    President Obama on Wednesday will declare a national monument in southern New Mexico, delivering a win for environmentalists but angering ranchers and local law enforcement, who say the land restrictions will end up creating a safe haven for drug cartels to operate within the U.S.
    Mr. Obama will declare about 500,000 acres as the Organ Mountains-Desert Peaks National Monument. About half of that land is expected to be set aside as wilderness, meaning it will be closed to vehicles and construction.

    Local ranchers say it’s a land grab that will interfere with their grazing rights, and border security advocates said the move will make it tougher for federal agents and local police to patrol the land, leaving a security gap that Mexican smuggling cartels will exploit.
    “This is about opposing so many thousands of acres that is going to create nothing more than a pathway for criminals to get into this country to do their criminal acts,” Dona Ana County Sheriff Todd Garrison told The Washington Times in a telephone interview Monday.

    Conservationists and tourism businesses have been pushing for the designation, hoping it will bring more visitors.
    “The Organ Mountains-Desert Peaks National Monument will help protect our way of life while allowing for responsible development and expanding opportunities for all Americans to enjoy the beauty and multi-cultural history of this unique landscape,” Billy Garrett, Dona Ana County Commission chairman, said in a statement.
    But land rights advocates said it is the precursor to more conflicts like the recent standoff in Nevada, where a rancher refused to comply with a court order that he stop grazing on Bureau of Land Management property, prompting the BLM to confiscate his cattle, though they were returned after a public outcry.

    The BLM, which is part of the Interior Department, will administer the national monument.
    The land contains five mountain ranges with fragile landscapes, prehistoric rock art and more recent historic sites such as a training area for the Apollo astronauts.
    The monument would cover hundreds of thousands of acres right next to the Mexican border.
    New Mexico’s representatives in Congress have been divided over the monument. Rep. Stevan Pearce, a Republican, called for a 50,000-acre monument, one-tenth the size of the one Mr. Obama will designate.
    But the half-million-acre proposal has the backing of the state’s U.S. senators, both of them Democrats.
    “An Organ Mountains-Desert Peaks National Monument will preserve important cultural links to our past and strengthen southern New Mexico’s economy by boosting tourism and recreational opportunities, like hunting, hiking, camping, and horseback riding,” Sen. Martin Heinrich said in a statement.
    Only Congress can declare a national park, which stops most land uses. But under the 1906 Antiquities Act the president has the power to declare national monuments, which offer heightened environmental protections.

    The New Mexico monument is Mr. Obama’s second designation this year. In March, he added 1,600 acres in the Point Arena-Stornetta region to the California Coastal National Monument established by President Clinton in 2000. House Republicans said the action wasn’t necessary because they had passed similar legislation that was awaiting Senate action.
    About half the Organ Mountains monument will be designated as wilderness, the highest level of protection, closing it to motorized vehicles and human construction.
    Sheriff Garrison said that will shut down roads that his department uses to patrol the land, though he said the cartels are unlikely to stop using it just because it is declared wilderness.
    “My fear is these areas will be used more than they are now because they’ll have access to it that will be private and closed off to every law-abiding citizen,” the sheriff said. “I believe this monument will hamper law enforcement’s ability to effectively patrol the area we need to patrol.”
    Administration officials said the declaration will incorporate a 2006 agreement between the Interior Department and the Homeland Security Department that allows U.S. Border Patrol some access to the land.
    That agreement prevents most routine patrols through wilderness, though it does allow them to continue to follow smugglers in hot pursuit.
    The agreement has been controversial for both sides of the immigration debate. Environmentalists and some immigrant rights advocates argue that the Border Patrol has used the arrangement to trample pristine land. Border security advocates say agents’ hands are tied when they are in pursuit of illegal immigrants and drug smugglers.
    Rep. Rob Bishop, a Utah Republican who has studied the issue, argues that the environmental restrictions have indeed hurt the Border Patrol’s ability to do its job.
    Hours before news of the designation broke Monday, Mr. Bishop, chairman of the Natural Resources Committee’s public lands subcommittee, sent a letter to Mr. Obama asking him to hold off until the border can be controlled.
    “It’s irresponsible to focus efforts on new land designations rather than finding solutions to existing criminal activities plaguing the border,” the congressman wrote.
    Mr. Bishop pointed to a case that was in the headlines last week, in which a National Park Service employee at Chiricahua National Monument in Arizona detailed the vicious attack she suffered at the hands of an illegal immigrant. Authorities said the man smashed her head into a metal bathroom door and hit her head with a rock, striking so hard that the rock broke.

    On Wednesday the Obama Administration is set to unilaterally designate a 600,000 acre national monument in New Mexico near the U.S.-Mexican border. The sanctuary, which will be called the Organ Mountains-Desert Peaks National Monument, has drawn sharp criticism from law enforcement who say it will impede border security. "By creating this monument, President Obama is ensuring a pathway to get drugs into the country" Zack Taylor, Chairman of the National Association of Former Border Patrol Officers, told Breitbart Texas.

    The Obama Administration will ultimately control how much access Border Patrol agents will have to the land, including whether or not they will be able to use vehicles.

    Taylor, who has 26 years of border security experience, pointed out that one of the most dangerous cities in the world, Juarez, Mexico, is right across the New Mexico border. Impeding law enforcement near this section of the border could allow Juarez's cartels and violence to enter the U.S. with ease.

    "This is the wrong place to put a monument," Taylor said. "The New Mexico border has no river--it's just an imaginary line. If criminal illegal aliens can walk across the border and into the sanctuary area, they will use that land for criminal acitivy and use it extensively. Everything surrounding the monument is in peril."

    Advocates of the Organ Mountains-Desert Peaks National Monument claim the land needs to be preserved for environmental reasons. But opponents claim this argument is a deflection from the real issue, which is the safety of U.S. citizens.

    "Who benefits form this more than the cartels?" Taylor asked. "The people who live there don't benefit, law enforcement doesn't benefit, the sheriffs don't benefit. The only people who benefit from this monument are illegal illegal immigrants brining drugs into this country. Environmentalists say we're protecting this land by shutting people out, but we're actually doing the opposite."

    Obama is creating the monument without approval from the Senate or Congress by using the Antiquities Act, a means by which presidents can unilaterally lock up land for environmental reasons.

    Taylor concluded, "The Obama Administration is using 'environmental concerns' as a tool to bypass Congress and take over the land. By doing so, he is completely ignoring national security and public safety."

    A top House Republican urged President Obama on Tuesday to ensure Border Patrol agents will have access to rugged and remote mountain ranges along the Mexican border that the president is designating as a national monument.

    House Judiciary Chairman Bob Goodlatte, Virginia Republican, said the president's action could make it more difficult for law enforcement to patrol huge swaths of the border in New Mexico.

    "Without law enforcement having access to federal lands, drug traffickers, human smugglers and potentially terrorists are able to exploit yet another loophole created by the Obama administration's lax immigration enforcement," Mr. Goodlatte said. "As President Obama moves forward with his decision, I urge him and his administration to allow Border Patrol agents to do their job and gain control of our nation's porous borders."

    Mr. Obama will use his executive authority Wednesday to designate nearly a half-million acres in New Mexico as the Organ Mountains-Desert Peaks National Monument. About half that land is expected to be set aside eventually by Congress as wilderness, which would close those areas to vehicles.

    Dona Ana County Sheriff Todd Garrison said Monday the president's action will create "a pathway for criminals to get into this country to do their criminal acts." The New Mexico Sheriffs' Association also is opposed to the move.

    On Tuesday, a spokeswoman for the U.S. Customs and Border Protection agency rebutted the claim that the national monument designation would threaten border security.

    "This designation will in no way limit our ability to perform our important border security mission, and in fact provides important flexibility as we work to meet this ongoing priority," said spokeswoman Jenny Burke. "CBP is committed to continuing to work closely with the Department of the Interior and the U.S. Forest Service to maintain border security while ensuring the protection of the environment along the border."

    The president's action is raising questions of border security just as he is seeking the help of law enforcement groups to pressure House Republicans to approve comprehensive immigration reform. Mr. Goodlatte challenged the administration's record of enforcing the borders, saying it has given priority to land preservation.

    "Documents show that the Departments of Interior and Agriculture are using environmental regulations to prevent the Border Patrol from accessing portions of the 21 million acres along the U.S.-Mexico border and over 1,000 miles of the U.S.-Canada border," Mr. Goodlatte said in a statement. "Unfortunately, Obama Administration officials have so far prevented Border Patrol agents from securing the border by denying them access to federal lands under the guise of environmental preservation."

    The president's announcement will mark the second national monument he has designated in New Mexico; he established the Rio Grande del Norte National Monument in March 2013. The area is twice as large as any of the previous 10 national monuments established by Mr. Obama.

    The land preservation is being hailed by groups ranging from sportsmen to environmentalists to American Indian tribes. The territory includes historical and cultural treasures such as ancient rock drawings; it also contains a wide variety of plant and animal life, including more than 200 species of birds.

    Mr. Obama's action is following the contours of a bill proposed by Democratic Sens. Tom Udall and Martin Heinrich of New Mexico, who wanted to set aside 498,815 acres. Their measure would establish eight wilderness areas.

    A rival bill proposed by Rep. Steve Pearce, New Mexico Republican, would create a national monument in an area about one-tenth the size of the Senate legislation.

    Mr. Pearce has said the president's action "bypasses the will of the people." But sportsmen and environmentalists disputed that claim.

    "Southern New Mexico sportsmen and women appreciate the president using the authority granted by law to establish the Organ Mountains-Desert Peaks National Monument because Congress failed to act on our behalf," said John Cornell, president of Dona Ana County Associated Sportsmen. "Sportsmen have wanted permanent protection of this entire area for a decade, but the smaller designation offered by Rep. Pearce fell short. It simply did not protect the lands sportsmen most wanted protection for."

    Land-rights advocates said the monument designation is the precursor to more conflicts like the recent standoff in Nevada, where a rancher refused to comply with a court order that he stop grazing on Bureau of Land Management property. The bureau, part of the Interior Department, will administer the national monument in New Mexico.

    On Wednesday President Obama is expected to announce that he will bypass the Senate and Congress to create a 600,000 "monument" near the U.S.-Mexico border in New Mexico. Republican politicians and law enforcement alike have offered sharp criticism of the monument, which in their view will impede Border Patrol efforts to keep U.S. citizens safe. On May 2, House Judiciary Committee Chairman Bob Goodlatte (R-Va.) released a statement urging Obama to give Border Patrol agents access to the land.

    Border Patrol may have limited access to the sanctuary, which will be called the Organ Mountains-Desert Peaks National Monument. The Obama Administration will have discretion over how much access agents get to the land and if they are allowed to drive vehicles on it.

    Juarez, Mexico, a dangerous city ridden with cartel activity, is right across the border from the targeted land. Critics of the new monument worry that impeding law enforcement's efforts in the area could allow violence from Juarez to enter the U.S.

    Goodlatte said in his statement, obtained by Breitbart Texas, "If President Obama is going to designate half a million acres as a national monument, then he needs to make sure that the Border Patrol has access to it in order to keep Americans safe from illegal activity along our borders. Unfortunately, Obama Administration officials have so far prevented Border Patrol agents from securing the border by denying them access to federal lands under the guise of environmental preservation."

    Goodlatte is not the only politician to express security concerns regarding the Organ Mountains-Desert Peaks National Monument.

    Utah Republican Rep. Rob Bishop, chairman of the Public Lands and Environmental Regulation subcommittee on the House Natural Resources committee, blasted the plan in a letter Monday. He argued the monument's creation will allow the area to become an unfettered drug corridor.

    "National Parks, monuments, and wilderness areas along our southern border have become prime drug-trafficking corridors for violent criminals and drug cartels," Bishop wrote in a statement obtained by Breitbart Texas. "Restrictive environmental laws within these federal corridors limit Border Patrol access and, as a result, make it easier for drug smugglers and human traffickers to move their drugs and people in and out of the United States unnoticed."
