    The Department of Homeland Security is facing questions about a so-called "hands off" list which, according to one senator, might allow people with terror ties to enter the U.S.

    Iowa Sen. Chuck Grassley, top Republican on the Senate Judiciary Committee, flagged the issue after obtaining an internal email exchange which discussed an airline passenger with apparent ties to Middle East terror groups.

    The May 2012 exchange between Immigration and Customs Enforcement and Customs and Border Protection focused on whether to admit the person -- who had a scheduled flight into the U.S. and allegedly was a member of the Muslim Brotherhood and a “close associate” of Hamas, Hezbollah and the Palestinian Islamic Jihad.

    The email also states the person had been the subject of advance screenings -- known as secondary inspections -- several dozen times in the past several years but not since 2010.

    A response email states that a Customs and Border Protection National Targeting Center watch commander said the person had twice sued the federal government, he’s “one of the several hands off passengers nationwide” and the DHS secretary is personally involved in the matter. The email also states the person was removed from the watchlist in December 2010.

    “I am puzzled how someone could be a member of the Muslim Brotherhood, indicted as a co-conspirator in the Holy Land Foundation trail … say that the U.S. is staging car bombings in Iraq … and be afforded the luxury of a visitor visa and de-watchlisted,” the email said.

    Grassley on Tuesday released the emails -- which he calls “disturbing” -- after starting an inquiry in February into the situation.

    CBP Commissioner R. Gil Kerlikowske responded to Grassley’s concerns in a letter last month in which he gave only “general information” on screening procedures. However, he offered to hold a more detailed briefing on the particular case “in the appropriate setting.”

    Kerlikowske also directed all questions about the terror watchlist to the Justice Department.

    Among the questions raised by the senator, in a separate letter to DHS Secretary Jeh Johson, is why the individual referenced in the 2012 emails was removed from the watchlist.

    Grassley spokeswoman Beth Levine said Wednesday the senator is taking a wait-and-see approach on the Obama administration’s offer to hold a briefing.

    “The senator hopes for appropriate answers to his questions,” she said.

    DHS did not respond to further questions about the alleged incident or the briefing.

    DHS Emails Reveal U.S. May Have Terrorist “Hands Off” List

    The Obama administration appears to have a terrorist “hands off” list that permits individuals with extremist ties to enter the country, according to internal Department of Homeland Security (DHS) documents obtained by a United States Senator.

    It’s unimaginable that any government would do this, but it seems like the Obama administration is constantly breaking new ground. The disturbing details of this secret initiative were made public this week by Iowa Senator Chuck Grassley, who has obtained DHS electronic mail discussing what could be a terrorist “hands off” list. The exchange includes a 2012 email chain between U.S. Immigration and Customs Enforcement (ICE) and U.S. Customs and Border Protection (CBP) asking whether to admit an individual with ties to various terrorist groups. The individual had scheduled an upcoming flight into the U.S., according to an announcement issued by the senator.

    The person was believed to be a member of the Muslim Brotherhood and a close associate and supporter Hamas, Hezbollah, and the Palestinian Islamic Jihad, according to the mail exchange obtained by Grassley’s office. The terrorist suspect had also been in secondary inspection “several dozen times of the past several years,” the agency emails reveal, but had not undergone a secondary inspection since 2010. This seems to imply that the suspect has been on the U.S. government’s radar for some time.

    It gets better. The DHS emails also reveal that this particular terrorism suspect has actually taken legal action against the U.S., presumably because authorities violated the hands off policy. The subject “has sued CBP twice in the past and that he’s one of the several hands off passengers nationwide,” according to the DHS emails obtained by Senator Grassley’s office. The documents go on to say that the terrorist’s records were removed and that the DHS Secretary (at the time Janet Napolitano) was involved in the matter.

    This is pure insanity and the senator has tried for months to get answers from DHS. In February he wrote a letter to DHS Secretary Jeh Johnson saying this: “I’m puzzled how someone could be a member of the Muslim Brotherhood and unindicted co-conspirator in the Holy Land Foundation trial, be an associate of [redacted], say that the US is staging car bombings in Iraq and that [it] is ok for men to beat their wives, question who was behind the 9/11 attacks, and be afforded the luxury of a visitor visa and de-watchlisted. It doesn’t appear that we’ll be successful with denying him entry tomorrow but maybe we could re-evaluate the matter in the future since the decision to de-watchlist him was made 17 months ago.”

    The agency’s response, dated April 10, apparently frustrated the senator enough to make the whole thing public this week. DHS let CBP Commissioner Gil Kerlikowske get back to Grassley. His letter says the agency does not have the authority to ignore information that renders an individual alien inadmissible because CBP does not have the discretionary authority to admit an inadmissible alien. “Accordingly, CBP does not have any list or other mechanism which would render an individual free of the grounds of inadmissibility or from any other inspection requirements, including secondary inspections,” Kerlikowske writes.

    He goes on to pass the buck to another agency, the Department of Justice (DOJ). “The Terrorist Watchlist is maintained by the Terrorist Screening Center, which was created by the Attorney General and is administered by the Federal Bureau of Investigations,” the CBP commissioner writes. “All questions related to the watchlist should therefore be referred to the Department of Justice for response.” Kerlikowske also offers to provide the senator with a “more detailed briefing on the particular case cited in your letter, in the appropriate setting.” That means nothing will be put in writing so as to avoid any sort of future incrimination in the event the scandal blows wide open.

    The revelation that the Department of Homeland Security maintains a “hands off” list of individuals with terrorist ties, allowing them unfettered entrance to the United States, is even more grievous considering the fact that the federal agency has repeatedly smeared ordinary Americans as violent extremists.

    “The Department of Homeland Security (DHS) secretly assembled a terrorist “hands off” list that permitted individuals with terrorist ties unfettered entrance into the United States, according to document released by Sen. Chuck Grassley (R., Iowa),” reports the Washington Free Beacon, adding that, “Jamal Badawi, a Canadian Islamist leader who has praised suicide bombing and is close to Hamas and Hezbollah,” was one such individual afforded DHS protection.
    The records of hundreds of terror suspects were also purged as a result of a deliberate DHS policy at the behest of former Secretary Janet Napolitano.
    As we reported in January, it also emerged that Muslim Brotherhood members with ties to terrorism traveling through Minneapolis Airport, New York’s John F. Kennedy Airport and Dulles Airport in April 2012 were handed “port courtesies,” with the State Department telling the DHS to ensure the men “not be pulled into secondary upon arrival at a point of entry.”
    To make matters worse, while turning a blind eye or indeed protecting suspected terrorists, the DHS has since its inception embarked on a public relations campaign to demonize Americans as violent extremists for little more than holding certain political beliefs.
    Perhaps the most egregious example emerged in 2012 when a leaked study (PDF) produced by the National Consortium for the Study of Terrorism and Responses to Terrorism at the University of Maryland, and funded by the DHS to the tune of $12 million dollars, largely ignored Islamic terrorism while concentrating on the threat posed by Americans who are “reverent of individual liberty,” in addition to;
    - Americans who believe their “way of life” is under attack;
    - Americans who are “fiercely nationalistic (as opposed to universal and international in orientation)”;
    - People who consider themselves “anti-global” (presumably those who are wary of the loss of American sovereignty);
    - Americans who are “suspicious of centralized federal authority”;
    - People who “believe in conspiracy theories that involve grave threat to national sovereignty and/or personal liberty.”
    While the DHS was compiling a “hands off” list of suspected terrorists who were to be given VIP treatment and allowing such individuals to enter the U.S. on a red carpet, the federal agency was simultaneously funding reports which characterized conservatives, libertarians and basically any American who cherishes liberty as dangerous radicals.
    Let’s also not forget the fact that the DHS is responsible for the release of around 68,000 convicted illegal immigrants each year.
    Given that suspected terrorists are now being deliberately allowed into the United States unimpeded while politically active Americans are being smeared as violent extremists, the Department of Homeland Security has become so bloated and corrupt that it now actually represents a security threat to the country, which is ironic given that it was created with the express purpose of protecting America from terrorism in the aftermath of 9/11.

    The Department of Homeland Security (DHS) secretly assembled a terrorist “hands off” list that permitted individuals with terrorist ties unfettered entrance into the United States, according to document released by Sen. Chuck Grassley (R., Iowa).

    The existence of a “hands off” list that permitted easy entrance for suspect individuals into the United States has drawn concern from Grassley, who released a cache of internal DHS emails detailing the list’s existence and discussion about permitting an alleged member of the Muslim Brotherhood to enter the United States.

    The emails—sent between U.S. Immigration and Customs Enforcement (ICE) and U.S. Customs and Border Protection (CBP)—reveal a row over the admittance of one alleged Muslim Brotherhood official tied to Hamas, Hezbollah, and other terror groups.

    While the individual in question is not named in the heavily redacted emails, the Washington Free Beacon has learned that the person referenced is Jamal Badawi, a Canadian Islamist leader who has praised suicide bombing and is close to Hamas and Hezbollah.

    Additionally, the emails reveal a larger campaign by DHS and its former head Janet Napolitano to purge internal records of hundreds of terror suspects, including Badawi, who had his records purged in December 2010.

    Sources who spoke to the Free Beacon and had reviewed unredacted versions of the emails indicated that many files pertaining to foreign terror suspects may have been purged by DHS. The sources said congressional investigators are currently looking into the matter.

    The emails between ICE and CBP that were released by Grassley show confusion as to why Badawi was being permitted entrance into the United States.

    “I’m puzzled how someone could be a member of the Muslim Brotherhood and unindicted co-conspirator in the Holy Land Foundation trial, be an associate of [redacted], say that the U.S. is staging car bombings in Iraq and that [it] is ok for men to beat their wives, question who was behind the 9/11 attacks, and be afforded the luxury of a visitor visa and de-watchlisted,” one official wrote in the DHS May 2012 emails released by Grassley.

    “It doesn’t appear that we’ll be successful with denying him entry tomorrow but maybe we could re-evaluate the matter in the future since the decision to de-watchlist him was made 17 months ago,” the email states.

    One of the unnamed officials goes on to state: “Based on a review of the statements of the subject, I think it is clear that he [Badawi] meets the definition of endorsing and inciting.”

    Grassley, in his initial letter to DHS on the matter, asked that officials explain why Badawi was removed from the terror watch list and to “describe the nature, extent, and reasons for the involvement of the DHS secretary or her staff in the removal of the individual from the watchlist.”

    Grassley also is seeking to learn “how many people are on the ‘hands off’ list mentioned in the email” and “what qualifies someone to receive the ‘hands off’ designation?”

    Officials responded to Grassley in April, telling him that they “would be happy to provide a more detailed briefing on the particular case cited in your letter … in the appropriate setting.”

    Badawi, the individual at the center of Grassley’s investigation, has long been tied to the Muslim Brotherhood.

    He also sits on the board of directors of Qaradawi’s International Association of Muslim Scholars (IAMS), which issued a fatwa in 2004 authorizing the killing of American troops in Iraq, according to reports.

    Badawi also was named as an unindicted co-conspirator in the U.S. government’s case against the Holy Land Foundation, which was convicted of funneling money to the terror group Hamas.

    Badawi has been recorded in the past powwowing with Hamas leader Khaled Mashal, who has been designated by the United States as a terrorist.

    Individuals tied to terror groups have gained entrance to the United States in multiple instances over the past few years.

    Hani Nour Eldin, a member of the Egyptian Islamic Group, a U.S. designated terror outfit, met with the Obama administration in 2012, according to the Daily Beast.

    Additionall, former DHS head Napalitano has told members of Congress that they should expect members of terror groups to be admitted to the United States for meetings.
