    Mandatory E-Verify–Trump’s Most Popular Immigration Reform Left Out of DACA Amnesty Discussions

    President Trump’s most popular pro-American immigration reform, the system known as “E-Verify,” which would bar employers nationwide from hiring illegal aliens over Americans, has been entirely left out of all negotiations regarding the nearly 800,000 illegal aliens shielded from deportation by the President Obama-created Deferred Action for Childhood Arrivals (DACA) program.



    DACA will end in March 2018 and despite amnesty for illegal aliens never being part of Trump’s “America First” agenda on immigration, the White House is now considering which pro-American immigration reforms it can get in return for granting an amnesty.


    Among the reforms the Trump administration is demanding in return for a DACA amnesty is the end to the process known as “chain migration,” which would cut legal immigration levels in half and raise wages for American workers; an end to the Diversity Visa Lottery program, which randomly gives out 50,000 visas every year to foreign nationals through a lottery system; and finally, full funding for his proposed border wall along the U.S.-Mexico border.


    While Trump wants to trade a DACA amnesty for reforms that would reduce legal immigration to the U.S. — thus reducing the mass immigration burden on America’s working and middle class — he has not included mandatory E-Verify in his demands.


    Under nationwide mandatory E-Verify, the big business lobby and corporate interests would see a major defeat, as employers would be held legally responsible for hiring illegal aliens. That responsibility could come in the form of thousand dollar fines for each illegal alien hired by an employer.


    Mandatory E-Verify is easily the most popular immigration reform in the country, with the most recent Pulse Opinion Research poll finding that nearly 60 percent of likely American voters want mandatory E-Verify to be part of a deal on DACA, if there is a deal.




    Months ago, when likely American voters were asked by Pulse Opinion Research if they supported mandatory E-Verify, a majority of 68 percent said yes. Another 71 percent of voters said businesses should be required to hire from pools of Americans with the highest unemployment rates before importing cheaper, foreign workers through various visa programs or hiring illegal aliens.


    Even if Americans had to pay more for products and goods, the Pulse Opinion Research poll showed nearly 60 percent of voters said it would be better for businesses to pay more to attract American workers, even if prices did rise.


    At the same time of deterring businesses from hiring illegal aliens over Americans, mandatory E-Verify would also likely greatly reduce illegal immigration to the U.S., as the program would cut off the number one incentive for illegal aliens to cross into the country through the southern border, while increasing Americans’ wages and job opportunities as they would no longer have to compete with cheaper, illegal foreign workers.


    Pro-American immigration reformers, like Kansas Secretary of State Kris Kobach, have scratched their heads as to why Trump has not demanded mandatory E-Verify in his DACA negotiations, telling Fox News that in the midst of a border surge because of a DACA amnesty, E-Verify would be one of the only deterrents to stem that problem.




    “He’d have to demand E-Verify, mandatory nationwide as well to make sure that this new surge of illegal aliens — which will come in, there’s no question, if we grant an amnesty, they will come in — make sure that they don’t take additional jobs from Americans,” Kobach said of Trump’s negotiations.


    A recent study by researchers Pia M. Orrenius and Madeline Zavodny found that “having an E-Verify law reduces the number of less-educated prime-age immigrants from Mexico and Central America — immigrants who are likely to be unauthorized — living in a state.”


    The research showed that the number of low-skilled, likely illegal aliens living in states with mandatory E-Verify was cut by 50 percent, a result that shows the “powerful effect” of the employment verification system, according to the Center for Immigration Studies’ Preston Huennekens.


    Trump is expected to meet this week, once again, with members of the Republican establishment and Democrats to discuss cutting a deal on DACA. There remains no indication, though, that mandatory E-Verify will be a part of those discussions.

    President Trump speaks to reporters Saturday at Andrews Air Force Base in Maryland. The Trump administration sent a list of immigration policy priorities to Congress that includes overhauling the country's green-card system, hiring 10,000 more immigration officers and building a wall along the southern border.

    President Trump on Sunday sent Congress a list of sweeping immigration changes he says "must be included as part of any legislation addressing the status of Deferred Action for Childhood Arrivals (DACA) recipients."

    Trump wants the border wall he campaigned on to be built, a crackdown on illegal immigration and to switch the U.S. legal immigration system from one that prioritizes family connections to one based on merit.

    Trump has promoted these policies before, both during the campaign and as president. But what's new is demanding that they be included in the legislative fix for the DACA program.

    "Without these reforms, illegal immigration and chain migration, which severely and unfairly burden American workers and taxpayers, will continue without end," Trump said in a letter to Congress.

    Last month, concluding that the DACA program put into place by the Obama administration through executive action was illegal, Trump announced that he would end it in six months. He called on Congress to enshrine in law the protections for undocumented immigrants who were brought to the country as children. The approximately 700,000 DACA recipients are often referred to as DREAMers. Under the program, they temporarily avoid deportation and receive work permits.

    Around that time, Trump had dinner at the White House with the two top congressional Democrats, House Minority Leader Nancy Pelosi and Senate Minority Leader Chuck Schumer, and all emerged talking about the rough outlines of a deal. A major component of that agreement was President Trump's willingness to take funding the border wall off the table, when it came to DACA legislation.

    After the apparent agreement with Pelosi and Schumer, conservatives vocalized their rage, accusing Trump of abandoning the hard-line immigration platform he campaigned on. Conservative commentator Ann Coulter said at the time, "If we're not getting a wall, I'd prefer President Pence."

    "DACA now, and the wall very soon," Trump told reporters on the south lawn of the White House in mid-September. "But the wall will happen."

    The White House immigration principles appear to be a departure from that earlier statement. White House documents call for "completing construction of a wall along the southern border of the United States" and ensuring "funding for the southern border wall and associated infrastructure."

    Pelosi and Schumer say these proposals are a clear break with what they believe was agreed to during that dinner at the White House.

    "We told the President at our meeting that we were open to reasonable border security measures alongside the DREAM Act, but this list goes so far beyond what is reasonable," Pelosi and Schumer said in a statement. "This proposal fails to represent any attempt at compromise."

    Beyond the wall, the Democrats say the administration's list is "anathema to the Dreamers, to the immigrant community and to the vast majority of Americans."

    Although Republicans control both chambers of Congress, they have a narrow majority in the Senate and have struggled to pass even top legislative priorities. And it's not clear that all, or even most, Republicans back what Trump is proposing on immigration. Passing a DACA fix is a top priority for Democrats, but they won't go along with Trump's long list of demands, meaning what once seemed like a bipartisan compromise in the works now looks more like another legislative standoff.

    In his letter to Congress, Trump said the list of proposals was developed from the bottom up, working with law enforcement professionals on the front lines of America's immigration system.

    "In response, they identified dangerous loopholes, outdated laws, and easily exploited vulnerabilities in our immigration system — current policies that are harming our country and our communities," his letter said.

    These recommendations happen to also align nicely with Trump's campaign rhetoric.

    Among the recommendations, as described by the White House:

    Fund and complete construction of the southern border wall
    Ensure the safe and expeditious return of Unaccompanied Alien Children and family units
    End abuse of our asylum system by tightening standards, imposing penalties for fraud, and ensuring detention while claims are verified
    Remove illegal border crossers quickly by hiring an additional 370 immigration judges and 1,000 ICE attorneys
    Stop "sanctuary cities"
    Strengthen law enforcement by hiring 10,000 more ICE officers and 300 federal prosecutors
    End visa overstays by establishing reforms to ensure their swift removal
    Protect U.S. workers by requiring E-Verify and strengthening laws to stop employment discrimination against U.S. workers
    End extended-family chain migration by limiting family-based green cards to include spouses and minor children
    Establish a points-based system for green cards to protect U.S. workers and taxpayers

    Sen. Tom Cotton, R-Ark., quickly offered praise.

    "The principles the president has put out show he understands what's broken in our immigration system and what's holding down wages for American workers," Cotton said in a statement. "I'm especially glad to see him call for ending chain migration and moving to a skills-based immigration system. These kinds of reforms are long overdue."

    Cotton introduced a bill to create a skills-based immigration system earlier this year, and while Trump voiced support for it at a White House event, the bill has just one co-sponsor.

    Thank you for your opinion Judy. The writers who focus on immigration have been providing valuable information on immigration, illegal immigration, refugee resettlement, foreign immigration threats, border violence, drug cartels, etc.

    Immigration stories are posted here from a variety of sources, those for and against us, trusted or not. Alipac has the largest collection from friends and foes.

    For me personally, lack of trust is directed at President Trump at this time with his words and tweets on doing something spectacular with love for illegally present foreign citizens. A great list of immigration requests indeed but I do not believe that President Trump will stand firm against the pressure to cave and make a deal. He wants some type of win but virtually everyone around him who he trusts including family wants amnesty. Stephen Miller is probably the only one who will hold fast but recognizing the president's desire for DACA amnesty he will do what he can for the American people.

    My hope continues to be that the sides cannot come together.

    A question: Suppose the GOP did concede a DACA extension or amnesty in exchange for other things. Caan't they obtain more in later bills? Like E Verify in a different bill? I think they should also remove the T and U visa programs. But they can get a lot of improved enforcement merely out of administrative decisions, without needing to get Congressional policy changes. The House will fund those.

    And the GOP is in a good position to pick up some senate seats in 2018, because so many that the Dems control are wide open races in states that Trump carried; they have a lot more to lose. It could very easily turn to 55-45 even if a few Republicans lose.

    Yes, if we pick up enough seats in 2018 in the Senate, then in 2019, we can zoom immigration legislation through Congress.

    It will be very difficult to increase Senate seats enough to pass non-reconciliation bills like immigration bills we want. We don't even have the votes to pass E-Verify, end chain migration or end anchor baby citizenship.
