N.Y. - Trial in rape, killing put off for three months

ALBION—The trial for Carlos A. Cardenas, an illegal immigrant accused of raping and strangling his 15- year-old sister-in-law last year, was put on hold for another three months when he appeared Monday in Orleans County Court.
His attorney, Public Defender Sanford Church, asked for more time to consult with a forensic expert. A new trial date was set for June 20.
Cardenas, 22, a Mexican citizen, confessed to the Jan. 15, 2011 killing in an 11-page signed statement, saying he accidentally strangled his sister-in-law Katherine “Katy” Sanchez in his East State Street home, after they had consensual sex and the teen threatened to tell his wife. Cardenas told police he hid her body in the basement, then moved it a few days later to an apple orchard, leading investigators to the site.
Church tried to suppress the confession, but County Judge James Punch ruled it admissible Jan. 13.
Cardenas, charged with second-degree murder, has rejected a plea bargain that would carry a sentence of 20 years to life. He faces 25 years to life if convicted at trial on the murder count.
