Guatemalan Man Sentenced For Human Smuggling, Reportedly Raped 17-Year-Old Girl



SIOUX CITY, IA - On Friday, Cristobal Francisco-Nicolas, 38, was sentenced in U.S. District Court to 18 months in prison, after pleading guilty to encouraging an alien to come to or enter the United States and unlawful possession of identification documents.

In May 2019, an unidentified man and his teenage daughter entered the U.S. illegally over the Mexican border, and subsequently taken into custody by U.S. Border Patrol Agents.

The next day, the pair was released from the El Paso Detention Center on an Order of Recognizance and Supervision.


In less than 24 hours after being released, the illegal aliens were caught on security cameras boarding a plane to Omaha, Nebraska, according to court documents.

In Omaha, Francisco-Nicolas picked them up and drove them to a stash house in Sioux City.

KTIV reported:

"On June 5, 2019, court documents claim after being raped five times, the victim said Francisco-Nicolas left for work and did not lock the door. That’s when the victim ran out of the house looking for someone who spoke Spanish to help her. This is when Sioux City Police found her and she told them she had been sexually assaulted."

"People at that home were interviewed by police. One of the people told police the couple helped approximately 10 family members and friends, who have traveled to the U.S. from Guatemala."

On July 10, 2019, both Cristobal Francisco-Nicolas, and his wife, Amy Francisco were arrested at the San Ysidro Port of Entry in San Diego. His 40-year-old wife also pleaded guilty of encouraging an alien to come to or enter the United States, and sentence to one year in federal prison.

Francisco-Nicolas received an incredibly light sentence, considering he was facing 15 years in prison on the charges.
