft, and use of false social security numbers in the hiring process by electronically providing a digitized version of the photograph on the employee's original federal or state issued document or documents for verification of the employee's identity and work eligibility; and

(5) Processing Applications of Aliens: The Department of Homeland Security has received and is processing and adjudicating in a timely manner applications for Z nonimmigrant status under Title VI of this Act, including conducting all necessary background and security checks.

(b) It is the sense of Congress that the border security and other measures described in such subsection can be completed within 18 months of enactment, subject to the necessary appropriations.

(c) The President shall submit a report to Congress detailing the progress made in funding, appropriating, contractual agreements reached, and specific progress on each of the measures include in (a)(1)-(5):

(i) 90 days after the date of enactment; and

(ii) every 90 days thereafter until the terms of this section have been met.If the President determines that sufficient progress is not being made, the President shall include in the report specific funding recommendations, authorization needed, or other actions that are being undertaken by the Department.

Note the loophole big enough to drive a truck through regarding the z visas. the loophole can be found in sec. 1(a), and section 601(h). The exceptions noted in 601(h) are broad and allow for just about anyone to gain probationary z status before the date triggers are met. Jim C

(2)If Mexican trucks are allowed into the United States, then the fence will not matter. There is no mention of certification that illegal immigration has been stopped or minimized only that the fence is in place.

We have now, today, sufficient laws on the books to properly address the immigration crisis. We have approval to build the fence, we laws against illegals in our nation and we have laws against employing illegals which, if enforced, would remove the demand and those here for jobs that they could not then have would self deport. BUT, we don't enforce the EXISTING laws so why in the hell would we now enforce a bunch of new ones? There should be no new laws until the ones on the books are enforced.

After reading large portions of this bill, I can not understand how any American citizen would support this bill. First it has enough loop holes in it to employ attorneys for the next decade. Second there is too much "trust me" content in this bill when the Congress and the President have proven to be untrustworthy on this issue. Finally, It calls for a huge expansion of government and a coresponding increase in taxes that will be needed for the increase in the welfare state provisions. This bill is bad for the country, it is bad for the political process and it is bad for the rule of law. There are no "good" points to the bill. In fact the only people that benefit from this bill are Mexicans and the ruling elite. I say not just no to this bill but HELL NO!

What is needed now is an old-fashioned posse to round up and jail all the co-conspirators to this coup attempt for allowing the invasion and takeover of our country and culture.

Am I the only one to notice the major flaw in this bill? This bill focuses strictly on the illegal immigrants and it does nothing to fix the problem with the legal immigration process. I see nothing that helps the people who have patiently waited years (and in some cases DECADES) to become legal immigrants. Shouldn't the Senate spend a little bit of time and focus on the people who have been LEGALLY trying to enter the US to become citizens?

The last bill of this importance to the nation that was pushed through and voted on before anyone in Congress could read it all, let alone before any of the public could understand and comment on it was the **Patriot Act**. Look who is repeating the same mistake (from our standpoint) with the same bum's rush tactic (from the Senators who support this). I hear various Sen members stating that immigrants have to leave and then return. May answer to them is “Get Real”. For the majority of immigrant are living day to day to support their families in there country. The US gives money to many country to help with poverty and when people want to help them selves instead of standing in line to receive a plate of food that doesn’t even begin to cover there hunger and unbearable conditions. This comes from people who have warm homes and refrigerators filled with food, saving and a paycheck coming in. You have families who can’t afford to send there children to school to become education to get that one step up. These head of household risk there lives to come to this country to be able to help there families. You expect them to be able to come up with all the immigration fees, legal fees and penalties on top of this and then ask them to leave everything they have to leave for who knows how long and then to try to come up the money necessary to come back and start over????? If they could afford all this they won’t have risked there lives crossing the boarder to come to this country. This country was founded on people who risk there lives to come here for a better live. Have we forgotten what this country is made of…. immigrants.

This bill is an insult to all of us that faced harships and family separation because we were "dumb" enough to follow the laws. I am dissapointed that this wonderful country that became my home when I got here at the age of 15, is advocating that it is ok to break laws and ride the system that has been built by law abiding and hard working citizens and immigrants that respected the laws; I am dissapointed that most of the ilegal hispanics that come here get used to the free rides and the consequence is that they teach their kids that they deserve everything without really working for it and without needing to follow any laws, and that it is ok to jump in front of the line without any regards for the people who are patiently waiting. The current bill cannot be amended to obtain a sensible bill. It needs to be killed. First, this country needs to end the practice of automatic citizenship to anyone born in this country. Children of illegals should retain the illegal status of its parents, even if a constitutional amendment is required. Second, every benefit, with the exception of life saving emergency medical care, should be restricted to those here legally. Third, we should require passport ID at all the same places the Europeans do, until we come up with a more secure form of identification. Fourth, we should deploy the National Guard and other military personnel on our borders to repel the invasion underway. Fifth, we should institute a policy whereby we recoup the cost of apprehending and jailing illegals who commit additional crimes from their home country. Sixth, if we need imported workers, we should improve the current system of legal immigration so the wait is reduced to 1 year or less. There's much more to be done, but this would be a great start.

It is time for us to develop a backbone. Illegal aliens are law breakers. I suggest the following: 1)Make it so hard economically for illegals to survive here that they will voluntarily go home--get rid of government programs. 2)Hit employers who hire illegals in their pocketbook--HARD. 3)Quit granting citizenship to babies of illegal alien mothers- treat them as what they are--dependants of illegal aliens and deport them home with their parents. We have tried amnesty programs in the past with what result? Illegal aliens are a securitry threat to the United States. We are indeed a nation of immigrants, but have laws to govern the logistics of becoming a citizen. It is past time to uphold them. Giving current illegals special accomodations is inherently wrong. I have Fillipino friends going through the legal process of becoming citizens annd they are getting no special treatment.If the United States does not get a handle on this major security issue we can expect more affronts to our homeland like 9/11 and Oklahoma City.

I'm a small business employer of LEGAL seasonal H2B workers. Unemplopyment in my area is ~2%. The H2B program is the ONLY way I've been able to get people willing to work in tree care. Called Employment Commission yesterday, again to ask if they had ANYONE wanting tree work job - they had NO ONE. We pay $12 - 20/hour. This is not min wage. This bill eliminates the LEGAL H2B seasonal program. Anyone want a summer job in central Virginia? If not, we'll probably go under.

She came without a Visa because she did not have the money or influence to buy one as most people who get a Visa do. She came to the United States looking for a better life. Seven years later she has worked gotten married (to me) and we have a 9 month old beautiful baby girl named Alexandria. My wife works in Foodservice and is looking to move beyond that. She has been paying payroll taxes for six years and paying her taxes yearly under her Tax ID which the government willingly bestows without the benefits of resident status and the security that would bring. In short my wife works and pays taxes, is not a criminal and never has been, is a wife and a mother to American Citizens but she is not allowed to be a citizen and there is currently no path for her to gain her citizenship. This bill is not perfect and I do not like the fact that my wife's citizenship has to wait for our slow moving government to protect our borders in order for my family to be able to live freely but I do feel it is a step in the right direction. My wife could never have come to this country the way that she did if the borders were properly protected and large businesses did not actively support using illegal immigrants for labor.

Late Friday night, an electronic version of the "immigration reform" bill was finally published, and quickly found its way into the hands of KLo at the Corner. From there, it has spread all over the net, of course.

But the published version is a big, clunky PDF file (which, if you like, you can download here.) Good if you plan on printing out all 326 pages of it, not so good if you are a blogger who wants to comment on a particular section and show your readers exactly what you're talking about.

So I've taken the copy published by NRO and parsed it into a format that allows for easy browsing online. Features of this version include:




A table of contents on the left side that allows you to jump directly to a section of your choice. I've also included a "Highlights" index at the top --- which should really be "lowlights" -- where I'll collect links to the most interesting sections and commentary on the bill.

My response to Mike: Not all illegal aliens are mexican, Mike but..."Of course, not all illegal aliens come from Mexico. In 1997, the illegal alien population was 54 percent Mexican. The illegal alien population is currently 70 percent Mexican, with 30 percent coming from other countries. Latin America, including Mexico, is the source of 90 percent of illegal aliens entering into the United States." Senators Feinstein and Craig Unveil Details of AgJOBS Program Included in Comprehensive Immigration Bill

Washington, DC – One day after Senators announced an historic agreement on comprehensive immigration reform, Senators Dianne Feinstein (D-Calif.) and Larry Craig (R-ID) unveiled details of the agricultural workers program included in the package.

The agricultural workers program mirrors legislation that Senators Feinstein and Craig introduced earlier this year.

“Immigration is one of the most difficult areas in which to legislate, because feelings run deep on both sides of the issue,” Senator Feinstein said. “It also must be remembered that we need 60 votes to move anything in the United States Senate. Therefore, compromise is the only way we are going to get a bill.”

This legislation is not perfect, but I believe it is a good beginning. It is a work in progress. It is subject to change. Any bill has to be bipartisan, and if we cannot get Republican votes, we cannot pass a bill.

But this bill has substantial accomplishments. It would:

Strengthen our borders through additional border patrol agents, building border fences, and enhance surveillance technology.

Provide a path to earn legal status for the undocumented in this country, which is estimated to be 10-12 million, including 2-3 million in California.

Enhance the ability of the government to fight against document fraud by including a provision to increase penalties for passport fraud.

Create of a strong employment verification system to crack down on illegal employment.

Gives young people an opportunity for an education through the Dream Act.

And provide a stable and consistent workforce for agriculture, through the AgJOBS program, which is included in the bill.

The agricultural workers program in the bill is fundamentally the same program that the growers and workers negotiated over ten years, and which Senator Craig and I have been fighting for.

This legislation would create a separate agricultural workers program. It provides a consistent, stable workforce for the one industry that depends almost exclusively on undocumented labor. And it provides a way out of the shadows for those who have worked in agriculture and who will continue to work in agriculture for a number of years.

My great thanks go to all who participated in these negotiations, but especially to Senator Kennedy, Senator Craig and Representative Berman, for working steadfastly to keep AgJOBS in the immigration bill.”

“The American people have rightly demanded that Congress solve the national problem of immigration, and the bill announced this week is a serious effort to do just that,” Senator Craig said. “The legislation contains provisions that will promote our economy, improve our national security, and deal fairly with both citizens and non-citizens alike. In particular, California agriculture should be pleased with the inclusion of the AgJOBS legislation that was introduced by Senator Feinstein and myself in the Senate, and Congressman Berman and others in the House. More than any other industry, the future of U.S. agriculture is tied to the outcome of the immigration debate."

Summary of AgJOBS Bill

Earned Adjustment Proposal for Agricultural Workers

Pilot program to allow certain undocumented agricultural workers to legalize their immigration status in the United States and to modify the current H2A program so that it is usable.

The first step requires that undocumented agricultural workers apply for a “ZA visa” if they can demonstrate that they have worked in American agriculture for at least 150 work days within the previous two years before 12/31/06.

The second step requires that a “ZA visa” holder demonstrate that they have worked in American agriculture for an additional 150 work days per year for 3 years, or 100 work days per year for 5 years, then they will be eligible to apply for a green card after the current backlog is cleared, in approximately 8 years.

This program will be capped at 1.5 million ZA visa cards in five years.

Individuals may participate in employment other than agriculture so long as the worker satisfies the 100 or 150 workdays each year, and if they don’t they will lose their status.

ZA visa holders (including spouses and children) will be allowed to travel in and out of the United States.

Spouses of ZA visa workers will be eligible to apply for their own work permit.

Aliens participating in the program will be required to pay a fine, and show that they are current on their taxes, and learn English.

The Department of Homeland Security will determine the adequate application fee necessary to offset the costs of this program and ensure that ZA visas are encrypted, have biometric identifiers and contain other anti-counterfeiting protections.
H-2A Program Modifications

The labor certification process, which often takes 60 days or more, is replaced by an “attestation” process. The employer can file a fax-back application form agreeing to abide by the requirements of the H-2A program. Approval should occur in 48 to 72 hours.

The interstate clearance order to determine whether there are U.S. workers who can qualify for the jobs is replaced by a requirement that the employer file a job notification with the local office of the State Employment Security Agency. Advertising and positive recruitment must take place in the local labor market area.

Agricultural associations can continue to file applications on behalf of members.

The statutory prohibition against “adversely affecting” U.S. workers is eliminated. The Adverse Effect Wage Rate is frozen for 3 years while it is studied, and thereafter indexed by a methodology that will lead to its gradual replacement with a prevailing wage standard.

Employers may elect to provide a housing allowance in lieu of housing if the governor determines that there is adequate rental housing available in the area of employment.

Inbound and return transportation and subsistence is required on the same basis as under the current program, except that trips of less than 100 miles are excluded, and workers whom an employer is not required to provide housing are excluded.

The motor vehicle safety standards for U.S. workers are extended to H-2A workers.

Petitions for admission of H-2A workers must be processed and the consulate or port of entry notified within 7 days of receipt. Requirements are the same as current law.

Employers may apply for the admission of new H-2A workers to replace those who abandoned their work or are terminated for cause and the Department of Homeland Security is required to remove H-2A aliens who abandoned their work.

H-2A visas will be secure and counterfeit resistant.

A new limited federal right of action is available to foreign workers to enforce the economic benefits required under the H2A program, and any benefits expressly offered by the employer in writing. A statute of limitations of three years is imposed.

Lawsuits in state court under state contract law alleging violations of the H-2A program requirements and obligations are expressly preempted. Such state court lawsuits have been the venue of choice for litigation against H-2A employers in recent years.
In addition to the numerous compromises, already contained in the AgJOBS bill, Senators Feinstein and Craig, and Representative Berman worked with Senator Chambliss to make additional changes.

1. End of the Line – Agricultural workers will now get their green cards after the backlog is cleared out (approximately 8 years).

2. Merit System – Agricultural workers will go through the point system created in the comprehensive bill; however, agricultural workers are entitled to receive the maximum amount of points available so they are the first to get their green cards at the end of 8 years.

3. Touch Back – At some point before agricultural workers get their green card they will go back to the closest country of origin – a special provision will be allowed if the individual is from a country farther away than Mexico or Central America.

4. Compromise on Legal Services – When disputes arise, courts will be allowed to consider what remedial efforts have been taken by the employer.

5. Judicial Review/Confidentiality – Once language is finalized on judicial review and confidentiality these provisions will be harmonized with AgJOBS.

6. English – Agricultural workers will have to show English proficiency as required under the larger bill, before getting green card.

7. Green Card not Automatic – If agricultural workers do not want to apply for a green card they could instead apply for a Z visa (after they have completed the 3-5 year work requirement).

8. 50% Rule – Agreed to compromise proposal that 50% rule applies to U.S. workers, but not Z visa holders.

9. Reporting requirement – Added language directing DHS to promulgate regulations to certify that the work requirement is either completed or excused (as provided in the bill) at the end of the 3-5 year period.

10. Wage Commission – Create a comment period where the Commission evaluating wage rates will take testimony and data from the public and hold public hearings.
