    Council to get a second illegal immigrant ordinance

    Ward 2 Councilman Ken Takasaki has drafted an ordinance prohibiting Clarksville from awarding contracts for goods or services to anyone who knowingly utilizes illegal immigrants.

    Under the proposed ordinance, contractors can only work for the city after attesting in writing that they will neither employ any illegal aliens nor use any subcontractors who employs illegal aliens.

    Contractors in violation of Takasaki's ordinance would be prohibited from working for Clarksville or submitting new bids for one year.

    Earlier this month, City Council tabled an ordinance from Ward 4 Councilman Wallace Redd which would have fined businesses or landlords $1,000 for sheltering or hiring illegal aliens and declared English the official language of Clarksville.

    ORDINANCE _________________

    AN ORDINANCE AMENDING APPENDIX F, PURCHASING RULES AND REGULATIONS, OF THE OFFICIAL CODE OF THE CITY OF CLARKSVILLE.
    BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLARKSVILLE, TENNESSEE:

    That Appendix F, Purchasing Rules and Regulations, of the Official Code of the City of Clarksville is amended by adding the following section:

    “Public Contract – Illegal Aliens.”

    SECTION 1.
    (
    1) The city or other city entities shall not contract to acquire goods or services from any person who knowingly utilizes the services of illegal aliens in the performance of a contract for goods or services entered into with the city or a city entity.

    (2) No person may contract to supply goods or services to the city or other city entities if that person knowingly utilizes the services of illegal aliens in the performance of a contract to supply goods or services entered into with the city or a city entity.
    (
    3) After the effective date of this ordinance, no person may enter into a contract to supply goods or services to the city or other city entities without first attesting in writing that the person will not knowingly utilize the services of illegal aliens in the performance of the contract and will not knowingly utilize the services of any subcontractor who will utilize the services of illegal aliens in the performance of the contract.

    (a)If any person who contracts to supply goods or services' to the city or other city entities, or who submits a bid to contract to supply goods or services to the city or other city entities, is discovered to have knowingly utilized the services of illegal aliens in the performance of such a contract to supply goods or services to the city or other city entities, the purchasing agents shall declare that person to be prohibited from contracting for or submitting a bid for any contract to supply goods or services to the city or other city entities for a period of one (1) year from the date of discovery of the usage of illegal alien services in the performance of a contract to supply goods or services to the city or other city entities.

    (b)The purchasing agent, or other agency of the City of Clarksville, Tennessee, under whose jurisdiction such work is to be performed, shall include in the specifications to bidders or in the invitations to bid, a clause prohibiting the successful bidder, including any subcontract of such successful bidder, from permitting the employment of any person or having any employees who are not legal residents of the United States.

    SECTION 2. This act shall take effect upon becoming a law, the public welfare requiring it.

    I don't get it. It is already against the law to hire illegal immigrants. We just know it isn't being enforced. Seems these towns could cite the law. Can anyone explain this to me?

    Illegals back before council
    Proposal prohibits city contractors from hiring illegal aliens

    City Council will again discuss an ordinance regarding illegal immigrants when it meets next week.

    Ward 2 City Councilman Ken Takasaki, who is running against Democrat Joe Pitts for the 67th District seat in the state House of Representatives, has drafted an ordinance prohibiting the city from contracting with anyone who knowingly hires illegal immigrants.

    Under Takasaki's ordinance, anyone who seeks contracts with the city to supply goods or services must attest in writing that they "will not knowingly utilize the services of illegal aliens in the performance of the contract and will not knowingly utilize the services of any subcontractor who will utilize the services of illegal aliens."

    A contract or bidder found to be in violation of the ordinance would be prohibited from contracting with or submitting bids to the city for one year.

    The ordinance, which proposes no fines, does not describe how the city would determine if contractors were in compliance.

    Earlier this month, the council tabled an ordinance proposed by Ward 4 Councilman Wallace Redd that would have fined businesses and landlords $1,000 for hiring or sheltering illegal immigrants and would declare English the official language of city government.

    Redd said he supports Takasaki's proposal.

    "I think it's great," Redd said. "We shouldn't contract (with) people that hire illegal aliens, because to hire illegal aliens is against the law. I don't know how many times I've said that in the last month."

    Takasaki also has a supporter in Ward 6 Councilman Marc Harris, who moved to table Redd's ordinance.

    "Now that makes plenty of sense," Harris said of Takasaki's ordinance.

    Takasaki sought help from HOPE
    In preparing his ordinance, Takasaki solicited the support of Tommy Vallejos, the director of the Hispanic Organization of Progress and Education. Vallejos spoke out against Redd's ordinance during council meetings and also called a press conference against it.

    Vallejos declined Takasaki's invitation.

    "I declined because he refused to stand up" against Redd's ordinance for being discriminatory, Vallejos said.

    "This is simply a political ploy," said Vallejos, who considers himself a "staunch Republican."

    Takasaki said his proposal is "not about politics.

    "This is about legal versus illegal. This is not about race," he said.

    Takasaki said America has a rich history of immigration.

    "I believe as Americans, we just want it done legally," he said. "This is not Wallace Redd's ordinance."

    Vallejos, who said he does not support illegal activity, said Takasaki's ordinance would "hurt the local businessmen," and that it wouldn't stand up in court.

    However, Takasaki's ordinance is similar to a state law signed by Gov. Phil Bredesen in June. That law, which goes into effect in January, prohibits state agencies from giving contracts to anyone who knowingly employs illegal aliens.

    The state law got its teeth earlier this month when Bredesen issued an executive order giving state agencies the authority to spot-check personnel records of state contractors.

    As Takasaki notes, the law signed by Bredesen passed the state Senate unanimously, while only one member of the House voted against it.

    Redd's ordinance to be revisited
    Redd, meanwhile, said he planned to ask his fellow council members to reconsider their vote to table his ordinance; however, he plans on waiting until a vote is made on Takasaki's proposal, which he called "a good first step."

    "I think the prudent thing is to not muddy the water with mine," Redd said.

    Harris, however, said he plans to bring Redd's ordinance up at next week's council meeting.

    Harris said he moved to table the ordinance not to kill it to allow him more time to gather information.

    Harris said he spoke with officials at Gateway Medical Center, the Clarksville-Montgomery School System and local law enforcement to find out how they are affected by illegal immigration. Harris said he still sees no reason to enact Redd's ordinance in Clarksville.
