    5 Senate Dems join Republicans to limit services to illegals

    In a stunning close to the first day of the special session, five Senate Democrats late Thursday sided with Republicans to send voters a measure limiting services to illegal immigrants.
    The defections made Republicans giddy, adding a dramatic twist in a fast-moving session likely to set the stage for a bitter November election.

    The proposal to limit government services was the cornerstone of the Democrats' agenda, but one they had expected to be signed into law and put into effect immediately, and not be put on the ballot.

    In committee, Democrats fought Republican efforts to put Senate Bill 1 on the ballot, but were thwarted on the floor when a single Democrat, Sen. Ron Tupa, of Boulder, broke ranks, leading other Democrats to change their votes and side with the GOP.

    Some Democrats were livid and referred to Tupa as "Dead Man Walking."

    The bill sponsor, Sen. Bob Hagedorn, D-Aurora, blasted both parties, which are scrambling to win control of the legislature in November.

    "It's a charade, and I'm disturbed when the focus of the legislature has become solely politics and not public policy," Hagedorn said. "We're rushing through to make policy on the fly to satisfy both Republicans' and Democrats' political thirst."

    Republicans were jubilant.

    "We've always said this was about letting the voters have a say on the issue," said House Minority Leader Mike May, R-Parker. "Today is a good day.

    "God, I love the Senate."

    Republicans know the bill could be in trouble today, however, during the official vote in the Senate, or if it makes it to the House.

    "It's a fickle world we live in around here," said Sen. Ken Kester, R-Las Animas.

    But the Democratic defection left Republicans energized and believing they have the other party on the run.

    Other bills debated Thursday were less contentious and received more bipartisan support. By the time the Senate adjourned around 10 p.m. and the House shortly before 11 p.m., lawmakers had introduced 40 proposals, many scheduled to be heard today.

    Republican Gov. Bill Owens called the special session last week in reaction to a Colorado Supreme Court ruling that disqualified a proposed ballot initiative that would deny government services to illegal immigrants.

    He also asked lawmakers to address common-law marriage after a state court ruled that girls as young as 12 and boys as young as 14 can marry, and deadlines for the Supreme Court to review ballot initiatives.

    Critics of a special session pointed out that the governor has been in office nearly eight years and has done little to tackle the problem of illegal immigration.

    "This is to take attention off of President Bush and the Iraqi war," said Rep. Rosemary Marshall, D-Denver.

    Several lawmakers expressed concern over the pants-on-fire pace, saying the five or so days lawmakers are expected to be in special session isn't long enough to consider so many meaty measures.

    The most controversial issue debated Thursday was Hagedorn's proposal to cut off most state services to illegal immigrants, exempting those under age 18 from having to prove citizenship to get services.

    During the committee hearing earlier Thursday, lawmakers amended it to allow agencies to provide some services to adults without proving legal status, such as screening and diagnosis for breast cancer and other diseases, prenatal care and anything the agency deems necessary to protect life, health or safety.

    Republicans blasted Senate Bill 1 as too broad, and Hagedorn didn't like all the changes, either.

    Then came a bitter three-hour debate Thursday night on the Senate floor, where Democrats have an 18-17 majority.

    Lawmakers voted to strip the amendments, and then Kester proposed sending it to the ballot.

    Tupa, who had initially passed, then voted "yes." He later explained it was a strategic vote on his part to "slow down the bill or derail it."

    "I just read it four hours ago and I have no time to take it in or determine what it will do. I'm afraid it will put the state on the hooks for tens of millions of dollars. I'm not sure how my constituents stand on it, and I need to find that out," he said.

    But after his vote, four Democrats then switched their "no" votes to "yes."

    They were Betty Boyd, of Lakewood; Ken Gordon, of Denver; Moe Keller, of Wheat Ridge; and Lois Tochtrop, of Thornton.

    "It seemed like the right thing to do," said Boyd.

    But Capitol observers noted that Boyd faces probably the toughest Senate contest in November, squaring off against Rep. Matt Knoedler, R-Lakewood.

    Several polls show Republicans and Democrats alike are fed up with illegal immigration and want lawmakers to do something about it.

    "My constituents truly wanted it to go to the vote," Tochtrop said, saying her earlier vote was "in error."

    In other action, the Senate Judiciary Committee on a party-line vote killed a Republican bill that would have required proof of citizenship for those registering to vote.

    Instead, Democrats approved a bill that increases penalties for those who illegally register.

    The governor dismissed that measure. "Increasing the penalties but not addressing the inadequate forms of identification that are currently acceptable is like snipping the leaves of a weed; it does nothing to address the root of the problem," Owens said.

    "I urge legislators to specify forms of identification, which truly verify a person's status."

    Owens had more success with his proposal to require people applying for jobs to provide a valid driver's license or identity card. Employers hiring those without the proper ID would be fined.

    Another bill that received approval was a measure by Rep. Bill Crane, R-Arvada, that would prevent illegal immigrants from getting any permit or license, including hunting and fishing licenses, building permits or a license to operate a business.

    Adrienne Benavidez, director of the immigrant advocacy group Color of Justice, argued the bill would burden government agencies and result in more people working or operating businesses without a license -or any government oversight.

    Yeah, well we'll see in November. Perhaps good men that care about the country and the people will come together in a new party and leave the jackasses in the dust.

    It's about time at least some Dems get it that the illegals are hurting what used to be the Dems' constituency: The working poor.
