    By Jerry Seper - A California congressman yesterday called on Homeland Security Secretary Michael Chertoff to override a ruling by a federal judge ordering the delay of construction of security fencing along the U.S.-Mexico border in Arizona.

    Republican Rep. Duncan Hunter, in a letter, expressed concerns over the ruling this week by U.S. District Judge Ellen Segal Huvelle in Washington and called on Mr. Chertoff to exercise his authority to waive all laws impeding the completion of necessary border infrastructure.

    "Environmental groups filing lawsuits to prevent the construction of critical border infrastructure comes as no surprise," Mr. Hunter said. "For years, a stretch of border in San Diego identified by the Border Patrol as 'Smugglers Gulch,' which federal law requires be fenced, has been left open and unprotected due to unrelenting legal action initiated by environmental groups.

    "This has created unnecessary complications in local efforts to secure the border and prevent illegal immigrants and drug smugglers from making their way into the San Diego community," he said.

    On Thursday, Judge Huvelle ordered a temporary halt on construction of a border fence along a 1.5 mile stretch between Mexico and Arizona, on grounds the federal government had not thoroughly performed an environmental impact study.

    The Defenders of Wildlife and the Sierra Club had asked for a 10-day delay, claiming the Bureau of Land Management and other agencies had failed to conduct a thorough study of the fence's effects on the environment.

    Judge Huvelle granted the request, saying the government had not adequately explained why it hastily performed an impact study and quickly began building the fence.

    "The reasons for urgency have not been sufficiently explained," she said, adding that studies done before the construction of border fences in Texas and California took longer and were done more thoroughly.

    The government has acknowledged that the land where the Arizona fence is to be built is a wildlife conservation area, but that it is overrun by illegal aliens, which is causing major environmental damage. It said the foot traffic alone, along with tons of trash left behind by illegal crossers, was worsening the environment and that the proposed fence would actually enhance the environment and wildlife preservation by inhibiting illegal traffic.

    Mr. Hunter said Mr. Chertoff possesses broad waiver authority to guarantee that dilatory legal requirements and lawsuits will not interfere with the timely construction of border infrastructure.

    "Secretary Chertoff rightfully announced that he would use this authority to complete the 'Smugglers Gulch' location, just as he has at other locations along the border, and this most recent delay should be treated no differently," he said.

    Why are all of these groups coming out of the wood work trying to block every effort to halt illegals from crossing the southern border with Mexico? As I and others have stated time and time again, why is it alright for Mexico to protect their border with South America by using the Mexican army on their southern border with the other countries to their south? This is just insane in the membrain. But then I don't think these people have a half a brain between them. I am just so sick of these groups and the president stooping to any level just to keep these people coming here when they know it is wrong. We don't have a government and it is obvious that the president and the stupid democrats want these people here and they themselves know that they are in violation of federal law. When Bush signed the secure fence act, it was just another dog and pony show. It was election time and he just did it to help his republican canidates. I don't think this like the war in Iraq will ever end. Its just going to go on and on. Why would a president turn on his own country and its citizens? Impeach The Idiot in the white house!     Considering the tons of trash left by the illegals at the border, you would think the environmental groups would support the fencing. For the life of me I can't see why the wildlife on the border would need water jugs, worn out tennis shoes, and used condoms.

    The tons of trash is even worse than I ever thought, Lou Dobbs showed it the other day and I could not believe what I was seeing. Put up the fence!!!NOW!

    That has got to be theeeee stupidest, most assinine comment I've heard out of a judge this week!!!!!

    Has this woman not seen the tons of garbage piled up in that area? Is she blind to stats of smugglers coming through that area? How many years has this same fight over this same area been going on?

    I'm getting so sick of hearing crap like this..............

    This could only happen in California; The Defenders of Wildlife and the Sierra Club ....are they allowing illegal immigrants to join their groups or are they blind to the obvious destruction that illegal immigration is having on the land they are concerned about? Any wildlife there has already run off for fear of being trampled on by the illegals immigrants pouring in or are already dead. The garbage left behind is destroying the environment.

    Mr. Chertoff who has the authority to secure this nation should waive off these meaningless rulings as there will always be someone filing. Its is his Job to secure our border and I expect him to stand up and do it! This is no excuse when he does have the authority to dismiss it; that is unless he really doesn't want to do the job that he is suppose to do!

    Remember that the Migrants are escorted to the border by armed men sometimes. If an animal of any size is seen it is more than likely shot and ate.
