Bruning's involvement with Arizona immigration law questioned

The chairman of the Legislature's Judiciary Committee questioned Friday Nebraska Attorney General Jon Bruning's decision to join in a legal brief involving an Arizona illegal immigration law.
Brad Ashford of Omaha said Bruning should not be taking on so-called cause célèbres when Nebraska has such budget troubles. Having the attorney general involved in some other state's litigation is troubling, he said.
Nebraska has its own version of an employee verification law, Ashford said Friday at an executive session of the Judiciary Committee. The committee was discussing the attorney general's budget.
Nebraska's law (LB403) applies to all state agencies and political subdivisions, as well as private employers who do state contract work. That law, unlike the Arizona law that penalizes businesses that knowingly hire illegal immigrants, has never been contested because Nebraska's Legislature acted in a prudent manner, Ashford said.
"The resources of this state should not be spent defending a law that is not our law," he said.
Shannon Kingery, a spokeswoman for Bruning's office, said no out-of-pocket expenses would be used by the state to sign on to the brief. She did not know how much staff time would go into the effort, but said it would not be an additional cost not already in the budget.
State agencies were asked to submit budget items to be reduced if a 10 percent decrease was necessary to fill a potential $1.4 billion gap between state revenue and spending. As part of those potential modifications submitted by the attorney general, the office could be forced to eliminate its interstate water litigation program, a cost of $2.4 million.
According to the budget document, that would negatively affect the state because the office needs resources to successfully defend a $72 million water-related damage claim pending in the U.S. Supreme Court.
Given that and Bruning's decision in August not to defend a new law (LB594) requiring health screenings for women seeking abortions, Ashford said, he had deep concern about the role Bruning should play in a Supreme Court deliberation involving an Arizona law.
Kingery said Bruning decided not to defend LB594 because he didn't want to squander state resources on a case that had little chance of winning.
The Associated Press reported Friday that a coalition of states, led by Missouri Attorney General Chris Koster, asked the U.S. Supreme Court to uphold the Arizona law penalizing businesses that knowingly hire illegal immigrants. The states, including Nebraska, are not party to the lawsuit, but rather filed a legal brief as a suggestion to the court.
