    Anti-Illegal Immigration Ballot Initiative Cleared To Gather Signatures

    SACRAMENTO (CBS13) – A proposed ballot initiative that would strengthen enforcement and tighten laws against undocumented immigrants has been cleared to begin gathering signatures from California residents for the November 2012 election.

    The proposal, filed by a group called the Taxpayer Revolution Committee, lays down a number of specific rules California agencies would be obliged to follow, including forbidding undocumented immigrants from obtaining driver’s licenses and identifying the California counties hardest hit by “alien transnational gangs.”

    The measure would also require law enforcement to “immediately verify with the United States Department of Homeland Security whether an immigration detail is to be issued” in the event a suspected undocumented immigrant is arrested.

    The California Secretary of State’s office announced Wednesday that the bill’s sponsors will have until May 25, 2012 to collect 504,760 signatures from California voters. The measure requires $35 million annually in new funding to combat transnational gangs, and the Legislative Analyst’s Office says increased law enforcement costs at a local level could require millions in additional funding each year.

    Illegal immigration has become a controversial political issue in California in recent months, fueled in part by the California Dream Act, which granted illegal immigrants access to state financial aid for public universities and was signed into law by Governor Jerry Brown in October.

    Arizona lawmakers weathered a political firestorm in 2010 after passing their own anti-illegal immigration measure, but legal challenges have halted the most controversial parts of the law from taking effect.

    Comments on the budget cuts to combat transnational gangs:

    Attorney General Kamala Harris stated: "Transnational gangs are the top emerging public safety threat to the people of California." The budget cuts will "...handcuff the state Department of Justice's ability to fight gang violence and disrupt the flow of drugs, guns and human beings across our border." "The cuts will likely eliminate 55 state lead task forces that coordinate the response to our growing gang problem." "We cannot allow the I-5 corridor to serve as a conduit for transnational gangs trafficking drugs, guns and human beings into California communities." "Organized crimes represent a serious public safety threat in California and their crimes - from drug dealing to gang violence to premeditated murder - reverberate throughout the state."

    On the Attorney General's website: "Violent gangs don't respect borders anymore than they respect the law."

    Gregory D. Totten, president of the California District Attorneys Association: "If this cut is allowed to stand, numerous entities within DOJ will be devastated."

    Irvine Police Chief and President of the California Police Chiefs Association David Maggard stated: "The Mexican drug cartels are steadily driving their operations into California.” "..the Sinaloa cartel is becoming firmly entrenched in California." "FBI sources with whom we have spoken believe that a majority of the 200 reported abductions in California are attributable to Mexican drug cartels."

    Imperial County District Attorney Gilbert Otero stated "...such a move would have a major negative impact on public safety in my county, in the state and across the nation."

    California Narcotic Officers Association President James Hodges stated: "It is fact that the Mexican drug cartels have dramatically increased their profiles in California."

    Narcotics Task Enforcer Jeff Catchings of South Lake El Dorado Narcotics Enforcment Team stated: "If you take away the threat of being caught in this community, it is going to be disastrous...I cannot say that enough."

    Additional remarks:

    The Legislature cut all funding to combat transnational gangs. That budget cut could affect 500 sworn officers and 400 other employees according to the AG's Legislative Division. This enforcement confiscated 7 million dollars in asset seizures last year, and will also lose matching federal funds.

    The Bureau of Narcotic Enforcement, the first in the nation founded 1927, is due to close. This department targets major drug dealers, violent career criminals, clandestine drug manufacturers and violators of prescription drug laws. Some law enforcement agents who are trained experts in investigating criminal gangs and organized crime have been reassigned to focus on recycling fraud and environmental issues.
    Director of the California Department of Justice, Larry Wallace, spoke of the potential for a statewide crime increase.

    The Governor and Legislature also ended the 30 year old marijuana eradication program that has confiscated up to 72% of the nation's marijuana over the last seven years, worth $70 billion.
    The transnational gangs are taking over the violent crime ridden barrio gangs, escalating drug smuggling, sex trafficking, kidnappings and homicides, much of it unreported by the media. With the infiltration of Mexican and Central American drug cartels CA is making 80% of the nation’s methamphetamine, more than the other 49 states combined.
    This state is headed in the wrong direction and it will effect the whole nation. This is why we need this initiative.

    Initiative Summary, with more details:
    ATTORNEY GENERAL to identify twenty counties most impacted by transnational gangs. Increased officer training to combat transnational gang cartels. State and local officers to act as federal officers, to be stationed at all booking, jail, and correctional facilities. Supervisor Gloria Molina signed the 287g contract for Los Angeles County.

    REQUIRES fingerprints of all booked into jail to be verified with ICE pursuant to the Secure Communities program. Supported by Governor Brown and Los Angeles County Sheriff Lee Baca, Alameda County Sheriff Greg Ahern, and many others in law enforcement. This program is violated by Santa Clara and San Francisco counties.
    ALLOWS law enforcement officers to verify immigration status with federal authorities pursuant 8 USC 1373 and 1644.
    DMV cannot accept driver's licenses or identification cards from other states that do not verify lawful status. All SSN's verified with the Social Security Administration. Immigration documents verified with the issuing federal agency.

    An anti-immigration initiative may appear on your November ballot, if the authors can gather up enough voter signatures.

    The Immigration Initiative proposed by the group called The Taxpayer Revolution Committee would require state and local law enforcement agencies to enforce federal immigration law, and in the event of an arrest it states "...the arresting agency shall immediately verify with the United States Department of Homeland Security whether an immigration detainer is to be issued for that person."

    Co-author Ted Hilton says they felt it was an important issue to present to California voters due to the rising problems with transnational gangs.

    "California Attorney General Kamala Harris has stated that the transnational gang crisis is the top emerging public safety threat to the citizens of California," said Hilton.

    The initiative, he says, would address that growing concern by training additional officers to specifically combat transnational gangs, and place trained officers that perform federal functions in ever jail facility in the state.

    "And that's how you save money down the line," says Hilton "because you can move prisoners into federal custody."

    Immigration advocates are concerned the measure would only fuel more discriminatory rhetoric.

    A prior provision to provide $35 million annually for 20 years to the California Department of Justice will not be in the final measure, however.

    Hilton says a finalized version, due out in three weeks, will be sans that requirement.

    He says they initially placed that requirement in the language of the initiative as a way to press state lawmakers to reinstate the funding they cut from the state DOJ in the budget passed over the summer.

    Harris and other California law enforcement agencies spoke out against the $71 million dollar cut in July.

    DA Harris said it would "cripple California's statewide anti-gang and drug trafficking operations."

    Hilton and his co-authors have until May 25th to collect more than 504,000 valid California voter signatures to get it on the November ballot.

    ABOUT THE AUTHOR

    As a graduate student Ted Hilton became a scholar of Constitutional Law, and over the last 20 years has researched the 14th Amendment's original intent, the debates written in the Congressional Globe, along with the study of numerous United States Supreme Court citizenship and jurisdiction decisions including Wong Kim Ark in its entirety.

    One of his degrees is in Mexican-American Studies. He has studied, taught, and written about this population beginning in the 1970's. Ted has lived and studied in Chile and visited extensively throughout Latin America.

    On May 4, 1991, at the border, Ted Hilton held the world’s first press conference on biometric identification for one of its creators, George Warfel, who had recently testified before Congress. Mr. Warfel unveiled the ID as a tool to stop illegal migrations.

    September 1991, Ted Hilton attended with the official County of San Diego delegation to meet congressional staff and lobby in Washington, D.C. for immigrant impact funds that were due San Diego County from the 1986 amnesty.

    He helped to bring national and international media to San Diego and held the first daytime demonstrations along the border and in various communities around San Diego County in 1990 to show the lack of border fencing, and the illegal migrant camps with fires in public parks and on private property. In 1991, Ted spoke in person to Leslie Stahl from 60 Minutes asking her to do a segment on the out of control border, but she did not see that as a major problem or future story.

    Ted Hilton is the orignial author and the first to submit legislation to the state’s Legislative Counsel in 1992 for issuance of the California driver’s licenses to only citizens and lawfully residing residents. SB 976 was written from this text. His proposed initiatives from the early 1990's were later sent to Rep. Sensenbrenner who was crafting the federal Real ID Act of 2005, in which several of the provisions are now included.

    Ted Hilton has authored several commentary op-eds; a ground-breaking call in the Sacramento Bee, February, 1992, to end public school education to those here illegally.

    On March 4, 1994, Ted Hilton's commentary on the 14th Amendment was published in The Daily Journal, the legal newspaper for County of Los Angeles. The newspaper stated it would research the article for accuracy before printing, and the editors titled it "Unconstitutional Citizenship." The article revealed the truth about the original intent of the subject to the jurisdiction clause and called on the state to stop registering births to those here unlawfully.

    In 1995, the Los Angeles Times printed his article on how to improve the use of state identification to stop services to illegal migrants, prevent welfare fraud, and deter criminals.

    On July 8, 2011 the San Diego Union Tribune printed his groundbreaking Birthright Citizenship article "Hearings Could Reveal True Meaning." Unknown facts from the Wong Kim Ark decision were revealed.

    Ted has worked closely on this text with the state's attorneys and with many in the law enforcement community. The latest version of the initiative is projected for the 2012 ballot.

    Immigration initiative petition drive starts

    Among the four new initiative petitions cleared Wednesday for signature gathering is one that would bring Arizona-style immigration enforcement to California. Another would require equal numbers of males and females in the state Legislature.

    That brings to 40 the number of petitions cleared for circulation in the state. With the tab for gathering the needed signatures in the neighborhood of $1 million per measure, most will never see the ballot.

    • The immigration proposal would require state law enforcement officers to enforce federal immigration laws.
    • The gender-balancing proposal would double the number of legislators, and require each district to have one male and one female. (If you think this one has a chance of passing, please email me for generous wagering odds.)
    • Another proposal would eliminate pensions and health benefits for part-time local officials.
    • The other plan cleared Wednesday would close loopholes allegedly used by insurance companies to avoid payouts.

    Other initiative petitions previously cleared for circulation include ones that would make same-sex marriage legal, would require parental notification before a teen had an abortion, would legalize marijuana, and would repeal the death penalty. See the entire list.


    At this point, four measures have qualified for 2012 ballots, two for June and two for November. (The Legislature this year approved a law moving all statewide initiatives to November, but two measures qualified for the June ballot before the law passed.)
    June:

    • A measure to reduce total term limit years for legislators from 14 to 12, but would allow the member to serve all of those years in the same house.
    • A new $1 per pack tax on cigarettes, with proceeds going to cancer research.

    November:

    • A measure originating from Orange County which would make it harder for unions and corporations to use employee money for political efforts. Read my story about this initiative.
    • A water bond put on the ballot by the Legislature.

    Additionally, there are two initiative petitions that are in the process of having their signatures verified:

    • A measure asking voters to throw out the new state Senate lines drawn up this year by an independent citizens commission. Read my story about this one.
    • A measure that would allow insurance companies to give proportional discounts to drivers with some prior insurance coverage.
