    Republican Iowa Rep. Steve King told The Daily Caller Friday that “defenders of the Constitution” may need to bring a lawsuit against the Trump administration over amnesty.



    President Donald Trump broke his campaign promise to immediately end Deferred Action for Childhood Arrivals (DACA) in an interview with the Associated Press Friday. He said that DACA recipients, known as DREAMers, should “rest easy” about his immigration policies.
    President Barack Obama instituted DACA in 2012, allowing people who arrived in the U.S. illegally as children to avoid deportation. Thousands of DACA applications and renewals have been processed since Trump took office.


    “We are after the criminals,” Trump told the AP. “That is our policy.”



    In an August campaign speech, Trump promised: “We will immediately terminate President Obama’s two illegal executive amnesties, in which he defied federal law and the Constitution to give amnesty to approximately 5 million illegal immigrants.”

    “We all know about his firm 100 percent promise to end the [Deferred Action for Childhood Arrivals] program,” King said over the phone Friday.
    The congressman told TheDC last week that he was “very disappointed” that Trump had yet to end DACA. “Is [Trump] going to force us to go back to court again?” he asked then.



    Several Republican states sued the Obama administration and successfully blocked his amnesty for illegal immigrant parents of American citizens. Referring to the need for a lawsuit, King told TheDC, “That’s what it looks like right now, and that’s troubling and disappointing to me.”
    When asked to clarify who may bring the lawsuit, the Iowa congressman answered, “any defenders of the Constitution.”



    “It is impossible to return the respect of the rule of law in regards with immigration” by keeping DACA, he said.
    Conservative author and open borders critic Ann Coulter was also no fan of Trump’s comments that young illegal immigrants should “rest easy.” She told TheDC in an email, “Yes, they can rest in the bus all the way home.”

    It's a shame no one sued Barack Obama over the DACA 2012 Amnesty or Trump wouldn't be dealing with it now, 5 years later.

    26 states sued Barack Obama over the DACA 2014 Expansion that would have added 5 million illegal aliens to the deferred action and they also sued over the Obama DAPA 2014 Deferred Action that would have added parents of DACA's, expanding it by another 5 to 10 million. But no one sued Obama over the DACA 2012.

    Iowa Republican Rep. Steve King, a hawkish conservative on immigration, warned President Trump that he could face a lawsuit over the administration's unwillingness to cancel an Obama-era program that provides relief from deportation for certain young, undocumented immigrants.

    In an interview with The Daily Caller, King drew battle lines when told that Trump said in an interview with The Associated Press that "Dreamers" can "rest easy."

    Under the Obama-era Deferred Action for Childhood Arrivals (DACA), qualifying undocumented immigrants who were brought to the U.S. with their families at a young age can be granted protection from deportation and be eligible for a work permit. They are often referred to as Dreamers.


    King expressed frustration about Trump's refusal to cancel the program despite repeated campaign promises to do so, arguing that "defenders of the Constitution" may need to sue Trump to block the implementation of the program.

    "That's what it looks like right now and that's disappointing to me," he told The Caller.

    "It is impossible to return the respect of the rule of law in regards with immigration [with DACA on the books]."

    Trump's conservative base has long shared frustration over his apparent leniency to Dreamers — applications are still being processed as part of the program.

    There have been several reports of DACA recipients being detained by immigration agents, including news this week that a Dreamer had been deported. Immigration and Customs Enforcement has said that DACA recipients are not guaranteed protection from deportation, but that they are not a priority.

    Past legal action against DACA has had mixed results. While a deadlocked Supreme Court blocked the expansion of the program to allow parents of these undocumented immigrants protections, court challenges to the original DACA policy were unsuccessful.

    Yes, they were unsuccessful. The original lawsuits by the 26 states didn't address the DACA 2012 policy, they tried to add it during the case, but the Judge disagreed and while stopping the DACA Expansion of 2014 and the DAPA 2014, refused to stop DACA 2012 and by doing so with an affirmative ruling in his DACA/DAPA 2014 ruling protected the DACA 2012 program.

    I've been trying to explain why the DACA 2012 is a different beast than the two others. DACA 2012 was done at the request of Congress as part of the appropriations process to address a "prioritization of resources". Steve King should know this. He's part of Congress, he should know why there is a DACA 2012 to begin with. Trump promised to end two OBAMA EO programs that were unconstitutional, that's the DACA 2014 and the DAPA 2014. DACA 2012 is a third program he never addressed during the campaign, it wasn't part of the 26 state lawsuit, it wasn't done by an Obama Executive Order, when the states tried to add it to their lawsuit after they had filed, the Judge rejected it and affirmatively kept it in place. It was created in response to a request from Congress as part of the appropriations process for DHS which is why it was done with a MEMO DIRECTIVE by Janet Napolitano.

    It's a different animal that the two others with a host of other issues. It should nevertheless come to an end. But how without being hit with thousands of lawsuits is apparently still being figured out. The last word on it was Sean Spicer who said in a press conference they thought they would let it expire in June of this year.

    What I don't understand is why didn't someone sue Obama in 2012 when Janet Napolitano established DACA 2012? Or better yet why doesn't our Republican Congress just pass a little bill that says "no executive authority shall grant work permits to any illegal alien"?

    Your first question is a good question and I don't have an answer for it. However, your second question is easier. I'd say it's because none of the Democrats would support it and whether we want to admit it, or not, DACA unfortunately has enough Republican support in the Senate that such a bill would probably never pass. Right or not, that's how I see it.
