Another previously deported Southeastern Provision employee taken into custody during the April 4 IRS-led raid at the Grainger County slaughterhouse was sentenced to time served on Monday, and will be on the fast track for deportation, according to court documents.
David Perez Bartelon has been in federal custody for approximately four-and-a-half months.
Bartelon, a Mexican national, was deported from New Orleans in December 2013, according to an indictment.
Eight Latino Southeastern Provision employees were indicted for illegal reentry. One was indicted for failing to self-deport after being instructed to do so.
The tenth previously deported employee detained by U.S. Immigration and Customs Enforcement, Virgen Mendoza Perez, was indicted – and has pleaded guilty to – illegally returning to the United States following a deportation for an aggravated felony conviction.
Perez was convicted of child abuse in Florida and deported in July 2015, according to an indictment.
She’s scheduled to be sentenced on Jan. 9, 2019, at which time she could be sentenced to time served and placed in line for deportation to Mexico.
The owner of Southeastern Provision, James Brantley, has filed a plea agreement indicating he will plead guilty to failure to pay tax, wire fraud and employing unauthorized aliens.
On April 18, about two weeks after the raid, personnel with the Department of Labor and Workforce Development returned to the beef meatpacking plant for an inspection and imposed $41,555 in penalties.
State labor officials gave Southeastern Provision until September 24 to remedy the identified deficiencies, although the company can seek an extension to come into compliance.
Southeastern Provision also may appeal the monetary penalties to the Tennessee Occupational Safety and Health Review Commission.
The serious violations state labor officials found that were associated with large fines include:
• Failure to install a guardrail to protect employees;
• Failure to conduct a hazard assessment;
• Failure to protect workers subjected to prolonged exposure of noise exceeding 85 decibels;
• Ensuring workers had eye protection to protect them from flying particles;
• Failure to provide eye-flushing facilities to treat workers exposed to corrosive materials;
• Lack of an infirmary to treat injured employees;
• Failure to label hazardous chemicals;
• Failure to utilize procedures dealing with “hazardous energy”;
• Failure to annually inspect energy-control procedure and failure to train employees to do so.
