Boy, 16, arraigned in ICE shooting

EDINBURG — The 16-year-old’s eyes grew red and a tear ran down his cheek Thursday as his mother implored Judge Jesse Contreras to release the boy to his family.
It would let him go to school and play sports, Ernestina Alvarado said at the teen’s arraignment in the 449th state District Court.
But Contreras said no; attempted capital murder is too serious a charge.
Authorities say that at about 3:30 a.m. July 3, the boy and his 18-year-old brother — driven by their father — pulled up behind a federal immigration agent who was parked and conducting surveillance near their land near Hargill. They allegedly opened fire on the agent, and when he tried to flee, the family followed and kept shooting.
Special Agent Kelton Harrison of U.S. Immigration and Customs Enforcement was shot in the midsection, but he has recovered.
The 16-year-old on Thursday pleaded not true to attempted capital murder and is scheduled to begin his trial as a juvenile Oct. 1. A plea of not true is similar to a plea of not guilty.
By state law, the names of juvenile offenders are not public record.
The boy, along with his father, Pedro Alvarado, 41, and brother, Arnoldo Alvarado, 18, were arrested shortly after the shooting. The father and brother await trial in federal court.
Last month, defense attorneys painted Pedro Alvarado and Arnoldo Alvarado as defending their property from a suspicious vehicle.
But Hidalgo County Sheriff Lupe Treviño described the attack in less noble terms.
“What alarmed me more than anything else is that they drove up to the agent and without asking any questions whatsoever they just came blasting — no warning, no nothing,” Treviño said. “And then, when the agent got out of there, they pursued him and continued firing at him.
“If that’s not a premeditated act of trying to kill somebody, I don’t know what is,” Treviño said.

Really, I mean REALLY? Who the hell are you kidding, Daddy and sons go out GUNNING for another human being; and you think we should just release him?
