Federal appeals court denies Fairfield mother's request to stay in U.S.

Maribel Diaz, mother of 4, will be deported to her home country of Mexico

    Updated: 6:35 PM EDT Apr 11, 2017

    MOUNT GILEAD, Ohio —
A federal appeals court has denied a Fairfield mother's request to stay in the United States, clearing the way for federal officials to deport her back to Mexico.

Maribel Trujillo-Diaz, a mother of four was moved to an Immigration and Customs Enforcement detention center in Louisiana Monday, ICE officials said Tuesday.

An ICE spokesman said the removal will go forward. It was said Trujillo-Diaz would remain in Louisiana until her deportation.

The spokesman said "The removal will go forward."

Trujillo-Diaz was detained last week by federal agents, according to her family. Diaz is married and has four U.S.-born children.

Trujillo-Diaz was being held at the Morrow County Detention Center, about 50 miles north of Columbus. She came to the United States illegally from Mexico in 2002, according to U.S. Immigration and Customs Enforcement.

More than 30 people gathered Tuesday for a prayer vigil in front of the federal courthouse in downtown Cincinnati. They called the decision a "grave injustice" and prayed for Trujillo-Diaz's safety and for comprehensive immigration reform.

"The family continues to struggle with this. This has been a very, very difficult thing, not only having their mother taken from them so suddenly, but it's been this emotional roller coaster," Father Mike Pucke said.

In a statement, ICE officials said:

"(The) case has undergone review at multiple levels of our nation's legal system, and the courts have uniformly held that she has no legal basis to remain in the United States. In 2014, the Board of Immigration Appeals dismissed her legal appeals and she became subject to a final order of deportation."

Trujillo-Diaz has since been moved to a facility in Oakdale, Louisiana.

She could take her family with her.... Illegal is illegal she does not belong here no matter how long she evaded deportation.

Maribel Trujillo Diaz deported back to Mexico

CINCINNATI -- Maribel Trujillo Diaz, a mother of four who'd been living in Fairfield, has been deported back to Mexico.

U.S. Immigration and Customs Enforcement carried out the deportation Wednesday as planned. She was on a plane Wednesday morning, according to Troy Jackson with The AMOS Project.

ICE took her to a Louisiana detention facility last week as it prepared for her final days in the United States.

Trujillo, who came to the country illegally in 2002, said she'd fled Mexico because drug cartels targeted her family.

What you're saying about her deportation

ICE officials first came into contact with her in 2007, when she was among dozens arrested during a federal raid of a Fairfield Koch Foods plant.

When immigration officials again moved to deport her in 2016, religious leaders' pleas on her behalf earned Trujillo a work permit meant to last until this July.

That permit was still valid when ICE arrested her again earlier this month, according to the Rev. Mike Pucke. He was Trujillo's pastor at St. Julie Billiart Church in Hamilton.

Some religious leaders, including Pucke, had pleaded for the federal government to stop her removal from the United States.

"We expect there will be a service at Maribel's parish in Hamilton on Sunday afternoon," Jackson wrote Wednesday.

A three-judge panel at Sixth Circuit Court of Appeals denied Trujillo's petition for an emergency stay of removal last week.

Trujillo's attorney, Emily Brown, said they decided not to appeal the full Sixth Circuit; rather, Brown said she "(hoped) ICE will use its discretion to do the right thing and not deport (Trujillo)."

Brown said she hoped statements by Sen. Sherrod Brown, Sen. Rob Portman and Gov. John Kasich on Trujillo's behalf would motivate ICE to halt the deportation.

She also said she was working with the Mexican Consulate to provide support for Trujillo, because "she basically has nothing" with her or waiting for her in Mexico.

On last week's "Hear Cincinnati" podcast, host Maxim Alter talked with a leader of the Archdiocese of Cincinnati, who has been working closely with Trujillo's family. He breaks down what happened before she was detained, what her options were to obtain citizenship and what happens next. Listen below (starts at 15:40):

Guardian Sob Story on Deportation of Illegal Alien Ignores Law

    by IAN MASON
    20 Apr 2017

British left-wing newspaper the Guardian published a blatantly misleading sympathy piece about a deported illegal alien on Wednesday.

The online piece, by Guardian chief U.S. reporter Ed Pilkington, presents Maribel Trujillo, an illegal alien from Mexico, as victim of what her lawyer and Pilkington’s headline describe as the “heartless policies” of President Donald Trump.

The article contains several obvious falsehoods, most pressingly its repeated assertion that illegal entry to the United States is not a crime. Pilkington describes Trujillo as “a mother of four American children from Fairfield, Ohio, who has never committed any crime in the 15 years she has lived in the US.”

Trujillo is not from Fairfield, Ohio, but from Mexico. She is not now, nor has she ever been, a national of any country but Mexico. She also has committed at least one federal crime: 8 USC §1325(a) – Improper Entry by Alien. The statute reads, “Any alien who (1) enters or attempts to enter the United States at any time or place other than as designated by immigration officers … shall, for the first commission of any such offense, be fined under title 18 or imprisoned[.]” And yet Pilkington describes Trujilo as having “no history at all of crime.”

Not only does the story, presented as the “latest sign Trump administration is indiscriminately targeting undocumented immigrants,” obfuscate the crime Trujillo committed 15 years ago (a period Pilkington inexplicably describes as “almost two decades”), it ignores the ostensible victim’s history with the law since. Federal authorities have been trying to remove Trujillo from America for ten of the fifteen years she has illegally resided in our country.

According to the George Soros-funded pro-open borders organization Human Rights Watch, she was arrested for the first time by U.S. Immigration and Customs Enforcement (ICE) in 2007 as part of an enforcement action aimed at the rampant and often inhumane use of illegal workers in the meat packing industry. A 2011 report by the Federation for American Immigration Reform details the impact of illegal aliens on wages in that sector.

Since her initial arrest, Trujillo, with the help of immigration lawyers, has managed to stave off deportation under successive administrations. Finally, in 2014, during President Barack Obama’s tenure, she has handed an order of deportation. Right up until her boarding a flight back to her country Wednesday morning, she continued her attempts to thwart deportation, filing a claim for asylum at the beginning of the month based on the fact that drug cartel’s operate in Mexico. Wednesday’s deportation came only after the claim failed. Pilkington himself characterizes this narrative as “the latest sign that the Trump administration is indiscriminately targeting undocumented immigrants.”

Breitbart News has discovered left-leaning journalists in the act of working with immigration attorneys to assemble these sympathetic stories before. In that report, Mark Krikorian, the director of the Center for Immigration Studies, told Breitbart News, “The mainstream media always looks for sob stories to undermine the legitimacy of immigration enforcement … They almost never like to tell comparable stories … of people killed by illegal immigrants, of the small contractor put out of business by those employing immigrant labor.”

It this instance, Trujillo’s story was picked up by many left-leaning news outlets as it unfolded, including the Rachel Maddow Show, the DailyKos, and at least one additional story in the Guardian. Each presents narrative of illegal alien victimhood and suggests, if not as strongly Pilkington, that Trujillo has committed no crime. None presents similarly sympathetic accounts of the negative effects of illegal migration.

Ah ha! Notice the KOCH , guess this is why the Koch brothers hate Trump so rabidly. Trump is going after the employees that allowed the Koch Brothers to amass their millions ( or is it billions?)
