An illegal immigrant from Mexico has been sentenced to 27 years in prison for the kidnapping and rape of a Clovis woman.

Prosecutors say 22-year-old Jesus Oscar Dominguez was convicted in September by a Curry County jury, but sentencing was postponed until Friday.

He received the maximum sentence allowed by law.

Dominguez was charged with raping the woman at gunpoint at her home on Feb. 21, 2010. The victim was unable to identify him because he masked his face with a hooded sweater.

Semen was collected and sent to the New Mexico Crime Lab for DNA examination. A match was found in a database of DNA samples from anyone arrested of a felony crime, also known as "Katie's Law."

Dominguez was jailed on unrelated charges when the match was made.

Illegal immigrant nets 27-year sentence under "Katie's Law"

LAS CRUCES - A "Katie's Law" conviction resulted in a 27-year prison sentence Friday for a 22-year-old illegal immigrant in Clovis.

Jesus Oscar Dominguez received the maximum sentence for the 2010 kidnapping and rape of a Clovis woman after a jury conviction in September, 2011 on charges of criminal sexual penetration and kidnapping.

The victim told police that on Feb. 21, 2010, a stranger - Dominguez - knocked on her door, told her he was friends with her father, that his car had run out of gas and he needed to use the bathroom and borrow a gas can. When he emerged from the bathroom, Dominguez brandished a firearm and forced himself on the victim, who was home with her 4-year-old daughter.

The victim was unable to positively identify the assailant, as he masked his face with a hooded sweater, but a rape kit resulted in DNA that, when entered into a database created under Katie's Law, matched Dominguez, who had an extensive history of illegal re-entry into the country and was then in jail on another charge of aggravated assault.

"Without Katie's Law there is a strong possibility that this defendant would never have been caught and brought to justice for this brutal kidnapping and rape," said Clovis District Attorney Matthew Chandler. "However, his DNA left behind at the crime scene was a perfect match to the DNA taken from him during a prior arrest. So, thanks to Katie's Law, a strong victim and a diligent jury, this dangerous criminal will spend the next 27 years of his life behind bars."
