    ALBERTVILLE, AL (WAFF) -An undocumented immigrant is in custody after Albertville police say he slammed into a local family, sending them to the hospital Monday night.

    Police are holding 48-year-old Faustino Otero Garcia on charges of driving under the influence.

    Police believe the family had stopped in a fast food restaurant for a bite to eat but were then slammed into by an impaired driver.

    The accident happened just after 6 p.m. in front of the Wendy's on Highway 431. Police say Garcia was driving erratically, and a driver behind him was trying to call police to inform them.

    They say he then did a U-turn and began traveling southbound at a high rate of speed, striking the family leaving the parking lot.

    The father and one of his sons were taken to Marshall Medical Center South where they were treated and released.

    Two other young children were flown to UAB where their conditions are not known.

    Garcia was taken into custody. Police believe there could be more charges.

    "You know, the investigation starts there. The accident, the cause of the accident, obviously right now we think alcohol is going to be a very large contributing factor," said Albertville Police Chief Jamie Smith.

    Garcia is being held in the Albertville City Jail on a $1,000 bond but also has an immigration hold.

    ALBERTVILLE Ala. -- Albertville Police confirm a drunk driver struck a vehicle carrying two adults and three children leaving Wendy's on Highway 431 around 6 p.m. Monday. Two of the children were hospitalized.
    Police arrested Faustino Garcia at the scene of the crash for driving under the influence.

    Albertville Police Chief Jamie Smith said Garcia was heading northbound on 431. "The vehicle in question made a U-turn and actually headed back southbound. From the witness statements, and from what I understand, at a very high rate of speed."

    Chief Smith said another driver on the road at the time, saw the car moving erratically and tried to dial 911, but it was too late. "The other vehicle was leaving the parking lot at Wendy's and then that's when the collision occurred."

    Two children, who Chief Smith believes are around 10-years-old, were thrown from the car during the crash and were flown to Children's of Alabama. The other three passengers were taken to local hospitals by ambulance.

    "Our investigators are looking at it to see if maybe we can upgrade a charge or add a charge of maybe an assault," Smith said.

    He said wrecks involving children are especially difficult. "Anytime you see a kid involved in something like that it's tough. It's tough on the fire guys, it's tough on the police. It's one of those things where you just have to put your feelings aside, and just do your job."

    Friends of the family involved in the wreck said the two children are still in the hospital but are stable.

    what would you do if this was some one in your family . would you say that ok . I don't think so you have the illegal immigrants out so fast .& don't say this could not happen to you it could .( NO amnesty )(no Deal.)( no Birth right.)( no Citizen ship.) at all & no green card) Trump get all of them the hell out & fast don't wait . (who going to be next to get kill)
