ACLU Sues Federal Government For Detaining Illegal Aliens

To be clear, being in the United States without permission is a crime. Liberals try to confuse this inconvenient fact by calling illegal aliens “immigrants” and “new Americans,” but make no mistake, these people are breaking the law. The American Civil Liberties Union (ACLU) not only won’t acknowledge the fact that these people are criminals, they also seem to think that they have the same rights as American citizens. The faux civil rights group is actually suing the federal government for detaining illegal aliens.

The ACLU of San Diego and Imperial Counties is suing the federal government for allegedly depriving immigrants of their due process rights by detaining them for months before giving them an opportunity to see an immigration judge.

People charged with crimes usually get to see a judge within 48 hours, while immigrant detainees who have not committed crimes are routinely held upwards of two months before they get a court hearing, said Bardis Vakili, senior staff attorney for San Diego’s ACLU.

The federal government doesn’t detain “immigrants” it arrests illegal aliens. Also, as I just pointed out, being in this country without permission is a crime. It’s astounding that the ACLU can’t grasps these simple facts, yet thinks it has the legal standing to sue the government for enforcing existing Constitutionally sound laws.

The lawsuit, announced Friday and filed in federal court against the Department of Homeland Security and the Department of Justice on Thursday, seeks to end the practice of long detentions prior to immigration hearings.

“If the government is going to deprive someone of their liberty, they need to be given some fair process. And locking them up and throwing away the key for two or three months or longer is hardly a fair process,” said Vakili.

Incarcerating someone for two months is not “locking them up and throwing away the key.” That’s actually not that long of a detention, considering how many illegal aliens there are clogging up the court system, which by the way is a problem the law breakers have created.

Missing from this argument is the obvious point that none of these illegal aliens are being detained against their will. They are chosing detention rather than going back to their home countries. Each and every one of them, except those charged with additional crimes in the US, has the option to self-deport. They would rather be in detention, hoping for some kind of technicality or loophole that will allow them to stay in America.

Another missing point here is that illegal aliens don’t have the same rights as American citizens. The enumerated and protected rights of the Constitution apply to US citizens not foreign nationals who have snuck into the country. Illegal aliens can’t vote, own a gun, work for the government, or assemble. Well, they aren’t supposed to do those things but democrats turn a blind eye when they do. The point is, the Bill of Rights doesn’t extend to non-citizens.

Illegal alines have basic human rights and the Supreme Court ruled that they also have a right to due process. Neither the Constitution nor the Supreme Court however says that they have a right to see a judge within 48 hours like the ACLU claims.

Unshockingly, this ACLU lawsuit has less to do with the illegal alien detention system, that is the same as it was under Obama, and more to do with the liberal hysterical reaction to Donald Trump’s presidency:

Vakili said the ACLU expects the duration of detentions to increase under President Trump as his administration ends catch and release policies and detains a rising number of immigrants.

“With the rhetoric that the administration is going to focus on detention and essentially default to detention decisions … the situation will get a lot worse if the court doesn’t step in now and say there’s a requirement here that you must present them quickly to a judge,” Vakili said.

There is nothing about the lawsuit that isn’t deceptive, but the fact that they are motivated in filing it because of something that might happen because of Trump makes it extra stinky.

They didn’t sue when Obama was president and they aren’t suing because anything is different now. They aren’t even suing because of something Trump did, but rather something he might do.

This could actually work in our favor. They do need to see an immigration judge immediately so they can be deported the hell out of here immediately. I happen to agree with their position. They need and more importantly we the people of the United States need swift deportation hearings within 48 hours to issue immediate fast track deportation orders. We need to recall that law that requires an immigration judge be a lawyer. They don't need to be a lawyer. This is simple as pie stuff.

Are you a citizen? Yes or no.

Do you have valid unexpired documents to be here? Yes or no.

If no and no, out you go.

Easy Peasy. Anyone with a college degree can figure this out honestly and fairly. ICE is on hand with all the facts and records to verify. If they were citizens they wouldn't be detained.

If they were legal immigrants with valid unexpired documents they wouldn't be detained, unless they'd violated the terms of those documents and didn't have their documents with them, committed crimes or in any other way violated the terms of the documents, they wouldn't be detained to begin with.

They sure did. All Trump has to do is say, 48 hour deportation hearings, it's the law, the ACLU said so and I'm sure the courts will agree. He can pull money from wherever to fund it, it's a civil rights issue. Issue an Executive Order that says all detained illegal aliens will be processed in 48 hours and he's waiving law degrees to be an Immigration Judge for Deportation Purposes. He can line up all those Treasury Agents in the IRS to be Immigration Judges. Their time will be far better spent in my opinion. They can have thousands processed at a time.

In fact they could have big auditoriums of them and ask who is a citizen? Who has valid unexpired documents? No one. Okay. Deport all of them at once, big giant rooms of them in 15 seconds.

Actually I disagree. What could happen should the ACLU win is more catch and release. Yep, they'll catch them and then be forced to release them until their case can be heard by an immigration judge. Nope, we need to keep them detained for as long as it takes to have their case heard and deport them, which means we need the ACLU to lose.

Unfortunately our immigration court system is not prepared to see all these illegals within 48 hours. I wish it was, but it just isn't. Oh, and it certainly isn't prepared to rule on their cases. We currently have over half a million awaiting their court date as we speak. ICE needs to have the authority to detain these folks for as long as necessary, not release them back on the streets until an immigration judge can hear their case.

You also seem to be forgetting that some of these cases aren't as cut and dried as you or I would like. Unfortunately many of them are seeking asylum and other remedies.

Whatever. You're operating under the old way that didn't work, MW. We're going for a new fast way to actually solve this problem instead of perpetuate it. Trump's already issued an Executive Order ending Catch and Release. Courts can't over-rule that.

I'm not operating under any way!!! That is the way the system works and anyone paying attention knows that. As for catch & release ...... it's still being done in some cases. I'd be more than happy to see the laws change and a couple thousand more immigration judges in place tomorrow, but obviously that's not going to happen. Nope, ICE needs the authority to hold these folks as long as necessary, not be forced to release them back on the streets.

Nope, they need to be rapidly deported, all of them. In one shot. They don't need individual hearings. Hold mass deportation hearings. None of US want to spend one more dime on these losers. We want them out of our country. We don't want to feed them, house them, cool them, heat them, medicate them, or supervise them.

WE WANT THEM OUT OF HERE.

The things I'm telling your are facts based on reality, not my own wishes and opinions. If I had my wish, I'd twitch my nose and have them all out of here today, but unfortunately I can't have my 'own' wish and neither can you. We have to operate under the reality we're given, not fantasy land wishes.

We want them out of here and a lawsuit that says deport or release is going to result in massive rapid deportations, under this Administration, in my opinion. In fact I think they'll all be gone before this lawsuit gets its first argument, because Trump isn't releasing these people back on the streets. No way.

That WILL be a show-down all the way to the US Supreme Court.

You have a point MW, I just get so frustrated with the ACLU filing frivolous lawsuits on behalf of illegal aliens, refugees, muslims and everything else that is anti-American.
