Driver who hit Colts linebacker was an undocumented immigrant, police say

    By Kimberly Hutcherson, CNN

(CNN)Indianapolis Colts linebacker Edwin Jackson and another man were struck and killed in a suspected drunken driving accident early Sunday morning.

Indiana State Police say the man they believe hit them is an undocumented immigrant who has been deported twice.

The accident took place around 4 a.m. Sunday. Authorities said Jackson was the passenger for a ride-sharing operator, identified as 54-year-old Jeffrey Monroe of Avon, Indiana. Monroe had pulled his 2018 Lincoln to the side of Interstate 70 in Indianapolis because Jackson had become ill, according to state police, who said both men were standing outside the car.

The car and the men were struck by a Ford F-150. One of the men was thrown into the center lane and was spotted, along with wreckage from the damaged vehicle, by a passing state trooper. As he slowed to stop for the crash, he struck the body in the center lane, officials said.

Police identified the driver of the F-150 as Manuel Orrego-Savala. Police said he gave them an alias at the scene -- Alex Cabrera Gonsales -- and attempted to flee on foot. He was taken to the Marion County Jail, accused of driving without a license and on suspicion of intoxicated driving.

Detectives said Orrego-Savala is a citizen of Guatemala who is in the United States illegally and was deported twice, in 2007 and 2009.

They're working with US immigration officials, who have placed a hold on Orrego-Savala.

US Immigration and Customs Enforcement released a statement late Monday saying Orrego-Savala was previously convicted of driving under the influence in Redwood City, California, in 2005. He has other "misdemeanor criminal convictions and arrests in California and Indiana," the ICE statement said.

Jackson, 26, was from Atlanta but made a home for himself with the Colts. "Edwin was loved by all in the Colts organization," the team said. "We admired his outgoing personality, competitive spirit and hardworking mentality. He was well-respected among all with whom he crossed paths, and he will be greatly missed in our locker room and throughout our entire organization."

Jackson was an undrafted free agent out of Georgia Southern in 2015. The team's head football coach, Chad Lunsford, said in a statement that Jackson represented "how a young man should live his life. He earned everything that he was given and left this world way too soon."

Such a terrible tragedy, all avoidable, if we enforced our laws, properly secured our borders, deported all these illegal aliens, you have to deport them all to remove their base of operations they return to, you have to deport them all, fast. You need to authorize state and local law enforcement to assist with and enforce US immigration law, they know who they are, where they are and what they're doing, they can get them rounded up and detained subject to rapid deportation hearings, 2 questions, are you a citizen, do you have have valid unexpired documents to be in the US, if no and no, then out you go.

Illegal immigrant suspected of killing Indianapolis Colts linebacker Edwin Jackson faces federal charges

By Elizabeth Zwirz | Fox News

An illegal immigrant from Guatemala suspected of killing an NFL player Sunday in a drunken driving crash now faces federal immigration charges, the Justice Department told Fox News on Tuesday.

Manuel Orrego-Zavala, 37, had been deported but re-entered the U.S. illegally before the crash that killed Indianapolis Colts linebacker Edwin Jackson, U.S. Attorney Josh Minkler said.

“The defendant in this case allegedly re-entered the country illegally for the second time before he put the public safety of Indianapolis at risk and took the lives of two innocent men early Sunday morning,” Minkler said in a news release. “In April, Attorney General Sessions directed all federal prosecutor to prioritize charging aliens that illegally re-enter the country, especially if they are a risk to public safety or there is a criminal history present. Following the rule of law is the foundation of our American democracy, and my office is committed to fulfilling the Attorney General’s directive.”

Authorities identified Orrego-Zavala as the suspected drunk driver who allegedly killed Jackson, 26, and Jeffrey Monroe, 54. The pair, who were standing on the shoulder on Interstate 70 in Indiana, died after being hit Sunday by a Ford F-150 pickup truck.

The suspect bolted from the scene but was arrested shortly thereafter by the responding officer. He then gave police the alias of Alex Cabrera Gonsales. Jail records viewed by Fox News on Monday morning said Orrego-Savala, under the alias of Gonsales, was driving without a license.

Orrego-Zavala previously was arrested by immigration officials in October 2006, according to Tuesday's news release, and was forced to return to Guatemala in 2007. He was not allowed to enter the U.S. for 10 years.

However in 2009, he was arrested again and sent back to his home country - and this time told he could not come back to the U.S. for 20 years, the news release said.

In a series of tweets on Tuesday, President Trump offered his prayers and sympathies for Jackson's family while emphasizing his argument on the need for immigration reform.

"So disgraceful that a person illegally in our country killed @Colts linebacker Edwin Jackson," Trump tweeted. "This is just one of many such preventable tragedies. We must get the Dems to get tough on the Border, and with illegal immigration, FAST!"

He continued: "We need a 21st century MERIT-BASED immigration system. Chain migration and the visa lottery are outdated programs that hurt our economic and national security."

Suspect in Colts player's death charged with immigration offenses

By Faith Karimi and Eric Levenson, CNN

(CNN)A Guatemalan immigrant who allegedly killed NFL player Edwin Jackson and his ride-share driver in a crash in Indiana has been charged in federal court with illegal entry after previous deportations.

Manuel Orrego-Savala, 37, an undocumented immigrant, was driving the car that fatally hit the Indiana Colts linebacker and driver Jeffrey Monroe early Sunday on Interstate 70, authorities said.

Orrego-Savala had a prior conviction for driving under the influence, and had been deported twice, according to officials.

"The defendant in this case allegedly re-entered the country illegally for the second time before he put the public safety of Indianapolis at risk and took the lives of two innocent men early Sunday morning," said Josh J. Minkler, a US attorney for the Southern District of Indiana.

The suspect "will remain pending" as Indiana authorities investigate the crash, Minkler said in a statement Tuesday.

Jackson started eight games in 2016 for the Colts, but did not play this past season due to an injury.

"Edwin was loved by all in the Colts organization," the team said. "We admired his outgoing personality, competitive spirit and hardworking mentality."

Indianapolis Colts owner Jim Irsay said he will pay for both men's funerals.

    The crash

After the crash Sunday, Orrego-Savala was accused of driving without a license and on suspicion of intoxicated driving, and taken to the Marion County Jail. His initial hearing will be held Wednesday, and he'll be appointed an attorney before then.

Monroe had stopped his 2018 Lincoln on the side of Interstate 70 in Indianapolis because Jackson had become ill, according to state police.

Both men were standing outside the car when a black Ford F-150 pickup truck drove onto the emergency shoulder and struck them.

One of the men was thrown into the center lane. A state trooper spotted the wreckage and as he slowed to stop for the crash, he struck the body in the center lane, officials said. Both men were pronounced dead at the scene.

During Orrego-Savala's arrest, he gave the Indiana State Police an alias -- Alex Cabrera Gonsales -- and attempted to flee on foot, authorities said. When Orrego-Savala appeared before a judge on Tuesday, he questioned why he was in court, and claimed he wasn't driving the car in the fatal crash, according to the court clerk.

A man listed as Alex Cabrera Gonsales was arrested last year in Whitestown, Indiana, after a driving infraction, according to a report by Whitestown Police officials, who confirmed both identities are the same person.

He was pulled over for failing to stop at a stop sign, and authorities found out he did not have a driver's license, according to the police report. He was arrested, and taken to jail for further processing.

Scott Rolston of Whitestown Police said the department generally would not communicate with ICE for a typical traffic stop.

Cabrera Gonsales pleaded guilty to operating a vehicle while never receiving a license, which is a misdemeanor, according to documents provided by CNN affiliate WISH-TV. He was sentenced to two days in the Boone County Jail and released after one day served.

    Deported twice

Orrego-Savala was arrested by Immigration and Customs Enforcement in October 2006, and deported to Guatemala in January 2007, according to a federal criminal complaint.

He was prohibited from returning to the United States for 10 years, according to federal officials.

Two years after he was deported, he returned to the United States illegally, and was deported again two months later in May 2009, with an order not to come back for 20 years, according to the complaint.

County authorities gave the suspect's name as Orrego-Savala, but the US attorney's office identified him as Orrego-Zavala.

    Trump tweets on crash

In a tweet Tuesday, President Donald Trump said it was "disgraceful that a person illegally in our country" killed Jackson. He called on Democrats to "get tough on the Border, and with illegal immigration, FAST!"

As part of his call for tighter immigration policy, Trump has repeatedly highlighted crimes in which the suspect is an undocumented immigrant. On the campaign trail, he spoke often about the 2015 killing of Kate Steinle in San Francisco, allegedly by a man deported five times previously. The man, Jose Ines Garcia Zarate, was found not guilty of murder in the case.

Indiana State Police said they are working with the prosecutor's office to file criminal charges against Orrego-Savala.

Twice-deported Guatemalan involved in fatal car crash that killed 2 men in Indianapolis also faces federal immigration charges

INDIANAPOLIS — A previously deported citizen of Guatemala, who was arrested Sunday for being involved in a fatal car accident that killed an NFL player and another man, was federally charged with illegally re-entering the U.S. after having been deported, which is a felony.

U.S. Attorney Josh Minkler, Southern District of Indiana, announced these charges Tuesday in Indianapolis.

According to the criminal complaint, Manuel Orrego-Zavala, aka Manuel Orrego-Savala, 37, was arrested Feb. 4, 2018, by law enforcement in Indianapolis for being involved in a fatal accident on Interstate Highway 70.

At the time of his arrest, Orrego-Zavala provided law enforcement authorities with the alias, “Alex G. Cabrera.” But officers with U.S. Immigration and Custom Enforcement (ICE) soon learned — through cooperation and information sharing with the Indianapolis Metro Police Department — his true identity was Manuel Orrego-Zavala, a citizen of Guatemala.

The complaint further states Orrego-Zavala was arrested by deportation officers with ICE Enforcement and Removal Operations (ERO) in October 2006, and removed from the U.S. to Guatemala in January 2007. Upon his removal, Orrego-Zavala was prohibited from legally re-entering the U.S. for 10 years.

In March 2009, he was again arrested by ERO. In May 2009, he was removed to Guatemala and prohibited from legally re-entering the U.S. for 20 years.

Orrego-Zavala will remain in custody while the case is investigated by Indiana State Police and Marion County (Indiana) Prosecutor’s Office.

The immigration charges will remain pending until the state concludes its criminal charges.

A criminal complaint is only a charge and not evidence of guilt. All defendants are presumed innocent until proven otherwise in federal court.

According to Assistant U.S. Attorney William McCoskey, Southern District of Indiana, who is prosecuting this illegal re-entry case, Orrego-Zavala faces up to 10 years of imprisonment, if convicted

Because of your failure to contact ICE, two men are now dead. Whitestown, Indiania, PD should be very proud of themselves!
