EL PASO, Texas (KFOX14) — The fines for hiring undocumented workers has risen, according to a conference in El Paso on how businesses can be sure to follow the law.
Last month, the civil fines for a first-time offense rose to a minimum of $573.
Not only have the fines risen, but Immigration Customs and Enforcement is also focusing on auditing businesses and looking for those that hire undocumented workers.
In the fiscal year 2018, there were 113 company management arrests for violations regarding unauthorized workers, and that was before the spike in crossings.
“If what's going on is I've got a domestic worker or a gardener who they're solely working for me, then indeed you can be subject to being seen as an employer,” said immigration attorney Kathleen Walker.
Walker said because of the grey area between validating citizenship and being discriminatory, people should seek legal counsel if they think they have an undocumented person working for them.
