NEW ORLEANS — The 5th U.S. Circuit Court of Appeals in New Orleans is hearing oral arguments in the immigration fraud case of a Cuban militant.
The Wednesday hearing came in an appeal by the federal government to the dismissal of charges against Luis Posada Carriles claiming he lied to investigators in his bid to become a U.S. citizen.
Posada is a former CIA operative and Army soldier who is accused in Cuba and Venezuela of plotting to blow up an airliner in 1976. He has denied any wrongdoing.
A federal judge ruled last year that the government manipulated an interview with Posada to bring the immigration charge against him.
Posada had told investigators he came across the Texas-Mexico border in a vehicle, and he was held in El Paso.
