    Fourth man admits guilt in killing of Border Patrol agent

    SAN DIEGO — Four years after U.S. Border Patrol Agent Robert Rosas Jr. was killed in an ambush, the fourth of five men indicted in his slaying pleaded guilty in San Diego federal court Wednesday.

    Marcos Rodriguez Perez, 28, pleaded guilty to charges of conspiracy to commit robbery and kidnapping, robbery, and carrying and using a firearm in a crime of violence. Rodriguez was scheduled to go on trial next month.

    During the brief hearing before U.S. District Judge James Lorenz, a dozen uniformed Border Patrol agents sat quietly in the courtroom, some staring ahead grimly, as Rodriguez answered a series of questions from Lorenz.

    Under the terms of a plea agreement, he will be sentenced to 58 years in prison when he is sentenced Nov. 14, according to a statement from the U.S. Attorney’s Office in San Diego.

    Rosas was shot to death while on patrol near Shockey Truck Trail in Campo the evening of July 23, 2009. Rodriguez and four others, all Mexican citizens, had gathered on the Mexican side of the border, all armed and with a plan to rob a Border Patrol agent of his night vision equipment, court records say.

    Rodriguez and two others, Daniel Castro Alvarez and Emilio Gonzalez Arezanas, slipped through a hole in the fence and made tracks in the dirt to lead an agent into an ambush. Rosas spotted the footprints, and when he followed them on foot he was surprised and detained at gunpoint by the trio.

    But Rosas fought back, and during the struggle he was shot nine times. His gun, night vision equipment and handcuffs were stolen, and the three fled back to Mexico.

    In November 2009, Castro, a teenager, pleaded guilty and was sentenced to 40 years in prison in April 2010.

    Gonzalez, Rodriguez and a fourth man, Jose Ramirez Dorantes, were arrested in Mexico in 2010 and 2011, and extradited to the U.S.

    Gonzalez and Ramirez pleaded guilty to charges of murdering a federal officer during the commission of a robbery and are to be sentenced in November. They face potential life sentences. A fifth man, Jose Chacon Morales, remains at large.

    Rosas, 30, was a popular and respected agent. He left behind a widow and two children. After his death, a five-mile stretch of Interstate 8 near Kitchen Creek Road was dedicated in his memory.

    Marcos Rodríguez-Perez admitted his role as one of five Mexicans who illegally entered the U.S. through a hole in the border fence and lured, trapped, and killed a young U.S. Border Patrol agent, Robert Rosas, Jr., all because they wanted to rob him of his night-vision goggles.

    The killing happened in 2009, but it took nearly two years for Mexican authorities to arrest and extradite Rodríguez-Perez to the U.S. He finally pleaded guilty and admitted his role, according to a recent press release from the U.S. Attorney’s Office.

    The killers allegedly traveled by car in Mexico to a remote area of the U.S./Mexico border for the deadly scheme. This raises concern due to the apparent Border Patrol leadership’s strategy of only placing boots on the ground in high population areas; Border Patrol agents are often left alone in secluded areas to perform their duties and service in protecting America.

    Further concern is raised by Border Patrol plans to cut the work hours of many Border Patrol agents, reducing the protection by up to one-third in some places along the border. The National Border Patrol Council, a voluntary union advocating for border security and the border agents who keep us safe, has proposed the Border Patrol Pay Reform Act. They believe the legislation will stop the severe cutbacks to agents' ability to properly secure the border and help reduce the dangers many of their agents face in remote areas.

    “Not only would our proposal save the tax-payers around $20 billion over ten years, but it is vital to reduce the risk of more of our Border Patrol agents being killed in remote areas as happened in this tragic and heartbreaking case,” said Border Patrol Council Vice-President Stu Harris of El Paso’s Local 1929. “Our thoughts and prayers go out to Agent Rosas’ family and we appreciate the hard work of the U.S. law enforcement community in bringing these killers to justice.”
