Second man charged in fatal wreck; investigators believe suspects were racing

Police have charged a second man in connection with the fatal car accident that killed a 4-year-old child in Boone County, and investigators believe the men were racing when the crash occurred.

Boone County sheriff's deputies arrested Marvin Navarro, 34, in Huntington and charged him Saturday night with negligent homicide, Sheriff Rodney Miller said.

The crash killed Tyler Evans shortly after midnight Aug. 31 when the truck he was riding in with his father and brother slammed into another vehicle driving in their lane of W.Va. 3 near Sylvester, police said.

The driver of the other vehicle, Christian Javier Sanchez-Rubio, was charged with drunken driving causing death and is being held at Southwestern Regional Jail.

Police now believe Sanchez-Rubio may have been racing with Navarro along W.Va. 3 when his truck crashed into the Evans' vehicle.

Miller said Navarro, who had been living in Whitesville, moved to Mount Sterling, Ky., shortly after the crash. Deputies spoke with Navarro and urged him to come to Huntington where he was arrested.

Navarro had a Texas driver's license in his possession and is believed to originally be from Houston.

He was arraigned in Cabell County and taken to Southwestern Regional Jail where his bond is set at $50,000.

Residents living near W.Va. 3 reported seeing two vehicles racing each other between Sylvester and Whitesville moments before the collision, Miller said.

"It appears they were watching these antics take place at the time of the crash," the sheriff said.

Deputies used a convenience store surveillance video from earlier in the night to determine Navarro had been with Sanchez-Rubio, Miller said. Police believe both suspects worked together at area coalmines.

Four-year-old Tyler Evans' father, Terry, was driving back from a friend's house shortly after midnight when he saw the headlights coming toward him in his lane.

Terry Evans swerved his 2002 Ford F-150 to the left but it wasn't in time to avoid a collision with a 2000 Dodge Dakota driven by Sanchez-Rubio, an illegal immigrant who had been employed in area mines.

Tyler, who was sitting in the passenger seat, took the brunt of the impact. Also injured was his little brother, 2-year-old Micah.

Police say Sanchez-Rubio had a fake Green Card and Mexican driver's license -- both of which identified him as Jose Carlos Madrigal -- while he worked at area coals mines for Minserco, a contractor based in Milwaukee, Wis.

Charged with causing a death while driving drunk, he is being held on $200,000 bond at Southwestern Regional Jail.

"It makes it harder for me because he shouldn't have even been here to begin with and then this happens," said 26-year-old Marsha Evans, Tyler's mother.

Mr Evans would make a good guest on Lou Dobbs

Another childs life wasted as a result of a company hiring illegal immigrants.

I guess coal mines are no longer jobs that are exempt for illegal immigrants. I read a recent report where there were only 43 illegal immigrants living in W.Va. since that state does not offer many other job opportunities except coal mining. Looks like even that is changing.

Illegal immigrant pleads guilty in wreck that killed 4-year-old boy

An illegal immigrant living in Boone County has been sentenced to up to 10 years in prison after pleading guilty to causing a fatal car accident that killed a 4-year-old boy.
Christian Javier Sanchez-Rubio, 23, of Whitesville entered his plea during a hearing Monday at the Boone County Courthouse in Madison. Circuit Judge William Thompson handed down the maximum 10-year-sentence, but Sanchez-Rubio will be eligible for parole.

He pleaded guilty to two drunken driving-related charges, including driving under the influence causing death and DUI causing injury.

Assistant Prosecutor Parker Bazzle said the plea came as a surprise to his office. The matter was only scheduled for a brief, pre-trial hearing Monday.

Bazzle said the two sides had been working on a plea, but no deal had been struck before Sanchez-Rubio formerly announced his plea in court.

"I came to court knowing it was a possibility, but I wasn't expecting a plea," Bazzle said. "I figured it was less likely than more likely."

Prosecutors said Sanchez-Rubio was speeding down W.Va. 3 near Sylvester on Aug. 6, 2006, when his 2000 Dodge Dakota truck collided head-on with a car driven by Terry Evans of Clear Fork. Police said Sanchez-Rubio's truck was in the wrong lane.

Evans' son, Tyler, 4, died from injuries he sustained in the accident. He was sitting in the passenger seat and had a seat belt on, police said.

His little brother, Micah, 2, who was sitting in the back seat, was also injured in the accident.

Police said after his arrest that Sanchez-Rubio had provided a fake immigration document and a Mexican driver's license, both of which identified him as Jose Carlos Madrigal. He had worked at coal mines throughout Boone County, police said.

Bazzle said Monday's hearing was very emotional, with members of the Evans family and Sanchez-Rubio all offering tearful testimony.

"He apologized for his actions," Bazzle said. "He came off as very sincere."

Sanchez-Rubio is being held at the Southwestern Regional Jail. He will remain there until Department of Corrections officials can find a place for him in the state penitentiary.

Bazzle said because of Sanchez-Rubio's illegal immigrant status, he could be deported after serving his prison sentence. That decision will be up to federal immigration officials, Bazzle said.
