ACLU Assails 100-Mile Border Zone as 'Constitution-Free'

Government agents should not have the right to stop and question Americans anywhere without suspicion within 100 miles of the border, the American Civil Liberties Union said Wednesday, pointing attention to the little known power of the federal government to set up immigration checkpoints far from the nation's border lines.
The government has long been able to search people entering and exiting the country without need to say why, which is known as the border search exception of the Fourth Amendment.
After 9/11, Congress gave the Department of Homeland Security the right to use some of its powers deeper within the country, and now DHS has set up at least 33 internal checkpoints where they stop people, question them and ask them to prove citizenship, according to the ACLU.

I went after the ACLU in my County Legislature meeting because they threatend to sue the county for restricting Level 3 Sex Offenders. During the public comments the head of the Albany NY ACLU was right behind me and I turned around and blasted him. I told him his group should be called the AACLU for Anti American Civil Liberties Union. I asked him where my rights as a law abiding working taxpayer were and asked him what about the rights of my daughter. He would not answer me. I took a lot of heat on the internet for what I said as did Susan Savage the Legislative Chair but so what. I have rights. Below is a sample of what they said about me.

I'm familiar with San Diego county and the check point Mr. Peppard went through is on Hwy 94 which runs parralel to the border. Hwy 94 is a rural country road and not an interstate. I've been through that check point many times and have had no problems with the agents working there. There are many such check points in San Diego county and they are set up to stop alien and drug smuggling along with other contraband, the agents are trained in what to look for and are for the most part nice people just doing their job.
Mr. Peppard would have been in Tecate Mex. and would have come out Hwy 188 and turned west on Hwy 94 traveling towards San Diego passing miles of open area where drugs could have been picked up and put in his vehicle, the fact that he was carrying a load of tiles would have lowered his vehicle some and that would alert the agents to check him. Granted nobody likes to be pulled over and checked but people who cross over the border and those who live along it should understand why this is being done. The agents are not gestapo types, in fact I have often joked with them when passing through but if they are given a hard time they can give it right back, they also have to have a reason to pull a vehicle into secondary inspection. North County lies in this 100 Mile Border Zone so some of our laws do not apply to Illegal Aliens and others.

The reference I was looking for was in the story I posted to.
I guess I have to read the story better the first time.
As you can see they posted my comment.Keenan said the news conference was part of a nationwide effort by the ACLU to call attention to the increased frequency of Border Patrol and police checkpoints around the country, particularly in areas within 100 miles of the border.
The Department of Homeland Security has been given broad authority by Congress to stop and question people without probable cause within this 100-mile zone, Keenan said.

Demetrio Antonio, 29, of Oceanside, who is an illegal immigrant, is surrounded by police officers. His car was impounded at an Oceanside Police Department checkpoint on Wednesday because he was driving without a licence.
