U.S. appeals court voids Ariz. voter law mandating proof of citizenship

    05:25 PM

A federal appeals panel has struck down an Arizona law requiring voters to show proof of citizenship but let stand the provision that they show identification to cast a ballot.

Two members of the three-judge panel of the 9th Circuit Court of Appeals in San Francisco — including retired U.S. Supreme Justice Sandra Day O'Connor — ruled that proof of citizenship conflicted with the intent of the 1993 National Voter Registration Act, which aims to increase voter registration. Arizona voters passed the proof-of- citizenship law, Proposition 200, in 2004.

The dissenting judge argued that the full appeals court had reached a different conclusion in a separate 2007 case.

The majority noted that Congress was well aware of the problem of voter fraud when it passed the voter act, and built in sufficient protections, including applying perjury penalties to applicants who lie about their eligibilty.
Oh yeah like that'l keep non-US citizens from voting. , PLEASE! They won't even enforce laws we already have, this is total BS!

Court ruling strikes down part of Arizona Voter ID law

    By: Associated Press

PHOENIX - A federal appeals court has struck down a key part of Arizona's law requiring voters to prove they are citizens before registering to vote or casting ballots.

Tuesday's decision by a panel of the 9th U.S. Circuit Court of Appeals found that the law requiring voters to prove their citizenship while registering is inconsistent with the National Voter Registration Act . That federal law allows voters to fill out a mail-in card and swear they are citizens under penalty of perjury, but doesn't require them to show proof as Arizona's law does.

Appeals Court Judge Sandra S. Ikuta's opinion was joined by retired U.S. Supreme Court Justice Sandra Day O'Connor, who heard the case as a temporary appeals court judge. The 9th Circuit's chief judge, Alex Kozinski, dissented.

My husband said what about section 4/Constitution, disqualification?

obama, biden, and all the rest be removed from office on impeachment for and conviction of, treason, bribery, or other high crimes and misdemeanors. Doesn't voter fraud fall under this?...This is insane!

Then we need to put this on our agenda also, we need to have a new National Voter Registration Act passed. We need to DEMAND it. It appears we can just count on Federal judges almost always deciding in favor of illegal aliens with our current laws, so we need the laws changed, ASAP. This is an example of needing to go on the offense, instead of always defense.

This is such crap. So its a law that voters have to be citizens, but its against the law to actually require the verification needed to enforce the law. Okay then.

Notice this ruling came out just in time for the elections. I'm sure its just a coincidence.

The Ninth Circuit Court of Appeals has overturned Arizona’s requirement that people show proof of citizenship to register to vote.

The split decision by a three-judge panel determined that the requirement to show proof of citizenship — passed by voters in 2004 — is not consistent with the National Voter Registration Act.
This is insane! More judicial activism on the part of the 9th Circuit! What a mockery. Our democratic process is being cheapened and reduced to a third world banana republic, which I suspect is exactly what the 9th would love to happen. They are doing their part in making it a reality.

Just a question, how many Democrats sit on the 9th Circuit? Not that this should be a political issue, but one has to wonder if in fact it is...
