    Border Patrol will stop referring migrant parents who cross into the U.S. illegally with children for prosecution, official says

    This story has been updated to clarify how migrant parents will be processed going forward.


    The U.S. Border Patrol will no longer refer migrant parents who cross into the United States illegally with children to federal courthouses to face criminal charges, a senior U.S. Customs and Border Protection official told The Washington Post on Thursday.


    The about-face comes just one day after President Trump signed an executive order ending his administration’s widely denounced practice of separating parents and children apprehended for illegally crossing the Mexico border. Trump’s order said the government would maintain a “zero tolerance” policy toward those who break the law, but the senior U.S. official, asked to explain how the government would change enforcement practices, said Border Patrol agents were instructed Wednesday evening to stop sending parents with children to federal courthouses for prosecution.

    “We’re suspending prosecutions of adults who are members of family units until ICE (Immigration and Customs Enforcement) can accelerate resource capability to allow us to maintain custody,” the official said.


    The official spoke on the condition of anonymity to explain how enforcement operations will change to comply with Trump’s order.


    A spokeswoman for the Justice Department, Sarah Isgur Flores, denied that prosecutions would be suspended.


    “There has been no change to the Department’s zero tolerance policy to prosecute adults who cross our border illegally instead of claiming asylum at any port of entry at the border.”

    Because ICE lacks the detention capacity to increase the number of families it holds in detention, the official acknowledged that many migrant parents and children will likely be released from custody while they await court hearings.


    Top CBP officials did not know what the executive order would ask them to do until its release Wednesday, the official said. The decision to cease prosecutions of parents with children was made by the Department of Homeland Security for logistical purposes because the official said it would not be “feasible” to bring children to federal courtrooms while their parents go before a judge.

    Adults who cross illegally will continue to face misdemeanor charges under the “zero tolerance” policy implemented six weeks ago, the official said.

    Most adults who enter illegally through the busiest span of the border — the Rio Grande Valley in South Texas — are sentenced to time served. But the official said the criminal prosecution of adults would ensure that lawbreakers face consequences.

    “When a consequence is applied, it makes a difference on recidivism and illegal activity at the border,” the official said.
    In recent weeks the number of migrants arrested along the Mexico border has declined slightly, according to the latest enforcement data. “It’s nothing we could call a trend,” the official said.

    CBP officials will monitor migration patterns at the border to see if the policy change leads to an increase in illegal crossings by family groups, the official said. “We’re going to watch closely and do what we need to do.”

    Congressman Mark Walker of North Carolina says that he and others met with Attorney General Jeff Sessions yesterday to stop prosecuting and separating families at the border. He said that he has worked with churches and refugees and this is not right. He said suspensions of prosecutions are necessary.

    Congressman Aguilar says according to the Washington Post that President Trump is walking back prosecuting families at the border, similar to what Congressman Mark Walker stated.

    The WHOLE family unit needs to be processed and returned to their country of origin within 48 hours!

    We cannot "catch and release" TWO BILLION people on the planet showing up at our Ports of Entry into OUR neighborhoods!

    Many of them are drunk driving and KILLING innocent American's!

    Obama and past President's have bused these people all over the country and placed this horrible problem on the backs of US citizens!

    We are now overrun with crime, drugs, rape, overcrowded schools, hospitals, roads, courts, jails, prisons and housing problems!

    We are going broke pay for 30 million illegal aliens, refugees, TPS and asylum liars!



    NO asylum claim should be processed UNLESS it is applied for in their country!

    We cannot allow the entire World to USE Mexico as an illegal pathway to gain entry at our border at our Ports of Entry!

    The Justice Department is denying a report in The Washington Post quoting a top U.S. Customs and Border Patrol official saying the Trump administration will suspend prosecutions of migrant parents with children who have been apprehended at the border.


    The Justice Department flatly denied that Trump is ending his “zero tolerance” policy shortly after the Post story was published, saying that The Post “never reached out” and that the report is “not accurate.”


    “We’re suspending prosecutions of adults who are members of family units until ICE [Immigration and Customs Enforcement] can accelerate resource capability to allow us to maintain custody,” the official told the Post.


    The article goes on to state the following:


    “There has been no change to the Department’s zero tolerance policy to prosecute adults who cross our border illegally instead of claiming asylum at any port of entry at the border,” Justice spokeswoman Sarah Isgur Flores said.


    The Customs and Border Patrol official told The Post that the administration would suspend prosecutions under it had more space to hold people in custody.


    “We’re suspending prosecutions of adults who are members of family units until ICE [Immigration and Customs Enforcement] can accelerate resource capability to allow us to maintain custody,” the official told the Post.
    He said that border patrol officials were instructed Wednesday night to stop sending immigrant parents with children to federal courthouses to face criminal charges.


    Former Ethics Director Walter Shaub, who served in the Obama administration, mocked Flores’ announcement, tweeting, “So you admit the Executive Order was a sham. Got it.”

    According to North Carolina Representative, Mark Walker, as noted, in an earlier post, he had a meeting with AG Jeff Sessions yesterday and family prosecutions would be suspended.

    Hopefully better clarification will follow.

    I'm for stepping it up! While the law requires to children to be separated from their parents when the parents are charged with the crime of entering the United States illegally, in order to accommodate the law which limits them to 20 days incarceration with children, they now are prioritizing those with children. That means illegal aliens are encouraged to bring children, whether theirs or not, to expedite the process.

    My suggestion is to prioritize them, but add the charges of child abuse and child endangerment to the illegal entry charge.

    When they break the law by coming into this country, bringing children with them on their committing of a crime is certainly endangering the child. And dragging the child across the desert is certainly abuse.

    Speeding up the process comes with a high price tag.

    So I guess as long as you bring kids with you, you are allowed to illegally enter this country now. And these kids will be here in time for the DACA Amnesty. It looks like we're royally screwed.

    Oh, and don't think this isn't going to encourage every able bodied person south of the border to start storming our country. It will look like an hour glass, where the U.S. is the bottom of the glass and Mexico and their southern neighbors are the top part. These countries, especially Mexico, will be drastically losing population because they will all be coming here. What the hell are our politicians thinking? I would really like to know.

    No asylum claims at our Ports of Entry.

    They MUST file for asylum from their home country.

    We cannot allow 2 billion people to line up on the bridge "claiming" asylum.

    Those cases should be reviewed on their soil.

    Many do NOT qualify and they know it. That is why they come illegally and now the scam of the "Caravan".

    Turn them away at the border. Go home and apply. Stop the human trafficking and put them out of business.
