BREAKING: Mark White’s Second Bill That Would Have Granted In-State Tuition to Illegal Immigrants Fails

Rep. Mark White’s (R-Memphis) second bill, HB660, that if left unamended, would have allowed the governing boards of state colleges and universities to grant in-state tuition to illegal immigrant students, failed in the House Education committee for lack of a majority on a 6-6 vote.

During committee testimony, the TN Board of Regents lobbyist explained that for their institutions, this bill was about revenue – filling seats in their schools and being able to make their own rules about border state recruiting. The UT lobbyist explained that flexibility in being able to offer in-state tuition as part of the universities’ business model could be more beneficial than the revenue generated by out-of-state tuition.

In sponsoring this bill, Rep. White wanted to uniformly expand the authority of the new school governing boards that were created by the Governor’s FOCUS Act, but White also used the bill as an opportunity to have a second bite at the apple to give illegal immigrant students access to in-state tuition should his other bill, HB863 fail to pass. That bill was defeated in the House Education committee yesterday.

During an earlier House Education subcommittee hearing, concern was raised by Chairman Harry Brooks, as to whether Section 5 of the bill would allow the school governing boards to offer in-state tuition to illegal immigrant students because that section removes the paying of in-state tuition from being a state benefit as currently contained in state law. White confirmed that it would be left to the individual schools to decide whether they wanted to “go in that direction.”

During today’s full House Education committee hearing, Rep. Mark White amended Section 5 out of his bill although he commented that the amended bill would not do what he originally intended.

However, Rep. Dawn White raised the concern that the companion bill to HB660 sponsored by Sen. Todd Gardenhire had already passed the Senate Education committee including Section 5 and questioned whether the two bills would ultimately be reconciled putting Section 5 back into the final bill.

Rep. Terri Lynn Weaver, citing the delegation of authority and questioned the constitutionality of the delegation, said this bill starts a “slippery slope” and is really a “trojan horse” for future erosion of what is appropriate legislative oversight over the unelected school governing boards.

When asked, the committee’s legal counsel side-stepped the question of whether the delegation of authority to the school governing boards was unconstitutional and instead, referenced that any rules made by the school boards would still have to be vetted by the legislature’s Government Operations committee.
Rep. Ron Lollar, agreeing with Rep. Weaver’s assessment of the bill said simply, “we need to do our jobs.”

Rep. Roger Kane was concerned that rules passed by the school governing boards on in-state tuition, because it is a state benefit, be given the most stringent filter which he believed was best achieved by the Education committee.

State Rep. Mark White Bringing Failed Bill for Illegal Immigrant In-State Tuition Back to Committee

Rep. Mark White’s (R-Memphis) second bill, HB660, that if left unamended, would have allowed the governing boards of state colleges and universities to grant in-state tuition to illegal immigrant students, failed in the House Education committee yesterday, but he has put it back on next Tuesday’s calendar and will ask the committee to reconsider its action.

Republicans Jimmy Matlock, Terri Lynn Weaver, Ron Lollar, Roger Kane, Debra Moody and Dawn White, voted “no” on the bill.


Republicans Eddie Smith, Mark White and Harry Brooks, along with all Democrats on the committee, voted “yes,” except that Democrat Rep. John DeBerry was absent when the vote was taken making it more than likely that the bill would have passed had he been present.


Mark White could have chosen to roll his bill until all members were present to vote, but chose not to and let the vote move forward.

According to sources at the legislature, Rep. DeBerry, a proponent for giving illegal immigrants in-state tuition, is pushing for a motion to reconsider White’s bill.

It is not clear whether any motion to reconsider White’s bill will require a two-thirds vote of committee members, which would take ten votes to revive the bill, or a simple majority which would be just seven votes.

White’s bill failed for lack of a majority on a 6-6 vote that was taken on a “roll call” as opposed to a voice vote, meaning that the votes of each individual committee member was recorded. However, the General Assembly website which normally reflects the roll call votes on each bill, shows “0-0” for yesterday’s vote on HB660.

Rep. Eddie Smith voted against Mark White’s other bill that would have granted in-state tuition to illegal immigrant students, but voted for White’s HB660, which, if reconciled with the companion bill carried by Sen. Todd Gardenhire and passed by the Senate Education committee, would restore the disputed Section 5 of White’s bill allowing the higher education governing boards to give in-state tuition to illegal immigrant students.

If Education Committee Follows House Rules Mark White’s Bill Will Fail Again

Section 5 of Rep. Mark White’s (R-Memphis) bill, HB660, would have allowed the governing boards of state colleges and universities to grant in-state tuition to illegal immigrant students. Despite amending his bill to remove Section 5, the bill failed for lack of a majority in the House Education committee this week.

If the Education committee follows the Permanent Rules of Order of the Tennessee House of Representatives the 110th General Assembly, White’s bill will not be revived for a new vote by the committee.

White has put his bill back “on notice” for the committee’s meeting on Tuesday, April 18th. However, before the committee can vote on the bill again, a motion for reconsideration would need to be offered and passed.
It has been confirmed with the House Office of the Chief Clerk, that a motion to reconsider White’s bill would have to be offered by a committee member of the “prevailing party.” It was also confirmed that when a bill fails to achieve a majority vote as in this case of the 6-6 vote on White’s bill, the “prevailing party” would be someone who voted against the bill.


Should any of the committee members who voted “no,” move to reconsider the bill, it would only take a simple majority of seven committee members to revive the bill.

It was also confirmed that because Rep. DeBerry was absent and did not vote on White’s bill initially, DeBerry is not eligible to offer a motion to reconsider.

If the House were to pass White’s amended bill, the companion billcarried by Sen. Todd Gardenhire and passed by the Senate Education committee, could restore the disputed Section 5 of White’s bill allowing the higher education governing boards to give in-state tuition to illegal immigrant students.

After the stunning defeat of the illegal tuition bill in the House Education Administration & Planning Committee, some members quietly (since doing so publicly would be politically incorrect, ya know) voiced concerns the legislation offering of taxpayer-subsidize college tuition to children of illegal aliens was poorly crafted and could expose the parents of thousands of illegal aliens to rapid deportation.


Seems that the forms that every student must fill out for college admission contains detailed information on the names, addresses and financial situation of those who are responsible for paying the bills for individual students. If the parents are illegal, this application process could serve as a roadmap to the physical location of thousands of illegals and possibly their places of employment, making them ripe for a visit from ICE agents.

Oops.

The universities, whose main goal is to fill the seats with paying customers, have tried to quietly reassure legislators that that information would remain confidential.
Right.

Democrat legislators were deeply worried that under the Trump Administration, immigration authorities would find a way to blow through that confidentiality faster than Lois Lerner killed conservatives’ tax applications. They had reason to be concerned.

But we here at RTP think the Dems were just being paranoid, since they all appear to be suffering from TDS (Trump Delusion Syndrome). Still, in a rush to bully his legislation through, Sen. Gardenhire presented a poorly-drafted bill that could have had huge consequences, unintended or otherwise.

Regardless of the reasons, the defeat is a HUGE win for Rep. Judd Matheny and the Conservative Majority Caucus. If you don’t think committed conservatives can make a difference, just ask Paul Ryan what happened to his lousy ObamaCare “repeal” bill.

Typically, the liberal Tennessean called the vote a “brutal defeat” for those who think Tennessee taxpayers should underwrite tuition for illegal aliens. Brutal? We didn’t see and truncheons or firehoses being used – just public debate.


For the folks at the Gannett/USA Today Tennessean, we use a favored chant from the Left:
“THIS is what Democracy looks like.”

All illegals should leave our country - they do not have permission to be here let alone be granted in state tuition. Rather than that, give our citizens' children FREE COLLEGE!

All records of parents are already recorded via food stamps, medicaid for each child. The American traitors, both party lines, are trying every which way to give in state tuition to illegals in TN - disgraceful. TN is not alone in this un-American activity.

We are the USA and have laws, abide by them or get out of your paid job to represent American citizens by upholding our laws.

The only real long-term solution is GET THEM ALL OUT OF OUR COUNTRY NOW. Lickety split. Quickly and quietly.
