    OMAHA, Neb. — A federal judge has thrown out most of Fremont's controversial ordinance that sought to ban hiring or renting to illegal immigrants.

    Shirley Mora James, an attorney for the Mexican American Legal Defense & Educational Fund, says the judge effectively gutted the ordinance.

    U.S. District Court Judge Laurie Smith Camp issued her ruling Monday in a lawsuit the Mexican American Legal Defense & Educational Fund and American Civil Liberties Union filed challenging the 2010 ordinance.

    Lincoln attorney Shirley Mora James, who worked with MALDEF, says the judge effectively gutted the ordinance. The law has been on hold while the lawsuits were decided.

    The Fremont ordinance was approved by voters in the eastern Nebraska city of 25,000. It would've required employers to check whether a person is permitted to work in the U.S. And anyone seeking to rent property would have had to apply for a $5 city permit.

    Both sides are declaring victory after a ruling Monday in which U.S. District Court Judge Laurie Smith Camp struck down portions of a controversial Fremont, Neb., ordinance against illegal immigration.

    Camp threw out portions of the ordinance that dealt with housing restrictions, but she let stand requirements that Fremont employers verify workers as legal residents of the U.S. before giving them jobs.

    Camp found that the housing portions of the ordinance violated the Fair Housing Act and were pre-empted by federal immigration law.

    “It’s a good day in Nebraska. It’s a good day in America,” said Shirley Mora James, a Lincoln lawyer who helped represent a Fremont landlord and undocumented tenants in the case.

    Kris Kobach, a Kansas lawyer, said Camp’s ruling upheld three-fourths of the ordinance.

    The only thing Camp overturned, he said, was a requirement that illegal immigrants be refused housing. Fremont authorities still can verify whether potential tenants are in the country legally — and notify federal authorities if those seeking housing turn out not to be legal U.S. residents.

    Kobach said no decision had been made on whether to appeal the case.

    It is also perfectly legal for a landlord to require background checks and ask for social security number. At least it was ok to as ME for that info on EVERY SINGLE apartment I ever rented.

    Wow! Look at how the Associated Press distorted this story!

    From their overly short article, any reader would think the Freemont illegal immigration ordinance was utterly tossed out. Unfortunately, this is the version most of America will be reading.

    The second article from the WORLD-HERALD actually includes both sides of the debate and points out that 3/4 of the Freemont law, the most important parts of the law, have been UPHELD!

    Obviously, the AP writers of this article intentionally misreported it in favor of landlords and employers who consistently house and hire illegal aliens.

    We're talking hundreds of millions of dollars each month spread out over the entire nation. That adds up into billions on an annual national scale.

    Money talks. It even manipulates main stream media.

    I believe that the intention of the Associated Press was to prevent any wildfire of similiar legislation across America now that a court has upheld 3/4's of the ordinance.

    Cities and towns across America were joining towns like Farmer's Branch in Texas and Hazelton Pennsylvania cracking down on illegal immigration until their efforts were stalled in the courts.

    Now the courts have cleared the way for that to resume and the Associated Press moves into position to try and stop that from happening.

    The Associated Press is not simply a news reporting wire service. From what we see here and the conduct we have observed again and again, AP is a propaganda network working on behalf of the lethal illegal alien invasion of America.

    States, counties, cities, and principalities are desperate across the country to reign in the flood of illegal immigrants from Mexico now famously creating fortunes for employers allowed to break immigration laws in all labor-intensive and blue-collar industries.

    There has to be resolution in favor of Americans without granting amnesty and restoring these industries to American citizens at fair wages.

    The underground economy exists largely because the mainstream media consistently refuses to report on it or its damaging effects. Instead, they manipulate the facts and convince Americans they have no choice but to accept permanent occupation from Mexico.

    A federal judge on Monday rejected a portion of a Nebraska city's ordinance that would have denied housing permits to illegal immigrants but upheld a requirement that employers verify the citizenship status of people they hire.
    U.S. District Judge Laurie Smith Camp found some of the housing provisions in Fremont's ordinance, approved by voters in 2010, are discriminatory in violation of federal law.

    Both sides in the contentious immigration debate claimed victory after the ruling, which stemmed from a combined lawsuit filed by the American Civil Liberties Union and the Mexican American Legal Defense and Educational Fund.
    Fremont's attorney Kris Kobach, who is also Kansas' secretary of state, said 75 percent of the ordinance was upheld, including a requirement that Fremont employers use the federal E-Verify database to ensure employees are legal.


    The judge also determined the city can still require anyone seeking to rent property to apply for a $5 city permit and swear they are in the country legally. Kobach said the ruling simply prevents the city from revoking those permits, even if applicants are found to be illegal immigrants.

    "This vindicates the city's position," Kobach said.

    But attorney Shirley Mora James, who worked with MALDEF on the case, called the ruling a clear victory for the plaintiffs because the housing penalties were struck down.

    "The court has gutted the ordinance, in my view. I do not see this as a victory for Fremont," Mora James said.
    Fremont City Attorney Paul Payne said no decisions would be made on when to implement the upheld portions of the law until a city council meeting next week. The law had been on hold while the lawsuits were decided.
    Once the ordinance goes into effect, employers in the city of 25,000 will have 60 days to get ready to use the federal E-verify database, so Kobach said that part of the ordinance likely wouldn't take effect until May. He said the other portions could be enacted next month.

    Last year, the U.S. Supreme Court upheld an Arizona law that required businesses to use E-Verify or face losing their business licenses.
