    A gaggle of pro-illegal alien activists and parasitic labor union members have turned to the American Civil Liberties Union and the Mexican American Legal Defense and Educational Fund to file a federal lawsuit alleging that Maricopa County Sheriff Joe Arpaio is committing civil rights abuses by doing the job for which he was elected and for directing his deputies to enforce the laws of Arizona.

    Apparently, the trouble-making activists are upset over the fact that Sheriff Arpaio, unlike the Los Angeles Chief of Police, William Bratton or the San Francisco Chief of Police Heather Fong, feels personally obligated to enforce all of the laws of his state, and to lock up every criminal that he, or his deputies can possibly get their hands on.

    Since the Maricopa County Sheriff’s Department first signed up for training by the U.S. Immigration Customs and Enforcement program in April 2007, Sheriff Arpaio’s dedicated deputies have managed to apprehend more than 15,975 illegal aliens in the state of Arizona. Entering the United States without legal authorization from the U.S. Immigration Bureau or staying in the U.S. after a legitimately issued visa has expired are violations of U.S. Immigration laws, and the people who violate either state or federal laws are commonly referred to as “Criminals.â€

    A coalition of Hispanic and labor groups in Phoenix accused Maricopa County Sheriff Joe Arpaio of racial profiling yesterday, alleging in a federal lawsuit that one of the nation's largest sheriff's departments is violating the civil rights of nonwhite U.S. citizens in seeking to arrest illegal immigrants.

    Lawyers for the American Civil Liberties Union and the Mexican American Legal Defense and Educational Fund, which filed the suit, also said the U.S. Justice Department and federal immigration agencies have failed to stop civil rights abuses in Maricopa County, which includes Phoenix, the state capital.

    "As charges of discrimination have mounted, Sheriff Arpaio has only dug in his heels, and the federal government has thus far done nothing to rein him in," said Robin Goldfaden, a lawyer with the ACLU Immigrants' Rights Project. "Unfortunately, court intervention is necessary for the Constitution to be upheld."

    Capt. Paul Chagolla, a spokesman for the sheriff's department, said a move by the groups to seek class-action status of a case filed in December was "old news." He said the 4,000-employee department would not try a case in the media and would not alter its operations.

    "We do not racially profile," Chagolla said. "The sheriff will continue to do his job, and his deputy sheriffs will continue to do their jobs enforcing the law in the state of Arizona."

    At issue are a series of sweeps, often conducted in Hispanic neighborhoods, in which sheriff's deputies and volunteers pulled over cars and stopped people on the street in a search for illegal immigrants and criminals. Critics allege the sweeps targeted individuals based on their physical appearance, such as dark skin or ethnicity.

    One plaintiff, Manuel Nieto Jr., a U.S. citizen, alleged that he was unlawfully handcuffed in front of customers and neighbors by his family's auto repair shop after police heard him listening to music in Spanish.

    "It's not a crime to be Latino or listen to a Spanish-language radio station but you wouldn't know that by the way Sheriff Joe and his posse treat people," Nieto said.

    "There's nothing fair or equal about armed deputies pulling people over and treating them differently because of the color of their skin," said Dan Pochoda, the legal director of the ACLU of Arizona.

    The lawsuit escalates a battle over immigration enforcement tactics in Arizona that could echo nationally during an election year. Similar lawsuits over the last two years have targeted border sheriffs in El Paso, and in Otero County, N.M., who assigned deputies to check the immigration status of people at checkpoints, during routine traffic stops, or in their homes.

    Since signing up for a U.S. Immigration Customs and Enforcement program in April 2007 that trains local law enforcement agents to enforce immigration laws, Maricopa deputies have found that 14,830 individuals arrested on state charges turned out to be in the country illegally. In the course of other duties, deputies discovered and arrested another 1,145 illegal immigrants, Chagolla said.

    But Arpaio, a former D.C. police officer and federal narcotics agent who calls himself "America's toughest sheriff," has also drawn controversy.

    Reelected since 1992 through such popular stunts as building a tent city jail with 2,000 inmates in the desert and forcing prisoners to wear pink underwear, he has also drawn criticism from local officials such as the police chief of Mesa and the mayor of Phoenix. In April, Phoenix Mayor Phil Gordon (D) asked U.S. Attorney General Michael B. Mukasey to launch a federal civil rights investigation, citing the department's "discriminatory harassment, improper stops, searches and arrests" of Hispanic people. The mayor has received no official response, a spokesman said.

    PHOENIX — The American Civil Liberties Union has revamped its racial-profiling lawsuit against Maricopa County Sheriff Joe Arpaio, including adding an aide to Phoenix Mayor Phil Gordon as a plaintiff.
    The new version narrows the focus of the charges against Arpaio and his department to "sweeps" and other enforcement actions where motorists were stopped and questioned because of their skin color, said attorney David Bodney, who filed the revised lawsuit Wednesday in U.S. District Court.
    Bodney said he believes that will be easier to prove in court based on the number of victims.
    He said the new lawsuit asks simply for Judge Mary Murguia to ban the Sheriff's Department from engaging in race-based discrimination and to require the sheriff to put "safeguards" in place to prevent future problems.
    The first lawsuit, filed in December, had sought not only monetary damages on behalf of a discrimination victim but a court order to dissolve the sheriff's special immigration enforcement unit.
    Sheriff's Capt. Paul Chagolla said Arpaio would not comment on the litigation.
    One of the new allegations involves Jessica Rodriguez, whom Bodney identified as an aide to Mayor Gordon.
    According to the lawsuit, Rodriguez and her husband, David, had been visiting Bartlett Lake when they came across a sign that said "road damaged" ahead of a washed-out section. Two sheriff's vehicles were parked on opposite sides of the damaged area.
    Like other motorists, the Rodriguezes turned around and headed the other way before being pulled over. The lawsuit says the couple was asked for Social Security cards and other information; other motorists, all Anglos, were simply stopped and warned about the turn, the suit says.
    Other plaintiffs complained of being singled out for special treatment because of their race.
    Arpaio has been at the center of controversy because of his decision to saturate certain areas with deputies whose specific aim is looking for even minor traffic violations. Arpaio has justified the sweeps saying they result in the arrests of illegal immigrants and of people with outstanding arrest warrants.

    Maricopa County Sheriff Joe Arpaio's immigration and crime sweeps are being targeted in a lawsuit that alleged his officers have racially profiled countless Hispanics.

    The attack on the sweeps alleged the officers based some traffic stops on the race of Hispanics who were in vehicles, had no probable cause to pull them over and made the stops so they could inquire about their immigration status.

    "From what we have been hearing on the ground, (Arpaio) has been violating people's civil rights left and right," said Kristina Campbell, an attorney for the Mexican American Legal Defense and Education Fund, one of the groups pushing the allegations. The allegations were filed Wednesday as part of an existing lawsuit.

    While Arpaio defends the sweeps in Phoenix, Guadalupe, Mesa and other cities as crime suppression efforts, he has been criticized heavily for conducting the crackdowns in heavily Hispanic areas and has fueled a backlash from some officials who consider the operations to be an unwanted intrusion into their communities.

    Sheriff's spokesman Capt. Paul Chagolla declined to comment on the lawsuit's contents, but said the agency doesn't racially profile people and that the sweep allegations were an attempt to refresh a civil case against the sheriff. "This is not a new lawsuit," Chagolla said.

    Allegations about the sweeps were added to a lawsuit, filed in December, that alleges a Mexican man in the country legally was unnecessarily detained by a deputy investigating the man's immigration status.

    Among Arizona's local police bosses, Arpaio has taken the most aggressive approach to cracking down on illegal immigration. His efforts include creating a special immigration unit, arresting more than 1,000 illegal immigrants under a state smuggling law and setting up a hot line to report immigration violations.

    The latest court filing alleged Arpaio, who has 160 patrol and jail officers trained in enforcing federal immigration law, has let deputies and posse volunteers perform immigration duties when they weren't trained to do so.
    The federal agency that gave the officers the special training has said the sheriff has stayed within the bounds of its training agreement.

    Phoenix Mayor Phil Gordon, who disapproved of the sweeps in Phoenix and has become Arpaio's most prominent critic, has asked for a federal investigation of Arpaio for possible civil rights violations.

    The U.S. Justice Department has declined to say whether it would investigate the sheriff.

    Bleeding hearts, anarchists and illegal alien advocates charge immigration enforcement is racist and scapegoats hispanics. Just what race, culture, nationality is an illegal immigrant? Many! However three out of four illegals are from Mexico and Latin America due to that areas proximity to us. Therefore, enforcing our immigration laws will affect more hispanics that other cultures. That is simple fact. That is not scapegoating or racism. That is simply and straightforwardly dealing with those who have broken our laws. By illegally entering our country in massive numbers, a large number of hispanicss have only themselves to blame when law enforcement catches up with them. Additionally, Arizona shares a border with Mexico, a hispanic country and a portal to the entire hispanic region of the world. Therefore, hispanic percentages of illegal aliens in Arizona are likely to be far higher than 75%.

    So let's see how simple math works. 75% of illegal aliens are of hispanic origin. Simple fact. Therefore, arresting illegal aliens will undoubtedly cause the vast majority (likely 75% or more) of the criminals to be of hispanic origin. Simple fact. Arizona is a border state, so the percentages of illegal aliens there is likely far higher than the country's average norm. Simple fact. However, the ACLU and MALDEF are unable to comprehend simple facts and cannot understand simple math. Sheriff Joe Arpaio can. Enough said.

    Here's parying that Sheriff Joe is safe and his job continues to be successful. To h*ll with the "racial profiling" propaganda.

    Here's a thought Joe can take to court with him, if it reaches that level:

    Hispanic is NOT a race, therefore no "racial" profiling can possibly have occurred. Let the ACLU find even ONE example of a "hispanic race." They can't, because it doesn't exist. Hispanic is a cross-breed between 2 of the 3 possible "races" of humans, much like other ethnicities.

    We need more public officials in office who show pure imagination and innovation in carrying out their duties. Sheriff Joe was smart to erect tents to house extra prisoners, rather than release these dangerous people back on the streets, or release them before their sentences are up, before these prisoners are properly reformed.

    Sheriff Joe works within the law to enforce the law. He arrests people for even the smallest infractions. For example, if he sees a group of day-laborers waiting in front of a place of business for the whole day, he arrests them for loitering. This isn't even a small infraction. The day laborers are most likely dissuading regular customers from patronizing the store.

    When these loiterers are arrested, it doesn't matter that the vast majority are Hispanic. They could be any race. They would still be arrested for loitering.

    Joe's crime sweeps have uncovered around 15,000 who were in the country illegally. With 15,000 people detained or deported, countless American lives have probably been saved. More American jobs have probably been saved as well. I don't see how the ACLU can argue against this.
