Donald Trump Rights Ship on Immigration: Demands Disney Rehire Workers Replaced by Cheap Foreign Labor, Calls Rubio ‘Silicon Valley’s Puppet’

Last night during the CNBC primary debate, Donald Trump, who to this point in the campaign had been the Republican candidate most closely aligned with the conservative grassroots on immigration policy, seemed to have altered his message in several significant ways.

Breitbart News documented some of these changes here.

Trump, who leads many national 2016 polls, granted Breitbart News an interview on the subject. Full questions and responses below:

BNN: The media has been filled with stories about companies flying in low-wage H-1B workers to replace American workers in tech jobs. Adding insult to injury, these American workers have been forced to train their replacements. If you were President, would you put a stop to this practice?

DT: Day one. This is why I got into this race. Because the everyday working person in this country is getting screwed. Lobbyists write the rules to benefit the rich and powerful. They buy off Senators like Sen. Marco Rubio (R-FL) to help them get rich at the expense of working Americans by using H-1B visas–so called “high tech” visas–to replace American workers in all sorts of solid middle class jobs. If I am President, I will not issue any H-1B visas to companies that replace American workers and my Department of Justice will pursue action against them.

BNN: Hundreds of workers at Disney were forced to train their foreign replacements. But while Florida Senator Nelson rallied to their cause, Senator Rubio did not. While Nelson has called for an investigation, Rubio has not. While Nelson has called to reduce H-1Bs, Rubio has demanded more. Senator Rubio has been the top promoter in Congress for expanding the H-1B program even though millions American tech workers are out of jobs. Rubio’s new bill triples H-1Bs and has zero protections for American workers. Advocates for tech workers said Rubio’s bill would “destroy” the U.S. tech workforce. Rubio’s bill is even endorsed by the CEO of Disney. What do you think of Rubio’s bill?

DT: It’s a disaster. It would allow any company in America to replace any worker with cheaper foreign labor. It legalizes job theft. It gives companies the legal right to pass over Americans, displace Americans, or directly replace Americans for good-paying middle class jobs. More than 80 percent of these H-1Bs are paid less than the average wage. Senator Rubio works for the lobbyists, not for Americans. That is why he is receiving more money from Silicon Valley than any other candidate in this race. He is their puppet.

BNN: During the debate, Senator Rubio listed several protections he thought American workers should receive. But the New York Times said Rubio’s bill would does the opposite of what he said, and does not contain a single one of the protections he mentioned. Instead, his bill simply triples the number of H-1B visas given as low-wage substitutes to corporations. Does Rubio have a problem with the truth?

DT: Yes, Senator Rubio is incapable of telling the truth. He should be disqualified for dishonesty alone.

BNN: Do you think agree with Senator Rubio that there is a shortage of talented Americans?

DT: Rubio is dead wrong. America produces the best and brightest in the world. It’s time to stand up for own students–many of whom are racked with terrible, terrible debt and facing a disastrous job market. We are graduating two times more students in science, technology, engineering, and math (STEM) than find jobs in those fields every year. We have a surplus of talented Americans and we need them to get jobs first.

BNN: What should happen with the Florida workers who have been replaced?

DT: I am calling TODAY on Disney to hire back every one of the workers they replaced, and I am calling on Rubio to immediately rescind his sponsorship of the I-Squared bill and apologize to every Floridian for endorsing it. I am further calling on Rubio to return the money he has received from Silicon Valley CEOs and to donate the money to a charity helping unemployed Americans whose jobs Rubio has helped to destroy.

Wish he would have stated such during the debate rather than saying he "never said that". The moderators at all the debates are really obnoxious and unnecessarily attacking candidates. They all need more training to be made more suitable for their positions. It is a turn off for the viewer and counter-productive in helping them make a decision @ selecting a candidate.

This action below might deserve its own post so move if desired. It came to me thru personal email so I don't have a website link to post other than the gov'd comment link.
An action thru Numbers USA to comment directly to DHS - Flood the federal register with comments.
    https://www.federalregister.gov/arti...em-degrees-and

Stand up for U.S. STEM workers and American students seeking STEM careers - deadline is 12/19 so ending soon. Below is a list of letters sent and talking points as you compose your own comment to the gov't link above.
The Department of Homeland Security has proposed a rule to expand a program called Optional Practical Training (OPT), which gives employers financial incentives to hire foreign students over Americans. Before the rule can go into effect, it must go through a public comment period. The Obama administration attempted to bypass the public process but a lawsuit on behalf of U.S. tech workers forced them to comply. Ian Smith explains why your comment is critical to stopping the rule:
"Because DHS must respond to each comment, they'll have to fully explain themselves and fix many of the problems raised. And the longer it takes for them to respond, the more likely they'll miss the court-appointed deadline."
A Freedom of Information Act request from the Center for Immigration Studies revealed two shocking takeaways about the OPT program that DHS proposes to expand:

    • OPT denied American workers more than 430,000 jobs during the years 2009-2013; and
    • OPT removed $4 billion from the Social Security and Medicare trust funds.

General Facts About The Optional Practical Training Program (OPT):

    • The original purpose of Optional Practical Training was to give foreign students extra tools to help their home countries when they returned but today it is more often used by foreign students as a bridge to stay in the U.S., and by employers to get around the H-1B cap. DHS' proposed rule runs counter to the original purpose of the OPT program.
    • There are approximately 568,000 F-1 students in the U.S. in addition to 98,000 in 12-month OPT programs and 30,000 in 29-month OPT programs. Giving employers incentive to hire from this giant pool of workers undermines the job opportunities for American STEM workers.
    • OPTs are sought after by employers because they tend to be younger (cheaper) than their American competitors. Employers save 7.65 percent when they hire foreign students instead of US workers because they don't pay FICA or Medicare taxes under the OPT program. OPT workers often hold jobs in the $60-$90,000 a year range, but they cost Social Security about $1 billion dollars a year.

Senator Charles Grassley of Iowa (in a letter to President Obama):

    • "By increasing the total amount of time a foreign student may work in OPT after each degree to 3 years - the same amount of time that an H-1B visa would be valid - there is little doubt that the Administration has administratively established a de facto shadow H-1B program, in violation of Congressional intent."
    • the proposed regulations are "irresponsible and dangerous considering the Government Accountability Office (GAO) report issued in March 2014 finding that the program was full of inefficiencies, susceptible to fraud, and that the Department was not adequately overseeing it."
    • "The report also found a major national security problem in that the Department does not know where tens of thousands of foreign students are living and working in the country. The GAO said that 'ICE cannot fully ensure foreign students working under optional practical training are maintaining their legal status in the United States.'"
    • "After the GAO issued its report in 2014, I wrote to you and urged you to consider issuing a moratorium on OPT approvals until the program was secured and students could be located. I also asked that the Department swiftly move to implement the GAO's recommendations. The Director of U.S. Citizenship and Immigration Services, Alejandro Mayorkas, responded on your behalf to my letter. He said the Department concurred with the recommendations and was working on them. I would like to know the status of each GAO recommendation, whether they have been fully implemented, and if not, why not."
    • "OPT is meant to be a temporary training program, not as a bridge to a longer-term work visa or a way for employers to hire cheaper foreign labor in lieu of Americans."

John Miano, attorney representing tech workers:

    • the proposed rule effectively "requires employers and universities to engage in unlawful immigration status discrimination."
    • "The rule requires these organizations to set up mentoring programs for foreign graduates to work under OPT. However, there is no requirement that American graduates receive the same benefit."

Professor Norm Matloff of UC Davis:

    • On a variety of measures, the former foreign students have talent lesser than, or equal to, their American peers.
    • Skilled-foreign-worker programs are causing an internal brain drain in the United States.

    Professor Norm Matloff (cont.):

    • If the U.S. indeed "needs" the foreign students to remedy a STEM labor shortage, why do these students need training?
    • If workers with such training are indeed needed, why won't these special mentoring programs be open to Americans?
    • OPT expands the pool of YOUNG workers....this is the core of how SCE, Disney and so on can legally save lots of money by hiring foreign workers -- the latter are younger, thus, much cheaper, than the Americans they replace.

Richard Trumpka, President of the AFL-CIO:

    • "expanding de facto guest worker programs like Optional Practical Training (OPT) - through which employers hire more than 120,000 young college graduates per year who hold F-1 visas - but do not even guarantee that those foreign graduates are paid the minimum wage, let alone the prevailing wage, chase Americans out of computer science and creates a self-fulfilling 'shortage' as Americans respond to a relatively better market as engineers in other fields."
    • "In 2002, 14.5% of black science and engineering majors chose computer science, versus 11.5% for all Americans. But by 2012, because of declining job prospects, the share of black science majors choosing computer science fell to 9.8%."
    • "The next Sergei Brin might be sitting in an American classroom right now, but if that future innovator cannot get an entry-level job in high tech because employers prefer importing temporary workers, entrepreneurial innovations will not occur in the United States."

David North, formerly of the U.S. Labor Department:

    • "there is no training in this program. It is just one more foreign worker program and it has nothing to do with students; it is for recent alien college graduates."
    • "U.S. employers are given a substantial bonus for hiring an alien college grad rather than an American college grad with the same skills and the same salary...it can be above $10,000."
    • "DHS, by defining a recent college grad as a student, takes both the worker and the employer out from under payroll taxes -- thus penalizing the Social Security and Medicare trust funds directly, and our elders indirectly."
    • "If the bonus given to employers for hiring a STEM graduate is worth $10,000 under the old rules, it is now worth $12,000, and is that much more likely to cause an employer to hire a former F-1 student than a green card or citizen graduate."

    Ron Hira of Howard University:

    • "It is pure fiction that someone with a master's degree in electrical engineering needs an additional three years to work as an intern to be a productive professional. Instead, the duration seems to come out of thin air, based purely on what the political types in the Obama White House believe that they can get through without facing significant opposition."
    • "It's an over-reach to claim that someone who completes a master's degree in as little as 12 months needs three years interning -- at low or no pay in many cases -- to get further training."

Daniel Costa, of the Economic Policy Institute:

    • the worker protections included in the new rule "are so vague and deferential to employers that they will be virtually unenforceable in practice in any meaningful way."

Ian Smith of the Immigration Reform Law Institute:

    • "Like other employment-visa programs, OPT works to lower the wages and living standards of a growing portion of the middle class."
    • "Although tech workers' wages have been flat for years and thousands of American STEM grads are out of work, tech executives and shareholders are rolling in money."
    • DHS "is neglecting its duty under federal guidance to discuss crucial economic considerations, such as how many OPT workers will be hired instead of American workers; how many STEM grads have given up finding work in the STEM field; how the new rule will affect tech-worker wages and American STEM-grad employment."
    • "Not only will this artificially expand the domestic labor pool by hundreds of thousands, but 100 percent of the new recruits will be young and therefore cheap, and almost guaranteed to neither unionize nor get poached from competitors (because their 'student' visas will be tied to their employers)."
    • "because these workers are still technically 'students,' they won't have to pay payroll taxes, saving the company around $10,000 for each of the three years they're in the program."

    Joe Cunningham of Red State:

    • "One of the big education pushes in the United States is to increase STEM (Science, Technology, Engineering, Math) education and create a workforce better suited to the jobs available in the modern era. Even schools that are not dedicated STEM schools are pushed to increase their STEM education, and other communities have gotten together to create STEM initiatives to supplement education."
    • But DHS' proposed rule "is pushing the ones raised and trained at home out of the job market that we created these education initiatives for and handing those jobs to students who have no ties to the U.S. other than their education."

    Sam Rolley of Personal Liberty:

    • "not only does the DHS's plan ensure that foreign-born graduates will be taking jobs that American college students desperately need, it also categorizes the foreign-born employees in such a way that exempts them from payroll taxes."
    • "a 2013 study from the left-leaning Economic Policy Institute found that there are plenty of American workers with and without degrees who are qualified to fill STEM jobs in IT sectors."
    • "Encouraging foreign-born STEM graduates to spend more time in the U.S. has one major impact, the EPI study found: wage suppression in tech-related fields."

An example of a short comment already submitted:
Companies don't want to hire Americans and they abuse {H-1B} and OPT to hire cheap immobile labor instead of hiring anyone over the age of 35, especially in software or tech areas.

Short or long comment ok - more personalized is better than form letter types.

Oh my God!! This evil government can't destroy our Americans fast enough, can it? First they give away the farm jobs, then the factory jobs, then the retail jobs, then the office jobs, then the STEM jobs, and now it's giving away our next generation of American educations ... to foreigners.

    WHY??!!

Donald Trump will stop them. He'll fire the worthless traitors in the Department of Homeland Security attempting such a treason against our next generation.

Folks, we haven't done a good job at saving our selves, can we at least rally to save our kids??!!

Please comment and fight this OPT with all we have.

I was very impressed and happy to hear Donald Trump say this. When he said that as President he would not issue H1B visas to replace American workers it was like a bell ringing.
