Immigration detainers ruled invalid in more than 30 states

Immigration detainers ruled invalid in more than 30 states including Texas

Jenni Lee , KVUE 2:13 PM. CDT October 06, 2016

AUSTIN - A federal court's ruling Wednesday invalidated thousands of Immigration and Custom Enforcement's immigration detainers sent to more than 30 states, including Texas.

The ruling does not affect those sent to the Travis County Jail, where undocumented immigrants are being held for deportation. But the non-profit group, Grassroots Leadership, expects that to change.

"This court decision essentially confirms what we've been saying for years, which is that not only do immigration detainers in the jail break up immigrant families, but they are also unconstitutional," said Grassroots Leadership Executive Director Bob Libal.

KVUE contacted ICE for a statement. A spokesperson said ICE is reviewing the court ruling to determine its course of action.

This is what happens when you let hair splitting lawyers invade the justice system---and accomplish something which is contrary to the overall purpose the law.

Plus, it looks like it came from the Chicago area. What did you expect?

The judge says I.C.E. has to get a judge to sign a warrant instead of using detainers, which is just a form signed by an I.C.E. employee.

“Under most circumstances, if they are going to seek the arrest of somebody, they need to get a warrant just like every other law enforcement agency would need to.”

Federal judge stops I.C.E. from issuing ‘detainers’

This would seem to go under the premise that illegal aliens are entitled to the same constitutional rights as U.S. citizens. Obviously I don't agree.
