AZ-Mexican gets 15 years in crash that killed 10 immigrants

Mexican man gets 15 years in crash that killed 10 immigrants
    by Lindsey Collom - Sept. 22, 2009 11:10 AM

A Mexican man has been sentenced to more than 15 years in prison over a fatal rollover that killed 10 undocumented immigrants.

Authorities say Brian Guzman-Ochoa, 39, was at the wheel of an SUV crammed with immigrants in August 2008 when the vehicle jumped a wash before flipping outside Florence.

U.S. District Judge Neil V. Wake sentenced Guzman-Ochoa to 188 months in federal prison Monday. The defendant pleaded guilty in April to one count of transportation of illegal aliens resulting in death.
"This case exemplifies how dangerous, and at times deadly, human smuggling can become," U.S. Attorney Dennis K. Burke said in a written statement. "Smugglers commonly treat crossers as human cargo, and they will face the consequences."

Court records show Guzman-Ochoa fell asleep at the wheel of a 2006 Chevrolet Suburban containing 19 people - all undocumented immigrants - in the early morning hours of Aug. 7, 2008.

Authorities said the vehicle was traveling at 78 mph when it drove off Highway 79 near Florence, flipped and sailed about 60 feet before landing upside down.

Seven men and two women died at the scene. Another man later died in a hospital.

Documents show Guzman-Ochoa told authorities he and another man guided 17 people across the desert for three days and nights before entering the Suburban. Fatigue was likely a factor in the crash, but authorities said Guzman-Ochoa was also under the influence of marijuana.

His arrest marked the 23rd time he was apprehended by U.S. Immigration and Customs Enforcement officials since 1999. ICE records show that at least three of those arrests had been on suspicion of transporting illegal immigrants.

The driver in a fatal rollover that killed 10 illegal immigrants last year was sentenced Monday to 188 months in federal prison.
Brian Guzman-Ochoa, 39, pleaded guilty in April to one count of transportation of illegal aliens resulting in death, according to a news release issued by the U.S. Attorney’s Office in Phoenix.
The Hermosillo, Son., resident was driving a 2006 Chevrolet Suburban northbound on SR 79 near Florence on Aug. 7, 2008 when he veered off the road and launched the SUV over a wash, crashing into the north embankment.
The vehicle contained 19 illegal immigrants, 10 of whom died as a result of the crash. Guzman-Ochoa later identified one of the victims, Jesus Enrique Barrera-Morales, as his partner in transporting the illegal immigrants from Mexico, according to the release.
