    An illegal immigrant, deported after serving time in an Iowa prison after being convicted of sex abuse, has been sentenced to more than six years in prison for illegally entering the U.S. for a third time and for failing to register as a sex offender.

    Osvaldo Montes Olarte, 34, was sentenced Friday to six years and five months in a federal prison during a hearing in U.S. District Court, Davenport.

    U.S. District Judge John Jarvey also sentenced Olarte to three years on supervised release for the immigration offense and seven years on supervised release for his failure to register as a sex offender.

    Olarte illegally entered the U.S. in 1995, according to a Department of Justice news release issued Friday.

    On April 27, 2001, Olarte was convicted in Scott County District Court of one count of third-degree sexual abuse, a Class C felony under Iowa law that carries a prison sentence of up to 10 years.

    According to Scott County District Court electronic records, Olarte was sentenced on May 24, 2001, to the 10-year maximum sentence but was paroled in April 2003 and turned over to the custody of what was then the Immigration and Naturalization Service. Olarte was deported to his home country of Mexico. He also was required to register as a sex offender.

    He illegally returned to the U.S. in 2008 and was again deported, according to federal court electronic records.

    Olarte again illegally re-entered the U.S. in May 2011 and was residing in Davenport from July through October 2011, according to federal court documents. He also failed to register as a sex offender.

    The case was investigated by the U.S. Marshals Service and was prosecuted by the U.S. Attorney’s Office for the Southern District of Iowa.
