    County clerks ask feds to review NY immigrant license law

    ALBANY, N.Y. (AP) - A county clerk in upstate New York is seeking a federal review of a new state law authorizing driver's licenses for immigrants who are in the country illegally.

    Saratoga County Clerk Craig Hayner, a Republican, wrote to President Donald Trump this week asking for the U.S. Department of Justice to determine the law's constitutionality. Hayner is leading the effort on behalf of 30 other county clerks.


    Hayner told The Associated Press on Thursday that clerks who follow the state law would be violating their oath of office, which requires them to uphold federal laws, including immigration laws. He also said that county employees are not trained to verify the foreign passports listed as acceptable identification under the new law.



    "It's not good government," he said of the law, which Gov. Andrew Cuomo, a Democrat, signed last week after it passed in the Democrat-led state Legislature.

    Federal officials have yet to respond to Hayner's letter.


    Twelve states already have similar laws, which supporters say allow immigrants to get to work, raise children and go about their daily lives.


    "Making sure that every driver is trained, tested and insured will make New York's roads safer for everyone and ensure that our industries have the labor they need to keep our economy moving," said Assembly Speaker Carl Heastie, D-The Bronx, after the bill passed.


    New York Attorney General Letitia James's office has already reviewed the bill and last week deemed it constitutional.


    "The legislation is well crafted," James said in a statement, adding that if it is challenged in court, "we will vigorously defend it."


    Some county clerks have said they will defy the law and sue to overturn it.


    Erie County Clerk Michael Kearns said last week that workers at Buffalo-area motor vehicle offices won't grant driver's licenses to those here illegally and will instead send applicants to a state-run auto bureau in Syracuse, more than two hours away by car.


    Clerks in Rensselaer, Niagara and Allegany counties have also announced that they won't follow the new law.

    New York will give licenses to undocumented drivers. Some county clerks refuse to comply.

    A county clerk in New York is challenging a new state law that would allow undocumented immigrants to obtain noncommercial driver’s licenses and learner’s permits.


    This week, New York Gov. Andrew M. Cuomo (D) signed the Driver’s License Access and Privacy Act, colloquially known as the Green Light Law, after an intense legislative debate. Advocates of the bill say it would mitigate stigma against undocumented immigrants, allowing them to contribute to the economy and more easily navigate their everyday lives. Critics of the law worry that there are scant details in the legislation about how to implement the policy, and that providing undocumented immigrants with driver’s licenses could compromise security. It ultimately passed with just one more vote than the minimum requirement, 33 to 29, according to the New York Times. The law takes effect in six months.


    In a statement after its passage, state Sen. Luis Sepúlveda (D) said that “this legislation will not only provide undocumented immigrants with a legal solution to obtain a driver’s license, but its positive impacts will include significant economic growth, improved road safety and keeping hard-working families together.”


    But Michael Kearns, the Erie County clerk, says he refused to comply because he thinks it is in violation of federal law and could have negative consequences on state and election security.

    On Tuesday, hours after Cuomo signed the bill, Kearns sent a letter to Erie County Attorney Michael Siragusa declaring, “I will not be granting driver’s licenses to illegal immigrants” and said that he planned to take action in federal court. He told The Washington Post on Wednesday that he hoped the courts could clarify whether county clerks could refuse to comply with the law and whether the legislation was legal in the first place.


    Kearns said he thinks the law, whose justification includes “the long-held need by undocumented immigrants and workers to secure driving privileges not only to get back and forth to work but to conduct tasks in their personal lives,” is in violation of the Immigration and Reform and Control Act of 1986, which prohibits employers from knowingly hiring undocumented immigrants.


    “This was a hastily passed bill, hastily signed by the governor,” he told The Post. “There’s going to be many unintended consequences, and we’ll be talking about them in the next couple months.”

    Kearns said he was worried that his staff, which was already strained by Real ID applicants seeking enhanced licenses required for domestic air travel and certain federal purposes, would now have to deal with a new influx of customers. He also said they were not trained to verify foreign means of identification that were approved by the bill, which include a valid foreign passport, consular identification document or a driver’s license from the applicant’s country of citizenship.


    New York residents can also register to vote when they obtain a license, and Kearns worried that a noncitizen could “purposefully or inadvertently” do so. “This would be an all-out opportunity for someone who has broken the law,” Kearns said.


    He said his office frequently issues licenses to noncitizens who are in the United States legally, including immigrants, students and refugees, but they are required to provide documentation of their immigration status.

    Kearns is not the only county clerk to resist the new law.

    Rensselaer County Clerk Frank Merola told News 10 ABC that he would refuse undocumented immigrants driver’s licenses because he worried that it would become difficult to distinguish them from citizens.


    “There’s no right to a driver’s license. It’s a privilege. It’s not a privilege we should be giving to someone that’s here illegally,” Merola said. “I’m not anti-immigrant. My wife is a naturalized citizen. My son is also a police officer, so I think more of law enforcement. I’ve never heard anybody in law enforcement come out and say this is a good idea.

    Not at all. It puts them in a tough position. They’re at a disadvantage here. We’re going to give them a license that looks just like yours or mine. They wouldn’t even know that they’re here illegally.”


    Emma Kreyche of Green Light N.Y., a coalition of activists who campaigned in support of the bill, dismissed claims that the new law could lead to noncitizens voting.

    “There’s no evidence to support this claim. I think it’s a smokescreen,” she told The Post. “Undocumented immigrants are not interested in committing crimes that would lead to their deportation. People just want to drive. This is a red herring.”


    She said that undocumented immigrants would be able to obtain only standard licenses that cannot be used for federal purposes.


    Kreyche said the law would “improve immeasurably the lives of hard-working New Yorkers” in multiple ways.

    Undocumented workers who labor near the state’s border with Canada often “live in fear” of being caught without a license, which could lead to deportation, she said. With driver’s licenses, Kreyche believes workers in the agriculture industry could feel more secure traveling to and from their jobs.


    Getting a license would also enable undocumented immigrants to purchase cars and insurance, which Kreyche and other advocates say will generate economic activity and improve road safety.

    She did, however, acknowledge that “there is a lot of work to be done to ensure its smooth implementation.”


    “The bill itself leaves a lot to the discretion of the Department of Motor Vehicles commissioner” to set regulations about how to issue driver’s licenses to undocumented immigrants, Kreyche said. But she dismissed criticisms that the implementation would be too burdensome for state and local government.


    The chief of staff to Sepúlveda, the bill’s sponsor, said processes were either already in place, or would be added, that would address concerns raised by critics of the bill.


    “The reality is that [clerks’ offices] process foreign documents every day for multiple different types of applications, so there are already high security systems in place. This is just folding into things that already exists," Sophia Lajaunie said. She noted that about $33 million had been earmarked by lawmakers to support clerks’ offices and other local officials during the implementation period.


    "There’s going to be a lot of education for the people at the DMV and the people who are applying” for the driver’s licenses, Lajaunie said.

    New York becomes the 13th state, along with the District of Columbia and Puerto Rico, to allow undocumented immigrants to have some form of driver’s license, according to the National Immigration Law Center.

    I don't like it either, but New Mexico has been giving driver's license to illegal aliens since 2003.

    If it was a violation of federal law some president, some congress, some attorney general, someone would have done something about it by now.

    Everybody has swept this festering problem under the rug and kicked this can down the road for FAR too long.

    This needs to stop, Laws need to be enforced, and these illegal aliens need to be deported on the spot...not be awarded our taxpayer funded benefits and privileges or citizenship.

    End the anchor baby scam! They are not U.S. citizens and should have never been issued U.S. Birth Certificates. Give them a Certificate of Child Born Abroad and deport them. They are citizens of the mothers country.

    A New York county clerk who refused to issue licenses to illegals in June plans to file a lawsuit Tuesday against the law.

    Erie County Clerk Michael “Mickey” Kearns made headlines in June when he openly defied Democratic Gov. Andrew Cuomo’s Green Light Bill that mandated clerks throughout the state issue driver’s licenses to those residing in America as illegal aliens. He is now fulfilling a promise he made to challenge the law he deems unconstitutional.

    Kearns calls the bill “inconsistent with federal law” and claims the bill forces him and other clerks to choose to their allegiance to either the federal government or government of New York.

    He also believes the law is a violation of the Immigration Reform and Control Act of 1986, which expressly outlaws knowingly hiring illegal immigrants, Fox News Reports.

    Kearns was not alone in his defiance when the law took root in June. Four more upstate clerks were also found resisting the law in Rensselaer, Niagara, Chautauqua and Allegany Counties.

    “I go back to the Constitution. You’re not supposed to help or aid anybody if they’re here illegally, especially if we know that,” Frank Merola, Rensselaer County Clerk, told ABC 10.

    Chautauqua County Clerk Larry Barmore completely rejected the bill in June. “I don’t mind sitting in jail for a few days,” he told WGRZ 2.

    Most New Yorkers opposed Cuomo’s bill when it was introduced–53% to be exact, according to a March Sienna poll.

    “The law is well crafted and contains ample protections for those who apply for driver’s licenses. As the state’s attorney and chief law enforcement officer, my office will vigorously defend it,” New York State Attorney General Letitia James told The Daily Caller News Foundation in June.

    They are breaking our Federal Laws by HARBORING, AIDING AND ABETTING illegal aliens.

    Issue them nothing, NO government taxpayer funded benefits or privileges.

    It is a "privilege" to drive in our country, not a right, and that privilege is reserved for legal U.S. citizens! Not this invasion of foreign nationals who have no right to be in our country, let alone driving on our roads.

    Sue the States for enrolling them in our schools, our healthcare system, our welfare, our food stamps, our WIC, our TANF, giving them IRS Tax Refunds!

    No illegal aliens shall collect ANY taxpayer funded benefits of a U.S. citizen, whether that citizen is a minor or otherwise! Stop rewarding these criminal trespassing illegal aliens. Deport them WITH their minor children!

    Our adult parents do NOT get a free pass to break our laws...they are separated from their children every day...and they go to jail!

    No more two sets of rules for those who are here legally and those who are not! This is complete lawlessness!

    DEPORT THEM ALL NOW!
