Most Colleges Knowingly Admit Illegal Immigrants as Students, Survey Finds

More than half of the colleges that responded to a recent survey said they knowingly admit illegal immigrants to degree or diploma programs under certain circumstances, according to findings released on Monday by the American Association of Collegiate Registrars and Admissions Officers.

The report of findings was based on responses from 613 of the association’s 2,000 U.S.-based member institutions. Of those that responded either fully or partially to the survey, 54 percent said they did, and 46 percent said they did not, knowingly admit undocumented students.

The percentages varied widely according to the type of college, with 70 percent of public two-year colleges and just 41 percent of private, nonprofit four-year colleges answering in the affirmative. Twenty percent of the respondents said they verify the immigration status of all applicants, while 31 percent said they do so only for those seeking financial aid. Nineteen percent said they verify applicants who seek to pay in-state tuition.

Among the special circumstances colleges consider when deciding whether to accept undocumented students is whether they graduated from an in-state high school and whether they had certified their intention to seek legal status.

The issue of illegal-immigrant students has prompted heated debate in many states, including North Carolina, where the state’s Board of Community Colleges voted in August to prevent them from enrolling in the state’s community colleges while it studies the matter. —Katherine Mangan

Uggghhhh. EVERY illegal aliens is "seeking legal status"!!! That's why they march by the millions in our streets!!

FOX news just reported on Colorado's debate over in-state a few minutes ago, with too Senators, one from each side of the issue. Guess they are having quite a heated debate on their senate floor.

At least a debate is going on for the public... the taxpayer dollars are the issue here, too.

It is not fair to give tuition breaks to those illegally in the United States when citizens in Colorado can not even afford to send their own children to college.

Tuition bill may be illegal, Suthers says

DENVER · A lawmaker's proposal to grant in-state tuition to illegal immigrants may violate federal law, according to a formal opinion by Colorado Attorney General John Suthers.

The opinion, issued in 2006, cites a 1996 federal law that prohibits illegal immigrants from receiving higher-education benefits unless those same benefits are made available to every legal resident of the United States.

In other words, the opinion says, if in-state tuition is offered to illegal immigrants, then everyone in the country can claim it. That would essentially put an end to out-of-state tuition, and cost Colorado universities millions of dollars.

California Supreme Court to take on state law granting in-state tuition to illegal immigrants
The justices have accepted the case that began with a lawsuit filed by out-of-state students and their parents, who argue that such a benefit violates federal law.

California's highest court is poised to be the next battleground in the debate over benefits for illegal immigrants as the justices have agreed to hear arguments on the constitutionality of a state law allowing undocumented students to pay in-state tuition at public colleges and universities.

The decision could affect hundreds of illegal immigrant students who attend community colleges, Cal State and UC campuses and who say they would not be able to afford a higher education if required to pay out-of-state tuition, which can cost more than triple the amount that residents pay.

But the outcome could have a broader effect -- at least nine other states, including Oklahoma, New York and Texas, have similar laws providing the reduced fees to illegal immigrants. Although a court decision would not be legally binding in other states, politicians around the country are looking at California as a litmus test for future legal challenges.

The state Supreme Court accepted the case late last month and will probably hear arguments later this year.

unambiguous and precedent setting," stated Michael Hethmon, general counsel
for IRLI. "In their ruling, the judges indicated that federal law preempts not
only California's in-state tuition law, but all such laws across the country."
Currently, nine other states offer in-state tuition benefits to illegal
aliens.

Monday's ruling will also affect many other state and local benefits currently
being offered to illegal aliens. "The decision also makes it clear that
federal law preempts many benefits that are being dispensed to illegal aliens
that are expressly prohibited under the Welfare Reform Act," said Kris Kobach,
senior counsel to IRLI. "In the court's opinion, citizens have the right to go
to court and sue to prevent illegal aliens from benefiting from a whole range
of government programs."

"Law-abiding citizens and taxpayers were the real winners in this decision.
This opinion strikes a blow for the rule of law, commonsense, and protection
of public resources, and the legal precedence it sets will be felt all across

Keith King is convinced that Colorado cannot make in-state tuition rates at its colleges and universities available to the children who are undocumented immigrants.

In a video released by the Republican senate caucus Wednesday the veteran legislator and first-term senator argued that SB 170 violates federal law.

The Colorado Springs Republican senator is not alone in his view.

There is another case pending in the California supreme court that challenges a similar law in that state, Olivas said, but it would be unlikely to have any impact on a Colorado law because Colorado courts are not bound by the findings of California state court judges and it is probable that the two states' laws would be significantly different.

In that California case, called Martinez v. Regents of the University of California, a state intermediate appeals court reversed the dismissal of a complaint by a college student that the Golden State's law granting undocumented immigrants the right to pay in-state tuition at state colleges. But that California court of appeals ruling was ordered "de-published," or removed from the law books, when the California supreme court decided in December to review the case.

He needs to read the "Immigration Nationality Act of 1996" Federal law prohibits giving in-state tuition to illegal aliens unless offered to students who are citizens of the other 49 states.....why can't these people get that through their thick head!!

MUSKEGON TOWNSHIP, Mich. —
The name of Rachel Harris' Web site says it all.

The 17-year-old high school senior recently launched http://iwanttogotonotredame.com to help her raise money to pay for an education at the school.

The site includes copies of her Notre Dame application form, letters of recommendation and her high school transcript.

Harris has applied for admission to the Roman Catholic school in South Bend, Ind., and expects to be accepted there. The problem is meeting its more than $46,000 annual cost of tuition, fees, room and board.

She hopes her Web site will generate enough in donations to help cover at least part of it. She has applied for at least 10 scholarships, she said.



Inspired in part by President Barack Obama use of the Internet as a fundraising tool, Harris said, "I decided to try and use the power of the Internet to help me pay for my college education."

She carries a 3.97 grade-point average and is ranked 10th in her class at Reeths-Puffer High School in Muskegon County's Muskegon Township.

She plans to pursue a degree in biomolecular engineering at Notre Dame and then attend medical school to become a pediatric endocrinologist, she said.

"The only thing that is keeping me from possibly going is the financial aspect to it, especially with these economic times," Harris said. "I'm just doing everything I can to not let that stop me from going there."

The above post makes me wonder where is the Bill Gates American scholarship fund? He has a Hispanic scholarship fund.

Bill: S1155 A bill that would suspend licenses for businesses that knowingly employ illegal immigrants and makes e-verifiy mandatory for all business, will not go forward...This bill written and introduced by Senator Jorgenson took the first step in the process in the State Affairs Committee where it passed unanimously. However, Chairman of the State affairs Committee Sen. Curt McKenzie has thrown the bill in his desk drawer and stated this bill is not going anywhere....so much for due process.

We need to call, e-mail, and fax the following members and DEMAND they force Mc Kenzie to remove bill No. S 1155 from his desk drawer and continue forward with the democratic process so this can become law, finish the peoples business and stop stalling. It is what the citizens in Idaho expect of our legislatures...
