    Man dies during Christmas Eve struggle with border agents at San Ysidro crossing



    San Diego police are investigating the Christmas Eve death of a 40-year-old man during a struggle with border agents at the San Ysidro crossing.

    The man, whose name was not disclosed, entered the United States from Mexico through the pedestrian walkway at about 7 p.m., according to homicide Lt. Paul Rorrison.

    During a computer check, U.S. Customs and Border Protection agents found that he had an outstanding felony warrant.

    Agents attempted to arrest the man, who was not handcuffed, but he "jumped over the processing counter and attacked an agent," Rorrison said.


    Other agents attempted to subdue the man. One used a Taser, Rorrison said.


    The man ''became unresponsive and stopped breathing," Rorrison. He died despite attempts at CPR.


    Four agents received "moderate injuries" and were taken to the hospital. Their names were not released.


    The San Diego County medical examiner will determine the cause of death.

    U.S. Citizen Dies At California Mexico Border Crossing After Being Shot With Stun Gun



    A 40-year-old U.S. citizen was shot with a stun gun at the San Diego border crossing. The man later died after border control officers were unable to revive him with CPR.

    According to NY Daily News, the 40-year-old man was crossing into San Diego from Mexico on foot. When he entered the border crossing, he was questioned by border control officers.

    The man was taken to another room for further questioning, at which point he attacked the border patrol officer. The agents were unable to subdue the man, so they used a stun gun.

    The border agents immediately provided CPR to the man, but they were unable to revive him at the scene.

    He was later pronounced dead at the hospital.


    The New York Times
    reports that “the man jumped over a counter Wednesday night and attacked an inspector after being escorted to a separate area for questioning at the San Ysidro port of entry between San Diego and Tijuana, Mexico, the police said.” The man was being taken for further questioning after a check showed the man was wanted on felony charges.


    Police report that heroin was also found on the man when a body search was performed. The U.S. Customs and Border Protection said the man was “combative” and attacked two inspectors after being held for approximately four hours. Police and border agents have not released the man’s name as family has not yet been notified.


    The San Ysidro port of entry is the highest traffic border crossing in the United States. In fact, approximately 50,000 motorists and 25,000 pedestrians enter the United States daily through the bustling San Diego crossing. To put that in perspective, that is more than all the people that travel through the two busiest airports in the nation daily – Miami and New York’s John F. Kennedy airports.


    Though the U.S.-Mexico border is the focus of most border crossing issues, a man was shot earlier in the week at the U.S.-Canada border crossing.

    Early Sunday morning, a male Canadian citizen approached the border control agents at the Detroit, Michigan, border crossing. The man approached border agents wielding a gun, and was subsequently shot by agents and taken to a nearby hospital. He recovered in the hospital and has since been taken into U.S. Department of Homeland Security custody for evaluation and questioning. Police on the Canadian side of the border in Windsor say they also had a confrontation with the man just 20 minutes before the bizarre border crossing confrontation.

    SAN DIEGO On Wednesday, Dec. 24, at approximately 6:45 p.m. PST, U.S. Customs and Border Protection officers at the San Ysidro Port of entry in San Diego, California, responded to and restrained a combative individual who was assaulting two CBP officers. After numerous attempts to restrain the assailant who continued to resist, an officer used his service issued electronic control device, and gained physical control.

    Several minutes later, the individual became unresponsive and a CBP Medical First Responder administered emergency medical aid.

    Emergency medical technicians arrived shortly after, continued emergency medical procedures and transported the individual to a local hospital, where a medical physician pronounced the individual deceased.


    CBP officers first encountered the male U.S. citizen when he applied for entry into the U.S. around 3 p.m. PST at the San Ysidro Port of Entry's pedestrian processing station. After records checks revealed that the individual should be considered armed and dangerous, CBP officers escorted him to the security office. There, officers conducted a pat down, seized heroin, and reviewed law enforcement records to confirm criminal history and a warrant for his arrest. After being seated in front of the security desk for further processing, the individual jumped over the desk and attacked two officers who were confirming the individual's criminal history.


    Four officers involved were transported to a local hospital to be screened and treated for minor injuries.


    The San Diego Police Department, CBP's Office of Internal Affairs and the DHS Office of Inspector General are investigating.


    U.S. Customs and Border Protection is the unified border agency within the Department of Homeland Security charged with the management, control and protection of our nation's borders at and between the official ports of entry. CBP is charged with keeping terrorists and terrorist weapons out of the country while enforcing hundreds of U.S. laws.

    SAN DIEGO (AP) - An autopsy finds a man who was shot with a stun gun by U.S. immigration authorities at a San Diego border crossing died of cardiac arrest.


    The San Diego County Medical Examiner's Office says in a report released Tuesday that 40-year-old Francisco Manuel Cesena's cardiac arrest occurred because he was shot and held face down on the ground and he was under the influence of methamphetamine and heroin. The manner of death is ruled a homicide.


    The report says the resident of suburban El Cajon became combative when he returned from Mexico at the San Ysidro port of entry Dec. 24 and was told he was being arrested. He was wanted a felony arrest warrant.


    Customs and Border Protection had no immediate comment on the status of its internal investigation.

    Tasers are deadly and kill people. No police outfit should be using them. They not only cause heart attacks, they cause thoracic compression which fracture and snap the spine. That's probably what killed Freddie Gray in Baltimore, they Tased him before putting him in the van and it looked like they Tased him on the back of the neck which is probably what fractured his neck and led to his death.

    If your objective is to kill illegal aliens, then yes it would be. If your objective is to arrest them, then no, it really isn't. Tasers are bad news and should be banned in the United States. Police use them as if they are not a lethal weapon when of course they are and have killed hundreds of innocent unarmed citizens and now it looks like they've killed an illegal alien. Our police officers need to learn how to fight like they did in the old days. This reliance on weapons against unarmed people is the wrong course.

    When did the Feds start using Tasers? A few years ago, they weren't allowed for use in federal law enforcement. I guess their use was brought in by Obama?

    Mounting Criticism Over Migrant Killings May Soon Lead To Border Agents Using Stun Guns

    The Border Patrol has come up with a solution in response to increased public scrutiny over the agency's use of deadly force, typically when confronting undocumented immigrants and smugglers in the field.


    Michael Fisher, the director of the 21,000-agent force said earlier this month, after mounting public pressure over immigrant shootings, that he'd review agency policy. He announced a directive to search for "less-than-lethal-equipment" for agents to use in the field for their protection, instead of or besides their standard-issue weapons.


    According to technology and government website Nextgov, the agency is now in the market for stun guns.


    Stun guns would seem to qualify under the new non-lethal category, as request for proposal posted on the Federal Business Opportunities website asks manufacturers to provide more information on their “electronic control devices” and “neuromuscular incapacitating projectile firing devices.”


    The info requested by the Border Patrol's parent agency, U.S. Customs and Border Protection, which is under Department of Homeland Security, includes how many stun guns could be made every month and “what quantity could be devoted to DHS?”


    The posting also asks companies to “provide all references to the applicable human effects testing and research information regarding specific device technology.”


    A Canadian study published last year found that the stress a stun gun places on a person’s could have fatal consequences, but, it admitted, the 33 deaths in that country that have been associated with stun guns since 1998, “were not necessarily” the direct results of stun guns and may have been caused also by underlying medical conditions such as heart disease.


    In one high-profile incident in the U.S., an 18-year-old Miami Beach graffiti artist died after police shot him in the chest with a Taser last summer.


    In his directive earlier this month, Fisher noted that since 2010 agents have been assaulted with rocks 1,713 times; they responded with deadly force 43 times, "which regrettably resulted" in 10 deaths.


    According to the Arizona Republic, while some agents have been seriously injured, none have been killed in rock-throwing assaults.


    Manufacturers have until April 9 to reply to CBP's information request.

      Border Patrol agents were involved in a high-speed pursuit that eventually led to an agent firing a Taser at the driver of the involved vehicle. An explosion occurred when the Taser was fired and the driver was burned to death. The dashcam video footage shows agents backing their vehicles away from the vehicle engulfed in flames.

    A newly released dashcam video from a 2012 incident appears to show a car explosion that killed the driver being ignited by a Border Patrol agent's Taser.

    The footage, obtained by NBC San Diego, shows the agent firing the Taser into the passenger side window moments before the car bursts into flames. A federal lawsuit filed by the family of the victim, Alex Martin, claims the explosion and death were caused by the Taser and that the Border Patrol agents did not attempt to save him, the TV station reported.

    The video shows an agent breaking a passenger side window with a flashlight, raising his Taser and shooting inside the vehicle. An explosion of fire erupts, throwing the agent back. The video then shows the agents backing their vehicles away and looking on as the blaze continues.

    Family attorney Gene Iredale told NBC San Diego that Martin was on his way back home from Texas when he got lost in Pine Valley, California, in March 2012. He had been on the road for 22 hours and Border Patrol agents dressed in plain clothes and unmarked cars attempted to pull him over for driving the wrong way on Interstate 8, he said.

    Five Texas Police Departments Ban Tasers

    Some communities are sidestepping the debate on Tasers’ safety by simply banning them altogether.

    About 16,000 law enforcement agencies internationally use Tasers, but this weekend, five police departments in North Texas — Mansfield, Richland Hills, Crowley, Murphy and Burleson — announced they had removed Taser guns from the list of equipment used by officers.

    While none of the Texas-based police department have explicitly explained why they decided to remove the Tasers, Pete Shulte, a private attorney, told a Texas blogger he thought the departments enacted the ban to protect themselves from lawsuits.


    Between 2001 and 2012, Amnesty International reported that more than 500 people in the U.S. had died after being shocked with Taser-technology either during their arrest or while in jail. The group urged police departments across the U.S. to at minimum lessen the frequency with which they use the weapon. But based on the number of lawsuits filed against police departments across the country, it’s not apparent that law enforcement listened.


    According to Amnesty International, the state with the highest number of Taser-related deaths is California, where 92 people died after being shocked during the study period. The next highest Taser-death state was Florida with 65 deaths, followed by Texas with 37 deaths. The deadliest police department was the Oklahoma City Police Department, which was involved in the Taser-related deaths of seven persons.


    Referencing a disclaimer issued by Taser International in 2009 — which said users should not aim for a person’s chest, and adjusted the safety warnings of the product to include that use of the product “could result in death or serious injury” — Shulte says Taser is not legally responsible for any deaths or serious injuries that may occur, leaving police departments on the hook for any lawsuits.


    “Well, now what Taser can do is say, ‘Police department, we told you that these devices could cause serious injury or death. It’s your policy that caused the injury to this person so we’re out of it,'” he said.


    “Of the hundreds who have died following police use of Tasers in the United States, dozens and possibly scores of deaths can be traced to unnecessary force being used,” said Susan Lee, Americas program director at Amnesty International. “This is unacceptable, and stricter guidelines for their use are now imperative.”


    “Even if deaths directly from Taser shocks are relatively rare, adverse effects can happen very quickly, without warning, and be impossible to reverse,” said Lee. “Given this risk, such weapons should always be used with great caution, in situations where lesser alternatives are unavailable.”


    Tasers or conducted electrical weapons (CEWs) are electroshock weapons that discharge 50,000 volts into a person, resulting in a complete override of the person’s central nervous system, which causes uncontrollable contractions of the muscle tissue. Not only is a person unable to control their muscles, but the high-intensity shock can lead to serious injuries and death in some circumstances if those volts hit near their vital organs, especially a person’s heart.


    Since police officers can fire a taser from as far as 35 feet away from a suspect, law enforcement officials have touted the device as a piece of equipment that has kept officers safe. But in 2012, Amnesty International warned law enforcement agencies the risks associated with this “non-lethal” weapon, which include death, may be higher than once realized.
    Tasers: Saving lives or destroying them?

    As Amnesty International reported, upon further review of 98 cases where a person died following a Taser shock, 90 percent of those victims were unarmed and many of them were shocked multiple times.


    “What is most disturbing about the police use of Tasers is that the majority of those who later died were not a serious threat when they were shocked by police,” said Lee.


    Some Taser advocates have tried to reason that most of the Taser-related deaths happened to people who have heart conditions, are intoxicated or struggle. Though Amnesty International reported more than 500 people have died after they were hit by a Taser, there is other research saying the use of Tasers has saved lives and reduced injuries, specifically among officers.


    But others, such as Dr. Douglas Zipes from Indiana University’s Krannert Institute of Cardiology, point out that the shock from the weapons “can cause cardiac electric capture and provoke cardiac arrest,” and often lead to an abnormally rapid heart rate and uncontrolled, fluttering contractions.


    But still, Steve Tuttle, spokesperson for Taser International, said those studies that found high-rates of abnormal cardiac behavior were flawed, since they only looked at a handful of cases.


    “There have been 3 million uses of Taser devices worldwide, with this case series reporting eight of concern,” Tuttle said. “This article does not support a cause-effect association and fails to accurately evaluate the risks versus the benefits of the thousands of lives saved by police with Taser devices.”


    He also claimed that some researchers like Zipes, who have testified as expert witnesses against Taser International, may intentionally omit key facts that contradict their opinion of the weapon.


    But others, such as Cincinnati defense attorney and legal expert Mike Allen, say that despite Zipes’ ability to earn $1,200 an hour to testify against Taser International, he is a trusted expert and his study “just adds credibility to the position that Tasers could be potentially dangerous.”


    Allen added that there have been at least 50 wrongful death lawsuits filed against Taser since the product first went on the market and added that “for a long time, [Taser International] was successful in getting them thrown out of court.
    “But now they seem to be getting some large judgments against them and that seems to be the trend,” he said. “There is some evidence the device was not properly tested, and I expect to see potential product liability actions against Taser.”
    These police departments did the right thing. I hope others follow-suit, but I doubt many will. Border Patrol should stick to guns and use them against armed people. No lethal weapon should be used against unarmed civilians, at least not in these United States.
