ICE agents told about Mexican immigrant Ivan Zamarripa-Castaneda after he left Denver jail

    Associated Press

DENVER (AP) — The Denver Sheriff's Department has said it is investigating why immigration authorities weren't notified of the release of a jail inmate until about an hour after he had already left.

Ivan Zamarripa-Castaneda of Mexico, 26, is charged with vehicular homicide in a hit-and-run crash that killed truck driver John Anderson, 57, on Interstate 70 on March 3. He was released from Denver's jail at 5:28 p.m. Saturday after posting $25,000 bond but U.S. Immigration and Customs Enforcement was not notified until 6:33 p.m., the sheriff's department said.

"This is unacceptable and the Sheriff has ordered an immediate internal review to determine why established notification processes did not take place before Zamarripa-Castaneda was released," the department said Sunday in a statement.

In a statement, Immigration and Customs Enforcement Denver Field Office Director Jeffrey D. Lynch said the agency was notified Saturday that Zamarripa-Castaneda would be released at an unspecified time.

He said deportation officers arrived at the jail less than two hours later to take him into custody and discovered he had already been released. The agency now considers Zamarripa-Castaneda an "immigration fugitive."

Lynch said that the agency was working with the sheriff's department to determine what happened to try to prevent similar situations from happening again.

"As law enforcement professionals, we should all have the same ultimate goal in mind — to protect the public by combating criminals. ICE helps fulfill that role by removing criminal aliens from the streets, and from the United States," he said.

The incident happened a year after U.S. Attorney Jeff Sessions criticized Denver's jail for giving immigration officials 25 minutes' notice before releasing an auto theft suspect, Ever Valles, they had expressed an interest in. He was involved in a fatal robbery several months later and was sentenced Friday to 29 years in prison.

The immigration agency requests jails hold inmates that agents are interested in in until they can arrive to detain them.

But Denver and other jurisdictions have said they cannot legally hold inmates after they post bond unless immigration agents obtain arrest warrants.

Illegal immigrant turns himself in to ICE following deadly hit-and-run car crash, report says

By Matt Richardson | Fox News

An illegal immigrant in Denver turned himself in to U.S. Immigration and Customs Enforcement (ICE) on Friday following a deadly car crash on I-70 earlier this month, a local report said.

Ivan Zamarripa-Castaneda, 26, who was charged with vehicular homicide and one count of leaving the scene of an accident resulting in death in the March 3 crash, is currently in the custody of ICE, according to FOX 31.

John Anderson, 57, a semi-truck driver, was killed in the accident that temporarily shut down the interstate.

Zamarripa-Castaneda allegedly fled the scene and was driving drunk. He was arrested the following day.

The agency will reportedly allow him to remain in Denver for his trial before choosing whether to deport him. Zamarripa-Castaneda was allegedly in the U.S. on a temporary visa that had expired three years ago.

ICE reportedly requested a notification if the suspect would be released. But after Zamarripa-Castaneda posted the $25,000 bond, he was allegedly let go, prompting the Denver sheriff to call for an internal probe of the department.

"This is unacceptable and the sheriff has ordered an immediate internal review to determine why established notification processes did not take place before Zamarripa-Castaneda was released," the sheriff's department said in a statement.

The Denver Sheriff Department, which operates the jail, told Fox News last week that unless ICE gets a federal criminal warrant that Zamarripa-Castaneda could leave detention after posting bond.

"The Denver Sheriff Department will not honor civil detainers as it is considered unconstitutional," the agency said in a statement.

ICE officials told Fox News last week they detain up to 40,000 people per day, and don't have the resources to go after every federal warrant.

ICE has about 20,000 employees, including an estimated 5,800 deportation officers who identify, apprehend and remove deportable immigrants. Currently the Trump administration is trying to add 10,000 more immigration officers.

No, they do not have enough officers to obtain a warrant on every illegal that is apprehended by local authorities.

Deploy the National Guard for the next 12 months.

Go on an all out raid in the entire State of California...then hit Chicago, NY, Florida and on down the line.

Let ICE arrest them...then hand them over to the National Guard to transport them to Federal Tent City on Federal Land with a panel of Federal Judges to process them and FAST TRACK them out of here.

Have buses standing by and LOAD the up!
