    President Barack Obama’s deputies opened a little-known immigration backdoor to put 45,000 DACA illegals on a multistep path to citizenship, according to the Senate Judiciary Committee.

    According to the committee, the “advanced parole” loophole has ensured:

    As of August 21, 2017, 45,447 DACA recipients have been approved for advance parole through an I-131 Application for travel documents. This approval allows a DACA recipient to travel out of the country and legally return, making them eligible to adjust their immigration status and receive a green card.
    Overall, 60,000 of the 800,000 DACA illegals have been allowed to apply for Green Cards via several legal routes. That number includes the 45,000 DACA illegals who are using the “advanced parole” backdoor.


    So far, 40,000 DACA illegals have been approved to get Green Cards. Many have received the cards, and 2,181 have subsequently applied for citizenship.


    The “advanced parole” backdoor has been used for several years. The process works like this: DACA illegals asked officials in Obama’s Department of Homeland Security if they could go home for an emergency and be allowed back into the United States under the “advanced parole” status. The status was previously reserved for a few emergencies, such as a sick traveler on an international flight.


    Once given a Green Card, the former illegal can gain citizenship and voting rights after several years.


    Citizenship gives the former illegals full access to U.S. federal spending programs, and also the “chain migration” right to seek citizenship for the parents who brought the illegals into the United States as children.

    The September 1 statement from the judiciary committee said:

    Preliminary data provided by U.S. Citizenship and Immigration Services in response to recent inquiries from the House and Senate Judiciary Committees indicate that the Obama administration allowed thousands of DACA recipients to exploit an immigration law loophole to obtain green cards. The data also show that more than a thousand DACA recipients have already obtained citizenship. The DACA program was never intended to provide a pathway to citizenship, and the program’s legal future is in jeopardy.


    As of August 21, 2017, 45,447 DACA recipients have been approved for advance parole through an I-131 Application for travel documents. This approval allows a DACA recipient to travel out of the country and legally return, making them eligible to adjust their immigration status and receive a green card. Another 3,993 had their applications denied.


    The data provided indicates 59,778 DACA recipients have applied for Lawful Permanent Resident (LPR) status—also known as a ‘green card’—and 39,514 have been approved. Of those who received LPR status, 2,181 have applied for U.S. citizenship and 1,056 have become U.S. citizens.

    The news about the 45,000 Green Cards comes as President Trump decides whether to end the DACA amnesty, which now provides work-permits and Social Security cards to 800,000 illegals.


    Business groups, GOP leaders, as well as Trump’s globalist aides, Democrats and the establishment media, are pressuring Trump to preserve the DACA program despite his campaign promise to immediately revoke the amnesty. He is expected to announce a decision by Monday.

    3,000 DACA Recipients Already Put on Path to Citizenship

    In response to a congressional inquiry, U.S. Citizenship and Immigration Services (USCIS) finally admitted that Deferred Action for Childhood Arrivals (DACA) illegal aliens are being put on a path to citizenship. Specifically, USCIS sent a letter to Sens. Chuck Grassley (R-IA) and Mike Lee (R-UT) that revealed that 2,994 DACA have "been approved for adjustment of status" — likely receiving legal permanent resident (green card) status — after further exploiting our immigration laws by being granted "advance parole." (See Letter from Senators Grassley and Lee, Mar. 2, 2016, and USCIS Response, June 29, 2016) Notably, this admission directly contradicts President Obama's promise from June 2012 when he unilaterally implemented DACA, stating in the Rose Garden, "This is not amnesty, this is not immunity. This is not a path to citizenship." (See Rose Garden Remarks, June 15, 2012)


    Advance parole is an administratively created tool that allows an illegal alien to leave the U.S. with a promise of being "paroled" back into the U.S. upon return. (See FAIR Legislative Update, Feb. 23, 2016) Advanced parole, which has no statutory backing, is ostensibly based on the humanitarian parole statute. (Immigration and Nationality Act § 212(d)(5)) Granting parole is significant, because it allows aliens to circumvent provisions in the law that would normally bar their admission. (See INA § 201(b)(2)(A)(i); § 245(a)) Generally, aliens who have been residing in the country illegally long term cannot simply return to the country if they leave. INA Section 212(a)(9)(B) bars the admission of aliens who have been illegally present in the U.S. between six months and a year for three years; it also bars the admission of aliens who have been illegally present in the U.S. for over a year for ten years. (INA § 212(a)(9)(B)) But, by paroling them instead of admitting them into the country, the 3- and 10-year bars do not apply. (Id.)


    Furthermore, now that the alien has entered the country through parole, the alien avoids certain grounds for inadmissibility, such as INA § 212(a)(6), which applies to aliens who are present in the country without "admission or parole," and INA § 212(a)(7), which applies to aliens who are not in possession of valid entry documents. (INA § 212(a)(6-7)) Moreover, paroled aliens who are immediate relatives of U.S. citizens are generally eligible to apply for a green card and citizenship. (See INA § 245(a), (c)(2); see also USCIS.gov)


    Ever since Congress rejected mass amnesty legislation, the Obama administration and its allies have been working behind the scenes to help DACA apply for advance parole. Not surprisingly, the Obama administration has expanded the grounds of advance parole to include "educational" and "employment" purposes to significantly expand the number of illegal aliens eligible to exploit advance parole and be put on a path to citizenship. For example, several Southern California university officials are creating "study abroad programs" for DACA students to get advance parole to essentially visit their families before returning to the U.S. with lawful status. (See FAIR Legislative Update, Feb. 23, 2016; The Fresno Bee, July 18, 2016)


    The number of DACA recipients who wind up on a path to citizenship by exploiting advance parole is likely to increase significantly before the end of Obama's presidency. According to the USCIS letter to the senators, as of December 31, 2015, 22,340 DACA have been approved for advance parole. (USCIS Response, June 29, 2016) Thus far, 5,068 DACA who received advance parole have applied for adjustment of status, and 2,994 were approved. (Id.) Importantly, the USCIS letter fails to include the number, if any, of DACA who were denied advance parole or adjustment of status. (Id.) Given the extremely high approval rate of DACA applications, it is likely that USCIS is rubber stamping advance parole and adjustment of status approvals for those who know to take advantage of the process. According to USCIS data over 800,000 illegal aliens have had their DACA applications approved through the second quart of Fiscal Year 2016. (USCIS DACA Data)


    While the USCIS letter sheds some light into this scheme, many questions remain unanswered. Predictably, USCIS did not fully respond to all the questions posed by Sens. Grassley and Lee and attempted to downplay the scope of advance parole with the numbers it provided. (Compare Letter from Senators Grassley and Lee, Mar. 2, 2016, with USCIS Response, June 29, 2016) For example, USCIS omitted the numbers of applications denied and how many applications were still pending. (Id.)

    Thousands of Dreamers have used a loophole in federal law to get on a full pathway to citizenship, top congressional Republicans revealed Friday, citing government data withheld by the Obama administration but provided by the Trump administration.

    The Dreamers were all part of DACA, the legally questionable amnesty program that’s under scrutiny right now as President Trump decides whether to scrap the Obama-era amnesty.
    The House and Senate Judiciary Committees revealed that more than 45,000 DACA recipients were approved for “advance parole,” which is permission to leave and reenter the U.S. despite not being in permanent legal status here.

    But under a quirk of law, those granted advance parole can then ask to adjust their status and gain legal residence — and eventually citizenship — as long as they have a qualifying relationship.

    The Obama administration had seemed intent on keeping the data secret, refusing to answer requests from Congress. The Trump administration complied.
    According to the data from U.S. Citizenship and Immigration Services, as of Aug. 21, 45,447 DACA recipients had been approved for advance parole.

    The loophole is known among immigration activists, and public colleges in California were urged to use it to help their illegal immigrant students here under the DACA program to gain legal status.

    The California-Mexico Studies Center actually advertises just such a program, charging thousands of dollars to give Dreamers a chance to travel south to Mexico to qualify for advance parole. Part of the fees the program collects help pay for “legal advice and filing assistance” in obtaining advance parole.

    Another class of 35 students took advantage of the program earlier this month, visiting Mexico then returning back to the U.S. legally — and now able to petition for permanent legal status, if they have another qualifying relationship such as a citizen child or spouse.
