The media desperately tried to reframe the attack as a protest gone bad, but it didn�t work and the story quietly fell off the radar.
Now, members of Antifa are openly threatening the judges on social media. Do they want to join their friends in prison?

Far-left extremists are making violent death threats against two federal Texas judges after they handed down long prison sentences to convicted members of a North Texas Antifa terror cell.
The threats followed last week�s first batch of sentencing where eight convicts received prison terms ranging from 30 years to 100 years after becoming the first defendants convicted in a federal Antifa terrorism case in U.S. history.
The threats are being directed at U.S. District Judge Mark T. Pittman and Chief U.S. District Judge Reed O�Connor.

Many of the threats were responses to updates on social media platform Bluesky from the DFW Support Committee, the far-left group that has been organizing support and cash donations for the defendants.
�So, when are we burning it all down?� asked one user under an alias. �He has an address,� referring to Judge O�Connor.

DHS Proposes Reforms to the H-2 Nonimmigrant Visa Programs

CIS submitted a comment explaining that the agency’s proposal must be amended to deter illegal immigration and provide stronger protections to workers

The Center for Immigration Studies (CIS) submitted a public comment last week to strengthen the U.S. Department of Homeland Security (DHS)’s proposal to reform the H-2A and H-2B nonimmigration visa programs. The proposal, titled “Modernizing H-2 Program Requirements, Oversight, and Worker Protections”, attempts to mitigate the exploitation of foreign workers by amending regulations to expand H-2 visa holders’ flexibilities; eliminate the requirement that foreign countries meet minimum compliance and cooperation standards in order for their nationals to be eligible to participate in a H-2 program; and clarify that employers may not ask workers to pay certain prohibited fees, among other reforms.

In our comment, however, CIS argued that DHS’s proposal did not go far enough to address the serious violations of labor, criminal, and immigration law that are facilitated by the H-2 programs and the federal government’s failure to engage in meaningful audits of the programs. Moreover, CIS suggested that DHS withdraw unauthorized provisions that, if promulgated, will transform the H-2 programs into “dual intent” programs by improperly encouraging temporary workers to apply for adjustment of status (green cards) while in the United States on nonimmigrant visas.
CIS also urged DHS to maintain and strengthen its standards for country eligibility in the H-2 programs, as well as impose stronger penalties on employers found to have violated existing requirements of either program. Additionally, CIS argued that rather than remove requirements that certain employers participate in E-Verify, CIS believes that DHS require all employers that hire H-2 workers to participate in the free eligibility-verification program.

Finally, CIS recommended that DHS work with the U.S. Department of Labor to make additional reforms the guestworker programs by:

Requiring employers to pay H-2 workers higher wages;
Requiring USCIS to prioritize the selection of H-2B petitions for employers in industries with the greatest need for workers;
Amending DHS’s deferred action program to include only those aliens who report unauthorized employment or violations of law that result in prosecution;
Reining in law-violators’ ability to petition for H-2 workers;
Creating a formal complaint intake system for DOL’s website, SeasonalJobs.dol.gov; and
Resuming and expanding worksite enforcement.

Without serious deterrence measures in place, including robust enforcement efforts, the H-2 nonimmigrant visa programs remain vulnerable to fraud and abuse.

Who Is ICE�s Newest Chief of Staff, and Will He Promote the Agency�s Mission?

Or will he follow his fellow Biden appointees in abolishing ICE from within?

The Biden administration has appointed a new chief of staff at U.S. Immigration and Customs Enforcement (ICE), Michael D. Lumpkin, who has more than 20 years of active duty military service as a U.S. Navy SEAL, where he served in various leadership positions. His appointment means ICE is now led by two officials with a Navy background, as the agency�s de facto director, Patrick J. Lechleitner, also served as a Navy signals intelligence specialist.

Lumpkin replaces Deborah Fleischaker, who previously worked in the Civil Rights and Civil Liberties (CRCL) office in the Department of Homeland Security (DHS). The question is whether Lumpkin will be a champion of ICE�s mission � unlike the Biden appointees who came before him � and work to put a stop to the ongoing release of countless criminal aliens into our communities. He has no immigration background, but he presumably understands the importance of national security and will hopefully take issue with the threats now under his watch.

When I worked in ICE�s Office of the Director, I worked to raise standards, create transparency, and focus the agency on threats that were being ignored, such as the mass fraud in the foreign student program. My colleagues and I worked to rebuild the agency after years of degradation under the Obama administration. It was clear to us that our predecessors weren�t trying to leave the agency in a better condition than they found it.

Lumpkin joins the agency amid ongoing destruction inflicted by the Biden administration. How many ICE officers will retire under his watch? What effort will he make, if any, to build the agency up? How will he make it more effective and more efficient in carrying out arrests and removals? Lumpkin will soon learn that his fellow political appointees are actively working to make ICE less effective and less efficient and that they�re getting quick results. He�ll also soon realize that without a quick change of course, he will be directly responsible for endangering the lives of countless Americans across the nation.
Why Was Lumpkin Appointed to ICE? Lumpkin has no immigration background, no policy experience related to immigration, and would seem to be an odd political appointment. It may be that Biden administration officials have quietly concluded that the open-border activists they�ve previously appointed to run the nation�s immigration system have created a horrific national security threat and one that threatens President Biden�s re-election. While the administration would not admit to these concerns publicly, Lumpkin�s background suggests national security and public messaging are the key issues that led to Lumpkin�s appointment.

Lumpkin was the assistant secretary of Defense for special operations / low-intensity conflict and describes himself as part of the �the special operations force (SOF) community�. He has advised the secretary of Defense �on special operations, counterterrorism, and counter threat finance activities and capabilities�. In 2015 testimony before the House Armed Services Committee, Lumpkin explained that between the SOF and conventional forces, the United States is able to �execute missions across the full-spectrum of combat and non-combat related activities� and that �beyond major contingencies, SOF remain the force of choice for those security force assistance missions in non-permissive and politically-sensitive areas, and missions where the host nation demands a small footprint�.
Though he hasn�t testified before Congress on immigration matters, Lumpkin noted in that 2015 hearing that �there exists a nexus between criminal enterprises and terrorist activities�. He explained:

More and more, we are seeing the convergence between criminal networks that facilitate the movement of people, weapons, drugs, and funding within conflict zones and violent extremists who take advantage of those channels as well.

Lumpkin would seem to understand that the expansive criminal activity occurring across our nation�s borders, at worksites, and in the foreign student program, for example, are creating serious threats that must he must address in his new role.
Lumpkin also has a background in �anti-propaganda� management, from his experience as the special envoy and coordinator of the State Department�s Global Engagement Center, where he worked to �counter extremism online in real time�, having been appointed by President Obama in 2016. In this role, he led �efforts to coordinate, integrate, and synchronize Government-wide communications activities directed at foreign audiences abroad for the purpose of countering violent extremism and terrorism�.

His focus was members of ISIS and people who �may be vulnerable to recruitment� and he has background in use of social media, as he explains here:

Using Facebook ads, I can go within Facebook, I can go grab an audience, I can pick Country X, I need age group 13 to 34, I need people who have liked � whether it�s Abu Bakr Al Baghdadi or any other set � I can shoot and hit them directly with messaging.

Perhaps Lumpkin has been instructed to use his experience and focus on getting other countries to stop encouraging illegal immigration to the United States. Perhaps he�s been instructed to develop a messaging campaign aimed at foreigners considering entering the United States illegally. In the past, DHS has made an effort to discourage illegal immigration through messaging campaigns in foreign countries. Lumpkin�s explanation of how his messaging efforts on terrorism worked would seem to be adaptable:

We have a wide range of partners. We have nation-states standing up messaging centers, working with the Global Engagement Center. We�re working with them to make sure that they have the technical skills to do effective messaging. We�re working with non-governmental organizations ... who work with these different audiences of susceptible populations.

In a recent podcast, Lumpkin spoke of how he can influence behavior and decision-making of individuals through messaging:

There�s all kinds of things you can do with a message to influence behavior, both positively and negatively, if you understand the audience and you understand the tools that are in front of you.

He explained further how broadly focused campaigns can be less effective than targeted social media campaigns:

The way government largely does things, they do things on scale, they think about, �let�s do some information operations, let�s drop fliers from an airplane, or let�s put something on TV,� so you end up with this big message trying to hit a bunch of people in a generic kind of way, hoping that it lands on those one or two or three people that are potential recruits. Historically that�s the way it�s happened. With social media, what it is today, I can buy audiences.

It's interesting to contemplate how Lumpkin views the efforts by the Biden administration to discourage illegal immigration through social media � efforts that are clearly not working as the U.S. border continues to see explosive, record-breaking levels of illegal immigration from all over the world, including from countries that are hotbeds of extremism. Take, for example, the frequent social media posts from ICE like this one:

In his new role, Lumpkin will have to consider the effect of law enforcement � actual arrests and removals � as a means of changing behavior. Social media posts have little effect when the U.S. government rewards people who ignore the messaging. In the immigration context, the federal government is abusing parole, ICE�s legal division is cancelling thousands of pending immigration cases against deportable illegal aliens, DHS is very liberally granting entry to aliens with illegitimate asylum claims, work permits are being handed out like candy, and arrests and removals have gone down so dramatically over the past few years that foreign nationals have little reason to believe they�ll ever be held accountable for violating our nation�s immigration laws. No amount of social media posts can overcome this type of open-border messaging.

Lumpkin will have to contrast what�s happening under the Biden administration with the type of messaging that occurred under the Trump administration, which was so effective that even the generally open-border media helped send the right message. Take this report from the New York Times in the summer of 2017:

CHOLOMA, Honduras � His bags were packed, and the smuggler was ready. If all went well, Eswin Josu� Fuentes figured he and his 10-year-old daughter would slip into the United States within days.

Then, the night before he planned to leave, he had a phone conversation with a Honduran friend living illegally in New York. Under President Trump, the friend warned, the United States was no longer a place for undocumented migrants.
Shaken, Mr. Fuentes abruptly ditched his plans.

From February through May, the number of undocumented immigrants stopped or caught along the southwest border of the United States fell 60 percent from the same period last year, according to United States Customs and Border Protection � evidence that far fewer migrants are heading north, officials on both sides of the border say.
[Illegal aliens] in the United States ... have sent a warning back to relatives and friends in their homelands: Don�t come.
The message is loud and clear here in Honduras. Manuel de Jes�s R�os Reyes, 55, stood in the unforgiving sun outside a reception center for deportees from the United States. His wife, who tried to cross the American border illegally in March, was on an incoming flight.
Mindful of the warnings from the United States, Mr. R�os had urged her not to go. �She didn�t pay attention,� he recalled. �Now she�s here. Thank God, she�s alive.�
If his wife talks about trying to cross again, he said, he will redouble his pleas. �Ah, my love,� he planned to tell her. �Stay here.�

Many in the Central American countries known as the Northern Triangle � El Salvador, Guatemala and Honduras � appear to be doing just that.

Migrant smugglers in Honduras say their business has dried up since Mr. Trump took office. Fewer buses have been leaving the northern Honduran city of San Pedro Sula bound for the border with Guatemala, the usual route for Honduran migrants heading overland to the United States. In hotels and shelters along the migrant trail, once-occupied beds go empty night after night.

Marcos, a migrant smuggler based near San Pedro Sula, said that last year he had taken one or two groups each month from Honduras to the United States border. Since Mr. Trump�s inauguration, however, he has had only one client. He blames Mr. Trump.

�People think he�s going to kick everyone out of the country,� Marcos said, asking that his full name not be published because of the illegal nature of his work. �Almost nobody�s going.�

Pro-enforcement messaging is only effective if combined with actual enforcement, but actual enforcement will require Lumpkin to push back on the administration�s anti-enforcement agenda that has permeated nearly every part of the agency.
Is Lumpkin Expected to Focus on Terrorism? With two military veterans in the top spots at ICE, it�s possible that the Biden administration is intending an increased focus on terrorism. Perhaps Lumpkin has been appointed because his background in national security and counterterrorism is meant to assist ICE in locating and arresting the large numbers of terrorism-linked illegal aliens who have entered the country under the Biden administration. DHS is aware of the severe national security threats they�ve allowed to unfold and though there�s been a lot of discussion of the number of terrorist threats identified along the U.S. border, what�s less public is a pressing concern regarding terrorists who are rumored to have been smuggled into the United States. If Lumpkin is putting his experience to work on this troubling issue, perhaps lives will be spared. But it will require Lumpkin to get ICE to significantly ramp up arrests, removals, and enforcement operations generally.

On the other hand, Lumpkin may be tasked by the administration with facilitating the immigration of more poorly vetted refugees from countries with serious national security threats.

Will Lumpkin Put ICE Back on Mission? Working at ICE will be a new experience for Lumpkin in that this appears to be the first time he will be running an agency with a mission that is routinely politicized and where his fellow political appointees are actively working to undermine the agency�s mission.

In a recent podcast, host Jon Becker lamented what he perceived as an effort by the Trump and Obama administrations to undermine bureaucracy:

One of things I�ve told people ... the last couple of administrations that�s bothered me is kind of the undermining of the bureaucracy, because to some degree the bureaucracy is the continuity, it�s the stability.

Lumpkin responded:

It is, very much so. ... If you�re gonna walk in there and say �I�m gonna do wholesale change to this operation�, okay, you�re delusional, you�re not gonna, it doesn�t matter if you�re Secretary of Defense or a GS-13 rolling in as a political appointee, it doesn�t matter, you�re not going to do wholesale change to the organization. They will fight you every step of the way.

Lumpkin claimed that policy changes are �done by consensus and it�s incremental�. The host responded that the �upside to the system resisting change is it prevents tyranny, it prevents somebody coming in and losing their mind and trying to undermine all of the institutions�.

That may be the case in a military environment, but that certainly hasn�t been the case inside ICE. The Biden appointees overseeing the management of our nation�s immigration laws have very clearly worked to undermine all of the institutions that Congress has tasked with carrying out enforcement of immigration laws. And the result has been a dramatic decrease in all enforcement metrics; under the Biden administration, ICE is making fewer arrests, carrying out fewer removals, and has dramatically reduced the number of criminal aliens being arrested. The result has been mass illegal immigration at a level never before experienced by the United States.

This has occurred while the Biden administration has spread misinformation aimed at the American public. While claiming their policies are designed to focus ICE on criminal aliens, the Biden administration has arrested significantly fewer criminal aliens than the Trump administration. For example, in FY 2018, the second year of the Trump administration, ICE arrested 138,117 illegal aliens with criminal records; in FY 2022, the second year of the Biden administration, ICE arrested only 46,396 illegal aliens with criminal records � a 66 percent decrease.

Lumpkin apparently doesn�t yet understand the mindset of the political appointees at DHS. He will soon learn that Kerry Doyle, his lead lawyer running ICE�s legal division, the Office of the Principal Legal Advisor (OPLA), said that �ICE is an agency that is currently out of control� prior to her appointment and that she has been described by media as �an outspoken critic of the agency [who] has led many lawsuits against it�. He will learn that Doyle supports sanctuary-city policies that exist explicitly to frustrate ICE�s mission, leaving thousands of criminal aliens to run free. He will learn that Doyle is an open opponent of ICE�s critical 287(g) program, which creates partnerships between ICE and local law enforcement, and that her opposition to the program is in support of the release of criminal aliens arrested for a litany of crimes, including manslaughter, armed carjacking, armed robbery, aggravated assault and battery, child rape, strangulation of a pregnant woman, assault and battery of a 60-plus disabled person, kidnapping, home invasion, burglary, fentanyl trafficking, cocaine trafficking, carrying an unlicensed firearm, credit card and identity fraud, and drunk driving, to name a few crimes on the records of aliens arrested in Massachusetts, where she testified against the program. Lumpkin should also take a look at Doyle�s canceling of thousands of pending immigration cases.

Lumpkin will also learn that Claire Trickler-McNulty is effectively the top political appointee at ICE, and that she�s busily consolidating decision-making under herself on all parts of ICE�s mission. Media explain that Trickler-McNulty �previously worked for a nonprofit organization that demanded an end to deportations and was affiliated with an 'Abolish ICE' movement during her tenure�. Most recently, Trickler-McNulty issued a memorandum requiring that any new contracts for detention or the so-called Alternatives to Detention (ATD) program must be approved by her. It reads, in part, �Moving forward, the Office of Acquisition Management will not accept any ATD or detention procurement packages without the attached completed and signed form.� As I explained to the Daily Caller:

�This is unnecessary bureaucracy specifically designed to remove the ICE director from the decision-making process on detention matters, and give a Biden appointee veto power. It also makes the process to expand or change detention more cumbersome, effectively discouraging officers from doing anything to improve efficiency in carrying out the agency�s mission,� former ICE Chief of Staff Jon Feere, who served during the Trump Administration, told the DCNF about the memo.

The goal of this new bureaucracy is to prevent the increase in detention space, which is clearly needed as thousands of illegal aliens pour across the border and thousands more are ordered removed by immigration judges. But the goal of the anti-ICE activists working inside ICE alongside Lumpkin is to hobble the immigration system and prevent ICE from playing its critical law enforcement role.

If Lumpkin is concerned about �undermining the bureaucracy� he should take a hard look at his fellow political appointees and ask how their activities are impacting ICE�s mission.
In the recent podcast, Lumpkin said, �Some ineffective leaders put their ego too close to their position, they think they are that position; they are not. They just happen to be the incumbent, and they are the keeper of the standards.�

I can assure Lumpkin that the Biden appointees at ICE are not interested in keeping any standards and have no interest in leaving the agency in a better condition than they found it. A lot of work had to be done by myself and other Trump administration appointees to rebuild ICE after years of degradation by the Obama administration, which, like the Biden administration, had no interest in efficient and effective immigration enforcement. If Lumpkin doesn�t invoke his new authority and push his belief on why it�s important for political appointees to be good stewards of government, ICE will continue on its downward trajectory, endangering many Americans in the process.

Lumpkin Should Talk with Officers. As a person who served in Lumpkin�s role, I had the opportunity to learn from many ICE officers and special agents. They have first-hand experience, good recommendations, and can provide a detailed look at how policies and practices are working � or not working � in the field. All too often, ICE headquarters makes decisions without sufficient input from people with their boots on the ground. But because ICE is a law enforcement agency with a hierarchical structure, the field carries out the orders from headquarters as directed. In order to put the best immigration policies forward, Lumpkin should build relationships with field offices and seek direct feedback from staff within Enforcement and Removal Operations (ERO).

Through this direct dialogue, Lumpkin will learn how the Biden administration�s policies are harming the agency and undermining public safety. Officers will likely explain to him how Secretary Mayorkas� so-called �enforcement priorities� have allowed most foreign nationals to ignore the State Department�s visa requirements and remain in the United States for as long as they�d like, ignore court orders from immigration judges to return home, engage in asylum fraud without consequence, and commit a host of crimes without fear of removal.

Lumpkin will also learn how ICE is losing detention space rented from friendly sheriffs due to burdensome and uncoordinated audits that are designed to discourage cooperation with ICE. He�ll learn how this is resulting in the release of countless criminal aliens into our communities.

Lumpkin will also learn how the 287(g) program is identifying thousands of removable criminal aliens but is telling sheriffs to release these criminals back into the community because the Biden administration no longer supports this critical federal program and is choosing to harm the public rather than use the program as Congress intended.

Lumpkin will also learn how thousands of unaccompanied alien children (UACs) are being subjected to abuse and exploitation at worksites across the nation � as reported by the New York Times in multiple expos�s � because the Biden administration isn�t letting ICE assist Health and Human Services (HHS) with the vetting and arrest of sponsors, and has largely ended worksite investigations.

Lumpkin will also learn how the Biden administration has turned most parts of every community in the country into a �protected space� for criminal aliens, prohibiting ICE officers from even conducting surveillance near playgrounds even when an illegal-alien child abuser is suspected in the area. I�ve mapped out the ridiculously overbroad and pro-crime policy here.

There�s ample opportunity for Lumpkin to get an earful on what�s really happening on the ground. Officers will be hesitant to speak with a high-level appointee who is associated with the Biden administration�s lawless approach to law enforcement, but if he can ensure them that the conversation is off the record, he�d learn a lot about the horrific public safety threats that are occurring under his watch.

How Long Will Lumpkin Last? The Biden administration has seen a lot of turnover among its political appointees at ICE. The administration�s first appointment to ICE�s legal division, John Trasvina, only lasted about seven months. ICE�s chief of staff position under Biden was held by Jason Houser for a while and then by Deborah Fleischaker for about a year. The Biden administration�s appointment of Scott Shuchart, an anti-enforcement activist who said, "there has never been any problem of terrorists crossing illegally the southern border�, may be ongoing (as terrorists cross our borders), but what he�s up to is unknown at this point. And the Biden administration�s plan to appoint a sanctuary city-advocating sheriff to the director�s position fell apart after a year.
Lumpkin has some time to begin to clean up the dangerous mess created by his fellow appointees. Will he take the opportunity to do so, or will he simply add to ongoing devastation?

WHAT PRESIDENT TRUMP MUST DO
TO DEFEAT THE DEEP STATE COUP

A. President Trump must refuse to concede. No matter what, he must not concede. This election was stolen by domestic enemies. Period. President Trump must refuse to recognize it as legitimate because it is not legitimate. He must follow the advice Hillary Clinton gave to Biden � to refuse to concede, no matter what. But by President Trump refusing to concede, he is stopping a coup rather than engaging in one.

B. President Trump MUST declassify ALL of the dirty secrets in the files of the CIA, NSA, FBI, ODNI, etc. on all of the compromised political, legal, academic, business, media, social elites, etc. He needs to order our Special Operations troops in SOCOM to take lead on securing all facilities where all the data is stored, and he must have SOCOM intelligence officers take lead on following his orders to IMMEDIATELY declassify all of the files on compromised American elites, so we can defeat the Deep State. The dirty secrets � who is a pedophile, who has taken bribes from Communist China and other foreign enemies, who has engaged in murder, etc, are the swam water that the swamp creatures swim in. It is how they are all both controlled and protected. So long as they obey the Deep State, they are immune from exposure and prosecution. If they dare to refuse to obey the Deep State, they can be destroyed by it in a matter of seconds. That is how the Deep State controls people. That is the root of its power (along with the Federal Reserve control on the financial system). And President Trump must strike at the root.

C. President Trump must do a MASS �WIKILEAKS�/SNOWDEN STYLE DATA DUMP. Both Julian Assange and Eric Snowden were heroes in the fight against the Deep State precisely because they dared to do what the Deep State fears most � exposure. The Deep State can throw such patriots into prison. But, it can�t stop the President of the United States, the Commander-in-Chief, from declassifying and dumping ALL of the Deep State�s dirty laundry. He has absolute authority to declassify anything he wants, and to disclose it to the American people. And he needs to do that for corrupt, compromised elites of both major parties. There are GOP traitors too, and they have undermined and worked to destroy our nation from within, right along with the domestic enemies within the Democratic Party and the communist left that is not dominating that party. Expose them all, once and for all. And may the heavens fall (it will be the Deep State that falls).

This is his final, last chance to actually drain the swamp.

20 Presidential Actions Needed to Reduce Work Visas and Permits

The grave employment situation created by the pandemic shutdown requires bold, sustained action from the president. As a first step, President Trump issued a proclamation on April 22 suspending the entry of certain immigrants, including some chain migration and employment categories, to help alleviate saturation in the labor market as the nation begins to recuperate from the pandemic shutdown.¹ The proclamation further directed the departments of Labor, Homeland Security, and State to propose additional actions "appropriate to stimulate the United States economy and ensure the prioritization, hiring, and employment of United States workers."
With 18.2 million native-born Americans and 4.3 million immigrants now out of work, millions more who have stopped looking for work, and deep uncertainty about the pace and scope of the national recovery, the case for dramatically reducing the number of foreign workers has never been greater.² The Center for Immigration Studies has prepared a list of 20 recommendations for additional urgent actions the Trump administration should take to reduce the number of work permits and visas and improve the integrity of the temporary work visa programs. These actions could potentially reduce the number of temporary foreign workers by 1.2 million, or nearly 50 percent.

These include putting a hold on all employment visa programs (temporary and permanent) to assess employer needs and labor conditions; examining the operation of these programs to curb fraud and abuse; and preventing employers who have downsized or accepted pandemic relief from the government from sponsoring workers from abroad.

Background

There are several ways non-citizens join the U.S. labor market, including obtaining a green card or immigrant visa; obtaining a temporary work visa; obtaining a work permit after arrival; and settling here illegally. This report deals primarily with the categories of temporary work visas and work permits, as these reportedly are the focus of the upcoming proclamation.

Every year, immigration agencies issue millions of temporary work visas and work permits to non-citizens for periods ranging anywhere from several months to several years. Last year, more than 900,000 new temporary work visas were issued and more than 1.8 million work permits were granted or renewed. These visas and work permit approvals are in addition to new green card and immigrant visa approvals. Due to varying rates of visa and status durations, it is difficult to determine the exact size of the stock population of temporary foreign workers, but we estimate it to be on the order of three to four million workers.

Difference Between Work Visas and Work Permits

The basic distinction between work visas (formally known as non-immigrant visas) and work permits (employment authorization documents, or EADs) is that temporary work visa holders usually arrive from abroad, while the temporary work permit holders typically enter on a non-work visa or illegally and later obtain permission to stay and work, under one of dozens of categories. The main categories of temporary work visas are agricultural and seasonal workers, specialty occupation (H-1B) workers, and exchange program workers. Each category has different requirements, which might include approval from the Department of Labor and U.S. Citizenship and Immigration Services (USCIS). Most temporary visa workers must also obtain a visa from the U.S. State Department at a consulate overseas.
Further details on the number and categories of workers are found in Tables 1 and 3. Visa workers have permission for entry and employment that is inherent to their visa status; they do not need a separate work permit.

In contrast, work permits are for non-citizens who are already in the United States, either without status or in a status that does not directly authorize employment. Examples of work permit grantees without legal status are asylum seekers, crime victims, and deferred action grantees (including DACA). Examples of work permit holders who entered on a non-work visa include students (in Optional Practical Training) and dependents of diplomatic or work visa holders. Work permits are adjudicated by USCIS. In some categories, work permits are essentially granted automatically pursuant to statutory authority from Congress; in others, USCIS has discretion to issue the work permits; others were created without congressional authority. This report recommends executive action to reduce issuances in the discretionary and extra-legal categories.
Table 2 shows the recent figures for selected categories of work permit issuances. These represent more than 90 percent of all work permit issuances.
Although most of the temporary work programs were created by Congress, the president has some discretion to determine or affect how many work visas and permits are granted each year. Unfortunately, for many years some of these programs and categories have operated as if on autopilot, with little oversight or management, and with little to no review of their economic or labor market effects. This has provided an opportunity for employers and labor brokers to find ways to maximize the number of workers they can import from abroad. The lack of oversight of work permits also has enabled presidents to create new de facto legalization or work authorization programs, as in the case of DACA, OPT, and the H-4 EADs.³
Recommendations for Immediate Action

The grave employment situation created by the pandemic shutdown requires bold, sustained action from the president. The actions we propose below should be maintained until the country returns to full employment and full labor force participation for American workers. This will ensure that the employers who have become dependent on these programs, or who have chosen a business model that depends on these programs, are able to adapt. The goal is to break the practices of replacing U.S. workers with visa workers, refusing to hire U.S. workers, or suppressing wages in certain business sectors through importation of cheaper workers.
We propose 20 specific short-term actions to preserve job opportunities for U.S. workers and to prevent U.S. employers from bypassing U.S. workers in the recovery:

Rescind approval of all labor certifications for pending employment-based immigrant visas and green card/adjustments of status, and require applicants to submit new certification requests for re-adjudication under current labor market conditions.
Rescind approval of all labor condition attestations (LCAs) for pending employment-based non-immigrant visa applications and require applicants to submit new attestations for re-adjudication under current labor market conditions.
Suspend adjudication of all Optional Practical Training work permit applications until the economy has recovered (as defined by pre-determined metrics). In the meantime, new regulations and guidance must be promulgated. New rules should include shorter training programs, oversight of training curriculum/plan, a requirement to show that the training is not available in a student's home country, improved monitoring of student and sponsor compliance, and a requirement that employers must pay $5,000 in advance to the Social Security and other payroll tax trust funds for the first year of OPT employment, or $10,000 for the STEM extension employers.⁴
Reduce the duration of stay for B-1 short-term business visas to 21 days, unless a visa holder shows a business need requiring a longer stay.
Deny LCAs/petitions from employers seeking H-1B visa workers at the two lowest wage levels allowed (Level 1 and Level 2 prevailing wages). These are applications on behalf of workers who would be paid less than the median prevailing wage for the occupation and region.
Suspend approval of all petitions/applications for part-time, seasonal, or peak-load workers. Currently these are allowed in the skilled and unskilled work visa categories.
Curtail temporary visa renewals and limit extensions to one year.
Require all employers petitioning for workers after the suspension to maintain a one-to-one match of new U.S. hires for each visa worker hire.
Suspend adjudication of work permits to H-4 visa holders (dependents of temporary work visa holders) until recovery.
Suspend adjudication of H-3 (trainee) visas until recovery.
Curtail adjudication of employment-related exchange (J) visas in the following categories: au pair, camp counselor, intern, trainee, professor, research scholar, summer work/travel, and teacher. (See Table 3 for the number of participants in exchange worker programs), until recovery.
Curtail adjudication of intracompany transferee (L) visas and petitions until recovery. Create a waiver for employers showing extraordinary need to move the employee to the United States. No waivers for blanket petitions; all applications should be considered individually.
Suspend adjudication of new E-2 (nonimmigrant investor) visas until the economy has recovered.
Suspend adjudication of O ("extraordinary ability"), P (athletes and entertainers), and Q (cultural exchange workers) non-immigrant visas until recovery. Create waivers for extraordinary circumstances.
Suspend adjudication of EB-5 (investor) immigrant visas and adjustment applications.
Suspend adjudication of all initial "discretionary" EAD (work permit) applications for aliens whose authorization would not be incident to their status, until recovery. Adopt a new requirement for all discretionary EAD renewals based on extraordinary circumstances, extreme hardship, or public interest (such as DACA, abused spouses, etc).
Implement a public outreach campaign for U.S. workers who have been furloughed by employers who keep visa workers on the job and similar incidents of apparent preference/discrimination in favor of visa workers.
Refuse to certify or approve replacement temporary workers or work permit holders for any corporate entity that has shut down facilities or substantially curtailed operations because of the pandemic.
Direct DHS (both FDNS and HSI working hand-in-hand), as well as the Labor and State Departments to institute vigorous pre- and post-audits of 25 percent of the certifications and LCAs submitted by employers seeking foreign laborers across all industries, with at least two purposes in mind: 1) Are the jobs really temporary in nature? And 2) Are there now enough citizen/LPR workers available to fill the jobs? Further direct DOJ to vigorously prosecute cases presented to them by DHS/DOL/DOS where fraud is present.
Prohibit the distribution of relief funds to employers with a "U.S. person" (meaning U.S. citizens and permanent residents) workforce of less than 50 percent. Prohibit approval of new visas or work permits for employees of companies or businesses that have received Covid-19 relief packages of any kind. Full repayment of such packages would allow the employer to start employing workers receiving new and renewed visas and EADs. This provision would relate to new and extended visas and EADs; there would be no requirement to discharge those aliens who are currently on the payroll with valid documentation during the life of those visas and EADs.

Recommendations for Regulatory Reform

The actions spelled out in this report will create both long-term and temporary job opportunities for hundreds of thousands of unemployed or displaced U.S. workers. However, some cannot be justified beyond the duration of the immediate public health emergency, no matter how helpful to the labor market. U.S. workers need more durable protections that will last beyond the scope of a presidential proclamation, in the form of regulations issued though the conventional administrative rule-making process.
Several transformative regulations already have been drafted, but have been de-prioritized and are stuck in the rule-making pipeline. We recommend the following for priority action:

Rescind a rule implemented under the Obama administration providing for the issuance of work permits to certain dependents of temporary work visa holders. There is no statutory basis for these work permits, and the program has been challenged in a lawsuit.⁵ The replacement regulation has been sitting in limbo in the White House for more than a year. Meanwhile, in 2019, more than 45,000 work permits were approved, representing lost job opportunities for U.S. workers.
Reform the H-1B program, in which more than 180,000 new workers arrived in 2019, joining an estimated 500,000 settled H-1B workers. The workers are approved for white collar, or "knowledge" jobs, most frequently in information technology, but also accounting, nursing, back office administrative work, physical therapy, and more. Employers do not have to show that there is a shortage of workers. Many of the visas are issued to foreign-owned staffing companies who place the foreign workers at U.S. companies to replace existing workers. There is strong evidence that employers are underpaying skilled workers and bringing in relatively modestly skilled workers at comparatively low wages.⁶
Reform to the L visa program, which was designed by Congress for multinational companies to transfer managers and executives for temporary assignments in the United States, but which has been used in recent years as a substitute for the more regulated and numerically limited H-1B program.
Scale back a provision of the Optional Practical Training (OPT) regulation providing for the issuance of work permits to foreign students and graduates. The proposed regulation would rescind an extension of time for foreign STEM graduates implemented by the Obama administration, and would permit such graduates to stay an extra 18 months rather than an extra three years. In addition, it imposes an annual cap on OPT work permits and adds wage and recruitment protections for the foreign workers. With more than 223,000 work permits issued in 2019, the OPT program was the second largest temporary work program, and it has never been approved by Congress. Employers hiring OPT workers are exempt from paying payroll taxes, which adds to their appeal.⁷ This regulation should correct that loophole, which costs the public approximately $2 billion annually in lost employer contributions to the Medicare, Social Security, and unemployment insurance trust funds.
Impose stricter controls on nine employment exchange visitor (J-1) programs (physician, au pair, camp counselor, intern, trainee, research scholar, summer work/travel, teacher, and professor), such as numerical caps and wage and recruitment protections. Table 3 shows the number of participants in each of the J programs in 2018.
Revise the H-2B seasonal employment program to improve oversight of recruitment, wages, and working conditions. In addition, employers should be prohibited from hiring H-2Bs to do the same work that they are employing J-1 summer work/travel exchange participants to do, and vice versa.
Change the short-term business visitor visa category (B) to regulate the types of work that are permissible. Generally, aliens entering with a B temporary visa are permitted to do work for an overseas employer if they are paid overseas. However, since business visitors are routinely permitted to stay up to six months and apply for a six-month extension, there is abuse of this category; for example, by staffing companies avoiding the restrictions of the H-1B or H-2B category or by Mexican truck drivers, who may obtain the visas to evade restrictions on their U.S. employment. Because most legitimate business visitors stay for less than a month, arriving business visitors routinely should be given a very limited duration of stay unless they provide ample documentation of the need to stay longer.

Finally, the president should pursue legislative reforms. These should take the form of narrow, targeted bills that can attract bipartisan support to address the most obvious problems in these programs, like prohibiting the replacement of U.S. workers with visa workers, reining in executive authority to issue work permits, and ending the EB-5 program and the diversity visa lottery. Eventually a major overhaul of our legal immigration system is needed that would adopt a merit-based selection system for employment immigrants, give greater priority to the most qualified applicants, eliminate extended family categories, and restore annual admissions to a more moderate level that reflects the national interest and supports a modern economy.

Some Central American migrants are marrying Mexicans to regularize their immigration status in Mexico, according to Gladys Canas. president of a migrant aid organization in Matamoros (the Mexican city opposite Brownsville, Texas) called Helping Them Succeed.

According to Canas, migrants from El Salvador, Honduras, and Guatemala waiting in Mexico for their U.S. asylum hearings began marrying Mexican citizens to acquire residency in Mexico. Not wanting to return home after their asylum claims are almost certainly rejected, some migrants initiated the steps to marry before their asylum claims in the U.S. were fully processed.

"So far in February, we have had 50 couples asking for reports on the requirements for marriage," Canas said.

Enrique Maciel Cervantes, an official with Mexico's National Migration Institute, said the wait time for a foreign national to obtain residency after they marry a Mexican citizen is short. "In two months a migrant is given their permanent residence in Mexico, and in a span of five years they can be a naturalized Mexican citizen."

As we have mentioned before, the DHS agency regulating schools for foreign students does not require that such schools be credentialed by an entity recognized by the U.S. Department of Education.

That's a jaw-dropping statement, but is par for the course with the Student and Exchange Visitor Program (SEVP), perhaps the most lax of the immigration enforcement agencies despite its being run by Immigration and Customs Enforcement (ICE).
So if a marginal school opens its doors and wangles a state or territorial license of some kind, it can start causing the issuance of F-1 visas for any number of foreign students, but there is one mild SEVP requirement: Without accreditation it must have letters from three other educational institutions saying that they accept the credits earned by its students.

A wannabe school for foreign students, the Virginia University of Science and Technology (VUST), in the Virginia suburbs of Washington, D.C., finds itself not only struggling to keep a state license to operate (more on that later), but has been unable so far to secure more than two such letters. (A CIS intern called VUST a few months ago about their ability to accept foreign students and was told "call us back in a couple of months, maybe we will have our third letter by then.")

The apparent lack of that needed third letter is despite the fact that VUST's fairly new president, Hasan Karaburk, has worked as executive or a teacher at the following institutions:

Virginia International University
Iglobal University
Tyson's College
Tyson's Institute
Stratford University
BAU International University
University of the District of Columbia
National Louis University
Moscow State University

The first five (all obscure) of these entities are in northern Virginia, the sixth and the seventh are in D.C., and the eighth is in Elgin, Ill. Moscow State is in Russia.

Setting aside Moscow State (which I think I would have dropped from my resume were I in his shoes), that's eight institutions that could have said "sure, we accept VUST transfer students."

But at least six of them have not made that statement. In addition, he might have called upon Northeastern University in Boston and the University of Virginia, both of which gave him graduate degrees, to make a similar statement. So despite the president's ties to ten schools (not counting Moscow State), he has still not been able to come up with the third transfer letter. And so VUST cannot accept foreign students.

As to Karaburk's degree from Northeastern, it is a PhD on his LinkedIn page, but it is listed as an EdD on the VUST website. Odd.

The State Council of Higher Education for Virginia (SCHEV), which has VUST on track to revoke its license, has given the institution until the end of December 2020 to secure candidate status with the Accrediting Commission of Career Schools and Colleges, otherwise SCHEV will resume the revocation process. VUST agreed to a consent decree with this provision on November 22, 2019.

In the first three years of its existence VUST failed to secure candidate status with any accrediting agency.
I tried many times over the past two weeks to talk with someone at VUST to confirm the fact that they do not take foreign students, but VUST does not answer the phone; a message indicates that they will call back, but I did not use it. Earlier, around the holidays, a male who spoke unintelligible English answered the phone angrily, but did not answer the question, or if he tried to do so, I could not understand it.

It is not clear whether VUST operates as an ally of the Islamic Gulen cult, whose role in education we have documented in the past, but Karaburk certainly has strong Gulen ties; he secured his first U.S. degree from Virginia International University, then a Gulen-controlled institution, and worked there for years, as well as working for another Gulen-related entity. A few years ago, he sought to establish a Gulen-linked charter school in Loudoun County, Va., but was turned down by local authorities.

Meanwhile, VUST remains off the government's long list of institutions that may admit foreign students; the list is maintained by SEVP.

Other marginal colleges, however, do remain on the SEVP list, as we will report in a forthcoming post.

Is There 100 Miles of New Border Wall, or Not?

It doesn't make much difference — keep building

Acting Secretary of Homeland Security Chad Wolf spoke at an event in Yuma, Ariz., last Friday to commemorate the completion of 100 miles of a new system of border walls along the southwest border. Is all of that wall actually "new"? Well, yes and no, but it doesn't really make a lot of difference, because it is a necessary improvement.

As for the confusion, here is an excerpt from CNN:

Yet of the 100 miles, few are areas where there was previously no wall. In Yuma, Arizona, where Wolf's news conference took place, run-down barriers were replaced with an enhanced system.

"One thing I want to emphasize is that every inch of the 100 miles that we have constructed is new border wall system," he added. "It's not so-called replacement wall, as some of our critics claimed. It is new wall."

Those two paragraphs float in the middle of the article, without any explanation or clarification as to the apparent discrepancy. ABC News casts a bit more light:

Customs and Border Protection [CBP] has referred to the new wall system as "replacements," but Wolf insisted on Friday that all 100 miles should be considered "new wall systems" because access roads, surveillance and lighting were also built along with the barriers.

That is a fairly significant improvement, for anyone who has traveled to the southwest border to take a look at the various barriers that have previously been erected between the United States and Mexico (as I have). In my February 4, 2019, post "Know Your Fences", I went into detail, with photographs, of the various barriers along the border in the Yuma Border Patrol Sector, where Wolf spoke.

It is clear from those photographs that there were portions of the border wall that were downright decrepit. This is not to suggest that the barriers should be spotless, but many were "walls" in name only, likely to deter the most casual illicit cross-border traffic, but not enough to stop the drug cartels that do their business in the area.

Replacing 90 miles of those old barriers (which CNN reports CBP had done by December 6), is an achievement in and of itself. Surplus Vietnam-era landing-mat fencing is better than nothing, but it is not as good as 30-foot-tall steel bollard walls.
As I have previously testified, border barriers do not stop illegal entry of drugs, migrants, and other contraband per se. Rather, they serve as impediments to slow that traffic long enough for the Border Patrol to respond to incursions. Lights serve as a deterrent where they are used and also allow Border Patrol agents to locate crossers in the dark. Surveillance equipment allows Border Patrol to identify where incursions are happening. Access roads enable agents to quickly respond.

Perhaps the El Paso County officials who recently sued the administration (unsuccessfully) in an attempt to block wall construction should talk to Yuma Mayor Douglas Nicholls, who was quoted in the Department of Homeland Security (DHS) press release on the January 10 event:

"The wall is a critical component in border security measures for Yuma's border region for the safety of our community, for proficient border crossing operations, and for economic stability. ... An efficiently operated, safe southern border region is pivotal to the economy as a whole, inclusive of Yuma's $3 billion agriculture industry. We experienced a dramatic reduction in incursions when the 2006 wall was constructed, which decreased illegal crossings by 95%. Fourteen years later with changes in immigration patterns, we need to keep safety and efficiency a mainstay."

All politics is local, but local politics is really local, as Mayor Nicholls' statements reflect. El Paso likely has some advantages over Yuma as it relates to the costs of illegal cross-border activity (as I have previously explained), but the flood of migrants through the Yuma sector in May 2019 put a huge burden on the town, forcing Mayor Nicholls to declare a state of emergency.

Wolf asserted that he was confident that DHS could complete, or begin construction on, 400 to 450 miles of fencing by the end of 2020, which would require the department to triple its efforts thus far. Given the lawsuits and pushback from Congress that the administration has had to fight just to get to this point, this is an ambitious agenda, but a worthwhile one. As he explained:

The new border wall system is an undeniable impediment to human smugglers, drug traffickers, and other criminals who have exploited our lack of effective border infrastructure to smuggle drugs, people and illegal contraband into our country.

Given the stakes, DHS should celebrate its milestone, and keep building.

EB-5 Bill Would Override Pending Regulations

Tens of thousands could be paroled in, effectively erasing the annual cap

A disastrous bill on the EB-5 (immigrant investor) program, covered with attractive cake frosting, looms just off the floor of the U.S. Senate.

It would simultaneously parole in some 73,000 aliens on either the EB-5 waiting list or with un-acted-upon petitions, most immediately and some over the next three years, thus blowing away the long-established 10,000 yearly limit on this program.
And it would restore the gerrymandering provisions regarding where the EB-5 investments can be located. These arrangements, which place most of the EB-5 funding on or near the nation's Park Avenues, are now in danger from a good set of new regulations, put together by both the Obama and the Trump administrations.

Were the Rounds bill to pass, it would override many of these useful regulations, which are scheduled to go into effect on November 21.

As governor of South Dakota, current U.S. Sen. Mike Rounds (R) watched as one of the state government's own agencies allowed a multi-phased, large-scale EB-5 scandal that included the grisly death of one of Rounds's former cabinet officers, a major EB-5 player named Richard Benda. He's the one who, according the redacted autopsy report accepted by the GOP state attorney general at the time, Marty Jackley, used a long stick to push the trigger of the shotgun aimed at his stomach.

The EB-5 scandals in South Dakota also included a wide variety of scams, such as the excessive over-payment of loans, a sharpster deep in the state government, loan sharks in Hong Kong, Russian railway tycoons playing through Cypriot and off-shore banks in the Caribbean, an over-built slaughterhouse in one town, and an overly expensive country music site in another, as we reported six years ago.

Back to the present. We got a copy of the not-yet introduced bill from a non-D.C. source. It will be, once introduced, sponsored by Sens. Rounds; John Cornyn (R-Texas), long a supporter of EB-5 just as it is; and Lindsey Graham (R-S.C.), the new chairman of the Senate Judiciary Committee, where the bill is headed.

The first 60 or so pages of this 87-page bill are filled with attractive material. The investors are to put up $1 million as investments, up from $900,000 that the regulations currently set to go into effect on November 21 demand, and there is to be a new fee of $50,000 laid on the alien investors to fund an EB-5 integrity program, which is described in some detail.
Then, on p. 67, we learn that in addition to the precisely defined targeted employment areas (TEAs) of the regulations set to take effect this month — which is where the moneys are to be invested — middlemen will be allowed to place the investments in "qualified opportunity zones" created under another federal law, which are subject to easy manipulation by the middlemen and their allies in state government.

The current TEA arrangements are so loose in their definitions of low-income areas that an EB-5-funded building was built on Wall Street on the grounds that it was in a depressed area. That TEA included the site of the structure, a lot of the East River, and then a thin stretch of Brooklyn until the TEA reached a depressed housing project miles from Wall Street, thus including an area with enough unemployment to justify the use of EB-5 funds for the new building.

Then on p. 84 of the proposed bill comes the bombshell. It would give the secretary of Homeland Security the power to "parole in" all of the alien investors who either have had an application pending for three years (the program is seriously backlogged) or have an approved petition three years old that has not yet created a visa because of the long-established country-of-origin provisions of the immigration law.

Were that to come to pass, the secretary, over a period of three years, could parole in (and give work permits to) some 73,000 investors and their family members, all in addition to the usual 10,000 a year flow of such immigrants. Most of those in line for these visas are from China, and some are facing a 16-year wait for their purchased tickets of entry.

Critics of the Rounds legislation worry that if the backlog of largely Chinese investors were to be admitted despite the numerical ceilings, other migration backlogs would be treated similarly by Congress, resulting in massive additional flows of legal immigrants, taking admissions well above the million-a-year level allowed under current law.

One Capitol Hill source said that the supporters of the Rounds-Cornyn-Graham bill were hoping to tie it to one of those "must-pass" spending bills, and thus to make it part of the law without hearings or floor votes. It is not clear if that is a realistic prospect or not, but that mechanism has been used for years to perpetuate the main part of the EB-5 program, which is essentially a temporary program needing re-authorization from time to time.

Back in 2014 Overpass for America was out there protesting the Communist Obama Central American invasion which at the time I thought was the end of the world. I was out protesting with this group or by myself just about every weekend that summer. The TRUMP Central American invasion is a MULTIPLE of the Communist Obama invasion. It's going to be 5-6 TIMES larger with NO END in sight. I'll never ever get back on Communist Facebook again but I get the impression Overpass is doing nothing about what's going on. Going out to an overpass with a bunch of American flags is a waste of time.

Yemenis Smuggled over Texas Border Wearing Hard-Hats and Reflective Vests

Three media narratives have surfaced since President Donald Trump became the first U.S. president to say out loud this past October that migrants and terror suspects from Muslim-majority nations are routinely smuggled to the American southern border through porous Latin America. The variations go something like this:

Such migration from Muslim-majority countries is an unproven myth and fear-mongering circulated with stories of prayer-rug discoveries to charge support for Trump's anti-immigrant policies.
Even if some Middle Easterners and the like are smuggled to the border from those countries, they're no threat worth worrying about.
No actual terror suspects have ever reached the southern border this way.

All three of those narratives have been exposed as materially false here, here, here, here, and here -- long before the president began commenting about this little-known migration threat issue.

Count this post as another in a long series demonstrating that migration from Muslim-majority countries of the Middle East, South Asia, and the Horn of Africa actually happens and is steady as she goes. We know this not only because of trace evidence such as prayer rugs, but rather through prosecution records showing that ICE Homeland Security Investigations (ICE-HSI) targets the smugglers of such migrants. As I have often written, ICE-HSI occupies the tip of the spear for this particular counter-terrorism effort, targeting the still-intact smuggling bridges that provide the means by which Islamist radicals have reached the border and have gained access to our nation's catch-and-release asylum system. And can and will again.

One of these cases is currently making its way through the federal district court in Del Rio, Texas.

The eight-count alien-smuggling indictment and complaint filed in United States of America v. Moayad Heider Mohammad Aldairi, a Jordanian with dual citizenship in Mexico and a home base in Monterrey, allege that he illegally transported at least seven Yemenis over the southern border in 2017 — near the same Piedras Negras (Mexico)-Eagle Pass (Texas) border-crossing that members of the last Central American migrant caravan were hoping to reach before Mexico detained them. The government alleges the Yemenis paid the defendant thousands of dollars each, paid "in Mexico, Jordan, and elsewhere" to get them into Texas through Latin America and that, once he got them into the Eagle Pass area, he gave some of his clients construction hard hats and reflective vests so they would "blend in better" after emerging from the Rio Grande on the American side.
American authorities arrested Aldairi abroad last year and extradited him to New York and then to the Western District of Texas, where he remains in custody pending the outcome of his case.

The latest word, according to court filings, is that he was planning to plead guilty on February 27, but then changed his mind. According to a filing by his San Antonio defense attorney, Ronald P. Guyer, the defendant wants to take this to a full trial in Texas. The reasons are not reflected in the court filings, and Guyer did not return several phone calls from CIS seeking comment.

Jury selection and trial were reset for March 19 in a Del Rio, Texas, courtroom, about an hour's drive from where the Yemenis crossed.

As an indicator of the sensitive national security aspects of this case, most of the filings — arrest warrants for at least a half-dozen witnesses bearing names such as Mohammed Al Huthaifi and Rasheed Samer Al-Dumani — remain sealed. The document sealings indicate a very active ongoing international investigation. Indeed, the government alleges that Aldairi used a number of co-conspirators in his alien-smuggling business.

But also because of the sealings, there's no public indication of whether one or more of the smuggled Yemenis might have been connected to terrorism in Yemen. Some of them did identify Aldairi in a photo line-up as their smuggler. Still, questions of terrorism connections are not implausible thoughts to have these days. An ongoing civil war in the country features al-Qaeda in the Arabian Peninsula (AQAP) and ISIS's Yemen branch. AQAP has held significant territory in Yemen and, in 2016, the group gained unprecedented resources by raiding the central bank and levying taxes.

Whatever else emerges from the Texas proceedings, one thing is not in dispute: Smuggling bridges make it possible for AQAP and ISIS operatives to reach our southern border from troubled lands like Yemen, whether they use them or not. This case demonstrates a homeland security risk that ICE and DHS professionals clearly are trying to manage with investigations and prosecutions.

Given a choice between believing a media punditry class claiming that this migration presents no threat at all or professional homeland security practitioners who think about this kind of migration all day long, every single day, for years — I'm going with the latter every time.

The History of the Flores Settlement

In April 2018, the Trump administration implemented new guidelines as part of its "zero tolerance" policy toward illegal entry, in response to the rising number of illegal aliens showing up with their children at the southern border. Under these guidelines, the Justice Department prosecuted every border infiltrator for the crime of entry without inspection.

After detaining the parents, the government could either put the children in a shelter (due to legal prohibitions on keeping children in detention for over 20 days), or release the entire family into the interior of the country — "catch-and-release" — and hope that they don't simply disappear into the illegal immigrant population. The first of these two options has been decried by critics as one of "family separation".

To understand how this conundrum arose, one must learn the history of the Flores settlement agreement.

Digging into its history bolsters the theory that the Clinton administration was well aware of what it was doing when it signed the agreement, and may have shared more in common with the activist plaintiffs than originally thought with regard to loosening the rules governing asylum.

A full understanding of this agreement requires understanding its history.

Beginning in 1985, the activist groups began a series of lawsuits against the federal government over its perceived mistreatment of alien minors in detention facilities (notably a 15-year-old Salvadoran girl named Jenny Flores), culminating in a consent decree, the Flores settlement, more than a decade later.
This 1997 settlement led to the government agreeing to set immigration detention standards for unaccompanied alien children (UACs), particularly regarding facility conditions and the timing and terms of the UACs' release.

When the government entered into the Flores settlement agreement, its stated intention was to finally resolve years of litigation against the INS, but this is only partially true. Recent comments and actions by Clinton administration officials indicate that they were at least partially motivated by a desire to cooperate with the activist plaintiffs to loosen asylum rules.

Since 1997, Flores has been significantly expanded upon by federal judges with loose border proclivities, and is now interpreted to mean that all minors in detention — accompanied by their parents or not — cannot be held for more than 20 days.

Partially driven by Flores, the number of apprehended aliens who claim credible fear (the first step in applying for asylum) has soared — up 67 percent in FY 18 vs. FY 17, and up over 10-fold from a decade ago. Moreover, only 3.5 percent of UACs are ever removed, according to DHS.

Congress could pass a law superseding Flores, but has yet to do so.

The Path to Flores: 1985-1997

Flores Settlement Timeline
The immigration laws and regulations of the United States were administered by the Immigration and Naturalization Service (INS) before Congress passed the Homeland Security Act of 2002 and President George W. Bush transferred that agency's responsibilities to what are now three agencies — U.S. Citizenship and Immigration Services (USCIS), U.S. Immigration and Customs Enforcement (ICE), and U.S. Customs and Border Protection (CBP), each located in the Department of Homeland Security.

It was during the time that INS had jurisdiction over immigration that Carlos Holguin, an immigration lawyer in Los Angeles, received a call from a Hollywood actor about that actor's housekeeper, an illegal Salvadoran immigrant.1 Her daughter, Jenny Flores, was being detained by INS. Jenny's mother didn't want to pick her up, as she feared bringing herself before INS would result in her deportation. INS would not release Flores to her cousins — they said that only legal guardians, for the sake of the child's safety, could pick her up. Jenny Flores later alleged that the conditions of her detention were substandard.

Eventually, this led to a 1985 class-action lawsuit on behalf of illegal immigrant children headed by several activist groups: The Center for Human Rights and Constitutional Law, to which Holguin belongs; the National Center for Youth Law; the ACLU; and the law offices of Streich Lang, which has since merged to become Quarles & Brady LLC.2

The lawsuit sought to establish standards for how INS handles detained minors, and specifically expressed concerns that Jenny Flores was strip-searched, that she shared living quarters and bathrooms with male adults, and that she couldn't be released to non-guardian relatives.

In 1988, Judge Robert Kelleher of the U.S. District Court for the Central District of California, who had been appointed by President Nixon, delivered a win to these groups. He ruled that the INS policy of strip-searching children was unconstitutional because the "defendants have failed to establish a plausible, much less compelling, need to routinely strip search detained juveniles." He also removed the restrictions that INS had in place regarding to which adults the detained minors could be released.3

However, in 1990, a three-judge panel of the Ninth Circuit Court of Appeals reversed Kelleher's decision, and instead sided with the government. Judge John Clifford Wallace and Judge Lloyd D. George (both appointed by Republican presidents) wrote in their majority opinion that "it is clear that Flores' substantive due process challenge to the regulation must be rejected. To the extent the district court based its ruling on this prong of due process law, it must be reversed."4

This victory for the INS was short-lived. One year later, the Ninth Circuit en banc (a full 11-judge court) reversed its prior ruling, and in a 7-4 decision affirmed Judge Kelleher's 1988 ruling.

On October 13, 1992, the Supreme Court began to hear oral arguments in the case. A year later, the Supreme Court delivered a significant win to the government, voting 7-2 in favor of reversing the lower court's decision. Justices Scalia, Rehnquist, White, O'Connor, Kennedy, Souter, and Thomas all held that there was no constitutional right for unaccompanied alien children to be released to someone other than a close relative, and further held that these minors could be kept in detention centers if they lacked a close relative or guardian in the United States to take them in.5 Scalia wrote: "Where the Government does not intend to punish the child, and where the conditions of Governmental custody are decent and humane, such custody surely does not violate the Constitution."

And yet, even after this sweeping victory, the lawsuits and pressure from activist groups did not abate. For example, a 1997 book penned by Human Rights Watch titled Slipping Through the Cracks alleged that the INS was still not complying with the terms of the Supreme Court's decision in Reno v. Flores. Following interviews with INS officials and tours of facilities, the authors argued that INS agents' attitudes ranged from being apathetic to harboring "ill will" toward detained UACs, and that the conditions of UAC detention were still poor.6

That year, in what was seen as an attempt to end the ongoing criticism and litigation by the government, INS Commissioner Doris Meissner signed the Flores settlement agreement. The agreement included several major concessions from the government:

The government would release children "without unnecessary delay" to (in order of preference) the children's parents, legal guardians, other adult relatives, or another individual designated by the parents/guardians.
The government would put children in the "least restrictive" setting appropriate.
The government would create and implement standards for the care and treatment of immigrant children in detention.7
That settlement laid the groundwork for the current asylum crisis at the border and extends well beyond its initial mandate.

Why Did the Government Sign Flores?

Why, just a few years after a sweeping Supreme Court victory, did the Clinton administration agree to the Flores settlement? The stated reason was that the government was looking to finally put an end to over a decade of litigation that began in 1985, and certainly there may be some truth to that. The settlement, however, seemed like a major concession by the winning side, and certainly one that could (and later did) crack the door open further for open-borders groups to exploit asylum laws for minors.

A 2018 NPR interview with former INS Commissioner Doris Meissner provides insight into that action. When asked by NPR's "All Things Considered" host Michel Martin about the Trump administration's "zero tolerance" policy, Meissner had the following response:

Well, so here is the situation. What — the reference that they're making is to a court settlement called the Flores decision, which took place in 1997. I'm very familiar with it because I signed it. And it was a settlement of a long-standing piece of litigation that said that children would be detained in the least restrictive setting possible and for the shortest period of time in order to be placed with either a family member or another care situation.

That law — that — and that's not a law. It's a court settlement, but it has the force of law. And it has been expanded by another court judgment just a few years ago to apply both to children and to families with children. So it is valid to say that it has the force of law. It is not actually a law. It would have — to change it would require legislation, which is what the Congress is talking about.

However, it is a judgment on the part of the administration how to implement that court decision. And this implementation of the court decision that says children need to be separated from their parents because their parent is being prosecuted — that has never happened before in the past from the time that this settlement took place through other administrations — both Democratic and Republican administrations.

Everybody has recognized that this issue is a balancing act — that we, of course, have a responsibility to enforce the laws at the border. But to those who are especially vulnerable — young people and families — there are other measures that can be taken that, of course, enforce the law but are not so excessively harsh as to violate a principle so fundamental as young children being in detention for long periods of time. [Emphasis added.]8

Meissner appears to be making a new admission here: Her decision to sign Flores was guided by humanitarian considerations for the children, rather than simply a concern about the risks of further litigation. There's nothing inherently wrong with that, of course, but it is curious that the 1997 defendant — the INS — didn't appear to think of detention reform much differently than did the activist plaintiffs. And, if the then-INS believed that these changes were necessary, it could have simply made them itself, without binding future administrations to its policies.

This view is reinforced by other INS actions under the Clinton administration during that same time period. Most notable is the decision of INS General Counsel Paul Virtue a year later, in 1998, to implement "parole in place", allowing the INS to grant parole to any alien applying for admission for humanitarian or "public benefit" purposes that further helped facilitate the vision of groups like the ACLU that were seeking significantly looser asylum policies.9

Certainly, President Clinton, Meissner, and Virtue (among others who supported the agreement at the time) could not have predicted the ways in which Flores would be even further contorted in the years to come. Nonetheless, Occam's razor states that the simplest answer tends to be the correct one. The simplest explanation for the actions of the Clinton administration around the signing of Flores in 1997 is that it held the same views on asylum laws that the activist groups did — namely, that they ought to be looser.

Developments Since Settlement, 1997-2019

In 2003, as part of a major government re-organization following the 9/11 terrorist attacks, Congress abolished the INS, and transferred its responsibilities to several entities within the Department of Homeland Security. The responsibility for transferring alien minors to their parents, however, was shifted to the Department of Health and Human Services, with the Office of Refugee Resettlement handling both care and custody of unaccompanied children.

Meanwhile, activists continued to allege that the terms of Flores were not being fully met by DHS/HHS. In 2008, Congress passed the Trafficking Victims Protection Reauthorization Act (TVPRA), which codified parts of Flores into federal law in what are called "savings clauses", preserving certain rights for alien children.

The next major change to Flores, and almost certainly the most significant, came in 2015. An Obama-appointed federal district court judge in California, Dolly Gee, ordered that the Obama administration must release detained children and their mothers who were caught crossing the border illegally, saying that detention centers in Texas had failed to meet the Flores standards.

This was a major development — Gee had now expanded Flores to cover not only unaccompanied children, but also accompanied children.10

In fact, Judge Gee even went a step further. Flores calls on the government to release children "without unnecessary delay". Gee interpreted that to mean 20 days. In other words, now all minors in detention, whether or not they were with their parents, couldn't be detained for more than three weeks. This ruling laid the groundwork for the current crisis at the border, in which children are released while their parents can still be detained awaiting hearings — hence, the "separation" of families. The alternative is simply releasing the entire family after three weeks or less. In other words, "catch-and-release".

The next year, in 2016, Ninth Circuit Judge Andrew Hurwitz, joined by judges Michael Melloy and Ronald Gould, reaffirmed that Flores applies to all children, regardless of whether they're accompanied — although they did reverse the notion that parents have an affirmative right of release.11

In the past few years, the number of aliens who have sought to initiate the asylum process by claiming "credible fear" of persecution during expedited removal — either at ports of entry or between them — has soared, in large part owing to the Flores settlement agreement and to Judge Gee. Aliens have clearly gotten the message that if they ask to be put into asylum proceedings, their children — and often if not usually the adults, too — will be released into the country shortly after they are apprehended as they await their removal proceedings. In fact, in FY 2018 alone, the number of aliens apprehended by Border Patrol claiming credible fear was 10-fold higher than a decade before, and 67 percent above the FY 2017 figure, reaching a staggering 92,959 claims. (See Figure 1.)

Aliens respond to incentives, and Flores remains a strong one. After all, if a Central American mother knows that bringing her child means that she can simply show up at a port of entry, claim credible fear, and then quickly be released from detention into the country regardless of the actual validity of her asylum claim, why wouldn't she do so?

There have been discussions in Congress about passing a law that would supersede Flores and finally settle the issue. Several Republicans, mostly notably Ted Cruz (R-Texas), called on Congress to fix Flores in order to resolve the related issue of child-parent separations and catch-and-release. As of early 2019, however, such a fix has yet to pass Congress, and doesn't look likely to any time soon.

USCIS Takes Tiny Steps Against Exploitative Child Marriages

The government has just whispered that it may have some worries about underage U.S. citizens in visa-creating marriages with older aliens, with most of the latter living overseas.

The problem, as USCIS does not explain, is that some immigrant families in the States force young, U.S.-born minors (usually female) to marry older aliens from, for example, the family's village overseas, giving that alien a green card and denying the young woman the right to fall in love and marry someone of her own choosing.

It is the ultimate denial of a citizen's rights, and it is designed to provide benefits to older, male non-citizens, typically people who have never lived here. To speak about the situation in these terms is to break the veil of silence regarding these old world customs, and the agency seems hesitant to say anything that might invite criticism from the "community", from the "community's" immigration lawyers, or from open-borders advocates generally. Most of these marriages are among Muslims, a fact not noted by the government.

Such marriages are not covered by numerical ceilings, so an unlimited number of such admissions can be secured by marrying off these young (citizen) women.

USCIS, commendably, is taking a few long-overdue steps in the right direction, but it is muting its message in somnolent verbiage; its announcement begins:

Guidance Clarifies Agency Requirements for Petition

Washington — U.S. Citizenship and Immigration Services (USCIS) announced today that it is publishing guidance for its officers to consider when adjudicating spousal petitions involving minors.

The guidance, published as an update to the USCIS Adjudicator's Field Manual (AFM), clarifies age requirements for a petitioner filing an Affidavit of Support for a spouse in conjunction with a concurrently filed I-485, and identifies factors officers should consider when adjudicating a Form I-130 spousal petition involving a minor.

Are you still awake? Think how sleepy these words would be should they be translated into, say, bureaucratic Arabic, or Farsi officialese.

Perhaps the agency should have declared:

We are concerned about teenage U.S. citizens, usually young women, in immigrant families, being pushed into marriages with aliens, sometimes twice their age, in order to secure a green card for the alien. As a result we have taken a number of steps to make sure that these young citizens are not pressed into forced marriages.

Or something to that effect.

The guidance provides the sensible, if modest, suggestions to USCIS officers, that they should make sure that:

The marriage was lawful in the place it was celebrated;
If a couple resides outside the place of celebration, the marriage is recognized as valid in the U.S. state where the couple currently resides or will presumably reside and does not violate the state of residence's public policy, and:
The marriage is bona fide, and the minor(s) provided full, free, and informed consent to enter into the marriage.

The age of consent varies in the states from 16 to 18, according to Wikipedia, but there are important exceptions, allowing for legal marriages at earlier ages, as noted in the USCIS press release:

In some U.S. states ... marriages involving a minor might be considered under certain circumstances, including where there is parental consent, a judicial order, emancipation of the minor, or pregnancy of the minor.

So, to put it in non-USCIS terms: the alien can't — in some places — marry that 14-year-old girl unless he made her pregnant.

USCIS can do better than this.

It might, for example, rule that in all cases where a minor is applying for a marriage visa for an alien that the minor be interviewed alone before the petition is considered. The family is often the problem.

It might, more boldly, say that it will consider no petition filed by anyone under 17 or 18, or related to marriages where the citizen is under 17 or 18, and sit back and see if that is challenged in the courts — and then see who wins, the government or the exploiting aliens.

The bottom line is that the government apparently has blurred two questions that should be seen as separate ones:

Should there be some limits on the weddings of young people?
Should such marriages of young people be accompanied by the addition to the U.S. population of an alien who probably could not become an immigrant in any other way and should that marriage present to the alien the remarkable benefit of a green card?

Clearly it is appropriate to regulate the second matter more carefully than the first, since there is a government-created good involved. If the 15-year-old citizen wants to spend the rest of her life married to the 45-year-old guy in the village in the Middle East, that's up to her and state and local law; but if the same marriage brings a green card to him, then the government can, and should, set down some conditions, and make a real effort to prevent marriages that are simultaneously population-expanding as well as exploitative of the citizen.

Since the passing of the Immigration and Reform Control Act (IRCA), 6 million illegal aliens have received amnesty in the United States. The IRCA Amnesty was supposed to "wipe the slate clean" and instead it's lead to the current situation of 12-20 million illegal aliens living in the country.

The Seven Amnesties Passed by Congress

1. Immigration and Reform Control Act (IRCA), 1986: A blanket amnesty for some 2.7 million illegal aliens

2. Section 245(i) Amnesty, 1994: A temporary rolling amnesty for 578,000 illegal aliens

3. Section 245(i) Extension Amnesty, 1997: An extension of the rolling amnesty created in 1994

4. Nicaraguan Adjustment and Central American Relief Act (NACARA) Amnesty, 1997: An amnesty for close to one million illegal aliens from Central America

5. Haitian Refugee Immigration Fairness Act Amnesty (HRIFA), 1998: An amnesty for 125,000 illegal aliens from Haiti

6. Late Amnesty, 2000: An amnesty for some illegal aliens who claim they should have been amnestied under the 1986 IRCA amnesty, an estimated 400,000 illegal aliens

7. LIFE Act Amnesty, 2000: A reinstatement of the rolling Section 245(i) amnesty, an estimated 900,000 illegal aliens

Immigration Reform and Control Act Amnesties

Amnesty No. 1- Immigration and Reform Control Act (IRCA), 1986 also known as the Simpson-Mazzoli Act

The Immigration Reform and Control Act of 1986 (IRCA) was enacted by Congress in response to the large and rapidly growing illegal alien population in the United States. The final bill was the result of a dramatic compromise between those who wanted to reduce illegal immigration into the United States and those who wanted to "wipe the slate clean" for those illegals already living here by granting them legal residence. As enacted, IRCA included a massive amnesty program for two main categories of illegal aliens:

1) those who could show that they had resided illegally in the United States continuously since at least January 1, 1982; and

2) those who had worked as agricultural workers for at least 90 days between May 1, 1985 and May 1, 1986.

As a "balance" to this huge amnesty, IRCA also included several provisions designed to: strengthen the enforcement of immigration laws (including sanctions for employers who knowingly hire illegal aliens); increase border controls; and create a program to verify the immigration status of aliens applying for certain welfare benefits.

The IRCA amnesty has been tied to terrorism. Mahmud Abouhalima, a leader of the 1993 World Trade Center bombing, was legalized as a seasonal agricultural worker as part of the 1986 IRCA amnesty. This allowed him to travel abroad, including several trips to Afghanistan, where he received terrorist training.

NOTE: In the 1990 Immigration Act, an additional 160,000 spouses and minor children of aliens amnestied under IRCA were granted amnesty as well. These 160,000 aliens are not included in the total numeric impact of the amnesty.

In addition, another 350,000 illegal aliens who were initially disqualified from the 1986 IRCA amnesty because they had traveled abroad while in the U.S. illegally may qualify for amnesty under proposed settlements in lawsuits resulting after the 1986 amnesty.

The 10-year impact of both the SAW and general amnesty in the Immigration Reform and Control Act was 2,684,892. The computation for the total number of immigrants to be added by this amnesty can be found on this chart.
Amnesty No. 6 - Late Amnesty, 2000: An amnesty for some illegal aliens who claim they should have been amnestied under the 1986 IRCA amnesty.

This amnesty was the result of an agreement between the Clinton White House, Senate Majority Leader Trent Lott, and Speaker of the House Dennis Hastert. The "late amnesty" allowed all illegal aliens who had been part of lawsuits claiming that they have been illegal aliens since before 1982 and should have received amnesty under the 1986 IRCA amnesty but for various reasons were denied, to renew their request for the amnesty.

The Late Amnesty of 2000 is expected to apply to an estimated 400,000 illegal aliens.
Section 245(i) Amnesties

Amnesty No. 2 - Immigration and Nationality Act, Section 245(i) Amnesty, 1994: A temporary rolling amnesty for 578,000 illegal aliens
Section 245(i) was added to immigration law when Congress passed this de facto amnesty as part of the FY 1995 Commerce, Justice, State Appropriations bill. Section 245(i) went into effect at the beginning of FY 1995 and was scheduled to sunset at the end of FY 1997 (Sep. 30, 1997).

In nearly all cases, a person must be an illegal alien to benefit from Section 245(i). There are two major kinds of illegal aliens who benefit: (1) Those who entered the country illegally. (2) Those who entered legally on visas but then violated the terms of their visa. Read what Section 245(i) actually does.

The INS estimates that at the end of FY 1997, Section 245(i) applications had resulted in an increase of 578,000 in the adjustment of status application backlog. This does not include Section 245(i) applicants whose status had already been adjusted as the INS does not track that separately.

Amnesty No. 3 - Section 245(i) Extension Amnesty of 1997

President Clinton twice signed continuing resolutions to extend the September 30, 1997 expiration date of Section 245(i). The first continuing resolution extended the deadline until October 23, 1997 and the second continuing resolution extended Section 245(i) until November 7, 1997. Section 245(i) was then further extended until January 14, 1998 by Congress as part of the conference report to H.R. 2267.

Amnesty No. 7- LIFE ACT Amnesty, 2000: A reinstatement of the rolling Section 245(i) amnesty
The LIFE Act of 2000 that was passed in December, 2000 reinstated Section 245(i) for the first four months of 2001 (Jan-April).

The House Immigration Subcommittee estimates that 900,000 aliens applied for adjustment of status in the first full year of the reinstatement.
Nation-Specific Amnesties

Amnesty No. 4 - Nicaraguan Adjustment and Central American Relief Act (NACARA) Amnesty, 1997

The Nicaraguan Adjustment and Central American Relief Act (NACARA) is an amnesty program for certain Nicaraguans and Cubans, and a de facto amnesty for certain Salvadorans, Guatemalans and Eastern Europeans.

The original bills that were introduced in the House and the Senate, H.R. 2302 and S. 1976, would have benefited only certain Nicaraguans, Salvadorans and Guatemalans. Cubans and Eastern Europeans were added later to mollify the anti-Communist sentiments of some members of Congress. At the same time, opponents of the amnesty tried to negotiate a requirement that the number of aliens granted legal residence under NACARA be subtracted from legal immigration ceilings, but managed only to secure minor reductions in the unskilled worker and lottery categories. In order to avoid lengthy debate on the costs and benefits of the amnesty and to ensure adequate support for it, the bill language was added as an amendment to the appropriations bill for the District of Columbia (H.R. 2607) and passed as part of that bill.

Nicaraguans and Cubans who have lived in the United States illegally since 1995, along with their spouses and unmarried children, were automatically granted legal resident status under NACARA, as long as they apply by April 1, 2000.

The 10-year impact of the NACARA Amnesty on U.S. population growth is estimated to be 966,480. The computation of the total number of immigrants to be added by this amnesty can be found in this report.

Amnesty No. 5 - Haitian Refugee Immigration Fairness Act Amnesty (HRIFA), 1998

The Haitian Refugee Immigration Fairness Act (HRIFA) is an amnesty program for Haitians. It was passed in the aftermath of the Nicaraguan Adjustment and Central American Relief Act (NACARA), when representatives of a long list of nationalities not included in NACARA claimed that it was discriminatory to refuse them the same special treatment. Haitians are the first group to succeed with this claim. As with NACARA, proponents of HRIFA sought to avoid a full congressional debate of the bill and so added it as an amendment to the omnibus appropriations bill for fiscal year 1999 (H.R. 4328), which was passed by both houses of Congress.

HRIFA grants permanent resident status to any Haitians who have been in the United States since December 1995, along with their spouses and children, as long as they apply before April 1, 2000. Haitians granted amnesty under HRIFA will not be counted against legal immigration ceilings, and no legal immigration ceilings will be reduced to make up for the extra number of permanent immigrants.

A group of six senators has come up with what they call a "bipartisan deal" on a DACA amnesty, but judging by details obtained by the Center, the aim is actually maximum amnesty, minimum border security and no cuts to legal immigration, and not a good faith effort to reach a deal with either the House of Representatives or the president.

Here's what they propose:

Amnesty for Dreamers, meaning DACA beneficiaries and other illegal aliens who arrived before June 15, 2012 (or claim to have) and were younger than age 17 (or claim to be) but did not qualify for or obtain DACA benefits. It is uncertain how much larger than the DACA program this amnesty would be.

DACA beneficiaries would have a period of conditional permanent residency, which may be lifted upon completing at least two years of college or military service or three years of work, or may simply lead directly to eligibility for citizenship after at least 10 years (or 12 if they did not have DACA).

The Dreamer amnesty would allow waivers for certain criminal convictions that exist under current law, if deemed to be "in the public interest."
Applicants for the program would have to pay up on any federal tax liability, if they had a DACA work permit, but not if they worked illegally prior to legalization. Does this mean that a lot of DACA beneficiaries have not been paying their taxes all these years?

The Gang of Six claims to address chain migration concerns by barring legalized Dreamers from sponsoring their parents for green cards. Instead, they give the parents instant, indefinitely renewable legal status and work permits, thus exacerbating the labor market disruption and fiscal costs of the presence of these illegal aliens.

The proposal claims to restrict chain migration, by eliminating the category for adult sons and daughters of green card holders, which admits about 26,000 people a year. However, it transfers those numbers to another chain migration category for spouses of green card holders and their children. So there is no net decrease in chain migration at all under this proposal.

Similarly, the proposal claims to end the visa lottery, but it preserves the numbers. It plans to take half of the lottery visas currently available and awards them to applicants from lottery countries, based on merit. The other half of the visas would be awarded to aliens who currently have Temporary Protected Status. When those run out (which would take at least 12 years), then all of the former lottery visas would go to applicants from countries in the new merit lottery program. So there would be no decrease in annual green cards.

Finally, the Gang agrees to fund the president's request for $1.6 billion for the border wall, $1.1 billion for other border security projects, and miscellaneous other border-related projects on a smaller scale.

There is no funding for ICE or interior enforcement, no expansion of E-Verify, nor any provisions to address the broken asylum system, sanctuary cities, the continued influx of illegal families and minors from Central America, visa overstays, an entry-exit system, the backlogged immigration court, illegal employment, or any of the other needs compiled at the president's request prepared by career immigration agency officials and outlined in an October memo.

This proposal is not a serious effort to find common ground with either the majority of congressional Republicans or the president. It pays only lip service to what is required to achieve the immigration policy improvements that Americans seek, and that they elected Donald Trump to accomplish.

Four pro-reduction Members of Congress were included in the bi-partisan group of Senators and Representatives that met with Pres. Trump today about creating a DACA deal.

But otherwise, the President was surrounded by champions of amnesties, increased foreign workers, gutted enforcement.

In reviewing the written testimony of the Government Accountability Office (GAO) before the House Committee on the Judiciary's Subcommittee on Immigration and Border Security for that subcommittee's October 26, 2017, hearing on "Oversight of the United States Refugee Admissions Program", however, I was struck by a vulnerability relating to fraud risk management that I have discussed before in the asylum context. Given the similarities between this issue in the refugee and the asylum contexts, I wanted to draw special attention to it.

In my report on "Fraud in the 'Credible Fear' Process", I detailed GAO's findings in a December 2015 reportcaptioned "Asylum: Additional Actions Needed to Assess and Address Fraud Risks". As GAO found in that report, U.S. Citizenship and Immigration Services (USCIS) and the Executive Office for Immigration Review (EOIR):

[H]ave limited capabilities to detect asylum fraud. First, while both USCIS and EOIR have mechanisms to investigate fraud in individual applications, neither agency has assessed fraud risks across the asylum process, in accordance with leading practices for managing fraud risks. ... Without regular assessments of fraud risks, USCIS and EOIR lack reasonable assurance that they have implemented controls to mitigate those risks. Second, USCIS's capability to identify patterns of fraud across asylum applications is hindered because USCIS relies on a paper-based system for asylum applications and does not electronically capture some key information that could be used to detect fraud, such as the applicant's written statement. Asylum officers and Fraud Detection and National Security (FDNS) Directorate immigration officers told GAO that they can identify potential fraud by analyzing trends across asylum applications; however, they must rely on labor-intensive methods to do so. Identifying and implementing additional fraud detection tools could enable USCIS to detect fraud more effectively while using resources more efficiently. ... Developing asylum-specific guidance for fraud detection, in accordance with federal internal control standards, would better position FDNS officers to understand their roles and responsibilities in the asylum process.

GAO's October 26 testimony details a similar failure by USCIS and the Department of State (DOS) as relates to refugee applicant fraud. Both USCIS and DOS play significant roles in USRAP:

Specifically, State's Bureau of Population, Refugees, and Migration coordinates and manages USRAP and makes decisions on which individuals around the world are eligible for resettlement as refugees in the United States. State coordinates with [the Department of Homeland Security] and other agencies in carrying out this responsibility. In particular, nine State-funded Resettlement Support Centers (RSC) that are operated by international and nongovernmental organizations and are located abroad with distinct geographic areas of responsibility communicate directly with applicants to process their applications, collect their information, and conduct in-person prescreening interviews. After such prescreening is complete, [USCIS] has responsibility for adjudicating applications from these individuals. In adjudicating such applications, USCIS officers are to conduct individual, in-person interviews with applicants overseas and use the results of these interviews in conjunction with other relevant information, such as the results of applicants' security checks, to determine whether USCIS will approve the applicants for resettlement in the United States as refugees.

GAO has previously found that: "There are ... questions as to whether USRAP is vulnerable to fraud because, for example, testimonial evidence alone, without corroboration, may be sufficient for refugee applicants to meet the burden of proof for establishing eligibility for resettlement in the United States." That office has underscored the importance of screening for such fraud:

Given the potential consequences that the outcomes of decisions on refugee applications can have on the safety and security of both vulnerable refugee populations and the United States, it is important that the U.S. government have an effective refugee screening process to allow for resettlement of qualified applicants while preventing persons with malicious intent from using USRAP to gain entry into the country.

In fact, ISIS has reportedly exploited the refugee crisis there to smuggle its fighters onto that continent. There is no reason to believe that it would not make similar efforts to exploit USRAP.

There are two main forms of fraud in USRAP: the making of false statements in support of a refugee application, and the submission of fraudulent documents. In its congressional testimony, GAO stated:

Although State and USCIS perform a number of fraud risk management activities and have responded to individual instances of applicant fraud, we found that these efforts do not position the agencies to assess fraud risks program-wide for USRAP or know if their controls are appropriately targeted to the areas of highest risk in the program. State and USCIS officials told us that each agency has discrete areas of responsibility in the refugee admissions process, and each agency's antifraud activities are largely directed at their portions of the process. Because the management of USRAP involves several agencies, without jointly and regularly assessing applicant fraud risks and determining the fraud risk tolerance of the entirety of USRAP, in accordance with leading practices, State and USCIS do not have comprehensive information on the inherent fraud risks that may affect the integrity of the refugee application process and therefore do not have reasonable assurance that State, USCIS, and other program partners have implemented controls to mitigate those risks. Moreover, regularly assessing applicant fraud risks program-wide could help State and USCIS ensure that fraud prevention and detection efforts across USRAP are targeted to those areas that are of highest risk, in accordance with the program's fraud risk tolerance. (Emphasis added.)

Because of the surreptitious nature of fraud, it is usually difficult to detect. This is all the more reason that USCIS and its respective partners in the asylum and refugee process, EOIR and DOS, work cooperatively to assess fraud risks.

In connection with that effort, all three should jointly undertake a study to assess the extent of fraud in the asylum and refugee processes. Specifically, USCIS, EOIR, and DOS should review a representative sample of cases involving aliens who have been granted asylum and refugee status and perform a forensic analysis of those cases to determine the factual validity of the claims therein. Such review should include in-country investigations, as well as interviews with successful applicants, their family members, and where possible, local officials in the countries of origin of those individuals.

In addition, all oral statements from applicants for asylum and refugee status, as well as all applications from those individuals, should be recorded electronically. This would enable investigators to identify trends across applications and search for the indicia of fraud, such as identical claims and language used by different applicants.

As with asylum applicants, adjudicators assessing refugee claims are often left with little more than the oral statements of the applicants, and perhaps a handful of non-self-authenticating documents. This renders USRAP particularly vulnerable to fraud. Given the importance of providing protection to those in legitimate fear of persecution, while protecting the American people from security risks, it is crucial that the agencies involved in USRAP utilize all of the tools at their disposal to identify and reject fraudulent claims. GAO has given USCIS and DOS a road map to follow in performing this task. It is up to the administration to ensure that they do so.

Washington, D.C. (November 2, 2017) – The Center for Immigration Studies published several articles detailing the Diversity Visa Lottery program’s history and relevant statistics following the attack by the Uzbek terror suspect in New York City. Sayfullo Habibullaevic Saipov is the fifth Diversity Visa Lottery recipient to be involved in terrorist acts in the United States.

Congress could have passed legislation to eliminate the visa program, stopping the exploitation of this national security vulnerability. Their concern is evident by the three hearings they held in less than three years – CIS testified at all three. The State Department inspector General in 2003 testified that "the Diversity Visa program contains significant risks to national security from hostile intelligence officers, criminals, and terrorists attempting to use the program for entry into the United States as permanent residents."

But voices like Senators Ted Kennedy and Chuck Schumer have been avid supporters, arguing that the United States requires the visa to generate increased ethnic diversity.

The security risk has grown over the years as the program admits a disproportionate share of immigrants from terrorist breeding grounds and has a high level of fraud. Of the top 10 source countries for Diversity Visa immigrants in FY 2016, four were on the U.S. Immigration and Customs Enforcement (ICE) list of Specially Designated Countries (SDCs): Egypt (2,855 immigrants), Iran (2,788 immigrants), Uzbekistan (2,378 immigrants).

Legislation eliminating the Diversity Visa Lottery has been introduced in the U.S. Senate by Senators Tom Cotton (R-AR) and David Perdue (R-GA). The RAISE Act (S.354) has a companion bill in the House, "Immigration in the National Interest Act" (H.R.3775), sponsored by Rep. Lamar Smith.

The Amnesty 'Me Toos' Begin

The U.S. Chamber of Commerce has written a letter to the acting head of the Department of Homeland Security (DHS) to urge that temporary protected status (TPS) be extended for nationals of El Salvador, Honduras, and Haiti when current their protections expire.

I encourage you to read it. The letter is a smooth-worded masterpiece of non sequiturs that urges continuation of the protected status that has been extended in each instance for far too long ("[t]hese designations have been in place since 2001, 1999, and 2010 respectively") and for all the wrong reasons. It not-so-subtly suggests that the aliens who have been the happy recipients of our government's abusive largesse of TPS in their behalf should be granted amnesty:

While the Chamber appreciates that the TPS program is intended to be temporary, the reality is these individuals have now lived and worked in communities across this nation for in some cases nearly two decades now. We urge you to extend the current TPS designations and to work with Congress on a more permanent resolution to the status of these TPS beneficiaries. (Emphasis added.)

That's the problem with amnesties. The minute one is mentioned — in this case, one for the so-called "Dreamers" who were also happy recipients of abusive governmental largesse in the form of a made-up program with no statutory basis (DACA) — it generates an immediate response of me-too-ism from anyone who has been treated "unfairly" by the immigration system.

Unfortunately, treated unfairly tends to be generic code for "Wait a minute, just because I'm in your country illegally, you mean you really want to force me to leave?"

Even more unfortunately, it isn't just the aliens themselves who turn up the volume to demand even more governmental concessions after receiving years of benefits to which they weren't entitled. It almost inevitably also includes an unholy alliance of open borders and alien advocacy groups working in concert with businesses and corporate employers who insist that they need unfettered access to cheap, pliable, and plentiful alien labor to do their bidding, often under conditions that citizens and resident aliens would find objectionable.

Then, of course, there are the politicians who fling themselves with abandon into the mix, either to virtue signal their liberal-progressive credentials, or because they receive generous campaign contributions from the cheap-labor business lobby.

The president opened Pandora's box when he suggested that it was up to Congress to do something about "Dreamers" as he phased out the DACA program ever-so-slowwwwly over a two-year period.

It is his responsibility to ensure that all parties clearly understand, under threat of veto, that if/when an immigration amnesty is presented, it must be exceptionally limited and include no one but qualified DACA recipients; and that it must be accompanied by significant trade-offs in the form of enforcement measures that address both the immediate border and the interior of the United States.

Documents Reveal that �Dreamers� Order Opened Door to Relatives of Illegal Immigrants, �Inundating� Border Towns with Petitions for Admission

(Washington, DC) � Judicial Watch announced today that documents obtained recently through a Freedom of Information Act (FOIA) request show that the Department of Homeland Security�s (DHS) U.S. Citizenship & Immigration Services (USCIS) abandoned required background checks late last year, adopting, instead, costly �lean and lite� procedures in effort to keep up with the flood of amnesty applications spurred by President Obama�s Deferred Action for Childhood Arrivals (DACA) directive, which grants illegal aliens a two-year deferment from deportation. Acting on a tip from a whistleblower at a federal law enforcement agency, Judicial Watch filed a FOIA request with DHS, for �all communications, memoranda, emails, policy guidance, directives, initiatives, and any other correspondence respecting the scope and extent of background checks to be performed (or not) on aliens applying to the Obama administration�s DACA program.� The FOIA was filed on October 26, 2012. The Immigration and National Security Act (INA) mandates a �coordinated, uniform, and efficient,� system of background checks. Instead, the FOIA documents reveal a costly, haphazard process, with only cursory review for the backgrounds of illegal aliens seeking �deferred status.� Document highlights include:

In a series of agency memos beginning in September 14, 2012, field offices were told to expect the National Benefits Center (which collects all DACA applications) to conduct only �lean & lite� background checks on illegal alien applicants, and that, henceforth, �NBC will not perform full TECS checks or any evidence review on these cases before we ship to the field.� An October 14 memo reiterated that under the new �lean and lite� policy, �Hits will be sent to the field without resolution.� On October 25, the St. Paul Field Director conceded to staffers that the new �lean & lite� procedures were for an indefinite period of time, saying, �I just can�t tell you when things will revert back to the way they used to be.�

An email chain from September 5 and through November 14 indicates managerial pressure not to turn any illegal alien applicant away for lack of ID, including the explicit directive in an October 3 memo, �Biometric processing should not be refused solely because an applicant does not present an acceptable ID.� In an October 1 memo further restricting independent action by agency personnel, they were instructed, �Every two weeks field offices will report the number of DACA requestors who appear for biometrics collection at an ASC during the previous two week period, but were turned away without fingerprints or photographs being taken. Field offices will also need to provide the reason why the DACA requestor was turned away by the ASC ISO.�

The documents suggest added taxpayer costs for the new deportation deferral program. On June 28, 2012, all Regional Service Managers were informed that they were to �come up with the number of guards that would be required and a dollar amount� in order to meet the new DACA processing requirements. On July 31, 2012, the agency announced, �In support of the President�s Deferred Action for Childhood Arrivals (DACA) initiative, USCIS is procuring 40 additional biometrics workstations.�

On November 9, 2012, just three days after Obama was reelected, in an �!!! IMPORTANT DACA MESSAGE!!! The agency was directed to: �Please put all DACA work on hold until further notice.� There are no later-dated documents in the production to indicate how or when USCIS resumed DACA background checks or application processing.

The documents also reveal that, contrary to DHS Secretary Janet Napolitano�s claim that DACA applied only to minors who came to this country illegally �through no fault of their own,� the directive actually created a new avenue of chain migration, whereby immediate relatives of DACA requesters could be approved for amnesty. As a result, according to a June 18, 2012, agency memo from District 15 Director, David Douglas, �some of the districts closer to the U.S./Mexico border have been inundated.� �The Obama administration seems to be throwing public safety and national security out the door in implementing its illicit and unilateral amnesty program for illegal aliens. Is Pres. Trump open to the DREAM Act amnesty with nothing in return? That's what some media reports from the last 24 hours suggest.
Earlier this week, Pres. Trump cut a deal with Democratic leaders, Sen. Chuck Schumer and Rep. Nancy Pelosi, to fund the government for three months, raise the debt-limit, and provide hurricane relief for Texas. According to reports, this newly budding relationship between the president and the two top Democrats could lead to Congress passing a mass amnesty bill.
According to The Hill:

Schumer announced on the Senate floor Thursday morning that Trump called him and asked how he could help advance legislation that would protect from deportation an estimated 800,000 immigrants who came to the country illegally as children.
Schumer urged Trump to put pressure on McConnell and Ryan to bring the Dream Act, which would create a path to legal status for these immigrants, to the floor.
"He said he wanted to help in the Dream Act, and there are many ways to help," Schumer said.

Reuters is reporting that Senior White House Advisor Jared Kushner (Pres. Trump's son-in-law) had met with Sen. Dick Durbin (D-Ill.) to discuss ways to protect the nearly 800,000 DACA recipients. Sen. Durbin is the top champion for the DREAM Act and recently introduced an updated version with Sen. Lindsey Graham (R-S.C.).
And Pres. Trump, himself, has been sending out mixed signals.
Tuesday, he urged Congress to "advance responsible immigration reform that puts American jobs and American security first" shortly after Attorney General Jeff Sessions announced that the administration would rescind the DACA amnesty.
But he sent out a Tweet later that day saying that if Congress didn't act on DACA, he would "revisit" the issue. He followed that up with another Tweet on Thursday telling DACA recipients that they have "nothing to worry about." It's been reported that Rep. Pelosi asked Pres. Trump to send out the second Tweet.
However, not everyone thinks the Trump-Schumer-Pelosi deal is good for Dreamers.
Amnesty champion Rep. Luis Gutierrez (D-Ill.) says the deal is bad for illegal aliens. Politico is reporting that Gutierrez believes that Rep. Pelosi and Sen. Schumer gave away the Party's leverage on the issue by compromising on three must-pass bills.
"The bond and trust between the Dreamers and the Democratic Caucus is broken," he said.

ACT for America is planning a nationwide �March Against Sharia � March for Human Rights� on June 10 that so far has 28 cities signed up to participate.

Organizers say they will be taking a public stand against female genital mutilation, honor violence, the blasphemy and apostasy laws, among other elements of Shariah that are increasingly showing up in American society.

Brigitte Gabriel, the founder of ACT for America, said America is now starting to experience some of the same atrocities of Shariah that her family escaped in Lebanon decades ago.

�We want to increase awareness about certain practices that are starting to happen in our country with the rise of Islamic immigration, because we are now hearing about female genital mutilation, like the cases in Detroit recently announced by the Department of Justice,� she told WND. �Who would have thought in 21st century America, after what women did working so hard in defense of women�s rights that we�d be talking about little girls being horribly mutilated, and that 513,000 girls are at risk of this barbaric Third World procedure, according to the CDC [Centers for Disease Control].�

ACT will also shine a light on honor killings and honor violence.

�It�s already here in America,� Gabriel said. �We�re seeing girls being killed simply for wanting to wear makeup. Under our Constitution they deserve the same rights and protections.�

She said U.S. feminists are �completely silent on this issue, and that is why we are trying to humanize this issue by putting names behind these atrocities. On our website we have faces of girls and woman who have been killed in the name of honor by their husbands in America. We want to personalize these faces so when people hear about honor killing and FGM they know it is happening here in America to American girls and women, not just in Pakistan or India or Saudi Arabia.�

Scott Presler received his �wake-up call� after the Orlando attack of June 12, 2016.

Scott Presler, one of the organizers of the event, said the left will try to paint the rallies as �Islamophobic� and anti-Muslim, because that�s what the left always does in its defense of the Islamist agenda.

If radical leftists want to hold counter protests in favor of female genital mutilations, honor killings and the death penalty for former Muslims who have left the faith, they are more than welcome to do so, he said.

�You cannot be pro-Shariah and call yourself a feminist � that is called fake feminism, people like Linda Sarsour are fake feminists and hypocrites,� said Presler, referring to the leader of the Women�s March on Washington after Donald Trump was elected president.

�And we�re not afraid to call them out,� he added. �We are here to protect our communities and educate them on the issues and get them to call their legislators to pass legislation that protects women and other victims of Shariah.�

Presler said his own wake-up call came one year ago on June 12, when the Pulse Nightclub in Orlando, Florida, was attacked by the son of an Afghan immigrant who killed 49 people in an act of jihad.

�I came out as gay after the attack on Pulse. I never intended to come out, at least not this soon, but after it happened, I felt I had to take a stand, I felt obligated, I had to fight for my community, my country,� Presler told WND.

In Muslim-majority countries where Shariah rules, there is no debate as to whether homosexuals should be allowed to marry. The debate is how best to punish them, and in some countries such as Saudi Arabia, how best to kill them � whether by beheading or throwing them off of tall buildings.

�We are under attack simply because of our sexuality. Just like women, just for being born a female you are already under attack, and I think that�s demonstrative of how extreme radical Islam really is,� Presler said. �I had to educate myself and now I�m trying to educate others.�

After the Orlando attack Presler said he joined ACT for America.

�I had seen Brigitte Gabriel�s videos in the past, but after Orlando that was my wake-up call. Her wake-up call was 9/11, whereas my wake-up call was Pulse Nightclub,� said Presler, who grew up in northern Virginia and now lives in Virginia Beach.

Gabriel told WND the first national anti-Shariah rallies have the goal of humanizing the effects of Islamic law on real Americans.

�We have former imams speaking, former Muslims, gays, women who survived acid attacks, we have everybody coming together and speaking saying �we are fed up.� We do not want to go down the path of Europe,� she said. �What is going on in Europe is a preview of what is coming to America and in fact is already here.�

Gabriel also points to the Orlando attack as an example of what can happen when Muslims fail to assimilate into American culture.

�We want to remind Americans what Shariah says about gays. We have a lot of people in America who may not agree with the gay lifestyle but they would never go out and kill gays, and certainly don�t teach their kids to go into gay nightclubs and blow people up,� she said. �So we want to wake up Americans and make them aware of who we are inviting into our country, we want people to come here who love America and our freedoms and who believe we are all equal in the eyes of God, we want them to assimilate, to adopt our laws, and respect the American culture, not go on importing people into our country who hold values that are completely opposed to our values, our country, our Constitution.

�They are welcome to come here but they are not welcome to mutilate their daughters� genitals or beat their wives or kill homosexuals.�

Presler said any city can host a march but ACT wanted to make sure a rally was scheduled for cities and states that have experienced terrorism, FGM or honor violence. Venues such as New York, Orlando, Atlanta, Minnesota, Michigan, and San Bernardino were a priority. Another rally is scheduled for Richardson, Texas, the site of the Holy Land Foundation terror-financing trial in 2008.

In Lawrenceville, Georgia, just outside Atlanta, a 42-year-old mother and her teenage daughter were attacked outside their own home by a Muslim refugee from Somalia one year ago. The Somali woman, dressed in a burqa with only her eyes showing, beat Dami Arno with her own American flagpole before she was subdued with the help of a neighbor.

At the rally in Austin, Texas, a survivor of female genital mutilation, Lauren Morris, will speak. Morris recently made a video about her experience.

Obama DOJ Reprimanded SPLC for Hateful Attacks on Immigration Control Groups

The radical leftist group that helped a gunman commit an act of terrorism against a conservative organization was officially reprimanded by the Obama Department of Justice (DOJ) for its hateful attacks, according to documents obtained by Judicial Watch. The Southern Poverty Law Center (SPLC) is an extremist nonprofit that lists conservative organizations that disagree with it on social issues on a catalogue of �hate groups.� The previously undisclosed DOJ rebuke is a vindication for groups targeted by the SPLC�s witch hunts and is especially impactful because the Obama administration was tight with the SPLC and even hired the controversial nonprofit to conduct diversity training for the government. Judicial Watch uncovered documents relating to the SPLC�s diversity training at the DOJ back in 2013.

Also in 2013, Judicial Watch reported that a Virginia man who planned a mass shooting based on the SPLC�s �hate map� of conservatives got a 25-year prison sentence. Prosecutors called it an act of terrorism and recommended a 45-year sentence. The terrorist, Floyd Lee Corkins, stormed into the headquarters of the Family Research Council (FRC) and carried out the politically-motivated shooting based on an SPLC target list. The FRC is a Christian organization that promotes the traditional family unit and the Judeo- Christian value system. Corkins pleaded guilty and admitted that he learned about the FRC from the SPLC, which describes itself as a civil rights group but labels conservatives who disagree with it on social issues as hateful.

In 2015, the SPLC issued a hit list of U.S. women against sharia law, the authoritarian doctrine that inspires Islamists and their jihadism. This included a starter kit for Islamists to attack American women who refuse to comply with Sharia law and a detailed list of female bloggers, activist and television personalities who reject Sharia law, which is rooted in the Quran. Among those targeted were colleagues and friends of Judicial Watch who fear for their safety simply for practicing their rights under the U.S. Constitution. That SPLC hate list is titled Women Against Islam/The Dirty Dozen and includes illustrations and detailed information on all the women, who are branded �the core of the anti-Muslim radical right.� The SPLC hate brochure further targets them by claiming that they�re �a dozen of the most hardline anti-Muslim women activists in America.�

Another favorite SPLC target is any group or individual that speaks openly against illegal immigration. The DOJ reprimand, issued last year but kept quiet at the agency�s request, involves the SPLC�s atrocious behavior during immigration court proceedings. Two groups that oppose illegal immigration, the Federation for American Immigration Reform (FAIR) and the Immigration Reform Law Institute (IRLI), were the target of personal, baseless and below-the-belt attacks from SPLC attorneys during official immigration court proceedings. The SPLC filed a motion attacking and defaming the two respected nonprofits by describing them as �white supremacist�, �eugenicist�, �anti-Semitic�, and �anti-Catholic.� In its reprimand the DOJ says it is troubled by the conduct of SPLC lawyer Christopher Strawn and that his conduct �overstepped the bounds of zealous advocacy and was unprofessional.� Furthermore, SPLC made �uncivil comments that disparaged FAIR and its staff,� the rebuke states, adding that the language constitutes frivolous behavior and doesn�t aid in the administration of justice.

The Obama administration kept the reprimand confidential and asked FAIR and IRLI to keep it under wraps. In the meantime, SPLC continues to publicly trash the groups and escalate attacks against them by putting them on the official hate list. The executive director and general counsel of IRLI, Dale Wilcox, says his nonprofit and FAIR will keep fighting for immigration policies that put America first. �The SPLC�s latest tactic in its never-ending witch-hunt and the federal government�s resulting reprimand should send the following message to the mainstream media,� Wilcox said: �Stop using the SPLC as a legitimate hate-watch source in your news coverage. That a cabal of biased list-keepers can play such an important role in distorting the immigration debate in this country is testament to the utter failure of much of the mainstream media which frequently publishes their inflammatory commentary and refuses to question their baseless methods or financial motivations.�

Eagle Forum Issues warning against Trans Pacific Partnership Deal

As Congress weighs granting President Obama more power through Trade Promotion Authority (TPA, also called fast-track), Eagle Forum has been warning about its risks. Now Sen. Jeff Sessions (R-AL) is listing his top five concerns with TPA:

Giving the President More Power: Under the rules of TPA, Congress can only vote up or down any trade agreement. Deals cannot be amended in either chamber or filibustered in the Senate. Once fast-track has been granted, it is difficult to take back until it expires. Finally, the President must report the details of an agreement to Congress at least 60 days before submitting implementing legislation, but he can classify or redact information.
Increased Trade Deficits: Previous trade deals such as NAFTA have increased our trade deficits, slowing down economic growth and costing Americans jobs. Manufacturing jobs are among the most vulnerable to foreign competition, yet TPA doesn't call for blocking foreign subsidies to industry.
Giving Up Sovereignty: The TPP is a living agreement, which "means that participating nations could both add countries to the Trans-Pacific Partnership (TPP) without Congress' approval (like China), and could also change any of the terms of the agreement." Implementing legislation is written in order to change any U.S. laws at the federal, state, or local level that conflict with the international trade agreement. It is then included in the final up or down vote, meaning no deliberation or debate is allowed.
Currency Manipulation: Many countries such as China and Japan devalue their currencies to lower the price of their exports and make imports appear more expensive. The Obama administration has turned a blind eye to currency manipulation during negotiations, and TPA doesn't address this problem.
Immigration: Immigration rules can be changed without congressional approval during the implementation of TPA. Language such as "reducing or eliminating barriers to international trade in services" can be interpreted to cover immigration or visas for foreign workers. Previous trade deals have been used by the executive branch to unilaterally increase certain visas. Other countries could potentially call for international adjudication if Congress tries to reform the guest worker program.

Between watching the slow evaporation of the 401K you worked so hard for, the company you just spent 23 years devoting your life too (go bankrupt), the abuses of the IRS, NSA, ATF, Obamacare, Corruption beyond comprehension, lies, lies and more lies-Americans have had it up to here (picture me running my finger across my forehead). The straw that has broken the camels back was no doubt, the Emperor Obama acting as an Emperor (by signing amnesty for millions of illegal aliens) and the Republicans announcing (once again) their collective lack of will to do anything about it.

United States Senator Jeff Sessions (R-AL) said this a couple of nights ago;

�No, we�re not going to impeach President Obama. Or have a move to impeach,� Sessions said at a Heritage Foundation event and then added, �The president has certain powers and we truly believe � and I think it�s accurate to say that he abused those powers.�

Speaker of the House John Boehner (R-OH) has yet to address the topic of bringing Impeachment to floor of the House in regards to this latest �abuse of power� by President Obama.

We know that the sailors aboard the Pinta, Nina and Santa Maria very nearly committed mutiny on our friend Chris. They were committing mutiny because they were afraid that Christopher had acquired permanent brain damage and was leading them to hell or someplace worse. They had lost faith in his leadership ability. It is that simple.

Americans are the first to go to war for supporting �what is right� and the �right thing to do�. We always have. Americans are the first to support �standing on the side of righteousness� even if it is costly. We do this because we are for the most part a �Bible believing nation� and the bulk of our citizens are Christians.

Senators Sessions, McConnell, Cruz, Paul, Lee, Ernst (our newest conservative hero) and the rest; know this and carve it in stone, we the American people WANT THIS PRESIDENT IMPEACHED!

WE THE PEOPLE know that you may or may not get a conviction in the Senate, but you can darned well get charges brought in the House. President Obama and the American people need to finally witness the total corruption that this President has been leading by and it all needs to air on the floor of the House of Representatives. Bring it to the floor of the Senate. If he is convicted, then fabulous. If he is not, at least the right thing has been done and the American people can and will hold those Senators accountable that failed to vote for conviction in the next election.

The United Nations is continuing to push to force the United States to welcome illegal aliens with open arms and give them amnesty.

Our constitution couldn�t be clearer that international law, unless ratified by the Senate, has no power on United States soil� Likewise, an international organization, like the United Nations, should have no authority over domestic issues. However the Constitution, in case you haven�t realized, doesn�t matter to the liberals pushing a globalist agenda.

That pesky little document hasn�t stopped the United Nations and its globalist allies from trying to force the United States to house these illegal alien �refugees.�

Yes, that is what the United Nations is calling the gang and cartel members who are sneaking across the border. Apparently, now they are refugees� Good to know. Someone should tell Border Patrol Agent Javier Vega�s family that everything is ok because he was killed by �refugees��

This really isn�t all that surprising. The UN�s own Universal Declaration of Human Rights declares that everyone has a human right to leave their country and receive asylum elsewhere. As far as the U.N. is concerned, these illegal alien invaders are just exercising their Constitutional rights.

The United Nations has been trying to force its open border policies on the United States for years. And now, the international body is actually making moves to force us to welcome and accept the hordes of illegals flooding our border!

The whole premise of this push revolves around the definition of refugee. This is where Barack H. Obama can help. The liberal media is reporting that Barack Obama is planning to issue an imperial decree that would instruct our embassies in Central America to screen illegal aliens and ship them directly to the United States at taxpayer expense.

You read that right. Hordes of illegal aliens won't be sneaking across the border and they won't even be surrendering to border agents because Barack Obama wants to put them on planes and buses and ship them directly to your town or city.

As reported by the liberal New York Times, the Obama Regime wants to bring these illegal aliens "into the United States without making the dangerous trek through Mexico." The Times further reports that Obama Regime "officials said they believed the plan could be enacted through executive action, without congressional approval..."

It's Crunch Time.

Congress will adjourn for five weeks on Friday and that means that if we can ensure that there is no vote on funding Barack Obama's illegal alien invasion over the next three days, we can stop it for the next five weeks... and if we can stop it for a few more weeks we can potentially stop it forever.

But preventing the House GOP from giving Barack Obama the money to implement his plans is no slam dunk. NewsMax reports: "A Republican aide who spoke on the condition of anonymity said the House is likely to approve less than half of the money Obama requested...."

Here's the problem. Even if John Boehner and Republican leaders place stipulations on the appropriation of funds (i.e. enhanced border security) and give Barack Obama "half" of the money he is requesting, what is to stop Barack Obama from simply spending the money as he sees fit? What's to stop him from simply using the money to further enable the illegal alien invasion that he manufactured with his pen and his phone?

After all, Obama has shown, time and again, that his administration is all too willing to ignore Congress and act lawlessly. You know it. We know it and John Boehner and our self-proclaimed Republican leaders know it.

The answer to stopping the immigration crisis that Barack Obama manufactured is NOT to give him half of the 3.7 billion dollars he requested. Thank You to all of You who were able to come to our NY ICE planning meeting for May
1st.

This email may be a little redundant for those attendees, but it is going to my main
Elist, so a lot of those who weren't able to make the meeting
can learn of our Counter Protest May 1st, which is THIS Thursday.

As most of You know, May 1st is the annual day that illegals stampede for
amnesty. And, when they aren't being aggressive or misrepresenting us
as "racists", they are trying to act like victims and portraying us as
heartless. I like to say, when they try to act like we are
unsympathetic, that, "My sympathies lie with Americans and legal
immigrants and their descendants, NOT illegal alien trespassers". I am
including they Rally Behavior section of our Bylaws before the Details
for our Counter Protest:

RALLY BEHAVIOR:
Remember: We use the term "illegal mass migration" or "illegal alien" to draw on how
it differs from lawful immigration.
NY ICEholds protest rallies to express our views and make our voices heard.
NY ICE DOES NOT CONDONE RACISM IN ANY WAY. NY ICE has been forced to endure the
accusation of "racism" at rallies. NY ICE believes that our opposition
resorts to juvenile name-calling because it can NOT argue on the facts,
since the facts are on OUR side. There is NOTHING racist about wanting
to secure our borders and have immigration laws enforced. The President
of NY ICE is herself Hispanic, and the granddaughter of LEGAL
immigrants.

Members do NOT separate from the Group while actively
attending a rally. We keep an eye on each other. Always act and speak as though
there is a camera and a microphone in your face, and the Press
is listening.
NY ICEmembers are educated in communicating with hard facts (and their
sources, when possible) at rallies. We find that facts alone are often
hard for the opposition to dispute. They are also useful when speaking
with passersby who want to know more. HOWEVER, since the opposition
knows the facts are on our side, they often engage in vulgarity,
cursing, and the display of the middle finger.

We are NEVER to engage in the same vulgar behavior, and
must hold ourselves to a higher standard, which the Press will take note of. If
communicating with hard facts does NOT work, a Member can walk
away, seek another Member, or annihilate the opposition's credibility
without sinking to vulgarity. (Knowing which method will be most
effective will come with experience in Street Actions).

The President may organize a Buddy System for the rally. If she does, every woman
will be assigned at least one
male "bodyguard" for the entire rally. If the numbers of men allow, she
will be assigned more than one. This bodyguard(s) is her "shadow" for
the rally from beginning to finish.

NY ICE is NOT against multilingualism, but when NY ICE speaks to the
Press, we speak to the Press in English. Individuals can speak to the
Press in a language other than English as individuals, and NOT as
Members of NY ICE.

* Ask the Representative how many legal students will be displaced illegal alien students. Throw out some numbers like 5K, 50K, 100K.

The answer is unknown because Staff Analysis states "The fiscal impact is indeterminate as it is difficult to identify the number of students who meet the criteria outlined in the bill."

* Ask the Representative how much it will cost to subsidize college tuition for illegal aliens. Throw out some numbers like, $50 million, $500 million, $1 billion.

FLIMEN Note 1: HB851 also includes two other provisions that FLIMEN does not necessarily oppose but when a bill contains provisions as egregious as HB851 then it makes sense to oppose the entire bill. FLIMEN does not object to in-state tuition rates for citizens (via birthright citizenship) or veterans but strenuously objects to in-state tuition for non-citizens ("undocumented immigrants").

FLIMEN Note 2: The Staff Analysis clearly states that federal law prohibits reduced tuition rates for any group unless reduced tuition rates are extended to all US citizens. The deceitful wording of the HB851 as well as tuition policies of several Florida state-funded colleges use deceitful wording in an attempt to bypass federal law.

Senate Democrats have sided with illegal immigrants over veterans of America�s military. As reported by Matthew Boyle of Breitbart, Senator Kelly Ayotte (R-NH) proposed a bill which would not just have paid for unemployment benefits for American citizens. It would have also closed a tax loophole that allows illegals to access the Refundable Child Tax Credit and instead replaced recent cuts to veterans pensions. Yes, when given an absolute choice, the Democrats sided with illegals over veterans.

The vote failed on Thursday 54-42, with all Republicans but Sen. Dean Heller (R-NV) voting for the amendment and against Senate Majority Leader Sen. Harry Reid (D-NV). Sen. Joe Manchin (D-WV) crossed the aisle to vote alongside Republicans in favor of the amendment.
The amendment would have been to the Unemployment Insurance Extension Bill, S. 1845. On the Senate floor while debating the amendment, Ayotte argued her amendment is �one that would fix fraud in our tax code that really came to light in 2011 in a Treasury IG [Inspector General] report.�
�What it would simply require is those who seek the additional child tax credit to file a Social Security number just like those who seek the Earned Income Tax Credit in this country,� Ayotte said.

It is important to contact your member of the U.S. House. When the other side calls and contacts members of Congress and we don't, they can win.....if we can push the amnesty debate into 2014, it has an even less chance of moving forward.

Earlier this week pro-cheap labor interests along with New York City Mayor Bloomberg and Facebook's Mark Zuckerberg organized a trip to Wash, DC of so-called conservatives to meet with mostly Republican U.S. House members to convince them do an amnesty for illegals. Help us provide a counter to this and STOP any new push for amnesty.
See our recommended response below but this is what the pro-amnesty folks (noted above) said to members of Congress according to media reports: big donors said they will not provide large donations to members of Congress unless they pass an amnesty. The illegals, they said, are hurting and we need to be compassionate. The US Chamber of Commerce said the world is passing us by. Their supports say the illegals want driver's licenses and don't want to be here in fear of being deported.
Congresswoman Renee Ellmers found time to meet with pro-amnesty cheap labor folks in person, but hasn't yet found time in her schedule to meet with NC LISTEN in person.
Our response:
Pro-amnesty supporters were in the halls of Congress earlier this week. They forgot to tell you that the rule of law is in fact important, and North Carolina has the sixth worst and highest unemployment rate in the nation. Why are illegal immigrants allowed to take jobs that belong to citizens......remember less than 15% of illegals do any kind of agricultural work. There seems to be plenty of compassion for illegals, but where is the compassion for unemployed citizens? The big donors say they won't give donations to candidates unless the candidate agrees to vote for amnesty........well we citizens, and there are many more of us, will NOT vote for any candidate that says they support an amnesty or pathway to citizenship for illegals.

The American Defense Project (AD Project) is calling on American citizens to contact members of Congress to encourage them to default on America�s debt as such an action would be in the best interest of future generations of Americans.
This activism effort is called �Jubilee America� in a reference to Leviticus 25:8-13 and the Christian and Jewish concept of forgiving debts every 50 years in which slaves and prisoners would be freed, debts would be forgiven, and the mercies of God would be particularly manifest.
The current US debt is about to exceed 17 Trillion dollars which breaks down to more than $53,500 per citizen in federal debt alone before adding the burden of state, county, and municipal debts as well. These debts can have an enslaving effect on American citizens and future generations as our citizens are now beholden to those that own our debts.
A default is inevitable if America�s debt and spending addictions are not broken and it should be clear to all that DC politicians will not balance our budget on their own.
�Defaulting on our national debt is the only way to stop out of control borrowing and spending in Washington DC,� said Jack Lawrence, Director of AD Project. �It will be a painful and dangerous time for our nation, but facing the realities, through controlled debt default, will be more surmountable now than later if they keep increasing the debt levels. Each infant born in America today, each of our children, each of our grandchildren owe more than $50,000 and that is unacceptable. We owe it to them to abolish this debt.�
The American Defense Project hopes that other grass roots organizations and lawmakers will begin to adopt the call for America to engage in a �controlled default� instead of a forced default that will be more damaging at a later date and higher debt level.
There is also a great danger that future politicians will enforce repayment of these current and future debts by subjecting American citizens to freedom and economy crushing surveillance state technologies and authoritarian police state tactics.
�American citizens will have to be disarmed, have our freedoms severely restricted, and face police state oppression to exact the amount of servitude required to repay debts of this size,� said Jack Lawrence. �These debts are a threat to our national security and way of life. Freedom and default are preferable to slavery and oppression repaying these debts will bring.�
The AD Project contends that controlled defaulting on our national debt is a preferable option because it could decrease the influence foreign governments like China and Saudi Arabia have on American political leaders. Controlled Default could force politicians to balance the budget once they are unable to borrow from lenders. Default would benefit the American economy by unencumbering our citizens and businesses from these destructive debts that take money out of our economy without producing anything or returning any benefits for our citizens.

Help Save Maryland/Virginia Partners Stand Against "Amnesty Fiesta" on Mall
A small but dedicated group of MD and VA citizens stood strong yesterday as the illegal immigrant tide washed onto the Mall in DC for their planned "Amnesty Fiesta".

We were well received by the Media and citizens that ventured out to watch this Sodom and Gomorrah extravaganza. We conducted many TV, Newspaper and Radio interviews.

I also did a short segment on WMAL Radio(105.9 FM, 630 AM) with the Chris Plante Show this morning about our participation. See some sample media links below, including the New York Times about our Mall presence.

Aided by the White House, which suddenly seems to have discovered the 1st Amendment, the desperate AFL-CIO, the illegal immigrant heavy SEIU and other Union facilitators bused in thousands of mostly non-English speaking illegal immigrants to participate.

The Illegals were literally "Extras" while a litany of pandering politicians, misguided civil rights and religious leaders, and Marxist-Leninists promoters dominated the stage. Even Senator Menendez (D-NJ) joined the Fiesta, looking tanned, rested and ready from his last jaunt to the Dominican Republic.

As with past illegal immigrant events in DC, Spanish was the dominant language. Hordes of illegals, corralled by their Union trainers were banging drums and chanting songs. The only English I heard was "No Justice, No Peace". Just lovely.

I asked the TV reporters from Telemundo while they were interviewing us why the sponsor, CASA of Maryland, continues to promote Spanish events in their quest for citizenship? Clearly Spanish doesn't help illegals assimilate or give warm feelings to Americans at large.

Instead it feels like an invasion (which it is) rather than a honest request for compassion and a pathway to citizenship. Seems Senor Torres of CASA is still on his Che Guevara ego trip.

What really pissed me off however, was the White House blessing and supporting this Illegal Immigrant event on the Mall while Americans are banned from all monuments/parks across the nation.

It's even more disturbing for me to see National Park Rangers (non-furloughed) aiding and abetting to help this event happen while I'm furloughed from my Government job!

Extra Rangers were even called in from parks around the region to keep the illegals under control, stripping park safety officers from during their real jobs rather than babysitting illegal immigrants.

All politics by the White House and their cohorts in the Senate.

House Republican leaders have chickened out and decided to fund a program that will destroy our country.

According to media reports, GOP leaders will attempt to pass a "trick rule" that allows them to pretend to defund Obamacare without actually doing so.

Under the trick rule, the House will pass a continuing resolution that fully funds Obamacare along with separate phony bill that defunds Obamacare. Democrats in the Senate will then throw the defunding bill in the garbage and send the real bill that funds Obamacare to the president's desk.

It's the "now you see defunding, now you don't" strategy.

We must act now and call on conservatives in the House to defeat the trick rule that funds Obamacare.

House rules are almost always passed along party lines so all we need is 16 Republicans to oppose the rule to defeat it.

Please call these members today and urge them to do EVERYTHING in their power to stop funding for Obamacare. Tell them to vote against the rule.

NY ICE (New Yorkers for Immigration Control and Enforcement) members were reaching out to NY citizens in Staten Island advising them about the dangers of immigration reform, asking for signatures to their petition which would be presented to Rep Michael Grimm to stop ILLEGAL ALIEN amnesty.

As you can see they had one know it all NYC progressive defending ILLEGAL ALIENS who went as far to say everyone here who is not native American is an illegal immigrant.

I grow so tired of these children who think because they are law student they know everything. Been there done that! (*side-note: I had my share of business law in college everyone that does becomes a smart ass) Here�s the problem with this young lady�s argument. There was no established govt in America when Europeans �discovered� and set foot on American soil. So these claims that everyone who isn�t native American is here illegally is a joke. If I�m wrong please lefty loons show me where the capitol of America was prior to settlement. What was the law on the �books� native Americans had pertaining to illegal immigration?

So the law student leaves and then eventually returns wanting the footage of her deleted. Ms. Attorney to be hated the fact that there was someone present just as smart if not smarter than she was, that knows the law about public video recording, so she does what most progressives do when they lose an argument. The video abruptly ends with this future attorney striking the young lady filming! You can see �Joanne� who is filming in this earlier clip from the day.

Arlington, VA � ProEnglish is providing legal support for a student who was suspended merely for asking that students speak English in her classroom and during student projects. Terri Bennett, a nursing student at Pima Community College (PCC) in Tuscon, Arizona asked school administrators to make sure students speak English in the class so she could learn.

After making this simple request, school administrators called Ms. Bennett a �bigot,� and she received a nine-month suspension. Ms. Bennett reached out to ProEnglish for assistance in May as PCC took these actions against her.

ProEnglish contacted the Arizona law firm of Munger & Chadwick to represent Ms. Bennett. On July 8, 2013, the school was served with a complaint from Ms. Bennett through her attorneys, seeking administrative review.

On Monday, July 15, a complaint seeking monetary damages against the school was filed in state court. The state Attorney General Tom Horne was also formally notified about Ms. Bennett�s case as the school is in violation of Arizona�s official English amendment.

�What happened to Terri Bennett is an outrage,� said ProEnglish Executive Director Robert Vandervoort. �For simply seeking a classroom environment where she can learn in English, Terri was harshly treated by the PCC administration, viciously insulted, and punished with a nine-month suspension.�

�This school should be known as �Politically Correct College,� Vandervoort continued. �We look forward to bringing justice for Terri and making sure other students are allowed to learn in English.�
