Media reports say Trump could help Congress pass an unconditional DREAM Act amnesty Fri, Sep 8th BREAKING: Rep. Lamar Smith introduced the Legal Workforce Act today. The bill would require all employers to use E-Verify on most new hires within two years -- NumbersUSA's top enforcement priority. The House Judiciary Committee approved the bill in each of the last three Congresses. Is Pres. Trump open to the DREAM Act amnesty with nothing in return? That's what some media reports from the last 24 hours suggest. Earlier this week, Pres. Trump cut a deal with Democratic leaders, Sen. Chuck Schumer and Rep. Nancy Pelosi, to fund the government for three months, raise the debt-limit, and provide hurricane relief for Texas. According to reports, this newly budding relationship between the president and the two top Democrats could lead to Congress passing a mass amnesty bill. According to The Hill: Schumer announced on the Senate floor Thursday morning that Trump called him and asked how he could help advance legislation that would protect from deportation an estimated 800,000 immigrants who came to the country illegally as children. Schumer urged Trump to put pressure on McConnell and Ryan to bring the Dream Act, which would create a path to legal status for these immigrants, to the floor. "He said he wanted to help in the Dream Act, and there are many ways to help," Schumer said. Reuters is reporting that Senior White House Advisor Jared Kushner (Pres. Trump's son-in-law) had met with Sen. Dick Durbin (D-Ill.) to discuss ways to protect the nearly 800,000 DACA recipients. Sen. Durbin is the top champion for the DREAM Act and recently introduced an updated version with Sen. Lindsey Graham (R-S.C.). And Pres. Trump, himself, has been sending out mixed signals. Tuesday, he urged Congress to "advance responsible immigration reform that puts American jobs and American security first" shortly after Attorney General Jeff Sessions announced that the administration would rescind the DACA amnesty. But he sent out a Tweet later that day saying that if Congress didn't act on DACA, he would "revisit" the issue. He followed that up with another Tweet on Thursday telling DACA recipients that they have "nothing to worry about." It's been reported that Rep. Pelosi asked Pres. Trump to send out the second Tweet. However, not everyone thinks the Trump-Schumer-Pelosi deal is good for Dreamers. Amnesty champion Rep. Luis Gutierrez (D-Ill.) says the deal is bad for illegal aliens. Politico is reporting that Gutierrez believes that Rep. Pelosi and Sen. Schumer gave away the Party's leverage on the issue by compromising on three must-pass bills. "The bond and trust between the Dreamers and the Democratic Caucus is broken," he said. Rep. Lamar Smith Introduced Mandatory E-Verify Bill

Rep. Lamar Smith reintroduced today the Legal Workforce Act, H.R. 3711. The bill would require all employers to use E-Verify within two years, fulfilling NumbersUSA's top enforcement priority.


"Nearly 20 million Americans are unemployed or underemployed," Rep. Smith said in a statement.

"Meanwhile, seven million people are working in the United States illegally. By expanding the E-Verify system to all U.S. employers, this bill will ensure that jobs only go to legal workers."


"A recent poll showed that 70 percent of voters support legislation that makes it illegal for businesses in the U.S. to hire illegal immigrants."


While the bill would require all employers to use E-Verify within two years, Ag employers will have 30 months before they have to start using E-Verify for field workers.


The Legal Workforce Act:

• Repeals I-9 System: Repeals the current paper-based I-9 system and replaces it with a completely electronic work eligibility check, bringing the process into the 21st century.
• Gradual Phase-In: Phases-in mandatory E-Verify participation for new hires in six month increments beginning on the date of enactment. Within six months of enactment, businesses having more than 10,000 employees are required to use E-Verify. Within 12 months of enactment, businesses having 500 to 9,999 employees are required to use E-Verify. Eighteen months after enactment, businesses having 20 to 499 employees must use E-Verify. And 24 months after enactment, businesses having 1 to 19 employees must use E-Verify.
• Agriculture: Requires that employees performing "agricultural labor or services" are only subject to an E-Verify check within 30 months of the date of enactment.
• States as Partners: Preempts duplicative state laws mandating E-Verify use but retains the ability of states and localities to condition business licenses on the requirement that the employer use E-Verify in good faith under federal law. In addition, the bill allows states to enforce the federal E-Verify requirement and incentives them to do so by letting them keep the fines they recover from employers who violate the law.
• Protects Against Identity Theft: The bill allows individuals to lock their Social Security number (SSN) so that it can't be used by another person to get a job. It also allows parents or legal guardians to lock the SSN of their minor child. And if a SSN shows unusual multiple use, DHS is required to lock the SSN and alert the owner that their personal information may have been compromised.
• Safe Harbor: Grants employers safe harbor from prosecution if they use the E-Verify program in good faith, and through no fault of theirs, receive an incorrect eligibility confirmation

House Votes on Immigration Amendments to Minibus Spending Bill

The House approved several good immigration amendments to the minibus spending bill that would fund the Department of Homeland Security and several other agencies for FY 18. The immigration amendments to H.R. 3354, the Make America Secure and Prosperous Appropriations Act, covered both E-Verify and sanctuary cities.


Rep. Steve King (R-Iowa) introduced several amendments to require each of the federal agencies included in the minibus to use E-Verify for all new hires. The amendments were combined into one and was passed by a voice vote.


The House also passed Rep. Jason Smith’s (R-Mo.) amendment to withhold Transportation and HUD funding from sanctuary jurisdictions. The amendment passed by a 225-to-195 margin. Rep. Henry Cuellar of Texas was the only Democrat to vote for the amendment. Most Republicans voted in favor of the amendment except:

Rep. Lou Correa’s amendment to reduce ICE funding by $100,000,000 and increase funding to the Coast Guard by the same amount did not pass. The final vote was 182-to-229, with all Republicans voting against it. Five Democrats also voted against the measure, including:

The House also defeated Rep. Roybal-Allard’s amendment to reduce ICE funding by $849,500,000 and increase funding to the Coast Guard by the same amount. The measure failed by a 170-to-240 vote. Rep. Don Young of Alaska was the only Republican to vote in favor of the amendment, while 15 Democrats voted against it, including:

Sen. Cotton Calls for Passage of RAISE Act

During an interview with CBS This Morning, Sen. Tom Cotton (R-Ark.) called for the passage of his RAISE Act legislation that would end chain migration and the visa lottery and transform the existing employment-based system to a merit-based one. Sen. Cotton was brought on to discuss his reaction to Pres. Trump ending the DACA executive amnesty.


Here are some of the excerpts from the interview:

"Well first, I want to say that President Trump took the right step yesterday, President Obama’s executive order was illegal. He said he didn’t have the authority before he issued it, and he said when he did issue it that it was temporary. That said, President Trump is trying to deal with the situation in the most orderly way possible. He can’t defend that order in court. But he wants Congress to take action. And I’ve talked to him and I’ve said I’m happy to try to help forge some kind of compromise.


"If we're going to give legal status to these young people in their 20's and 30's, who are here through no fault of their own, we have to recognize that's going to have negative consequences, it’s going to open up a whole new category of people who could get legal status. Namely their parents, who violated the law by bringing them here. And it’s going to encourage other people to bring their children across the border in the future, which is a very dangerous thing to do.


"So, my legislation, the RAISE Act, would stop unlimited family chain migration, addressing the first problem, and then enhanced enforcement measures would address the second problem. That’s a straightforward and targeted package that doesn’t try to boil the ocean or solve every problem, but solves the problem right in front of us.


"Congress has tried to pass a big, sweeping immigration bill three times in the last eleven years, it’s failed every time. It’s time we take a different, incremental commonsense approach."

How the end of DACA amnesty will roll out

I'm already seeing a lot of confusion and some misleading reports on what Pres. Trump did today.


The following is based on what the Administration has issued publicly and on a briefing we received this morning from the White House.
There is NOT a 6-month delay on ending the DACA amnesty


I was extremely concerned when I first heard over the weekend that Pres. Trump was going to end the executive DACA amnesty but only after giving Congress six months to enact a legislative amnesty.


That would have provided six months for immigration expansionists inside the Administration to delay the end of DACA even further once the deadline approached.
The reality is not perfect but is far better than advertised.

1. DACA ends today for anybody wanting to apply for the first time for a work permit or any other benefit.
   
   
2. DACA ends Oct. 5 for anybody wanting to apply for a renewal of a work permit.

Perhaps the most important thing is that no applications of any kind will be accepted after Oct. 5. For the Administration to be pressured to reverse its decision would require ramping up a whole new bureaucracy that will be closed down soon after Oct. 5.
Opening up jobs for Americans won't begin in earnest until March


My top concern about the DACA work-permit amnesty has always been the addition of hundreds of thousands of illegal aliens competing in the legal labor market against struggling American workers and legal immigrants already here. This has created downward pressure on wages and meant that hundreds of thousands of Americans -- particularly Millennials -- do not have jobs at this time.


Atty Gen. Sessions noted this morning that around 800,000 DACA work permits have been given out since Pres. Obama created them in 2012. Those work permits were for two years but could be continually renewed under Pres. Obama's order.
We were told this morning that around 690,000 work permits are still in effect due to some recipients not renewing along the way for various reasons.
That attrition will continue and provide some relief for American workers immediately.


Here's how the order has been laid out:

1. PENDING FIRST-TIME DACA APPLICATIONS: Young adult illegal aliens whose first-time applications for a work permit are still pending will be processed despite the end to accepting new applications as of today. (About 33,000 applications are said to be pending.)
   
   
2. DACA WORK PERMITS THAT EXPIRE SEP. 5, 2017 THROUGH MARCH 5, 2018 or which have renewal applications pending right now:
   
   These illegal aliens will be allowed to renew for one more two-year period. But they will have to apply by Oct. 5, 2017. Many of these are likely to miss the deadline or decide for various reasons not to renew, which will begin to open up jobs as their employers are required to end their employment at the expiration of their work visa. (Presumably, as many as 150,000 to 200,000 illegal aliens might be given this gift of being allowed to renew for one more two-year work permit.)
   
3. DACA WORK PERMITS THAT EXPIRE AFTER MARCH 5, 2018: These illegal aliens will not be allowed to apply for renewals for the Oct. 5 deadline. They will be able to hold their jobs -- or even get new jobs -- until the expiration date on their work visa. Perhaps a thousand work visas a day will be expiring starting March 6 and through 2019.

DON'T LISTEN TO THE SMUGGLERS


The White House is concerned that smugglers in other countries will entice people to fork over their savings to get to the U.S. before Oct. 5 in order to file for these work permits.


The fact is that nobody can gain anything under this order unless:


(a) they filed an initial application before today
(b) or they already have a work permit
When the DACA amnesty was created, it created the humanitarian crisis known as the Border Surge in which large numbers of children and youth were enticed to take the dangerous journey to the U.S. under the promise that our government would never require anybody here illegally to ever leave. The Trump announcement today should send the opposite message: There is no pathway for staying if you decide to come here and be an illegal alien.
THE THREATS BEFORE US


Huge efforts among the mainstream media, corporate lobbyists, the community of foundations and leaders of both parties in Congress are already underway to pass an amnesty for these DACA recipients. Typically, they do not include any provisions to reduce the harm to vulnerable American workers, or any provisions to keep foreign parents from putting their children into this situation in the future.

EBI: 'The Bible Does Not Teach Open Borders'

The Evangelicals for Biblical Immigration (EBI) sent a letter to Pres. Trump and GOP leadership advising them that they believe the Bible does not support open border ideals or should be used to support amnesty programs such as DACA. This letter comes as the Trump administration is finalizing their plan to end Pres. Obama’s unconstitutional executive amnesty.


“While some faith groups use selective Bible words for open borders and amnesty, we consider the whole counsel of scripture,” the letter reads. “We find that the bible does not teach open borders, but wise welcome.”


Phil Cohn, President of Christ for All Peoples; General William Boykin of the Family Research Council; Maria Espinoza of the Remembrance Project, an organization representing the families of those killed by illegal aliens; author Eric Metaxas; and Christian political advocate Rick Scarborough have all signed the letter.


“Though there are tragic stories on every side of illegal migration, for our elected officials, responsibility to oaths must prevail,” the letter continues. “In the policy decisions ahead, while treating undocumented people kindly, we ask that you would first and foremost honor often forgotten American citizens whose families have served our nation for many generations.”

Honorable President Trump, Majority Leader McConnell and Speaker Ryan:
We agree that immigration reform and DACA are difficult subjects. God loves the foreigner. Indeed, God loves us all. It takes time to discern the balance of mercy and justice by which a nation thrives.


It is easier to speak publically of mercy, as we, and many, do. And, while loving mercy, who will also stand for justice to those citizens who cannot find a job due to cheaper foreign labor? Who will speak of the real cost of illegal immigration to our states? And while many non-citizens are good neighbors, who will stand for justice for Americans victimized by people here illegally who do not uphold our values and laws? And who will prevent more needless crime and death?


The Church is called to serve all people, and our Government leaders are elected to defend and uphold the Constitution and the rule of law. Though there are tragic stories on every side of illegal migration, for our elected officials, responsibility to oaths must prevail. Law and order sustain stability and peace. A nation of wise rule grows strong enough to sustain care for the vulnerable in our midst.


While some faith groups use selective Bible words for open borders and amnesty, we consider the whole counsel of Scripture. We find that the Bible does not teach open borders, but wise welcome. We are to welcome the lawful foreigner, who, like a convert, comes as a blessing (eg.s Ruth and Rahab). We also find Nehemiah building walls to protect citizens from harm. In Isaiah 1, we see God condemning the destruction of borders and indigenous culture.


All lives matter. The lives of North, Central and South Americans matter. The lives of Africans, Asians, Europeans and people from the Middle East matter. In Scripture, we learn that God placed us each in a family, a land, an epic story of creation, the fall and redemption. The Bible envisions a world of beautiful and unique nations, not a stateless “open society” run by global oligarchs. Each of us is called to be a blessing where God has placed us in the world.


In policy decisions ahead, while treating undocumented people kindly, we ask that you would first and foremost honor often forgotten American citizens whose families have served our nation for many generations, and the patient people who have applied lawfully to come here and to become citizens of the United States. These lives also matter. These people also dream.
