    Fremont council to discuss judge’s ruling on ordinance

    The Fremont City Council is set to go into executive session Tuesday to discuss a judge’s ruling on the illegal immigrant ordinance.


    The council will meet at 7 p.m. on the second floor of the Municipal Building, preceded by a 6:45 p.m. study session.


    U.S. District Court Judge Laurie Smith Camp issued a declaratory judgment a week ago, upholding most parts of Ordinance 5165 requiring Fremont businesses to use the E-Verify system.


    Smith Camp also let stand provisions allowing the city to require occupancy permits, but struck down provisions that would allow the city to revoke licenses.


    Kris Kobach, the Kansas-based attorney who wrote the ordinance and defended it on behalf of the city against lawsuits by the American Civil Liberties Union Mexican American Legal Defense and Educational Fund, said the ordinance will go into affect March 5 and businesses will have to be registered with E-Verify by May 4.


    However, Fremont City Attorney Paul Payne, in a prepared statement, said the city is reviewing the court’s opinion and that there would be no decisions on implementation until after the council meets Tuesday.


    “We are currently researching the city’s options concerning the District Court’s ruling. The Fremont City Council will be briefed on those options Tuesday,” Payne said.


    Fremont voters passed the ordinance on June 21, 2010, and it was scheduled to take effect on July 29, 2010, before the city council decided to delay its implementation until 14 days after legal challenges were settled.


    The council will also consider:


    * An interlocal agreement with Dodge County for a joint communications center.


    “The agreement establishes not only a communications center, but also outlines the control and governance of the center,” Payne said in a staff report.


    Initial and ongoing equipment costs will be split on an equal basis between the city and the county, Payne said. Other expenses will be shared on a 65 percent city, 35 percent county basis.


    * Reconsidering a supplemental agreement with Terracon Consultants Inc. for lead remediation at the former Izaak Walton trap range.


    The council on Feb. 14 deferred the request for a $36,000 addition to the $92,400 contract until after the city receives a no further action letter from the Nebraska Department of Environmental Quality.


    Tuesday’s resolution includes a stipulation that the supplemental agreement would not be paid until after the letter is received from NDEQ.


    * Advertising for bids for sidewalk curb ramp replacement on Military Avenue from Broad Street to Bell Street. The estimated cost is $50,600.


    * Advertising for bids on a tract clearing at 730 E. First St.


    * A request by Kevin and Lori Yount to enlarge a nonconforming use for a new 150-foot by 200-foot building at All Metals Market Inc., 1225 County Road Y. The request, which is in Saunders County but within Fremont’s zoning jurisdiction, was approved by the Fremont Planning Commission.


    * Annual reports from the Fremont Fire Department and Keene Memorial Library.


    * A Fremont Transit System drug testing policy.


    * New ambulance fees.
