Here's some more updates. Pima County Atty Barbara LaWall told KGUN she will not be prosecuting the Chuy's people on state charges. (as predicted)

We need to put pressure on State Atty General Tom Horne to prosecute on State charges. He's a good guy and should listed if this gets a lot of attention.

Also, all three of the main defendants were released without bond after their court appearances yesterday. The judge didn't believe they are a flight risk. However she did take their passports and said they had to get the court's permission to travel out of Arizona which is pretty standard.

I thought these guys might be flight risks, but they do have their restaurants back open and operating now.

Agents also arrested 40 illegal immigrants they encountered Wednesday at Chuy's locations in Arizona and California, including 18 in Tucson, Picard said. They are facing administrative immigration charges. But they weren't the focus of the investigation, Crocker said.
Watch, this is what they will be concerned with
conspiracy to defraud the Internal Revenue Service and tax evasion
They will set the illegals free to work again as they continually do.

It is ok to take jobs from the working American youths but you better pay TAXES!

Oh, think of the REVENUE for the IRS to redistribute to the illegals through public assistance.

There will be back taxes and PENALTIES that will be calculated back to, I can't imagine when. $$$$$

Of course the lawyers will get their big chunk defending them to the IRS to keep them out of jail for tax evasion $$$$$$

Meanwhile, the illegals go down the road to next joint and go to work so the IRS can bust and get into the knickers of that employer also. This could turn into a good deal for the American taxpayer if the government didn't spend every dime on some new reparation or welfare program.

I wonder if the illegals are turning them in themselves for the Catch a tax Cheat bounty that the IRS pays for tips?

    Whistleblower - Informant Award
The IRS Whistleblower Office pays money to people who blow the whistle on persons who fail to pay the tax that they owe. If the IRS uses information provided by the whistleblower, it can award the whistleblower up to 30 percent of the additional tax, penalty and other amounts it collects.

    The Government NEEDS more REVENUE!!

Does Congress want the IRS to catch tax cheats?
This article is by Stephen Ohlemacher of The Associated Press.

Every dollar the Internal Revenue Service spends for audits, liens and seizing property from tax cheats brings in more than $10, a rate of return so good the Obama administration wants to boost the agency's budget.

House Republicans, seeing the heavy hand of a too-big government, beg to differ. They've already voted to cut the IRS budget by $600 million this year and want bigger cuts in 2012.

The IRS has dramatically increased its pursuit of tax cheats in the past decade: Audits are up, property liens are up and asset seizures are way up. President Barack Obama and Democrats in Congress see stepped up enforcement as a good way to narrow the nation's staggering budget deficit without raising tax rates or cutting popular spending programs.

"It makes little sense to cut the agency that collects revenue," said Rep. Jose Serrano of New York, the top Democrat on the House subcommittee that oversees the IRS budget.

IRS mining mortgage and UBS data to find tax cheats
    By Lita Epstein
    Posted 10:00AM 09/01/09
UBS (UBS) data won't be the only data used to find tax cheats. Thanks to a report by the Treasury Inspector General for Tax Administration (TIGTA), called "Mortgage Interest Data Could Be Used to Pursue More Nonfilers and Underreporters," the IRS plans to start looking at how it can use Form 1098 mortgage interest statements to catch tax dodgers.

TIGTA auditors found that many people pay significant levels of mortgage interest, yet they are not filing tax returns or filing returns indicating that their income is not sufficient to cover their mortgage obligations and basic living expenses. The report recommended that the IRS explore the possibility of making greater use of data from mortgage interest statements to pursue tax evaders.
"Information reporting is a key component in IRS compliance programs that are designed to detect and pursue noncompliant taxpayers who underreport income, overstate deductions or fail to file tax returns," said TIGTA Inspector General J. Russell George in a statement. "Individuals who fail to file required returns and/or underreport their income create unfair burdens on honest taxpayers and diminish the public's respect for the tax system."

WASHINGTON – President Barack Obama proposed increasing the budget for the Internal Revenue Service by 9.4 percent to hire more than 5,000 new employees, most of whom would pursue tax cheats.

The president’s fiscal 2012 budget released today sets funding for the tax-collection agency at $13.3 billion, an increase of $1.1 billion from 2010, the last time a full appropriation was made for the IRS.

Almost half of the increase, or $460 million, would support the agency’s tax-enforcement programs. Under the plan, the IRS would focus on fighting tax evasion through the use of offshore accounts and cheating by corporate and high-wealth taxpayers.

Chuy's executives make first court appearance

TUCSON (KGUN9-TV) - On Thursday, the grills were still cold at most Chuy's restaurant locations across the city, as the father-son owners made their first appearance in court. On Wednesday, federal agents arrested Mark and Christopher Evenson and company accountant, Diane Strehlow, for hiring undocumented workers and paying them under the table.

During the hearing Thursday, a judge released the three Chuy's executives from jail on a promise that they would appear in court. The U.S. Deputy District Attorney in the case had no objections to that ruling, and only asked that the three surrender their passports and agree not to travel outside the state of Arizona without permission.

The defendants are facing several counts of knowingly hiring illegal immigrants, as well as tax fraud. The feds alleged that the Evenson's avoided paying $400,000 in taxes by paying those undocumented workers in cash. If convicted, they face millions of dollars in fines, and decades behind bars. In the courtroom, some current and former Chuy's employees served as character witnesses.

Christopher Evenson fought back tears as his family looked on. Attorney Walter Nash said the family's ordeal has already become quite emotional.

"They're upset. They're emotional. They'll bounce back in the next couple of days and get on about their business of living their lives and defending their case," Nash said.

Family members respectfully declined to comment to KGUN9 News as they left the courthouse. The three defendants will be arraigned on Monday, April 25. It's still unknown whether they will face state charges as well. Attorney General Tom Horne said he hasn't received any information from the Pima County attorney.

The company that owns the Chuy's Mesquite Broiler franchise name released this statement:

"Chuy's Mesquite Broiler Restaurants are owned by a number of individuals, not just Mark and Chris Evenson. While we are deeply disturbed by the alleged actions, they do not represent the values and ideals of the Chuy's Mesquite Broiler restaurants."

You may have taken my comment wrong. I did not mean it as it is ok in the eyes of the public, but in the eyes of our politicians and corporations it appears to be,since they keep protecting the illegals.
