    Acting Homeland Security Secretary Chad Wolf exclusively told Fox News' "Tucker Carlson Tonight" Wednesday that DHS was immediately suspending Global Entry and several other Trusted Traveler Programs (TTP) for all New York state residents -- a dramatic move in response to the liberal state's recently enacted sanctuary "Green Light Law."

    The sweeping order came a day after President Trump, in his State of the Union address, condemned left-wing states and local governments that "release dangerous criminal aliens to prey upon the public," and called on Congress to pass a law establishing civil liability for sanctuary cities.

    In a letter to top New York state officials obtained exclusively by Fox News, Wolf noted that the New York law prohibited state DMVs from sharing criminal records with Customs and Border Protection (CBP) and Immigration and Customs Enforcement (ICE).

    "In New York alone, last year ICE arrested 149 child predators, identified or rescued 105 victims of exploitation and human trafficking, arrested 230 gang members, and seized 6,487 pounds of illegal narcotics, including fentanyl and opioids," Wolf wrote. "In the vast majority of these cases, ICE relied on New York DMV records to fulfill its mission."

    Illegal immigrants rushed to New York DMVs in large numbers after the law, which allowed them to obtain driver's licenses or learner's permits regardless of their immigration status, took effect last December.

    The law, Wolf went on, "compromises CBP's ability to confirm whether an individual applying for TTP membership meets program eligibility requirements," and will "delay[] a used vehicle owner's ability to obtain CBP authorization for exporting their vehicle."

    As a result, New York residents "will no longer be eligible to enroll or re-enroll" in select TTPs -- including Global Entry, NEXUS, SENTRI, and FAST.

    Wolf noted that TTP "permits expedited processing into the U.S. from international destinations (under Global Entry); Canada only (under NEXUS); and Canada and Mexico only (under SENTRI)." Additionally, TTP allows quicker processing for commercial truck drivers entering or leaving the U.S. (under FAST).

    TSA PreCheck was not among the TTPs affected by the order.

    Wolf further warned that because the New York law "hinders DHS from validating documents used to establish vehicle ownership, the exporting of used vehicles titled and registered in New York will be significantly delayed and could also be costlier."

    He said DHS' assessment was ongoing and future enforcement remained possible.

    During his State of the Union address, Trump explicitly called out New York's sanctuary policies.

    "Just 29 days ago, a criminal alien freed by the Sanctuary City of New York was charged with the brutal rape and murder of a 92-year-old woman," Trump said. "The killer had been previously arrested for assault, but under New York's sanctuary policies, he was set free. If the city had honored ICE's detainer request, his victim would be alive today."

    New York Residents No Longer Eligible to Apply for or Renew Trusted Traveler Programs

    Release Date: February 6, 2020

    State Law Prevents CBP from Determining Program Eligibility

    WASHINGTON — Effective immediately, residents of the State of New York will no longer be eligible to apply for or renew membership in U.S. Customs and Border Protection Trusted Traveler Programs due to state legislation that restricts CBP’s access to certain criminal history information maintained by the New York Department of Motor Vehicles (DMV).

    In addition, the Vehicle Exports program will be affected. Vehicles titled in New York may be de-prioritized for export, as resource limitations require, when supporting documents cannot be authenticated through information sharing with New York DMV.


    The decision comes as the State of New York implements the “Driver’s License Access and Privacy Act,” which prohibits CBP from accessing information maintained by the New York DMV. Without access to this information, CBP cannot properly complete security checks for Trusted Traveler Program applications and renewals submitted by New York residents, greatly increasing our security risk.


    “Nothing is more important than the safety of the United States and our citizens, and the New York Green Light law makes us less safe and shields criminals,” said CBP Acting Commissioner Mark Morgan. “We recognize that many New York residents and businesses will be negatively affected by this change, but we cannot compromise the safety and security of our homeland. When states take negative measures that hinder our ability to protect our great country, we must respond.”


    New York residents will no longer be eligible to apply for or renew membership in CBP Trusted Traveler Programs and CBP will cancel all pending Trusted Traveler Program applications submitted by residents of New York. Refunds will be processed automatically.


    New York residents who are currently enrolled in Trusted Travel Programs will retain their benefits until their memberships expire.


    CBP’s Trusted Traveler Programs provide secure, expedited processing for pre-approved, low-risk travelers. The programs include Global Entry, NEXUS, SENTRI and FAST.

    ALBANY, N.Y. – The state will sue the Trump administration over its ban on residents applying for Global Entry and other expedited border crossing programs, officials announced Friday.

    The announcement from Gov. Andrew Cuomo and Attorney General Letitia James came a day after the U.S. Department of Homeland Security implemented its policy for four of its Trusted Traveler Programs, which allow low-risk, vetted travelers to use expedited lanes when crossing border lines or reentering the USA.


    The federal policy, which does not allow New York residents to enroll or reenroll, came in response to the state's Green Light Law, which allows undocumented immigrants to apply for driver's licenses and blocks DMV data from federal immigration authorities.


    At a news conference in Manhattan, Cuomo lambasted the DHS decision, calling it "extortion" and accusing the agency of carrying out President Donald Trump's political agenda.

    He argued the decision unfairly targets New York residents.


    "We're going to sue the federal government," said Cuomo, a Democrat.

    "We're going to disclose this political intrusion into government, this ham-handed political tactic that once again hurts New Yorkers to make their political point."


    Decision applies to four pre-clearance programs


    The federal policy applies to four border crossing programs: Global Entry, for those entering the USA from international destinations; NEXUS, for those entering from Canada; SENTRI, for entries from Canada and Mexico; and FAST, for commercial truckers.

    It does not apply to TSA PreCheck at airports.


    Those who have membership in the affected programs will be able to participate until their membership expires.


    The decision could affect about 175,000 New York residents whose memberships expire in 2020, according to DHS Acting Deputy Secretary Ken Cuccinelli.


    An additional 80,000 people who were in the midst of the months-long vetting process will have their applications denied, he said Thursday.


    Trump has made immigration a major plank of his platform, criticizing states and cities with "sanctuary" policies meant to shield undocumented immigrants from federal authorities.

    Green Light Law expands driver's license eligibility

    New York's Green Light Law, which took effect in December, allows undocumented immigrants to apply for a driver's license by using foreign-issued documents to prove their identity and age.

    The law includes a measure that prevents the state Department of Motor Vehicles from turning over any data to federal immigration authorities such as ICE and Customs and Border Protection, which was meant to keep the agencies from mining the data to more easily track down those without legal immigration status.


    When the law took effect, the DMV blocked ICE and the Border Patrol from accessing its databases, which contain photos, vehicle registration information and some criminal history that federal immigration agencies had access to for years, according to the DHS.


    Because the DHS no longer has access, it can't adequately perform a background check for New York residents applying for the Trusted Traveler Programs, the agency said.


    "This law that New York has introduced has made our law enforcement officers less safe on an individual basis," Cuccinelli said Thursday. "It has also made New York less safe."


    Leaders protest NY unfairly targeted


    Neither James nor Cuomo shed much light on their legal strategy, though both spoke of how the law targets New York residents.

    The 14th Amendment requires equal protection under the law.


    In a statement, James said the federal policy will "negatively impact travelers, workers, commerce and our economy."

    “This is political retribution, plain and simple, and while the president may want to punish New York for standing up to his xenophobic policies, we will not back down,” said James, a Democrat. “We plan to take legal action and sue the Trump administration for its unfair targeting of New York state residents."


    New York GOP Chairman Nick Langworthy, a Trump supporter, said the blame rests on Cuomo and Democrats who supported the Green Light Law.


    “This is an issue of safety and security, which Democrats have zero regard for anymore," Langworthy said in a statement. "Once again, Cuomo is on the side of law-breakers over citizen taxpayers."

    Global Entry Has Started to Reject New Yorkers.

    State residents are feeling the effects of the Global Entry suspension. ... "You do not meet the eligibility requirements because you have listed the state of New York as your current residence," a verified letter states as the reason why the application was rejected.
