Officials: Agents in impending ICE raid shouldn't expect cooperation from local authorities

Federal immigration agents shouldn't expect cooperation from local authorities when they begin a mass roundup of migrant families with deportation orders, an operation slated to begin Sunday at the direction of President Trump.

Several elected officials in cities expected to be targeted by U.S. Immigration and Customs Enforcement (ICE) have either condemned the impending arrests or said they won't allow local resources to be used to assist the federal agents.

The operation is expected to target 2,000 families in up to 10 cities, including Chicago, Baltimore, New York, Houston, Los Angeles and Miami. On Monday, Trump announced via Twitter that ICE would be “removing the millions of illegal aliens who have illicitly found their way into the U.S."

Next week ICE will begin the process of removing the millions of illegal aliens who have illicitly found their way into the United States. They will be removed as fast as they come in. Mexico, using their strong immigration laws, is doing a very good job of stopping people.......

Chicago Mayor Lori Lightfoot said in a statement that the city has taken steps to support immigrants families, and that ICE agents would get no assistance from the city.

"I reiterated that CPD will not cooperate with or facilitate any ICE enforcement," said the first-term mayor. "I have directed – and Superintendent [Eddie] Johnson has confirmed – that CPD has terminated ICE's access to CPD's databases related to federal immigration enforcement activities."

The President should understand that not only are these threats cruel and antithetical to our American values, they are actually making our communities less safe by sending more residents into hiding, cut off from resources, support, and opportunity.

Los Angeles Mayor Eric Garcetti also reaffirmed that the city and local law enforcement wouldn't participate in or support the operation.

“Los Angeles will always stand with our immigrant brothers and sisters, and our law enforcement officers will never participate in these actions,” Garcetti said in a statement. “No Angeleno should ever have to fear being snatched from their home or separated from their loved ones — and we are doing everything we can to provide immigrant families with the information and support they need.”

California's Democratic Gov. Gavin Newsom, in a similar vein, called the impending removals "cruel" and "misdirected," adding that it creates "unnecessary fear and anxiety."

"I want Californians to know they have legal rights and protections, regardless of their immigration status," said Newsom. "California is a place of refuge – that includes our schools, our courts and our hospitals and clinics. We hold certain institutions sacred and people should continue to access programs and services they need.”

Immigrant advocates are warning families about the planned arrests and what resources are available to them.

The Office of Immigrant Affairs in New York tweeted a link Friday advising immigrants of their rights in light of Trump's directive.

Likewise, the San Francisco-based National Immigration Law Center is urging undocumented immigrants to know their rights. The advocacy group said "targeting innocent immigrant families with secret raids that are designed to inflict as much fear and pain as possible."

Houston Police Chief Art Acevedo the arrests could impede law enforcement efforts in the future.

"It instills fear," Acevedo said. "We rely on the cooperation of that population to keep all Americans safe, all residents safe, and all members of society safe. ... When you say you're going to go arrest millions of people, that has a chilling effect on the cooperation."

I think there is a better way ICE could do this. Even though I hate sanctuary cities, if I had limited resources, I would prefer to work with cities and states that support immigration enforcement rather than fight with cities that are going to fight me. I would make open invitations to both cities and states that says that ICE has a program where they will work with local law enforcement who are most interested in working with them and will support their affords. For example, local police can assist in surrounding businesses for raids or transporting captured illegal immigration to jail. To me, this make way more sense than going to cities where there are little support.

But an even better idea than chasing/hunting thousands of illegal immigrants is to allow states to do what President Obama prevented them from doing. Many cities wrote laws offering to help the federal government enforce immigration laws. The Supreme Court struck down some of these laws, but they never said that they were illegal. They only said that if the federal government (previously President Obama) did not want the assistance of the States, they could refuse the help. If the current President Trump wants to accept the help, he could let local law enforcement capture illegal immigrants during normal jail processing, hold them in jail as part of ICE detention, and release them to ICE agents when they arrive.

Delegation of Immigration Authority Section 287(g) Immigration and Nationality Act

Overview

U.S. Immigration and Customs Enforcement (ICE) 287(g) Program enhances the safety and security of communities by creating partnerships with state and local law enforcement agencies to identify and remove aliens who are amenable to removal from the United States.

The Illegal Immigration Reform and Immigrant Responsibility Act of 1996 added Section 287(g), to the Immigration and Nationality Act. This section of law authorizes the Director of ICE to enter into agreements with state and local law enforcement agencies, that permit designated officers to perform limited immigration law enforcement functions. Agreements under section 287(g) require the local law enforcement officers to receive appropriate training and to function under the supervision of ICE officers.

The 287(g) Program continues to receive overwhelmingly positive feedback from its partners. The mutually beneficial agreements allow state and local officers to act as a force multiplier in the identification, arrest, and service of warrants and detainers of incarcerated foreign-born individuals with criminal charges or convictions.

Those deemed amenable to removal are identified while still secure in state or local custody, potentially reducing the time the alien spends in ICE custody. The state and local partners benefit by reducing the number of criminal offenders that are released back into the community without being screened for immigration violations. Gang members, sex offenders, and murderers are often identified and taken into ICE custody after serving their criminal sentences, thus being removed from the community. The efficiency and safety of the program allows ICE to actively engage criminal alien offenders while incarcerated in a secure and controlled environment as opposed to the alternative of conducting at-large arrests which can pose safety concerns for the officers and the community and may result in collateral arrests. Federal, state and local officers working together provide a tremendous benefit to public safety through increased law enforcement communication and overall community policing effectiveness.

Memorandum of Agreement

ICE and the requesting Law Enforcement Agency (LEA) sign a Memorandum of Agreement (MOA) that defines the scope, duration and limitations of the delegation of authority. It also sets forth the training requirements, the terms of ICE supervision, and requires the partnering LEA to follow DHS and ICE policies when its designated immigration officers (DIOs) perform delegated immigration enforcement functions.

How to Participate

Officers participating in the 287(g) Program must possess U.S. citizenship, complete and pass a background investigation, and have knowledge of and have enforced laws and regulations pertinent to their law enforcement activities at their jurisdictions. Types of Models

• Jail Enforcement Model
  The 287(g) Program utilizes the Jail Enforcement Model (JEM) to accomplish its mission, which is designed to identify and process removable aliens with criminal or pending criminal charges who are arrested by state or local LEAs. The JEM Program is supervised by the local ICE Office of Enforcement and Removal Operations Field Office. Under the JEM, nominated state and local law enforcement officers will be trained, certified, and authorized by ICE to perform only those immigration functions that are established on the Standard Operating Procedures (SOP) of the Memorandum of Understanding. ICE provides a training program conducted at the Federal Law Enforcement Training Center ICE Academy in Charleston, SC.

• Warrant Service Officer Model
  The 287(g) Program developed the Warrant Service Officer (WSO) model to provide an opportunity for jurisdictions to participate in a narrower cooperative agreement with ICE. Under the WSO model, nominated state and local law enforcement officers will be trained, certified, and authorized by ICE to perform limited functions of an immigration officer within the law enforcement agency’s jail and/or correctional facilities as set forth in the Standard Operating Procedures of the Warrant Service Officer Memorandum of Agreement.
  
• ICE provides a training program conducted by certified instructors at a location most convenient for the participating LEA.

287(g) Successes

In fiscal year (FY) 2018, the 287(g) Program encountered approximately 700 aliens convicted for assault, 670 convicted for dangerous drugs, 150 convicted for sex offenses/assaults, 150 convicted for obstructing police, 125 convicted for weapon offenses, and 13 convicted for homicide.

Recent Arrests

South Carolina: On January 7, 2019, a Designated Immigration Officer from the Horry County Sheriff’s Office 287(g) Program encountered a citizen of Jamaica who was charged with assault/attempted murder. The subject’s prior criminal history includes an arrest for driving without a license. The subject was admitted into the United States as a non-immigrant B-2, Temporary Visitor for Pleasure, and had stayed past the duration of the visa. The Horry County 287(g) Program placed an immigration detainer, Form I-247A, and warrant on the subject.

Texas: On November 18, 2018, Designated Immigration Officer from the Galveston County Sheriff's Office 287(g) Program encountered a citizen of Mexico who was charged with sex offender’s duty to register (Failure to Register). The subject had previously been convicted of aggravated sexual assault of a child. The Galveston County 287(g) Program placed an immigration detainer, Form I-247A, and warrant on the subject.

Georgia: On March 13, 2019, a Designated Immigration Officer from the Charleston County, SC Sheriff’s Office 287(g) Program encountered a citizen of Mexico who was charged with criminal sexual conduct with a minor second degree – victim 11 to 14 years of age. The individual had previously been removed. The Charleston County 287(g) Program placed an immigration detainer, Form I-247A, and warrant on the individual, who will be served with a Notice of Intent/Decision to Reinstate Prior Order, Form I-871.

• Overview

The highest priority of any law enforcement agency is to protect the safety and security of the communities it serves.

ICE prioritizes the removal of public safety and national security threats, those who have violated our nation’s immigration laws, including those who have failed to comply with a final order of removal, and those who have engaged in fraud/willful misrepresentation in connection with official government matters.

Secure Communities is a simple and common sense way to carry out ICE's enforcement priorities for those aliens detained in the custody of another law enforcement agency (LEA). It uses a federal information-sharing partnership between DHS and the Federal Bureau of Investigation (FBI) that helps to identify in-custody aliens without imposing new or additional requirements on state and local law enforcement. For decades, local jurisdictions have shared the fingerprints of individuals arrested and/or booked into custody with the FBI to see if those individuals have a criminal record and outstanding warrants. Under Secure Communities, the FBI automatically sends the fingerprints to DHS to check against its immigration databases. If these checks reveal that an individual is unlawfully present in the United States or otherwise removable, ICE takes enforcement action – prioritizing the removal of individuals who present the most significant threats to public safety as determined by the severity of their crime, their criminal history, and risk to public safety – as well as those who have violated the nation’s immigration laws.

The federal government, not the state or local law enforcement agency, determines what immigration enforcement action, if any, is appropriate.

Only federal DHS officers make immigration enforcement decisions, and they do so only after an individual is arrested for a criminal violation of local, state, or federal law, separate and apart from any violations of immigration law.

The Basics

ICE completed full implementation of Secure Communities to all 3,181 jurisdictions within 50 states, the District of Columbia, and five U.S. Territories on January 22, 2013.

While the biometric interoperability has remained constant since full implementation was achieved, ICE’s operational posture under Secure Communities was temporarily suspended by DHS policy from November 20, 2014, through January 25, 2017.

Since its reactivation on January 25, 2017 through the end of Fiscal Year (FY) 2017, as a result of Executive Order No. 13768, entitled Enhancing Public Safety in the Interior of the United States, more than 43,300 convicted criminal aliens have been removed as a result of Secure Communities.

How Does Secure Communities Work?

Through the aforementioned Executive Order, DHS has been provided clear and common-sense priorities for immigration enforcement focused on the faithful execution of the immigration laws of the United States, as passed by the Congress. Secure Communities will utilize all available data systems and Criminal Alien Program resources to identify and take enforcement actions (to include the lodging of detainers) against criminal and other priority aliens while they are in the custody of another law enforcement or correctional agency. This will prevent their release back into the community, and thus stop the cycle of recidivism perpetrated by many of these criminal and immigration offenders.

Secure Communities had a long and successful history prior to its suspension as indicated above. In fact, from its inception in 2008 through FY14 and since its reactivation on January 25, 2017 through the end of FY 2017, Secure Communities interoperability led to the removal of over 363,400 criminal aliens from the U.S.
