Roughly a year ago, the Frank Hawkins Kenan Institute of Private Enterprise, part of the Kenan-Flagler Business School at the University of North Carolina at Chapel Hill, released a study on &quot;The Economic Impact of the Hispanic Population on the State of North Carolina.&quot; Since that time, the study has been widely quoted, usually in a misleading manner.<br />
<br />
Of course, the very first news release from UNC carried the headline: &quot;North Carolina's Hispanic immigrants contribute more than $9 billion to economy, cost state budget net $102 per Hispanic resident, new study shows.&quot; While that statement is completely untrue, the misrepresentation was soon exaggerated even further.<br />
<br />
The reference to the state budget quickly disappeared, and Dr. James H. Johnson, Jr., one of the study's authors, characterized the study as showing &quot;... the Hispanic population in 2004 had<br />
an economic impact of about $9.3 billion on our economy and when we look at the cost to the state it is about $61 million or about $102 per Hispanic resident in the state. When you factor in the $9.3 billion in economic impact based on their consumer spending, we found that the<br />
Hispanics contribute far more to the state's economy than they cost us.&quot;<br />
<br />
The message of a net cost to the state of &quot;about $102 per Hispanic resident&quot; and an overall positive benefit was repeated again and again by the proponents of illegal immigration. The $102 number was so bogus that UNC needs to do what it did in 2003 when it was determined that a &quot;UNC scientist falsified data for journals,&quot; they need to tell the authors to issue a retraction or retitle the study.<br />
<br />
A more accurate title for the study would be: &quot;The Economic Impact of Hispanic Immigration on Three Items in the State Budget That Don't<br />
Begin to Capture the Cost to North Carolina Taxpayers of Hispanic Immigration Offset By Imaginary Numbers, Including An Arbitrary Multiplier Effect and Local Taxes That Are Not Available for<br />
Offset Because They Pay for Expenses that are Not Included,&quot; but that might not be as useful for misleading the public.<br />
<br />
Occasionally the North Carolina Bankers Association has been named as the source of funding for the study, but the study document admits that the idea for the study and the selection of the people to do the study did not come from the Bankers Association. When Dr. Johnson said, &quot;we think<br />
and we found that the Hispanics contribute far more to the state's economy than they cost us,&quot; it sounds like he had an opinion before he conducted the study, and he found what the people who picked him to do the study wanted to find.<br />
<br />
Since the Consulate of Mexico in Raleigh and the Chairman of the North Carolina Hispanic Chamber of Commerce picked the study's authors before they approached the Bankers Association to ask for funding, some might think the study results are hardly surprising. Clearly, the Mexican Consul and the Hispanic Chamber of Commerce would have a vested interest in persuading the public and business community at-large of the importance of the Hispanic community and minimizing the cost<br />
of illegal Hispanic immigrants.<br />
<br />
When Nolo Martinez, who served as an advisor to former Governor Jim Hunt on immigration issues and serves as a senior policy advisor to El Pueblo (a non-profit statewide advocacy and policy group dedicated to strengthening the Latino community), told the Montgomery County Commissioners:<br />
<br />
&quot;The latest research from 2004 showed that immigrants in North Carolina contributed over $755.5 million in taxes … (and) the net cost to the state was over $61 million annually, or about $102 per immigrant,&quot; he was making an untrue statement. When he predicted that North<br />
UNC Study MISLEADS PUBLIC On Impact Of Illegal Immigrants The UNC studywas suggested by the Consulate of Mexico in Raleigh and the Chairman of the North Carolina Hispanic Chamber of Commerce, and funded by the North Carolina Bankers Association.<br />
<br />
If the Bankers Association paid for a serious academic study on &quot;The Economic Impact of the Hispanic Population on the State of North Carolina,&quot; they should ask for a refund.<br />
<br />
Carolina may &quot;become the Hispanic capital of the eastern United States,&quot; he could be right.  Clearly, by using the study to minimize the true costs of illegal immigration, he is helping achieve that goal.<br />
<br />
Few would question the positive contributions that legal Hispanic immigrants are having on our state and country. But, by failing to distinguish between legal and illegal immigrants, the study uses the positive benefits of legal immigration to offset the astounding cost of illegal immigration.<br />
<br />
Unfortunately, the only way the authors could even come close to showing a positive net benefit from Hispanic immigration when illegal immigrants were included was to ignore certain basic facts and mix apples and oranges.<br />
<br />
If the Bankers Association paid for a serious academic study on &quot;The Economic Impact of the Hispanic Population on the State of North Carolina,&quot; they should demand a refund. That may sound harsh, but<br />
the study's authors were made aware of the following deficiencies shortly after the study was released. It is hard to imagine they were unaware of them before the study was released.<br />
<br />
Even if we accept their decision to ignore any cost/benefit differences between legal and illegal Hispanic immigrants, the study is still fatally flawed. The most obvious flaw is that no matter how you define &quot;State of North Carolina,&quot; the study does not accomplish what it claims to accomplish.<br />
<br />
Most people think the study measures the economic impact of Hispanic immigration on the people of North Carolina, but it does not. Some may think it measures the impact in terms of the cost to North Carolina taxpayers, but it does not. Some think it measures the cost to the<br />
state budget, but it does not. If you read the study, it claims to determine the &quot;net cost&quot; while limiting cost to only three items in the state budget, but it doesn't even do that.<br />
<br />
Education<br />
<br />
As a former chairman of the House Education Committee, I was shocked by the education cost numbers in the study. Since the study shows that Hispanic enrollment was 101,380 in 2004,I knew there was no way the cost of educating Hispanic students could be just $466,847,000, the cost used in the study, or less than $5,000 per student, when the average per pupil cost per public school student in North Carolina in 2004 was more than $7,000, excluding construction costs.<br />
<br />
The study stated that Hispanics &quot;are not nearly as well educated as non-Hispanics&quot; and &quot;poverty rates are much higher among Hispanics.&quot;<br />
<br />
These two factors, alone, indicate that Hispanic students would cost more to educate than the state average cost, even ignoring language barriers. Yet the study simply used the percent of Hispanic students in the total K-12 student population applied to what it called the total cost, without recognizing that such an approach clearly understated the cost.<br />
<br />
The study also found that &quot;Hispanic students accounted for 57 percent of the total growth in the North Carolina Public Schools,&quot; yet, there is no way the study's cost numbers could possibly include construction costs, which were close to $1 billion in 2004.<br />
<br />
In frustration, I contacted the study's authors and asked where they found their cost numbers. They directed me to the Post-Legislative Budget Summary 2004-2005, published by the Office of State Budget and Management. Checking the summary revealed that the authors intentionally ignored costs paid by North Carolina taxpayers through federal and local taxes, even though those numbers were readily available in the same chart.<br />
<br />
The study did not include state educational costs attributable to Hispanic students that were not directly reflected in the K-12 budget, such as costs to the community colleges and universities, and the amazing impact of the influx of non-English speaking students who require more resources than English speaking students.<br />
<br />
Those costs were clearly economic impacts affecting the state and the state budget, yet, they were ignored. In other words, the education cost numbers are not even close to the true costs of providing educational services to Hispanic students, and no serious attempt was made to approximate the true cost of providing educational services to Hispanic students.<br />
<br />
That revelation caused me to look more closely at the other two cost numbers, and I found they were just as incredibly understated. As with education, you can look at the state budget and find line items that can be used to arrive at the costs used in the UNC study. But credible researchers<br />
should know that a few random budget numbers do not represent the total cost to the state, or even to the state budget, on the impact illegal Hispanics have on the cost of health care and law enforcement.<br />
<br />
Healthcare<br />
<br />
The health care piece completely ignores the cost shifting that occurs because of the way our country funds health care. Local hospitals are required to treat patients who do not have insurance or the ability to pay, but the state budget does not capture the impact on taxpayers<br />
for the full cost of treating the uninsured. North Carolina even requires counties to pay a portion of Medicaid costs. Once again, the authors ignore the costs paid by North Carolina taxpayers that do not flow through one small part of the state budget, even though the budget item clearly understates “the economic impact of the Hispanic population” on health<br />
<br />
Law Enforcement<br />
<br />
The cost of law enforcement is also understated, since the report acknowledges that the authors simply applied the percentage of Hispanic prisoners in state prisons to the state budget cost for corrections. The percent of Hispanic prisoners in state prisons seriously understates the number of Hispanics who are breaking the law and burdening our courts and law enforcement system. The effect of deportation in reducing the number of criminals who reach the state prisons is a factor, of course, but because of our legal system, it takes time for the rising tide of Hispanic crime to affect the state prisons.<br />

<br />
“COCAINE . . . shipments transported into North Carolina by Mexican organizations are used to supply crack cocaine distribution networks that further present an enormous social threat to North Carolina’s inner city communities. . . .<br />
<br />
“METHAMPHETAMINE . . . Most methamphetamine in North Carolina is imported in multi-pound quantities<br />
from Mexico through the Southwest Border states, but a significant amount also comes from Mexican sources of supply based in Northern Georgia . . .<br />
<br />
“MARIJUANA . . . Mexican trafficking organizations<br />
control most of the wholesale market in foreign-grown<br />
marijuana throughout the state . . .”<br />

As Mecklenburg County Sheriff Jim Pendergraph said: “The average citizen has no idea how much illegal immigrants are costing them in the criminal justice system alone. My jail system is 20percent illegal immigrants and rising quickly, and most of those illegal immigrants are Hispanic.”<br />
Furthermore, while the cost of incarceration is high, we build prisons because the cost of letting criminals roam freely is even higher. Most law enforcement in North Carolina is handled through police departments, sheriff departments and local jails. Once again, these costs are completely ignored by the study. The effect of Hispanic immigration on the drug trade (see <a href="http://www.dea.gov" target="_blank" rel="nofollow">www.dea.gov</a>) and gang membership is also well known, but it wasn’t even mentioned in the study, nor are the traffic accidents and deaths attributable to illegal Hispanic DUI offenders, even though all of these impose negative economic impacts on the state.<br />
<br />
Local Taxes<br />
<br />
Even if some people might think it is acceptable to ignore most of the burdens imposed on North Carolina taxpayers in determining “economic impact,” the study does one thing that is clearly unacceptable in an academic study. While excluding the costs of education, health care and law enforcement paid by the federal government (funded by North Carolina tax-payers) or local governments, the study includes all local taxes paid (directly or indirectly) by Hispanic residents as an offset to state budget costs.<br />
<br />
In other words, even though Mecklenburg County may spend more on education, health care and law enforcement for Hispanics than they produce in local taxes, every dime Hispanics pay in local taxes is assumed to be an offset to the costs identified in the state budget.<br />
<br />
Is logic taught at UNC? The study is guilty of double counting. It is hard to imagine that the study’s authors would make such an obvious error. <br />
<br />
Ignoring obvious and easily obtainable costs is questionable; double counting is completely unacceptable.<br />
<br />
Conclusion<br />
<br />
If there is any question of intent, the inclusion of the motor vehicle use tax without inclu-sion in the study of any transportation costs from the state budget drives the point home. The UNC study was clearly designed to encourage support for Hispanic illegal immigration by ignoring costs and/or overstating benefits.<br />
<br />
Imagine the public’s reaction if, after being repeatedly encouraged to support lifting the moratorium on new hog lagoons based on a study of “The Environmental Impact of Pork Production on the State of North Carolina” by two N.C. State University professors that was funded by the N.C. Bankers Association, the citizens learned that they picked the professors to conduct the “study” and that the “study” had omitted little details like water pollution.<br />
<br />
Would there be an outcry from the public, politicians and the news media on the veracity of the study? Do you think that study would be receiving the attention and accolades the UNC study is receiving? The study that claims to measure “The Economic Impact of the Hispanic Population on the State of North Carolina” does nothing of the sort. Producing such a study cheapens the reputation of the UNC System and damaged the full disclosure of the real impact illegal immigrants are having on North Carolina taxpayers and all levels of government.<br />
<br />
An honest study would have been helpful, but instead, we got a total misrepresentation of the facts.<br />

Americans for Legal Immigration PAC (ALIPAC) played a central role in the defeat of HB 1183 in 2005 which attempted to establish taxpayer subsidized In-State Tuition for illegal aliens in North Carolina and is now warning lawmakers and the public that the measure may be snuck into law this year by past governor Jim Hunt and his legislative allies.<br />
<br />
&quot;We are being told that Jim Hunt and his supporters in Raleigh plan to try to avoid public discourse, on this legislation, by sneaking it into a budget bill or other omnibus legislation,&quot; says William Gheen of ALIPAC.  &quot;Since their above board tactics failed in 2005, they may resort to a sneak play.&quot;<br />
<br />
In 2005, Jim Hunt announced HB 1183 at a press conference, which resulted in extensive media coverage and a massive backlash from the public.  Angry e-mails and phone calls flooded the offices of the General Assembly; ten lawmakers quickly pulled their names from the bill leaving it to die in committee.<br />
<br />
&quot;We know for a fact that over 80% of North Carolina's likely voters oppose this measure,&quot; says Gheen.  &quot;This law replaces many American children in the limited seats in our Universities, with illegal aliens at taxpayer expense!&quot;<br />
<br />
During the debate over HB 1183, Elon University released an erroneous poll claiming more NC citizens supported the measure than opposed it.  Later polls, including one from the Civitas Institute, showed over 80% opposition to the measure.<br />
<br />
Since 2005, the In-State tuition measure has failed in Virginia, Florida, and Georgia as well as in Massachusetts where it failed by a vote of  96-57.<br />
<br />
Of the nine states that have this measure in place, many found the provisions snuck into law, without a chance for public input or debate!<br />
<br />
&quot;We are asking lawmakers, media, and citizens to be diligent for any underhanded attempt to pass in-state tuition for illegals into law, without proper debate,&quot; says William Gheen.  &quot;We are asking the supporters of this measure to do the right thing and follow the legislative process to allow proper debate.&quot;<br />
<br />
During the 2005 debate on this issue, State Senator Neil Hunt discovered that provisions had already been snuck into law, which allows illegal aliens to receive In-State tuition, at NC Community colleges.  His amendment to close this loophole passed the Senate, in the budget bill, by a wide margin.  The amendment was later removed, behind closed doors, by unnamed legislators.<br />

I represent the organization, Americans for Legal Immigration PAC or ALIPAC, found on the web at <a href="http://www.alipac.us" target="_blank">www.alipac.us</a><br />

While we are a national organization and a leader in the fight against illegal immigration in America, I live in Raleigh and North Carolina is where I was born and raised.  <br />
<br />
Many of you are familiar with my prior service to the General Assembly and campaigns.<br />
<br />
ALIPAC is credited with having played a key roll in the defeat of HB 1183 in 2005.  This bill, also known as the In-State Tuition for Illegal Aliens bill, went down in flames after a huge backlash from the public.  It was later proven that over 80% of NC's likely voters rejected this legislation.<br />
<br />
In 2006, we played a key part in the passage of four historic new laws in North Carolina that crack down on illegal immigration by bringing more license security, screening all new state employees for legal presence, cracking down on human smugglers, and empowering local police to enforce immigration law.<br />
<br />
As our NC lawmakers come to realize that over 80% of their constituents want a crackdown on illegal immigration, at the state and local level, then more laws are possible in the 2007 Session.<br />
<br />
We are asking our lawmakers to consider legislation that accomplishes the following.<br />
<br />
1.  NC needs to pass a law similar to the comprehensive enforcement bill of Georgia known as the &quot;Georgia Security and Immigration Compliance Act&quot;<br />
<br />

4.  Provide funding grants for local law enforcement agencies that want to train officers to enforce immigration laws.<br />
<br />
5.  Cut off state taxpayer benefits and welfare for illegal aliens except for immunizations and emergency medical care.<br />
<br />
6.  Add language to our DMV operations to require certification of &quot;Legal Presence&quot; for recipients of driver licenses.<br />
<br />
<br />
The public attitudes show a strong majority of NC Citizens support these measures.<br />
<br />
We stand ready to assist you with the legislative process and will gladly provide you with any information you need on this matter.<br />

I would like to request a correction on your next show, regarding the deceptive and false comments made by Chris Fitzsimon, about my position on illegal immigration and the position of my organization Americans for Legal Immigration PAC (ALIPAC). <br />
<br />
Mr. Fitzsimon has demonstrated on several occasions that he is willing to disregard the truth when describing me or my organization.  He is still very upset with us for defeating HB 1183, the in-state tuition for illegal aliens bill he supported. <br />
<br />
On NCSPIN on Dec. 3, 2006, Fitzsimon erroneously claims &quot;I don't know many people, maybe Bill Gheen, many people who think tomorrow we are going to round up 12 million or 14 million Americans and send them back.&quot;<br />
<br />
I have never made the statement that Americans should be rounded up for any reason.  I have never even advocated that millions of illegal aliens should be &quot;rounded up&quot; and I certainly have never stated that any such plan could be done quickly or &quot;tomorrow&quot;.<br />
<br />
Illegal aliens are not Americans and Mr. Fitzsimon is wrong to describe them as such or malign my character by claiming I would advocate that American citizens be rounded up for any reason.<br />

Mr. Fitzsimon is quite aware that I favor the strengthening of and enforcement of our existing immigration laws and that I feel enforcement would lead to an attrition, in the number of illegal aliens in NC and America, over a period of years. By cracking down on employers, removing taxpayer benefits for illegal aliens, and allowing our local police to enforce immigration law, as Rufus Edminston applauded, we can reduce the illegal alien population through attrition. <br />

Our positions are clearly displayed in the platform area at <a href="http://www.alipac.us" target="_blank">www.alipac.us</a> and in the widely released document &quot;How to Reverse Illegal Immigration in America.&quot;<br />
<br />
NCSPIN viewers and fans deserve to receive accurate information through the show and the show should not be a platform for Mr. Fitzsimons false and misleading attacks on people that disagree with his radical far left positions on illegal immigration.<br />

I watch your show and receive your e-mails as do many of my friends, coworkers, and family members in North Carolina. Chris Fitzsimon heads up a group called NC Policy Watch which is aligned with the pro-illegal alien group El Pueblo. You can often spot Chris moving through the hallways of the NC Legislature with El Pueblo's taxpayer funded lobbyists. <br />
<br />
El Pueblo is an affiliate of the National Council of La Raza (The Race). El Pueblo receives over $400,000 in NC Tax grants each year and then violates their non-profit tax status by using the money to lobby NC lawmakers for more money for El Pueblo and illegal aliens. <br />
<br />
You know you are doing something right when left wing extremists like Chris Fitzsimon are on the attack and exposing themselves to easy criticism by making several false statements in a 45 second broadcast that aired on 101.1 FM in North Carolina. <br />
<br />
Fitzsimon falsely claims that our mainstream, multi-ethnic, and multi-party organization Americans for Legal Immigration PAC is a &quot;Radical Right Wing Group&quot; In his mind, American citizens writing and calling their lawmakers to oppose bills such as HB 1183 &quot;In-state tuition for illegal aliens&quot; is 'Radical&quot; when in fact this legislation is opposed by over 80% of NC's likely voters according to a Civitas Institute Poll. It is Chris Fitzsimon of NC Policy watch that holds the extreme view on this issue. It is also very extreme to pump out four lies in 45 seconds through the NC Media. <br />

Fitzsimon's broadcast contains at least four lies in 45 seconds. <br />

<b>Lie 1.</b> He claims that state house candidate Marge Carpenter, that is running against one of Fitzsimon's liberal Democrat buddies (Democrat Representative Phil Haire), stated illegal aliens were using forged immunization records for their children to enter school. In fact, Marge Carpenter raised this question as one of her many concerns about illegal immigration in NC. Fitzsimon wants listeners to believe Marge Carpenter is issuing unproven statements when in fact she merely raised the question. <br />
<br />
<b>Lie 2.</b> Fitzsimon accuses ALIPAC of being a &quot;Radical Right Wing Group&quot; and while we acknowledge we lean to the conservative side, every plank on the ALIPAC platform is supported by over 80% of the LEGAL American citizenry and we have to have at least two scientific polls to confirm that before it becomes a stance. Over 16% of our supporter base is non-caucasian and 6% of our base is Hispanic. From our forming concepts to our current operations, ALIPAC is representative of the American majority. <br />
<br />
<b>Lie 3.</b> Fitzsimon claims that William Gheen of ALIPAC was unable to produce evidence supporting Marge Carpenter's 'claims&quot;. Since Carpenter raised a question and made no claims and since William Gheen never made any such statements or raised such questions, we are under no onus to provide 'evidence' to radical liberals like Fitzsimon. Not that he even called us or wrote us to ask. Determining or defining the truth was clearly not his objective. <br />
<br />
<b>Lie 4: </b> (The Kicker) William Gheen's response to the Asheville Citizen Times stated that it is a known fact that illegal aliens are engaged in rampant identity theft and documents fraud and they are spreading diseases once vanquished in America. We pointed out that we have never made this claim, but applaud Marge Carpenter for raising the question and making illegal immigration a central campaign issue. Chris Fitzsimon excluded the documents fraud element in our statement knowing full well that there is extensive evidence of this. ALIPAC even supports inoculations and emergency medical care for illegal aliens to help protect our school children from the ravages of 3rd world diseases illegal aliens bring in. Fitzsimon falsely claims that &quot;There is no evidence illegal aliens are spreading diseases.&quot; <br />
<br />
What rock has this pseudo intellectual been hiding under? Along with a copy of this response to Fitzsimon's publicly broadcast lies, we are sending him ten or fifteen sources confirming the fact illegal aliens are spreading diseases in America. It is also common knowledge that LEGAL immigrants must pass medical screenings to immigrate while illegal aliens bypass this process and are bringing in diseases that are common in their impoverished environments. <br />
<br />
It is my personal opinion that Chris Fitzsimon is aware of this problem but is banking on low public awareness of the issue. <br />
<br />
We would like to request that Chris Fitzsimon try to engage in some rendition of the truth in his commentaries, but we feel such a request will fall on deaf ears. Chris Fitzsimon is a mouthpiece for the ultra liberal Democrat status quo in this state. He still holds sour grapes because he was deployed to help pass HB 1183 in 2005 and we smashed him and his bill in the political chops. Chris Fitzsimon proved ineffectual as HB 1183 went down in flames! <br />
<br />
Now he continues to scratch at our eyes, screaming in dismay at our successes. Stop being such a crybaby, Chris! When you get on the air and lie in our state, we are going to point it out when you lie at least four times in 45 seconds in a public broadcast. Our defeat of your terrible bill was just the beginning of our victories over you that you will have to endure. Try to be more of a man about your losses, please. <br />
<br />
Furthermore, after the elections are over, we plan to take a closer look at NC Policy Watch and their supporting organization the A. J. Fletcher Foundation to see if any public tax dollars support these groups. If they do, then what Mr. Fitzsimon has just done could be illegal. It is illegal for tax supported groups to try and affect the outcome of elections and races for public office. <br />
<br />
When your opposition starts screaming and resorting to desperate tactics that fully expose their willingness to lie like Chris Fitzsimon has, then you know you are doing well. We will make sure that any stations broadcasting the comments of this left wing extremist are made aware of his agenda and false and derogatory comments. We will also make sure that lawmakers are aware of the fact they cannot trust information sent to them by Chris Fitzsimon or NC Policy Watch as they are proven liars and propagandists. <br />

Chris Fitzsimon has damaged his credibility with lawmakers, the NC Media, and the public by resorting to such desperate and deceptive tactics. Keep it up Chris, pretty soon you will not even be allowed on the air or quoted in articles, as more people learn how you are prone to lying. <br />

Those that espouse the truth have great advantage over those that depend of falsehoods to support their opinions. May good triumph over evil and may the truth prevail over liars like Chris Fitzsimon of NC Policy Watch. <br />

Over 50 Republican Campaigns for NC House and Senate have made fighting illegal immigration a central issue in their campaigns this year promising to oppose in-state tuition for illegal aliens, cut off driver licenses and all taxpayer benefits for illegal aliens.<br />

&quot;NC Democrats are responsible for making our state the top destination in America for illegal aliens,&quot; said William Gheen of ALIPAC. &quot;State Republicans see this as a strong wedge issue that can remove incumbent Democrats from office.&quot; <br />

The Pew Hispanic Center has indicated NC has one of the fastest growing populations of illegal aliens in America with close to 500,000 illegal aliens recently entering the state.  The Kenan Institute reports that wages in NC have been depressed by over 2 billion dollars.  <br />

&quot;If Republicans make gains in Raleigh this year, illegal aliens will be fleeing our state in 2007 like they are fleeing Georgia and Pennsylvania in 2006 due to new state laws,&quot; says William Gheen. &quot;If the Democrats retain control, the battle will be to stop them from giving more taxpayer resources to the illegal aliens.&quot;<br />

Republicans are using radio ads, TV ads, direct mail, and phone banks to reach voters with their immigration stances in the final days of the campaigns.  Democrats are mostly ignoring the issue or playing defense.  Special efforts have been launched to warn the public about the Democrat lawmakers that sponsored HB 1883 &quot;Instate tuition for illegal aliens&quot; which was one of the top news stories in 2005. The North Carolina Republican Senate Caucus today issued the North Carolina First plan at a press conference led by Senate Republican Leader Phil Berger (R-District 26). The plan outlines priority legislation Republican Senators will introduce in the upcoming session. <br />
<br />
Senator Berger made the following statement regarding the N.C. First plan:<br />
<br />
“In recent years, Democrat leadership has given North Carolina annual billion dollar tax increases, a floundering public school system, plant closings and job losses, ever higher health care costs, and disgraceful scandals. For many years, the Senate Republicans have seen the need for legislation addressing the issues in the North Carolina First plan. Repeatedly, the Democrat majority has blocked those initiatives and referred Republican bills to committees that never meet. <br />
<br />
“The 21 members of the Republican Senate Caucus are committed to making North Carolina a better place to live, work, and raise our families. We strongly believe that by implementing the North Carolina First plan, our state will return to its rightful status as the leader and First State in the southeast.”<br />

North Carolina First<br />

Republican Senators will introduce legislation, and a Republican Senate Majority will bring <br />
to a vote in the 2007 Session, bills to:<br />
<br />
1. Restore citizens’ faith in State Government that recent Democrat scandals have undermined.<br />
• A Constitutional Amendment limiting the duration of legislative sessions <br />
• Provide term limits for the office of President Pro Tempore of the Senate and Speaker of the House of Representatives<br />
• Require disclosure and regulation of politician's legal defense funds<br />
• Prohibit lobbyists' soliciting campaign contributions<br />
<br />
<b>2. End North Carolina’s status as a safe-haven for illegal immigrants.<br />
• Make English the official language of government business in North Carolina<br />
• End in-state tuition for illegal immigrants at North Carolina Community Colleges<br />
• Stop welfare and entitlement benefits for illegal immigrants<br />
• Stop illegal immigrants from receiving or renewing North Carolina Driver’s licenses<br />
• Require a valid photo ID be shown when voting</b><br />
3. Improve Education.<br />
• Use national tests to evaluate student performance <br />
• Create a merit pay program for effective teachers <br />
• Remove violent and disrespectful students from classrooms and empower classroom teachers to deal with problem students<br />
• Lift the cap on public charter schools<br />
• Strengthen vocational education<br />

4. Reduce North Carolina's tax burden.<br />
• Reduce and effectively cap the gasoline tax<br />
• Eliminate North Carolina’s “Death Tax”<br />
• Eliminate the temporary sales and income taxes<br />

5. Prioritize spending, eliminate waste, and make government more efficient.<br />
• Require Zero-Based Budgeting<br />
• Establish a Taxpayer Protection Act for North Carolinians<br />
• End the raids from the Highway Trust Fund<br />
<br />
6. Amend North Carolina's Constitution to define marriage as being between one man and one <br />
woman.<br />

7. Enact meaningful medical malpractice reforms. <br />

8. Increase the availability and affordability of healthcare and healthcare insurance.<br />
• Reinstate the child healthcare tax credit repealed by the Democrats in 2002<br />

9. Amend North Carolina’s Constitution to protect private property from being taken for economic <br />

• Increase active sentences for gang related crimes<br />
• Require every person charged with a felony to provide a DNA sample for the State’s DNA database<br />

non partisan way, it has become clear where the problem is in Raleigh.<br />
Time is running out for significant action addressing our illegal<br />

Our main goal is to get legislation passed to secure NC Licenses, secure<br />
our voter registration, protect taxpayer funds, and protect lives in NC<br />
from illegal aliens.  Our secondary goal has been to illustrate for the<br />
public who is their ally and who is their opposition on this issue since<br />
we know over 80% of the voters want state immigration enforcement action.<br />

The NC Democrats have been clearly exposed for aiding and abetting illegal<br />
aliens in this state.  Despite efforts on the county and city level in NC<br />
and despite 30 states passing immigration enforcement legislation, the<br />
Democrats want to cling to the weak &quot;It's a Federal issue!&quot; defense.<br />

Cities, Counties, grieving families, and members of Congress are all springing in to action.  Many state lawmakers have responded too, but Jim Black and Marc Basnight are blocking their bills from even being discussed.<br />
<br />
Do Jim Black and Marc Basnight really think they can prevent the NC Legislature from fully addressing this issue this year by burying bills in committee?  It would seem so at the moment.<br />
<br />
We hope that Jim and Marc will take a few moments to look closely at the pictures of some of the victims.  There will be many more over the next year if NC Lawmaker's leave Raleigh without cracking down on illegal immigration issues.<br />

William Gheen of Americans for Legal Immigration PAC (ALIPAC) will file as a North Carolina lobbyist on Thursday of this week so he may work with the North Carolina General Assembly to pass immigration enforcement legislation during the short session.<br />
<br />
Since he holds a paid position with a Political Action Committee, Gheen will register with the NC Secretary of State's office.  His goals are to help organize public support for legislation and assist lawmakers as they address North Carolina's illegal immigration crisis.<br />
<br />
&quot;Our state is already a top destination for illegal aliens in America,&quot; says Gheen.  &quot;With Tennessee, Virginia, and Georgia cracking down on a state level we are now faced with an even greater influx of illegal aliens.  North Carolina must act now to stop our state from turning into a Disaster Area.&quot;<br />
<br />
William Gheen's legislative efforts will encourage lawmakers to pass a bill like Georgia's Security and Immigration Compliance Act which passed by large margins and was supported by over 80% of Georgia's voters.  Senator Robert Pittenger has filed this bill in NC.<br />
<br />
Lobbying priorities will be to secure North Carolina's licenses to prevent illegal aliens from obtaining them, to cut off taxpayer benefits to illegal aliens, to empower and fund local police to enforce immigration laws, and to crack down on employers that hire illegal aliens.  Each of these measures has the support of over 4 out of 5 NC voters and has passed in other states, yet the General Assembly has yet to act.<br />
<br />
&quot;Our goal will be to get the House and the Senate working in bi-partisan fashion to pass these measures.&quot; says Gheen.  &quot;We must put the welfare of our citizens first.  If the General Assembly waits another year to pass immigration enforcement legislation, we will have another 100,000 illegals in our state by then, further exacerbating an already enormous problem.&quot;&quot;<br />

Gheen also plans to bring a large group of NC Citizens to the Legislature to lobby for this legislation in May and to bring lawmakers and activists from Georgia and Virginia to speak with NC lawmakers about this legislation.  Gheen played a key role in the defeat of the HB 1183 &quot;In-State Tuition for illegal aliens&quot; bill in 2005.<br />

I want to know who told the &quot;Supervisor&quot; to accept &quot;Fake ID`s&quot; and to &quot;Talk Down&quot; employes who catch and &quot;Illegal Alien&quot; useing a &quot;Fake ID&quot;.<br />
I didn`t mention any names for fear of the Clerks being fired.<br />

	Immigration reform in North Carolina is down to 1 bill that is still alive after the Democratic leadership in the Senate and House killed all other bills without a vote.<br />
<br />
            HB 1474 can still pass this year because it has received a fiscal note showing some financial impact which means it is not subject to the Crossover Deadline.  All other immigration reform bills were stymied by the Democratic leadership and not even allowed to be debated in committee.  Representative Earl called for the fiscal note with the backing of Rep. Culpepper derailing the bill before the deadline.<br />
<br />
	Ã¢â‚¬Å“The Democratic leadership would not let bills that would secure our licenses, our state budget, our voter files, or even our citizens safety from illegal aliens be discussed at all.Ã¢â‚¬? Says William Gheen.  Ã¢â‚¬Å“The leadership knows that many Democrats would join with Republicans to make these bills law so they are supporting illegal aliens by inaction and procedural tricks.Ã¢â‚¬?<br />
<br />
	All immigration reform bills were suppressed except for HB 1474 which passed in the House Judiciary 3 Committee with unanimous bi-partisan support.  HB 1474 is now the only hope for any action on illegal immigration in North Carolina this year.  HB 1474 has enough support to pass the NC House.  The Democratic leadership will not allow this bill to come to the floor without massive public outcry.<br />
<br />
    	Ã¢â‚¬Å“By the latest estimates, there will be at least another 50,000 illegal aliens in North Carolina by this time next year,Ã¢â‚¬? says Gheen.  Ã¢â‚¬Å“The public needs to put the pressure on the Democratic leadership in the House and the Senate to pass HB 1474.   NC Tax Benefits should not go to illegals.  That money is for NC Residents.Ã¢â‚¬?<br />
<br />
	ALIPAC is encouraging the public to tell legislators not to block the only bill that would address illegal immigration this year.  The public is encouraged to say Ã¢â‚¬Å“DonÃ¢â‚¬â„¢t come home from Raleigh without addressing this issue.  William Gheen will be returning to his position as Senator Hugh WebsterÃ¢â‚¬â„¢s Legislative Assistant after a two month temporarily leave of absence to defeat HB 1183.  It is up to the public now to demand reform.<br />

This bill would restrict all state taxpayer benefits and welfare from illegal aliens 19 years and older except for emergency care and k-12 schools which are federally mandated.<br />
<br />
The bill requires applicants for public assistance to prove their US citizenship or legal presence in the US.  Or they can sign an affidavit that gives them 90 days to prove it while they receive benefits.  If they sign the affidavit but fail to show &quot;legal presence&quot; the NC Attorney General turns their names over to Immigration and Customs Enforcement ICE.<br />
<br />
This bill was passed by large margins in VA and has passed the NC House Judiciary 3 Committee unanimously with bi-partisan support.  It is similar to Arizona's Prop. 200 minus the citizenship requirement for registering to vote.<br />

			<content:encoded><![CDATA[<div>Nobody knew that a provision had already been slipped into the law that would allow illegal aliens to receive in-state tuition at NC Community Colleges.<br />

The word got out when Forsyth Community College said they would admit illegals at out of state rates and then Sen. Hunt put Amend. 3 into the Senate Budget.<br />
<br />
Now the state knows where Forsyth was headed eventually.  Illegal aliens in community college at in-state tuition rates.<br />
<br />
Amend 3. may get pulled from the budget on the house side if we do not protect it.  We must protect it by making members of the NC House aware of the provision and asking them to keep it in the budget bill.<br />
<br />
Amendment 3 adds the language Ã¢â‚¬Å“who is lawfully present in the United StatesÃ¢â‚¬? &amp; Ã¢â‚¬Å“who remains lawfully within the United StatesÃ¢â‚¬? the General Statutes regarding Community College tuition rates (Section 8.13. G.S. 115D-39) <br />

Many of you are aware of a project ALIPAC is conducting in North Carolina called the &quot;Battle for NC&quot;.  While we continue our national operations and continue to gather funds for Congressional candidates in 2006, we launched this campaign to defeat a state bill.<br />
<br />
HB 1183 &quot;In-State Tuition for illegal aliens&quot; is now a political dead duck thanks to the efforts of ALIPAC, the public outcry, and the good people in talk radio.<br />
<br />
Today we are releasing exciting information.  We are going on offense now to push for immigration reform measures in NC.  Our next effort is called &quot;Support Amendment 3&quot;  Please read today's press release and you can write me at <a href="mailto:WilliamG@alipac.us">WilliamG@alipac.us</a> if you want to enjoin the &quot;Battle for NC&quot; effort.<br />
<br />
Please circulate the following information to others.  Our activists plan to carry this information to other states where they are fighting similiar bills.<br />
<br />
1.  You need groups and individuals that are willing to organize the public, speak with the press, and visit lawmakers directly.<br />
<br />
2.  Talk radio news format shows are the best way to reach the public.  The hosts of these shows either know or will quickly realize what a hot button topic this is with the public.<br />
<br />
3.  The public needs help to organize a campaign of letters, faxes, e-mails, and most importantly calls to legislators.  Those organizing such efforts should keep track of who supports or opposes the legislation for the effort and for the next election cycle.<br />
<br />
4.  Utilize the polls.  Online polls and national polls on immigration issues illustrate that over 80% of the public does not support measures like in-state tuition for illegal aliens.  The supporters of such bills can generate bogus polls, so rely on the other more accurate polls to illustrate what we know to be fact.<br />
<br />
5.  Stay focused on the messages.  Here are the messages that worked in NC.<br />
<br />
--&quot;In-state tuition for illegal aliens will replace legal American citizens in the limited classroom seats in college.  Everyone knows that colleges turn people away each year.  For each illegal alien in college, that's one American that isn't.&quot;<br />
<br />
--&quot;In-state tuition for illegals will serve as a magnet and attract more illegal aliens to a state.  No lawmakers supporting law-breakers&quot;<br />
<br />
But it's for the children of illegal aliens they say!<br />
<br />
--&quot;The responsibility for the children of illegal aliens is with their parents that decided to break our laws, not with the taxpayers of our state.  In-state tution is taxpayer subsidized&quot;  (Find out how much your state pays in tax dollars per-in state student)<br />
<br />
--&quot;In-state tuition for illegal aliens violates a 96 Federal law which states you have to offer all Americans in-state tuition if you want to offer it to illegal aliens.  These laws are under court challenge in Kansas.&quot;  (You may want to tell lawmakers and the press in your state you will file a court challenge)<br />

	North CarolinianÃ¢â‚¬â„¢s recently discovered that illegal aliens could attend their community colleges at tax subsidized in-state tuition rates after only being in the country 12 months when Forsyth Community college made national news that they were going to admit illegals at in-state tuition rates.  An amendment placed in the state budget by Senator Neil Hunt (R-Wake) last Thursday would close that loophole and secure in-state tuition access to only those Ã¢â‚¬Å“legally presentÃ¢â‚¬?.<br />
<br />
	Senator Tony Rand called a recess when Amendment 3 was submitted by Senator Hunt.  After the recess the Senate voted UNANIMOUSLY to include this provision in the budget bill which has now passed the Senate and is headed for the House.<br />
<br />
	Ã¢â‚¬Å“We need to make sure that only North Carolina Citizens qualify for in-state tuition.  ItÃ¢â‚¬â„¢s kind of a Ã¢â‚¬ËœNo-BrainerÃ¢â‚¬â„¢Ã¢â‚¬?, says Senator Hunt.<br />

Although the amendment has the support of the entire Senate, pro-illegal alien legislators may try to remove the language in the House.<br />

	Representative Marian McLawhorn, a chair of the committee HB 1183 has been referred to, has pulled her name from the bill which has now lost 10 of its original sponsors.  Rep. Sauls, a remaining primary sponsor of the bill says Ã¢â‚¬Å“I donÃ¢â‚¬â„¢t think it will passÃ¢â‚¬? (Dunn Daily Record) <br />

	In a desperate attempt to save HB 1183 from the 9 out of 10 North Carolinians that think providing incentives like tuition grants to illegal aliens is a bad idea.  Elon University has released a Ã¢â‚¬Å“Push PollÃ¢â‚¬? that shows 49% of North Carolinians support this bill. (wink, wink)<br />
<br />
	The Winston Salem Journal reports Ã¢â‚¬Å“In asking respondents about the bill, the poll informed them that the bill would require students to have attended a North Carolina high school for at least four years and applied for legal immigration status.Ã¢â‚¬?When you lay it out like that, we get a fairly positive response from people who support this idea,&quot; said Tim Vercellotti, the assistant professor of political science at Elon who directs the poll.  (The Winston Salem Journal did not report how many ways Mr. Vercellotti configured the poll before getting the results he desired.)<br />
<br />
When originally contact about this poll by the Winston Salem Journal, William Gheen had to recover from fit of laughter before replying Ã¢â‚¬Å“That's either incorrect or a big lieÃ¢â‚¬?<br />
<br />
Upon closer examination we can now clearly see that Elon conducted a Push Poll which is a common technique used by political campaigns.  Respondents are asked poll questions after a series of positive or negative statements about the subject to see how they can Ã¢â‚¬Å“pushÃ¢â‚¬? the numbers.  Mr. Vercellotti acknowledges that you get a Ã¢â‚¬Å“fairly positiveÃ¢â‚¬? response when you Ã¢â‚¬Å“lay it out like thatÃ¢â‚¬? <br />

After a review of Mr. VercellottiÃ¢â‚¬â„¢s comments; William Gheen had this to say.<br />
<br />
Ã¢â‚¬Å“One has to wonder why Elon University is using political campaign techniques in their poll.  HB 1183 sounds like a great idea as long as you do not weigh the opposing views before making a decision.  HB 1183 is a great bill on the surface until you actually think about it.  HB 1183 sounds like a great bill as long as you only hear one side of the story.Ã¢â‚¬?<br />

<b>Students will pay price for illegal immigrants</b><br />
<br />
A recent opinion piece, Ã¢â‚¬Å“Tuition policy limits future for undocumented immigrantsÃ¢â‚¬? discusses the issue of giving in-state tuition to illegal immigrant students and hints that it might be a dream come true for some. <br />
<br />
Giving in-state tuition to illegal immigrants will become a bad dream for legal residents in North Carolina. First of all, giving privileges to those who have come illegally to America becomes a reward for having broken the law. It will encourage more illegal immigration. <br />
<br />
There happens to be more qualified students in North Carolina than there are openings in our state universities. Therefore, every illegal immigrant allowed into the universities with in-state tuition will victimize one (legal resident) North Carolina student. <br />
<br />
We are told by illegal-immigrant advocacy groups that the dependent of an illegal immigrant should not be punished for what their parent has done. But if illegals are allowed to attend our universities, North Carolinians will be made to pay the price of illegal immigration. Already illegals are allowed to attend our state universities as out-of-state students. Each one will disenfranchise an American student. <br />
<br />
What must be going on in the minds of the tens of millions of would-be immigrants who are waiting patiently in line to legally come to America? They arenÃ¢â‚¬â„¢t even able to attend as out-of-state students. They must feel like a chump for playing by the rules. <br />
<br />
There are a lot of issues we can honestly debate, such as how much money to spend on schools or how to fix Medicare. But we certainly shouldnÃ¢â‚¬â„¢t be discussing how to better reward illegal immigrants at the expense of North Carolinians.<br />

	Americans for Legal Immigration PAC (ALIPAC) will host a series of town meetings across North Carolina to provide information and address public concerns about illegal immigration and the Ã¢â‚¬ËœIn-State Tuition for illegal aliensÃ¢â‚¬? bill.<br />

	The meetings will be to raise awareness and to assist people that want to join the lobbying bill.  The culmination of these events will be on May 17th when concerned citizens will go to Raleigh to lobby lawmakers on Ã¢â‚¬Å“Immigration Reform Day at the Legislature.Ã¢â‚¬?  Several elected officials, national leaders, and speakers will be attending.<br />
<br />
	The supporters of HB 1183 represent a small minority since multiple polls are showing that 90% of the public is opposed to this bill. Elected officials, concerned citizens, and community activists will be attending the meetings.  The meetings are open to all that want to learn more about what they can do to oppose illegal immigration.  Democrats, Republicans, and Unaffiliated voters are working with Black, White, Latino, Asian, and Native American citizens to promote the meetings.<br />

An Open Letter to El Pueblo &amp; Ms. Bazan-Manson: <br />
<br />
I am writing you today to ask that you please stop trying to falsely label me, Americans for Legal Immigration PAC (ALIPAC), and 9 out of 10 LEGAL North Carolinians as hateful racists because we donÃ¢â‚¬â„¢t think giving illegal aliens in-state tuition is a good idea. Almost every time someone brings up the issue of illegal immigration or opposes your desire to establish even more benefits for illegal aliens you make the wildest claims. <br />
<br />
Read the latest headlines about illegal immigration. <br />
<br />
Now you and some of the supporters of HB 1183 are trying to say that the many law abiding legal citizens that are calling Representatives to complain about their support for this ridiculous bill are a small minority of hate filled racists! You are holding up a few angry e-mails that you received and falsely claiming that these angry e-mails are representative of the opposition to HB 1183. <br />
<br />
Why is it that you and some supporters of HB 1183 are spending all of this time and energy calling other people names and making false accusations and associations instead of debating the merits of your bill? <br />
<br />
Ms. Bazan-Manson, the people calling Representatives and asking them not to vote for HB 1183 may be angry or shocked, but they represent close to 90% of the LEGAL citizens of this state. They are also exercising their civic rights in an appropriate way. It is you and your organization that represents the political minority on this issue Ms. Bazan-Manson. <br />
<br />
I know it must be upsetting for you to hear the concerned citizens of North Carolina calling all of the NC talk radio shows and Rush Limbaugh holding your bill up as an example of legislative insanity. I can imagine your dismay at the news that 9 lawmakers have pulled their names from the bill. The online polls showing 90% of North Carolinians oppose your plan must be discouraging as well, but please Ms. Bazan-Manson donÃ¢â‚¬â„¢t try to label many good people that care about our state and nation as bad people. <br />
<br />
In my opinion, you are trying to play the race card because you are losing this debate on the bill. It is a desperate and last ditch attempt to save a bill that should have never been filed. Many North Carolinians are angry that we are even debating this legislation in the first place. I know that you are disappointed at the public reaction to your bill, but please do not try to claim that good people of North Carolina that fund your organization with close to $400,000 of tax grants each year are a bunch of mean spirited redneck racists that write nasty notes. That dog won't hunt! <br />
<br />
Our organization has members that are Black, White, Hispanic, Asian, and Native American. We have members that are Republicans, Democrats, Unaffiliated and 3rd party voters. We do not support or tolerate racism or aggressive behavior and we do support those that follow our laws and legally immigrate. <br />
<br />
ALIPAC has encouraged people to keep the high ground on every level of this debate and I encourage you to show some dignity and leadership to do the same with El Pueblo and those that support HB 1183. <br />

	Although online polls should not be considered fully accurate or scientific, they do give us some indication of public attitudes.  Three current online polls in NC show that at least 90% of North Carolinians oppose In-State Tuition for Illegal Aliens.  How could some politicians and newspaper editorialists be so off base with public opinion?<br />

	The supporters of HB 1183 point to the fact that similar legislation has passed in 9 other states as an indication of support.  Americans for Legal Immigration PAC has learned that HB 1183 may violate federal law and there is an active court case filed against such legislation in Kansas OH.  The lawsuit has been filed by Chris Kobach and FAIR (Federation of Americans for Immigration Reform)<br />

England joins Representatives Coleman, Wilson, Pate, Ray, Yongue, Rapp, and Tolson on the list for a total of eight lawmakers that have removed their names.  Representative Tolson is still listed as a sponsor but has made public comments to the media about his intention to withdraw his name.<br />

A BILL TO BE ENTITLED<br />
<br />
AN ACT to enaCt the north carolina taxpayer and citiZen protection act, to require proof of citizenship to regIster to vote, and to provide that to receive certain public benefits, an applicant for public assistance program benefits must provide proof that the applicant is a united states citizen or, if not a united states citizen, is lawfully present in the united states under federal law; to provide for temporary benefits to be paid in cases where the applicant cannot provide proof at the time of application; to require certain state agencies to cooperate with local governments and the united states department of homeland security to develop a system for verifying lawful presence in the united states; to provide that a person who willfully employs an individual who is indigent and is not lawfully present in the united states shall be responsible for the cost of medically necessary services to the individual employed; and to authorize any individual to file a complaint with the affected state agency for its failure to comply with this act.<br />
<br />
The General Assembly of North Carolina enacts:<br />
<br />
SECTION 1.  Short title. This act may be cited as the &quot;North Carolina Taxpayer and Citizen Protection Act&quot;.<br />
<br />
SECTION 2.  Findings and declaration. This State finds that illegal immigration is causing economic hardship and lawlessness in this State and that illegal immigration is encouraged by public agencies within this State that provide public benefits without verifying immigration status. This State further finds that illegal immigrants have been harbored and sheltered in this State and encouraged and induced to reside in this State through the issuance of identification cards that are issued without verifying immigration status, and that these practices impede and obstruct federal immigration law, undermine the security of our borders, and impermissibly restrict the privileges and immunities of the citizens of North Carolina. Therefore, the people of this State declare that it is a compelling public interest of this State to discourage illegal immigration by requiring all public agencies within this State to cooperate with federal immigration authorities.<br />
<br />
SECTION 3.  G.S. 163Ã¢â‚¬â€˜82.4(a) is amended by adding a new subdivision to read:<br />
<br />
&quot;(11)   A statement that the applicant shall submit evidence of United States citizenship with the application and that the application shall be rejected if no evidence of citizenship is attached.&quot;<br />
<br />
SECTION 4.  Article 7A of Chapter 163 of the General Statutes is amended by adding a new section to read:<br />
<br />
&quot;Ã‚Â§ 163Ã¢â‚¬â€˜82.6A.  Proof of citizenship.<br />
<br />
(a)       A county board of elections shall reject any application for registration that is not accompanied by satisfactory evidence of United States citizenship.<br />
<br />
(b)       A county board of elections shall, within 180 days of the effective date of this Act, compile and publish a list of approved documents, or a combination of approved documents, that establish satisfactory evidence of United States citizenship. <br />
<br />
(1)       The board of elections may, at least 180 days prior to the date of a general election, amend the list of approved documents. <br />
<br />
(2)       In compiling or amending the list of approved documents, the board of elections shall give due consideration to facilitating voter registration by all citizens as well as the deterrence and prevention of fraudulent registration by unauthorized persons, and shall provide an opportunity for submission of public comments by interested citizens.<br />
<br />
(3)       The Board of Elections shall ensure that the list of approved documents conforms to all relevant federal and State laws protecting the voting rights of United States citizens.<br />
<br />
(c)       Notwithstanding subsection (a) of this section, any person who is registered in this State on the effective date of this section is deemed to have provided satisfactory evidence of citizenship and shall not be required to resubmit evidence of citizenship unless the person is registering in another county.<br />
<br />
(d)       For the purposes of this section, proof of voter registration from another state or county is not satisfactory evidence of citizenship.<br />
<br />
(e)       After a person has submitted satisfactory evidence of citizenship, the board of elections shall indicate this information in the person's permanent voter file. After two years, the board of elections may destroy all documents that were submitted as evidence of citizenship.&quot;<br />
<br />
SECTION 2.  Article 2 of Chapter 108A of the General Statutes is amended by adding the following new section to read:<br />
<br />
&quot;Ã‚Â§ 108AÃ¢â‚¬â€˜25.4.  Proof of lawful presence required for State and local programs of public assistance; temporary assistance; system for verifying lawful presence; exceptions to application of this section; employer liable for medical services to indigent employees not lawfully present.<br />
<br />
(a)       At the time of application for public assistance program benefits or for an identification document issued by the State or political subdivision of the State, an applicant shall provide affirmative proof that the applicant is a citizen of the United States or is lawfully present in the United States under federal immigration law. The affirmative proof shall consist of any valid document or combination of valid documents recognized by the Division of Motor Vehicles under G.S. 20Ã¢â‚¬â€˜7(b3). The State or local government agency responsible for administering a program of public assistance shall not provide public assistance program benefits to an applicant unless or until the applicant has met the requirements of this section. A State or local government agency administering public assistance benefits shall not accept an identification card issued by a State or local government agency, including a drivers license, to establish identity or determine eligibility of public assistance benefits unless the State or local government agency that issued the card has verified the immigration status of the applicant.<br />
<br />
(1)       An applicant who cannot provide the proof required under this subsection at the time of application may alternatively sign an affidavit under oath, attesting to either United States citizenship or to classification by the United States as an alien lawfully admitted for permanent residence, in order to receive temporary benefits or a temporary identification document as provided in this section. The affidavit shall be on or consistent with forms prepared by the State or local government agency administering the public assistance benefits program, and shall include the applicant's social security number and an explanation of the penalties under State law for fraudulently obtaining public assistance benefits. An applicant that knowingly provides false information on the affidavit or application for public assistance benefits is subject to criminal penalties applicable in this State for fraudulently obtaining public assistance program benefits. An applicant who has provided the sworn affidavit required by this subdivision is eligible to receive temporary public assistance program benefits as follows:<br />
<br />
a.         For 90 days or until such time that it is determined that the applicant is not lawfully present in the United States, whichever is earlier;<br />
<br />
b.         Indefinitely if the applicant provides a copy of a completed application for a North Carolina birth certificate that is pending in accordance with Article 4 of Chapter 130A of the General Statutes, or a substantially similar law of another state. An extension granted under this subÃ¢â‚¬â€˜subdivision shall terminate upon the applicant's receipt of a birth certificate or a determination that a birth certificate does not exist because the applicant is not a United States citizen;<br />
<br />
c.         An applicant who has provided the sworn affidavit in accordance with this section is eligible to receive a temporary identification document for either 30 days or until such time that it is determined that the applicant is not lawfully present in the United States, whichever is earlier; or<br />
<br />
d.         A State or local government agency shall report in writing to the Attorney General of this State, and to a federal immigration law enforcement office designated by the Attorney General of this State, an applicant or beneficiary described in this section that fails to verify the applicant's or beneficiary's own legal presence in the United States. An employee of a State or local government agency who knowingly and willfully fails to report violations of federal immigration law is guilty of a Class 2 misdemeanor. A supervisor of an employee who knows of the employee's failure to report and fails to direct the employee to make the report is guilty of a Class 2 misdemeanor.<br />
<br />
(b)       This section does not apply to State or local public assistance program benefits that are excepted from verification of eligibility under federal law.<br />
<br />
(c)       The definition of &quot;State or local public benefit&quot; under 8 U.S.C. Ã‚Â§ 1621(c) shall apply to programs of public assistance under G.S. 108AÃ¢â‚¬â€˜25. The definition shall exclude any State and local public benefit excepted from verification of eligibility under 8 U.S.C.A. Ã‚Â§ 1621(b), including services necessary for the treatment of an emergency medical condition. <br />
<br />
(d)       This section shall be enforced without regard to race, religion, gender, ethnicity, or national origin. <br />
<br />
(e)       Any person who believes that a State or local government agency has failed to comply with this section in the administration of public assistance program benefits may file a complaint in writing with the State or local government agency charged with administering the program.<br />
<br />
(1)       The State or local government agency shall provide a written response within 60 days of receipt of the complaint, or within 30 days if the complaint alleges erroneous determination that the person is not lawfully present in the United States.<br />
<br />
(2)       A person with reasonable cause to believe that a State or local government agency has failed to cease an act or practice in violation of this section may, within 75 days after receipt of the agency's written response to the person's complaint made pursuant to subdivision (1) of this subsection, institute a proceeding for injunction or mandamus to remedy the violation giving rise to the complaint.&quot;<br />
<br />
SECTION 3.  G.S. 108AÃ¢â‚¬â€˜70 reads as rewritten:<br />
<br />
&quot;Ã‚Â§ 108AÃ¢â‚¬â€˜70.  Recoupment of amounts spent on medical care.<br />
<br />
(a)       The Department may garnish the wages, salary, or other employment income of, and the Secretary of Revenue shall withhold amounts from State tax refunds to, any person who:<br />
<br />
(1)       Is required by court or administrative order to provide health benefit plan coverage for the cost of health care services to a child eligible for medical assistance under Medicaid; and<br />
<br />
(2)       Has received payment from a third party for the costs of such services; but<br />
<br />
(3)       Has not used such payments to reimburse, as appropriate, either the other parent or guardian of the child or the provider of the services;<br />
<br />
to the extent necessary to reimburse the Department for expenditures for such costs under this Part; provided, however, claims for current and past due child support shall take priority over any such claims for the costs of such services.<br />
<br />
(a1)     Any person who knowingly and willfully employs a nonÃ¢â‚¬â€˜United States citizen who otherwise is not a resident of the State, shall be responsible for the cost of providing medically necessary services for those persons or members of the household who are medically indigent, if the medical condition leading to medically necessary services arises during the course of employment. A cause of action for reimbursement plus costs and attorneys' fees shall accrue against an employer of the medically indigent person to the State for services provided under the State Medical Assistance Plan, and to any county or health care provider that provides health care services to the indigent person. A person who, in good faith, relies on documentation establishing employment authorization in the United States, where the document appears to be authentic on its face, is not subject to this subsection.<br />
<br />
(b)       To the extent that payment for covered services has been made under G.S. 108AÃ¢â‚¬â€˜55 for health care items or services furnished to an individual, in any case where a third party has a legal liability to make payments, the Department of Health and Human Services is considered to have acquired the rights of the individual to payment by any other party for those health care items or services.&quot;<br />
<br />
SECTION 4.  G.S. 108AÃ¢â‚¬â€˜24(6) reads as rewritten:<br />
<br />
&quot;Ã‚Â§ 108AÃ¢â‚¬â€˜24.  Definitions.<br />
<br />
As used in Chapter 108A:<br />
<br />
Ã¢â‚¬Â¦<br />
<br />
(6)       &quot;Resident,&quot; unless otherwise defined by federal regulation, is a person who is living in North Carolina at the time of application with the intent to remain permanently or for an indefinite period; or who is a person who enters North Carolina seeking employment or with a job commitment. For purposes of G.S. 108AÃ¢â‚¬â€˜25.4 and G.S. 108AÃ¢â‚¬â€˜70, a person is not a resident of this State if the person is determined ineligible for public assistance benefits under G.S. 108AÃ¢â‚¬â€˜25.4.&quot; <br />
<br />
SECTION 5.  All State agencies administering programs of public assistance in this State shall cooperate with local governments and the United States Department of Homeland Security to develop a system to facilitate verification of an individual's lawful presence in the United States in furtherance of this act.  The system developed may include all or part of the Systematic Alien Verification Entitlements Program operated by the United States Department of Homeland Security.<br />
<br />
SECTION 6.  Section 1 of this act is effective with respect to voters registering on or after January 1, 2005. The remainder of this act becomes effective January 1, 2006, and applies to applications for public assistance programs submitted on and after that date.</div>

	At least four NC Representatives have pulled their names off of HB 1183 as co-sponsors and there are reports that others plan to or have already done so!<br />
<br />
        Ã¢â‚¬Å“We are racing to determine which legislators plan to remove their names.  We have confirmed that Representatives Wilson, Pate, Tolson and Coleman have already dropped their sponsorship of the BillÃ¢â‚¬? says William Gheen (President of ALIPAC).  Ã¢â‚¬Å“Several lawmakers have told me that they were not accurately informed about the repercussions of the Bill.  They did not realize that this legislation would cost thousands of legal Americans their seats in college at taxpayer expense.Ã¢â‚¬?<br />
<br />
Americans for Legal Immigration PAC has launched a lobbying campaign with many concerned citizens to block HB 1183.  There are finite numbers of seats in the UNC College System and each seat taken by an illegal alien would replace one legal citizen.  UNC colleges turn away thousands of applicants each year. North Carolina families have paid into the UNC system for over 100 years to build these institutions.<br />

Ã¢â‚¬Å“We are encouraged by these developments and will intensify our efforts!Ã¢â‚¬? Says Gheen.  Ã¢â‚¬Å“The lawmakers that continue to support this bill need to answer an important question. NC General Assembly members, staff, and members of the media:<br />
<br />
How many illegal aliens are in North Carolina?  Probably close to half a million!<br />
<br />
In truth, nobody can accurately answer that question but we do have some idea.  <br />
<br />
North Carolina has between 300-600 thousand illegal aliens and our population of illegals is growing faster than almost any other state in America.  The safest way to call it?  <br />
<br />

<br />
Estimating illegal aliens is an inexact science due to the nature of this crime.  Governmental agencies and researchers have great difficulty in such assessments because our systems are not designed to detect illegal aliens.  K-12 schools do not inquire about a studentÃ¢â‚¬â„¢s immigration status.  Neither do our police departments or hospitals.  Combine this with the fact that illegals try to go undetected and engage in document fraud and identity theft, and it is clearly impossible to provide lawmakers with exact numbers.<br />
<br />
Here is what we do know.<br />
<br />
According to the US Census and the Pew Hispanic Center (which uses Census data for their estimates) NC has one of the fastest growing populations of illegal aliens in America.  <br />
<br />
The Pew Hispanic Center estimate of 300,000 illegal aliens in NC is derived from the US Census estimate of close to 200,000 illegal aliens in NC as of Jan. 2000.  By applying the average rate of increase between 1990-2000 of approximately 20,000 new illegals taking up residence per year we arrive at the 300,000 estimate for 2005.<br />
<br />
There are some serious flaws in this estimate and 300,000 should be considered as the minimum range of NC's illegal alien population.<br />
<br />
1.  The US Census estimates and the Pew Hispanic Center estimates are in the lowest range of national estimates.<br />
<br />
TIME Magazine has estimated that there are 15 million illegal aliens in America.<br />
<br />
Barron's has released a study by the Wall Street investment firm Bear Stearns<br />
that places the national illegal population at 20 million.<br />
<br />
There are other studies and the US Census estimates continue to occupy the low end of the spectrum.  <br />
<br />
If we use the range of national estimates of 10-20 million illegals in the US to NC's estimates, we can estimate with some degree of confidence that NC has 300-600 thousand illegal aliens.<br />
<br />
2.  Another important factor that pushes the estimates higher than 300,000 is that illegal immigration rates increased in the late 90's and continued to escalate in the first half of this decade.  Reports from the US Border Patrol and from Time Magazine illustrate this.  <br />
<br />
In the mid 90's the accepted estimate was half a million illegal aliens entered the US to stay each year.  By 2001 that estimate was approximately 1 million per year.  TIME Magazine's recent and history making article &quot;Who left the door open?&quot; has upgraded that estimate to 3 million per year!<br />
<br />
3.  Another important factor that pushes the estimates up further is NC driver licenses.  North Carolina remains as one of the few (10) remaining states that does not require &quot;Legal Presence&quot; to receive a driver license.  A license is essential to illegal aliens since it is needed to work a job that law prohibits them from having.  It is also needed to rent houses and apartments and to open bank accounts etc.  NC continues to dispense thousands of licenses to illegal aliens and the Florida Department of Licenses us informs us that buses full of illegal aliens are chartered to NC and back just to get an NC license.<br />
<br />
We have close to half a million illegal aliens in NC and that number is growing rapidly.  Can you imagine what will happen when we advertise in-state tuition rates for the children of illegal aliens?<br />

Even if we use El Pueblo's exceptionally low estimate of 1,600 students enrolling the first year this bill will cost our taxpayers approximately $51,200,000 (4*8,000*1600) over 4 years if these students graduate in 4 years.  NC taxpayers pay roughly $8,000 per year to subsidize in-state tuition students.  Can you image what the costs will be if this number enrolls each year?  <br />
<br />
HB 1183 WILL cost our taxpayers tens of millions of dollars and the state budget is already running severe deficits!<br />
<br />
HB 1183 WILL cost thousands of legal Americans their seats in college.  We have a finite number of spaces in college classrooms and our colleges turn away people every year!<br />

HB 1183 WILL increase the flow of illegal aliens into North Carolina as soon as the newspapers of Central and South America announce that in-state tuition access and subsidies are available to illegal aliens in our state!<br />
<br />
Many of our legal North Carolina families have paid taxes to build these universities for over 100 years!  Now they will be forced to pay more money to replace their own family members in college with foreign nationals?<br />
<br />
Will you support or oppose HB 1183 and if you support it what would you like to say to the thousands of North Carolinian children that will NOT be going to college if you pass it?<br />

	ALIPACÃ¢â‚¬â„¢s President, William Gheen, issued this statement today in response to El PuebloÃ¢â‚¬â„¢s press conference and the filing of a House bill that would deprive legal NC students from a college education at taxpayer expense.<br />
<br />
        Ã¢â‚¬Å“The overwhelming majority of North CarolinaÃ¢â‚¬â„¢s taxpayers will not support this bill,Ã¢â‚¬? says William Gheen (President of ALIPAC).  Ã¢â‚¬Å“This bill will eventually displace thousands of our citizens in college.  We have one of the fastest growing populations of illegal immigrants in our state.  Can you imagine what the flood will be like when Central American newspapers announce Ã¢â‚¬Å“Come to NC for subsidized college access!Ã¢â‚¬?<br />

Americans for Legal Immigration PAC is scheduling Ã¢â‚¬Å“Town MeetingsÃ¢â‚¬? across the state to warn North Carolinians of the impact of this bill.  Meetings have been scheduled in Raleigh, Winston Salem, Monroe, Greenville, Washington, and Asheville North Carolina.  More town meetings will be added shortly.<br />

Ã¢â‚¬Å“We are going to rally the state to defeat this bill and insist that our lawmakers respect the majority of their legal constituents.Ã¢â‚¬? Says Gheen.  Ã¢â‚¬Å“I feel that any lawmaker that supports this bill will be looking for a new job after the 2006 elections.Ã¢â‚¬?<br />

Members of the North Carolina Legislature:<br />
<br />
      	I have requested a temporary leave of absence from my position as the legislative assistant to Senator Hugh Webster so I may share information with you that is not being provided to you by our research staff or the local media regarding North CarolinaÃ¢â‚¬â„¢s illegal immigration crisis.<br />
<br />
     	Our researcherÃ¢â‚¬â„¢s hands are tied because state agencies are not collecting data on the legal presence of those that demand services and we are dealing with law breakers.  This combined with a heavy political bias in some local media sources, such as the Raleigh News &amp; Observer, has left most of our lawmakers in the dark or operating on limited information.  <br />
<br />
	Here is a perfect example. If you read the News &amp; ObserverÃ¢â‚¬â„¢s Ã¢â‚¬ËœUnder the DomeÃ¢â‚¬â„¢ report yesterday, you might be inclined to think that I left my position under some shadow of controversy and that Senator Fern Shubert had been demoted to phone girl after her service to our state as a Senator.  Although Ms. Lynn Bonner may wish her readers to believe this lie that she manufactured through omissions, nothing could be further from the truth.<br />
<br />
	Here is what Ms. Bonner knows but chose not to share with her readers:<br />
<br />
	Two weeks ago, Senator Webster asked me to arrange a press conference to discuss his bill Ã¢â‚¬Å“Taxpayer and Citizen Protection ActÃ¢â‚¬? (SB 976).  This bill is a hybrid bill based off of ArizonaÃ¢â‚¬â„¢s successful public ballot initiative called Proposition 200 and a bill recently passed in Virginia.  The bill was inspired by materials Senator Webster received from another elected official in his district.  It is over 5 pages long and it was prepared in haste to make the bill drafting and filing deadlines.  Many people assisted in the creation of the bill and there are complex issue addressed within it.  I will send you more information about this bill soon.  The bill requires proof of legal residence for those that apply for state aid that is not mandated by Federal law.<br />
<br />
	During the press conference, Senator Webster was asked a question about what documents would be accepted as proof of legal residence.  As a staff member of Senator Webster, I spoke briefly to provide the details of a late language addition to the bill text regarding this matter. <br />
<br />
	Immediately after the conference, Senator Webster and I were confronted with a series of baseless aspersions and accusations hurled at us by the partially taxpayer funded non-profit group El Pueblo and their paid lobbyist Paula Wolfe.  One of the accusations was that I was lobbying on immigration issues since I provided information during the press conference on the bill.   <br />
<br />
	The next day, I asked Senator Webster if he would consider granting me a leave of absence because Paula Wolfe inadvertently made an excellent suggestion!  Someone did need to actually get out into the halls and lobby to counter her push to replace legal NC residents in college with illegal aliens at taxpayer expense.  Fern Shubert offered to fill in at my position because she cares about the illegal immigration issue too and would like to see someone doing what I have set out to do while making sure a friend like Senator Webster is assisted during my absence.<br />
<br />
	El Pueblo came to the legislature yesterday and was only able to muster less than 100 attendees for Latino day due to their support for illegal aliens.  The Associated Press reported Ã¢â‚¬Å“Several HundredÃ¢â‚¬? attended.  This is false and further illustrates the need for me to enter the hallways.<br />
<br />
	I look forward to meeting with you and presenting you with the most accurate and timely news and information about our illegal immigration crisis.  I hope that you and your staff will look into this matter and make every effort to assure that North Carolina does not suffer the fate of California where illegal immigration has destroyed their state budget, their tax base is fleeing the state, and they are closing hospitals and schools.<br />
<br />
 	I will be sending future e-mails on this topic and calling to schedule an office visit shortly.  IÃ¢â‚¬â„¢ve worked for many of you during the campaign cycles over the last 10 years and IÃ¢â‚¬â„¢ve worked on the Sgt. At. Arms staff and for the DOT and DOP.  I hope that we can all work together to have a candid discussion on the issue of illegal immigration in North Carolina.<br />
