Tennessee is the latest state to pass legislation banning the establishment of sanctuary cities. House Bill 2315 passed the House 64-23 and the Senate 25-5 and now awaits the signature of Republican Governor Bill Haslam.

Introduced by Rep. Jay Reedy, the bill mandates that Tennessee law enforcement comply with detainer notices from Immigration and Customs Enforcement (ICE). It further attempts to prevent the future creation of local sanctuary policies by barring such jurisdictions from receiving "any state moneys until the sanctuary policy is repealed, rescinded, or otherwise no longer in effect."

According to the Center's sanctuary city map, Tennessee does not currently have any sanctuary jurisdictions, and neither ICE nor the Department of Justice identified any Tennessee localities with such policies.

Tennessee follows Iowa and Texas as the most recent states to ban sanctuary policies state-wide. The opening text of the bill says that "allowing illegal immigrants to reside within this state undermines federal immigration laws and state laws allocating available resources." With the passage of HB 2315 Tennessee has made clear their state's commitment to enforcing federal immigration law.

NASHVILLE - Tennessee Republican gubernatorial hopeful Diane Black on Thursday urged Gov. Bill Haslam to sign a controversial anti-"sanctuary city" bill that threatens local governments with loss of new state economic development grants if they don't cooperate with federal immigration officials.

"The voters of Tennessee want our leaders in Nashville to get tough on illegal immigration," said Black, a congressman running in the multi-candidate GOP gubernatorial primary on Aug. 2, in a statement. "Sanctuary cities have no place in our state, and Governor Haslam should sign the anti-sanctuary cities legislation passed by the General Assembly – the duly elected representatives of the people of Tennessee."

She called it a "common-sense bill that supports law enforcement and prohibits local governments from rewarding illegal immigration. It needs to become a common-sense law."

Haslam's office had no immediate comment.

When asked about the legislation last week, the term-limited governor told reporters "on that bill in particular we want to look at any constitutional issues that might exist as well as real issues for local law enforcement."

"We literally haven't seen the language," said Haslam, noting provisions "took a couple of turns there in the end."

Although Tennessee already has a 2009 law barring cities and counties from adopting so-called "sanctuary" policies regarding undocumented immigrants, proponents say the bill, sponsored by Sen. Mark Green, R-Clarksville, and Rep. Jay Reedy, R-Erwin, applies to unwritten policies and practices and has economic consequences.

The bill requires local sheriffs and police to go along with U.S. Immigration and Customs Enforcement requests to hold immigrants suspected of entering the country illegally.

The requests, under what is known as a "detainer" or "immigration hold," are used by federal authorities to have local and state law enforcement agencies detain people suspected of being in the U.S. illegally who've come into contact with police.

Under President Donald Trump's administration, federal officials are moving more aggressively on deportation efforts.

During committee hearings, Terry Ashe, executive director of the Tennessee Sheriffs Association, told lawmakers that sheriffs typically comply with U.S. Immigration and Customs Enforcement detainer requests to keep detainees for 48 hours. That often runs longer because the limitation doesn't include weekends and holidays.

But Ashe said sheriffs need flexibility to release people mistakenly identified as being in the U.S. illegally. Law enforcement currently has discretion to do that, Ashe said.

TN Republican Governor Bill Haslam is an amnesty supporter. It will be good if he approves this but the tidal wave of Soros funded opposition to any actions against illegal immigration is fierce. The massive demonstrations regularly play out at the Legislature with chants of Si Se Peude.

A Republican candidate for the Tennessee House said Hispanic numbers are growing. They are coached and wear those necklace signs often in the halls of the legislature. He observed them within the last couple of weeks. They are props being used by the TIRRC and open borders to shame American citizens and lawmakers.

Look at the numbers of illegal aliens, hear their chants and demands.

With the ICE raid of April 5 in Bean Station, the tremendous human cost of an increasingly aggressive immigration policy was exposed for all to see. Who could not be moved by the tears of wives, children and relatives suddenly separated from a husband and father or a loved one, not knowing if they will ever be reunited again? Imagine the kind of fear that families are experiencing in deciding to keep their children home and out of school - several hundred according to area schools - in the days following the raid.

Yes, there is a legal side to immigration and the right of a country to regulate its borders. But as the ICE raid revealed so clearly, there is a human side, a human cost as well. With the passage this past week in the Tennessee General Assembly of SB2332/HB 2315, the legal side of enforcement could become much more severe and the human cost that much higher.

According to the Tennessee General Assembly website, the bill of concern “revises present law prohibitions against local government action to interfere with the enforcement of federal immigration laws and extends those prohibitions to state government entities.” Anytime local government or the state loses, or in this case surrenders, its right to govern and enforce laws as it best sees fit, I believe there is a longer-term danger to the dignity and rights of the overall community of people.

But what I find particularly troubling beyond what the bill seeks is that even Tennessee law enforcement agencies do not support this bill. Many have voiced their concern that this bill is simply not necessary and will only cause more problems for law enforcement than it allegedly attempts to stop. Law enforcement is rightly concerned that this bill will result in racial profiling because of the pressure it puts on officers to try to avoid having someone claim they are not cooperating with immigration authority. It may also result in an increase in claims of racial profiling against officers as they attempt to uphold the law.

Another reason this bill is not necessary is that sanctuary cities have been illegal in Tennessee since 2009. For this reason and many others, both on the legal side and human side of the issue of immigration, I pray Gov. Haslam will not give his signature to this bill.

Perhaps it is best to ask the communities in Morristown and Bean Station how much better off and safer they feel now since the ICE raid? Or perhaps ask the local cattle ranchers and farm owners how this raid has affected their enterprises.

For people of the Christian faith, the commandment enjoined upon the Israelites continues to challenge us to recognize our own alien status as a pilgrim people journeying to our true homeland in Heaven: “You shall treat the alien who resides with you no differently than the native born among you; have the same love for him as for yourself; for you too were once aliens in the land of Egypt” (Leviticus 19:33).

I hope the Governor signs the bill. I guess, we'll just have to wait and see if he's a Governor of Tennessee or of Soros.

Sanctuary city bill critics hope rally, letters prompt Haslam veto

Critics of a bill that would ban sanctuary cities in Tennessee and require local law enforcement officials to comply with federal detainer requests are continuing their efforts to encourage Gov. Bill Haslam to veto the proposal.
After sending a letter to Haslam expressing opposition to the bill, the Tennessee Immigrant and Refugee Rights Coalition is set to gather Thursday evening for a rally to pressure the governor to reject the measure.



Organizers of the rally, which was set to begin at 6 p.m. at Legislative Plaza, said hundreds of participants attended the event.




In the organization's April 26 letter, TIRRC's co-executive director Stephanie Teatro noted the legislation in question overlooks the fact that Tennessee does not have any sanctuary cities and that local law enforcement officials comply with federal immigration law.



The bill directs local law enforcement officials to comply with U.S. Immigration and Customs Enforcement requests to hold immigrants for purposes of deportation.


A sponsor of the bill said the measure was simply to provide “teeth” to a law already on the books in Tennessee that prohibits sanctuary cities.



TIRRC says the legislation, which was passed on the final day of the 2018 session, would require all law enforcement officials to inquire about immigration status during routine encounters with residents.



The bill also prohibits local officials from asking for probable cause or a judicial warrant before detaining an individual at the request of the U.S. Immigration and Customs Enforcement, TIRRC says.



"These new mandates would severely restrict the ability of local police to make common-sense, public safety decisions and would force local governments to bear the risk and expense of federal immigration enforcement," Teatro said.



Beyond the language of the bill, Teatro said the "true intent" of the bill was clear when it was under consideration in the legislature. On April 11, the bill's sponsor, Rep. Jay Reedy, R-Erin, used an ethnic slur while referring to Mexican migrants. Teatro also noted among the proponents to speak in favor of the bill was the Federation for American Immigration Reform, an organization deemed a hate group by the Southern Poverty Law Center.



On Wednesday, the Southern Poverty Law Center sent its own letter to Haslam, calling the bill unconstitutional.


The organization pointed to the requirement that local law enforcement comply with requests from federal officials while saying "such detentions would violate both the federal and Tennessee constitutions, which prohibit unreasonable seizures."



As the bill was under consideration in committee, a legislative attorney said the legislation raised "constitutional issues."


Haslam, who can either sign, veto or allow the measure to become law without his signature, previously said he was still weighing his options and wanted to ensure there were no constitutional issues with the bill.



In addition to TIRRC and the Southern Poverty Law Center, the American Civil Liberties Union of Tennessee has encouraged Haslam to veto the measure.



Beyond Thursday's rally, TIRRC is also organizing an effort to get community members to sign onto their own letters outlining their opposition to the bill.



The legislature approved the sanctuary cities bill less than a month after federal officials raided a meatpacking plant in East Tennessee and arrested nearly 100 immigrants.



After the raid, more than 500 children reportedly stayed home from schools in Hamblen County.
