An illegal alien who served time in York County prison for child molestation is now accused of refusing to leave this country, according to the U.S. Attorney's Office in Harrisburg.

Michael Alexander Mendoza, 29, was indicted Tuesday in federal court on a single charge of failing to depart the United States in violation of a deportation order, according to federal court records.

The Peruvian citizen faces up to four years in prison if convicted, followed by deportation.

Mendoza, formerly of Orrtanna, pleaded guilty in March 2010 to committing a statutory sexual assault in Hanover and was sentenced to 11½ to 23 months in prison, court records state.

He was paroled in February 2011, but remained in county prison on a federal immigration detainer until Jan. 4, when he was taken into custody by federal officials, a county prison official said.
